JUSTICE GORSUCH, with whom JUSTICE THOMAS and JUSTICE ALITO join, concurring.

The central question we face today is: Who decides? No one doubts that the COVID–19 pandemic has posed challenges for every American. Or that our state, local, and national governments all have roles to play in combating the disease. The only question is whether an administrative agency in Washington, one charged with overseeing work-place safety, may mandate the vaccination or regular testing of 84 million people. Or whether, as 27 States before us submit, that work belongs to state and local governments across the country and the people’s elected representatives in Congress. This Court is not a public health authority. But it is charged with resolving disputes about which authorities possess the power to make the laws that govern us under the Constitution and the laws of the land.

I start with this Court’s precedents. There is no question that state and local authorities possess considerable power to regulate public health. They enjoy the “general power of governing,” including all sovereign powers envisioned by the Constitution and not specifically vested in the federal government. (1)(2)(3) And in fact, States have pursued a variety of measures in response to the current pandemic. E.g., (3)(4)

The federal government’s powers, however, are not general but limited and divided. See(5). Not only must the federal government properly invoke a constitutionally enumerated source of authority to regulate in this area or any other. It must also act consistently with the Constitution’s separation of powers. And when it comes to that obligation, this Court has established at least one firm rule: “We expect Congress to speak clearly” if it wishes to assign to an executive agency decisions “of vast economic and political significance.” (6). We sometimes call this the major questions doctrine. (7)

OSHA’s mandate fails that doctrine’s test. The agency claims the power to force 84 million Americans to receive a vaccine or undergo regular testing. By any measure, that is a claim of power to resolve a question of vast national significance. Yet Congress has nowhere clearly assigned so much power to OSHA. Before JW came on General, we talked what can be done to support QR and other boards in some cases.

In the Works

1. Resurrect board where anons can communicate with 8kun admins.

Would enable anons (espec. coders) to give bug reports and ask questions to 8kun admins. Hoping also to include have a thread on bans and ban appeals. Will let anons know when that board is ready.

1. Fix broken bread number function

Site admins will work on fixing the broken editing function in subject field for OP posts - so we can change wrong numbers.

1. Release bans

Jim W is starting to release bans, especially those made recently for no reason. Not that easy to locate and release, but anons should soon notice a difference.

1. Create fully functioning pastebin alternative

Anon had created a high quality pastebin substitute, qanonbin or q-bin for short, that was used after pastebin started censoring our bakes. No longer available. Control C is ok but could also cut us off someday. Also pretty basic. Jim W had a coder use open source stuff to create fullchan.net, which is a functional in-house bin, but basic.

Idea is to gather a gp of coders to build on fullchan foundation to develop a full-function pastebin alternative similar to q-bin. We have screenshots so not hard to model.

Could be freeware but another idea is to allow 8kun mgmt to offer it for a modest amt to help fund 8kun. Costs about $10,000 to run this place every month. What a great way to give back.

1. Support image permanance by nixing CP and other illegal materials

A big reason we have problems with posting images (no one wants to do business with 8) is because of illegal postings. Or at least, that is the excuse. Let's take it away.

Goal is to try to find and eliminate illegal imagery asap. More achievable now because we have onsite anon BVs that are active on the board. Anon volunteers could also regularly check for CP (etc), especially in side threads using the index, where you can see recent posts. One way or another, there should be a way to keep Q boards free of CP. So we have a chance at keeping archived images central to our work

QR Past

QR has been in the hands of FastJack for almost 3 years.

At best, his leadership was benignly neglectful.

At worst, it has been diametrically opposed to the goals and values espoused by Q.

When OSS arrived after refplatformig, the two joined forces to kill the kitchen, which almost destroyed the QR board.

ALMOST- but not quite.

Because against all odds, anons refused to let this board die.

Despite the chaos, the bans, the attacks, and the incredibly crappy doughs, they carried on.

AND STILL CARRY ON.

Eventually, the level of incompetance became unsustainable -

FJ plain forget to check into the board for almost 3 weeks, all the BVs except OSS left, and all OSS did was ban anons on a whim.

That is how they lost "their" board.

QR Now

News admin has been in place for 12 days.

Had to scramble at first, because this situation was not anticipated.

But here is what has been done so far -

• all bans made for no reason for the last 17 weeks have been lifted by 8kun admin

• a board is being set up that will allow anons to request ban lists for earlier dates

• the same board has a thread for bug fixes and other technical issues noticed by anons

• the catalog has been cleaned and updated; BVs monitor daily

• staff is monitoring bakes to help alert bakers to wrong breads numbers or split bakes

• staff locks breads in favor of signed in baker, unless it is OSS

• Staff has banned OSS from baking and made his notes subject to editing by anons/bakers

• New threads are under development for newfags, new bakers, and diggers doing research

• Working on an in-house pastebin/control C that is powerfull, secure and easy o uuse.

