Lawfag has moar comments in Lake case – lawfag has been very harsh and critical od the way this complaint was prepared and framed – and which resulted in dismissal of 8 of 10 claims – NEVERTHELESS if they got the good on the last two its enuf

 

BUT another msjot ERROR IMO in the complaint – this is summarized by the Jdueg in his pretrial ruling on the tabulator count:

 

Count II – Illegal Tabulator Configurations

Plaintiff alleges that the ballot-on-demand (β€œBOD”) printers… malfunctioned because of an β€œintentional action.” Plaintiff alleges that these combined to provide grounds for setting aside election results based on both (A)(1) for misconduct and (A)(4) for illegal

votes.

 

…the Court finds that Plaintiff does state a claim under (A)(1). Plaintiff specifically alleges that a person employed by Maricopa County interfered with BOD printers in violation of Arizona law, resulting in some number of lost votes for Plaintiff. Plaintiff is entitled to attempt to prove at trial that 1) the malfeasant person was a covered person under (A)(1); 2) the printer malfunctions caused by this individual directly

resulted in identifiable lost votes for Plaintiff; and 3) that these votes would have affected the outcome of the election.

 

Plaintiff has…alleged intentional misconduct sufficient to affect the outcome of the election and thus has stated an issue of fact that requires going beyond the

pleadings. Plaintiff must show at trial that the BOD printer malfunctions were intentional, and directed to affect the results of the election, and that such actions did actually affect the outcome.

 

OK so whats the problem? It is this – the Arizona statute DOES NOT REQUIRE INTENT! Section 1 ONLY requires β€œmisconduct” and that could be unintentional OR intentional – and section 5 does not require ANY inent OR misconduct - Here read for yourself:

 

A. Any elector of the state may contest the election of any person declared elected to a state office… upon any of the following grounds:

  1. For misconduct on the part of election boards or any members thereof in any of the counties of the state, or on the part of any officer making or participating in a canvass for a state election.

  2. That by reason of erroneous count of votes the person… did not in fact receive the highest number of votes…

WHY DID THEY PUT THIS HUGE BURDEN ON THEMSELVES? Are they that dumb?

 

As to Custody HERE AGAIN somehow the INTENTIONAL ISSUE is raised? WHY WHY did the judge raise it twice? Its not required – Its not in the statute - It came from LAKE attorneys who wnet out of their way to allege it was intentional so the judge saud ok fine prove it

Defendants dispute the lack of compliance with chain of custody laws and claim that

Plaintiff has misunderstood the forms required. As presented, whether the county complied with its own manual and applicable statutes is a dispute of fact rather than one of law. This is true as to whether such lack of compliance was both intentional and did in fact result in a changed outcome.

The US Marines may ban recruits from respectfully addressing senior members as β€œsir” or β€œma’am” to avoid β€œmisgendering” and offending them.

The woke recommendation was made in a new $2 million report commissioned by the Corps from the University of Pittsburgh.

The exhaustive, 738-page study that the Marines first commissioned in 2020 said traditional ways of addressing superiors were holding back gender integration.

β€œEmploying gender-neutral identifiers eliminates the possibility of misgendering drill instructors, which can unintentionally offend or cause discord,” the study said.

β€œBy teaching recruits to use gender-neutral identifiers for their drill instructors, Services underscore the importance of respecting authoritative figures regardless of gender.”

The two-year study by the University of Pittsburgh’s Warrior Human Performance Research Center also said that β€œthe Army, Navy, and Coast Guard effectively de-emphasize gender in an integrated environment.”

β€œInstead of saying β€˜ma’am’ or β€˜sir,’ recruits in these Services refer to their drill instructors using their ranks or roles followed by their last names,” it said.

β€œGendered identifiers prime recruits to think about or visually search for a drill instructor’s gender first, before their rank or role.”