• Anons alerted to heavy CP presence and asked to actively look for it and make global reports

QR Goal

Overall: to create a board that "neat and tidy" for Q

Whether or not Q returns to post, the board should be a place that supports the honors the work)

• Promote greater anon awareness and responsibility

• Support bakers and build a good working relationship with them

• Work with agreegators like Qresear.ch so we know how to "feed" their sutsl

• Ensure that CP is detected early and cleaned up right away

• Develop policies (like content policies) that allow for the great possible freedom of expression but that also make is harder for for shills to attack w/impunity

• ( what have i left out?)

'Four mai roles for admins:

1- keep board/breads neat and tidy

2 - provide resources or links to support the work

3 - to develops policies and rules of thumb that support out work

4 - to help anons to be more aware of what goes on here (situational awarenss)

In the current bread, have been banning this "pig" poster who keeps evading bans and saying FU by posting the ban notices. Could be OSS, but he's not the only shill here.

Bans are almost entirely inffective at this point, only reason to use them to discourage the minority of shills who will abide by them OR to use ban offenses to justify an official perma-ban.

Whether it can be enforced or not, can be used at least to prevent someone from BAKING or TAKING NOTES - or to justify AUTHORIZING ANONS OR BAKERS TO TAKE OVER THEIR BAKES or REJECT PURPOSELY OFFENSIVE OR INAPPROPRIATE NOTES (muh joos, unsauced, etc.)

We cannot prevent 100% of spam, it is labor intensive to delete all the spam on every bread unless illegal.

For especially offensive spam, plz make a report and we will try to take care of it. But the staff is modest and cannot be here 24/7. So filtering is the other alternative.

In the near future, will develop a formal CONTENT POLICY.

This will clarify what is and is not acceptable speech.

It will not affect 95%+ of what is posted, but will target stuff most anons don't want here - spam, hardcore pron, personal attacks and posts purposely designed to create a HOSTILE WORK ENVIRONMENT that seeks to obstruct our ongoing efforts to dig, meme, and pray.

But once you allow the image to be changed, how can you say what is and is not ok? That is the problem.

PROPOSAL:

To return to the custom of having one General image. Would provide a unifying imagee for General breads, making them stand out in the Catalog.

Does not have to be original General image (with Q instead of Q_anon), although that one will be submitted too.

Could also be another image from an enterprising meme anon.

HOW IT WOULD WORK:

• There would be a thread and give anons about a week or two to come up with images.

• To submit, post your image plus a paragraphs (minimum 2-3 sentences) saying why you think this image would be the best.

We can do either – but if anons want a pool, have some suggestions based on

• image size (it's a SMALL image so the simpler, the better)

1. Use either no text or just Q Research – with any additions being short phrases like "For God & Country" or other unifying themes (WWG1WGA?)

Later, some objected - proposed a POOL to select from.

We can do either.

If anons want a POOL, have some suggestions based on

• iwo jima image (most anons use anyway – unifying theme newly commemorated)

• findability in the catalog (should look different from side threads)

• image size (it's SMALL- so the simpler, the better)

SUGGESTIONS:

1. Use either no text or just Q Research – with any additions being short phrases like "For God & Country" or other unifying themes (WWG1WGA?)

2. Use black and white, greyscale or subtle colors (this is to distinguish General Images from others)

3. Use 16:9 or similar ratio (not too squarish)

Later, there was another 'coup' involving OSS.

In Fall 2020, baker OSS gained enough influence with FastJack to beginning an erosion of QR that lasted about 20x as long. Anons protested again to Q, who asked for admins to "clean up the ship." FJ hired some additional BVs. But nothing changed for the better. Over 15 months, two things happened:

1 - OSS made Globals and Notables a place to attack his 'enemies'

2 - OSS continued to gain influence, and consistently created the kind of chaos that enabled changes that we neither directed by admins nor discussed by anons – banner changes, dough changes, ban policy changes. Ideas for Notetaking & Baking

• In the past, anons usually practiced baking and notetaking on /comms/ board. When they were ready to bake, they came on the board and signed in as baker. Bakers did both notes and bakes.

• Sometimes bakers worked with notetakers, but usually, each knew the other's routine. So it was clear who was doing what. Both signed in and coordinated at the start of bread.

• Now we have longer breads and more notes. Some breads get ghosted. So having notetakers is a good thing. But need a little coordination to eliminate confusion and also DUP notes that must be merged.

SUGGESTED GUIDELINES

• GENERALLY: If a new baker comes on the board, takes a handoff and then sees notes that are not his, it's confusing.

This is why it's better to post notes ONLY

(a) during GHOSTED breads (with a signin to DOUGH before posting)

(b) when baker requests a noter

OR

noter asks baker if he would like a noter and baker agrees.

• If a baker picks up a GHOSTED bread where there is a signed in notetaker (which he'll see by checking the DOUGH, right?), it is a courtesy for baker to check in with the notetaker and let him know whether he would like notetaker to continue or whether he wants to note the bread himself.

Anons APPRECIATE both bakers and noters. But better comms would make things run smoother.