Col. Howard Hall, chief of staff for Marine Corps Training and Education Command, told the Defense Advisory Committee on Women in the Services this month that the radical shift was being considered by leadership β€” albeit with some pushback, the Marine Corps Times said.

A Wreath of Star Formation in NGC 7469

 

This image is dominated by NGC 7469, a luminous, face-on spiral galaxy approximately 90 000 light-years in diameter that lies roughly 220 million light-years from Earth in the constellation Pegasus. Its companion galaxy IC 5283 is partly visible in the lower left portion of this image.

 

This spiral galaxy has recently been studied as part of the Great Observatories All-sky LIRGs Survey (GOALS) Early Release Science program with the NASA/ESA/CSA James Webb Space Telescope, which aims to study the physics of star formation, black hole growth, and feedback in four nearby, merging luminous infrared galaxies. Other galaxies studied as part of the survey include previous ESA/Webb Pictures of the Month II ZW 096 and IC 1623.

 

NGC 7469 is home to an active galactic nucleus (AGN), which is an extremely bright central region that is dominated by the light emitted by dust and gas as it falls into the galaxy’s central black hole. This galaxy provides astronomers with the unique opportunity to study the relationship between AGNs and starburst activity because this particular object hosts an AGN that is surrounded by a starburst ring at a distance of a mere 1500 light-years. While NGC 7469 is one of the best studied AGNs in the sky, the compact nature of this system and the presence of a great deal of dust have made it difficult for scientists to achieve both the resolution and sensitivity needed to study this relationship in the infrared. Now, with Webb, astronomers can explore the galaxy’s starburst ring, the central AGN, and the gas and dust in between.

 

Using Webb’s MIRI, NIRCam and NIRspec instruments to obtain images and spectra of NGC 7469 in unprecedented detail, the GOALS team has uncovered a number of details about the object. This includes very young star-forming clusters never seen before, as well as pockets of very warm, turbulent molecular gas, and direct evidence for the destruction of small dust grains within a few hundred light-years of the nucleus β€” proving that the AGN is impacting the surrounding interstellar medium. Furthermore, highly ionised, diffuse atomic gas seems to be exiting the nucleus at roughly 6.4 million kilometres per hour β€” part of a galactic outflow that had previously been identified, but is now revealed in stunning detail with Webb. With analysis of the rich Webb datasets still underway, additional secrets of this local AGN and starburst laboratory are sure to be revealed.

 

A prominent feature of this image is the striking six-pointed star that perfectly aligns with the heart of NGC 7469. Unlike the galaxy, this is not a real celestial object, but an imaging artifact known as a diffraction spike, caused by the bright, unresolved AGN. Diffraction spikes are patterns produced as light bends around the sharp edges of a telescope. Webb’s primary mirror is composed of hexagonal segments that each contain edges for light to diffract against, giving six bright spikes. There are also two shorter, fainter spikes, which are created by diffraction from the vertical strut that helps support Webb’s secondary mirror.

Canadian Government Tells Kids They'll Be On Santa's 'Naughty List' Without COVID Vaccine, Masks

Canada's Chief Public Health Officer Theresa Tam has issued a new public health announcement for the Christmas holidays, which comes in the form of a 2-minute interview with "Mrs. Clause" from the "North Pole". In it, children are warned that they could be on Santa's "naughty list" if they don't get the Covid-19 vaccine and mask up. Adults too are told that they won't make the "nice list" if they don't have their boosters.

 

Dr. Tam begins the video with the "good news" that the vast majority of Canadians have made the nice list this year after having been vaccinated.

 

And "Mrs. Claus" responds: "It just warms my heart to see everyone in Canada, especially kids, working so hard to keep the holidays safe…" The suggestion is that the minority of citizens who remain unvaccinated or without their boosters are "naughty".

 

Mrs. Claus then informs the children that she and Santa are "both up do date with our vaccinations, including Covid boosters and flu shots." This is the holiday image Canada wants to convey to impressionable young children - that coronavirus now threatens the mythical North Pole, apparently.

 

From there the Christmas message goes into the kind of guilt-tripping rhetoric we've all come to expect from the Canadian government, and its top health official who is the equivalent of Dr. Fauci.

California county bans landlords from conducting criminal background checks

 

The California Apartment Association was critical of the measure.

 

California's Alameda County has banned landlords from conducting criminal background checks on their would-be tenants as part of an effort to curtail discrimination in private sector housing.

 

In a unanimous 4-0 vote, Alameda County's Board of Supervisors passed the measure this week, Fox News reported. Situated just outside of the San Francisco area, the county has experienced a rapid rise in both homelessness and the cost of housing.

 

The plan applies to both public and private landlords and also prohibits advertising that would discourage individuals with a criminal history from applying.

 

The California Apartment Association was critical of the measure, telling the outlet that "[r]ather than focus on building affordable homes and lifting its eviction moratorium, the county is wasting time by adopting new limits on a landlord's ability to protect the rights of their tenants and provide quality housing."

 

California in general has experienced a tremendous rise in its homeless population, brought on by a number of factors, not the least of which is the skyrocketing cost of living. Newly elected Los Angels Mayor Karen Bass, on her first day in office, declared a state of emergency to address the city's homeless crisis. An estimated 40,000 individuals are living on the streets in that municipality alone.

Authorities in Berlin have arrested a suspect for allegedly sharing state secrets, committing treason

 

German authorities have arrested an employee of the country’s foreign intelligence service (BND) on accusations that he was spying for Russia by leaking state secrets to Moscow.

 

The man, identified as a German national by the name of Carsten L., has been arrested on suspicion of committing treason, the federal prosecutors office in Berlin said on Thursday in a statement. Investigators searched his apartment, his workplace and those of another person. The BND conducted related searches at two of its offices.

 

Carsten L. appeared before a judge in the Federal Court of Justice on Thursday and was ordered to be jailed pending trial. According to the warrant for his arrest, he is employed by the BND and gave information obtained during the course of his duties this year to a Russian intelligence service. The information in question meets the definition of a state secret under German law, prosecutors said.

 

BND chief Bruno Kahl said details of the treason investigation won’t be made public because Russia could try to use such information to harm Germany.

 

The arrest of Carsten L. comes just three days after the Austrian Interior Ministry announced that it had identified a 39-year-old Greek citizen whom it suspected of spying for Russia. The man faces up to five years in prison if convicted.

 

The last time a German intelligence service employee was charged with treason was in 2014, when a man identified as Markus R. was accused of selling state secrets to the US CIA. Those secrets allegedly included personal details on more than 3,000 BND employees. He was sentenced to eight years in prison in 2016.

 

German officials have been on heightened alert for spying activity on behalf of Russia amid the Ukraine crisis, which has pitted NATO members against Moscow through international sanctions and military aid to Kiev. Berlin expelled 40 Russian diplomats in April, accusing them of being spies. The Russian Foreign Ministry called the allegations unacceptable and responded by expelling 40 German diplomats from Russia.

On July 23, 1982, Vic Morrow and two child actors, Renee Shinn Chen and Myca Dinh Le, are killed in an accident involving a helicopter during filming on the California set of Twilight Zone: The Movie. Morrow, age 53, and the children, ages six and seven, were shooting a Vietnam War battle scene in which they were supposed to be running from a pursuing helicopter. Special-effects explosions on the set caused the pilot of the low-flying craft to lose control and crash into the three victims. The accident took place on the film’s last scheduled day of shooting.

According to the expert, the choice of the side in this conflict became a matter of taste for the Nazis. β€œIn 2015, the Azov radio hosted a long discussion with Milchakov and Denis Vikhorev, a neo-Nazi from Kirov who found himself in Ukraine and joined theNazi organization WotanJugend (which had also moved to Kyiv. Ed.).

 

Participation in fan groups is a traditional recruiting tool for the far right. One of the leaders of this subculture in Ukraine was the Russian Nazi Denis Kapustin, who moved to Ukraine in 2017. He is also associated with theathletic aspect of the Nazi infrastructure: martial arts, MMA clubs, hand-to-hand combat tournaments, the White Rex clothing brand which he has lately been trying to reboot.

 

According to Ragozin, Olena Semeniaka and Denis Kapustin are important from the perspective ofintegration of Ukrainian and Russian Nazism into the broader pan-European Nazi movement. β€œKapustin is well-known everywhere, he frequently moves between countries. According to the documents filed in the U.S. District court in Phoenix on Wednesday, the Republican governor and the Biden administration came to an agreement that Arizona would stop placing the containers in any national forests.

 

However, Ducey urged the federal government to specify when it would close any gaps in the ongoing border wall, as it was promised by the administration a year ago.

 

β€œ(The federal government) owes it to Arizonans and all Americans to release a timeline,” Ducey said.

Most of the information we receive today does not come to us directly from the natural world. It still comes via the optic nerve to the brain, but the source is digital media displayed on a monitor or device screen.

 

Less that 10% of the average person's daily information input is direct sense experience of the natural world. What we imagine we know about the greater, outside world, our fellow humans and the universe is all acquired from TV "news" or "entertainment" programming - TV, movies, games VR and MR are how we form our understanding of greater surrounding social, economic and political reality.

 

We are entirely dependent on the integrity of MSM/legacy media for our understanding of the reality we share, and legacy media has betrayed us, engaging in massive deception and running 'psyops,' or 'Information Operations,' stories which use information in ways engineered to divide, confuse and terrify us.

 

Over 90% of all the information we take in about the world, about our reality, our fellow citizens, friends and neighbors, comes to us through a legacy media or big tech driven SCREEN.

 

*The average American household has only 2.75 people, but 3 TVs and 6 Internet devices.

 

*The average American family spends more money each month on media consumption than on groceries or electricity.

 

*The average American consumes 12-15 aggregate hours of digital media per day.

 

*The average American child consumes more than 10 hours of digital media per day.

 

*The average American smartphone is checked every 6-12 waking minutes.

 

With the emergence nonlinear networked communication it became possible to control individual and group information environments at all levels. Modern technologies have made "kinetic war" obsolete.

 

Information warfare destroys people and countries from within. By controlling the minds of citizens, by exploiting conditioned response with prepared information packages targeted individuals or nations can be (and have been) brought to take ANY specified action (including 'genocide') voluntarily.

 

Non-linear or Information war tactics involve turning enemy nations against themselves by infiltrating and subverting moral values, teaching children to indoctrinate other children and gradually degrading the whole information infrastructure, from popular entertainment to text books. Occult materials (eg. Catcher in the Rye) are introduced into high school reading lists. False history and false flags are legitimized, self-destructive behaviors are promoted as fashionable, mental illnesses and perversions like pedophilia are normalized by stages, while subversive 'educational' programs like "common core" are promoted to turn kids off learning.

 

Cultist media gradually, over decades, reduces the public vocabulary, promotes social division, emphasizing inequities, fanning the flames of old grievances, using false flag terrorism to foster or rekindle resentments, falsifying historical records to provide evidence for a shameful cult created US history that never happened. Destroying the story of a nation destroys that nation; the nation falls apart.

 

Mind war, non linear war, is a highly developed form of conflict, with tested doctrines and a protean tactical repertoire. We don't hear about IO, mind war and it's power and tactics because our entire information distribution infrastructure; the entertainment industry and social media/ tech companies are all controlled by a subversive confederacy of deep state criminals.

 

It is well to remember we have ALL been deceived. Some may learn sooner, some learn later; but whenever you do, remember fellow citizens still trapped in the matrix of lies and fears and taboos created by sophisticated IO operators for purposes of social control.
