(Headline USA) Prosecutors at the bribery trial of Sen. Bob Menendez rested their case on Friday after presenting evidence for seven weeks, enabling lawyers for the Democrat and two New Jersey businessmen to begin calling their own witnesses next week to support their claims that no crimes were committed and no bribes were paid.

On their final day of direct questioning, prosecutors elicited details about the senator’s financial records by questioning an FBI forensic accountant. Judge Sidney H. Stein then dismissed jurors for the weekend. Defense attorneys are scheduled to begin presenting their case on Monday in Manhattan federal court.

Later Friday, Stein rejected requests by lawyers for all three defendants that he acquit their clients on grounds that prosecutors had failed to provide sufficient evidence to the jury for it to deliver a verdict. The requests are a routine feature of trials after prosecutors rest.

Prosecutors say gold bars and hundreds of thousands of dollars in cash found in a raid of Menendez’s home two years ago were bribes paid by three businessmen from 2018 to 2022 in return for favors that the senator, using his political power, carried out on their behalf.

Defense lawyers claim the gold belonged to his wife and that Menendez had a habit of storing cash at home after his family lost almost everything in Cuba before they moved to New York, where Menendez was born.

“The government hasn’t proven its case,” the senator remarked as he left the courthouse Friday afternoon.

Menendez, 70, is on trial with two of the businessmen after a third pleaded guilty in a cooperation deal with the government and testified at the trial. Menendez’s wife, Nadine Menendez, is also charged in the case, which was unveiled last fall. Her trial has been postponed while she recovers from breast cancer surgery. All defendants have pleaded not guilty.

Menendez’s lawyers are planning to spend up to three days presenting testimony from several witnesses to support their argument that Nadine Menendez, who was Nadine Arslanian when she began dating the senator in early 2018, kept him in the dark about her financial troubles. The couple married in the fall of 2020.

The defense also plans to introduce testimony to try to show that Arslanian was in close contact with the senator at the height of the alleged conspiracy in late 2018 and early 2019 because she was being harassed by an ex-boyfriend.

Stein said Thursday that defense lawyers can elicit testimony to counter evidence introduced by prosecutors that might otherwise be interpreted to suggest that Arslanian and the senator seemed to be closely following each other’s whereabouts because they were involved in the alleged conspiracy.

But he said he wouldn’t allow the jury to hear testimony that she underwent treatment at a hospital because of an abusive relationship with an ex-boyfriend. He said Friday that a witness also cannot testify about specific acts of stalking or abuse.

“This is not going to be ‘Days of Our Lives’ or some soap opera,” the judge warned lawyers Thursday.

Behind the Curtain: Biden's salvation plan

A massive political, PR and personal campaign is underway to reject calls for President Biden to drop his re-election race — and rally Democrats to move on from public debateabout age and his future, top officials tell us.

Why it matters: Biden has zero interest in stepping aside — and First Lady Jill Biden and key family members and friends agree, according to people who talk regularly with them.

The intrigue: Biden, who has ducked tough interviews and avoided no-holds-barred press conferences, is now considering both. Look for a town hall or big one-on-one interview this month.

The latest: During a family gathering at Camp David on Sunday, Biden family members, including Hunter, went through with a long-scheduled session with celebrity photographer Annie Leibovitz. The Bidens insisted the president stay in the race, we're told by people close to them.

•"They're all-in, and want him to stay in," a Biden source told us, adding that the campaign is "charging ahead."

Behind the scenes: Some Biden friends and family blamed longtime aides who had prepped Biden. They complained about everything from data-heavy answers to his makeup to his briefing on camera angles.

• But the president smoothed it over: He called former chief of staff Ron Klain, who led the team, and one of the things they talked about was that neither he nor the family blames the prep.

• Campaign spokesman Kevin Munoz told us: "The aides who prepped the president have been with him for years, often decades, seeing him through victories and challenges. He maintains strong confidence in them."

Klain, who is expected to lead Biden's prep for the second debate — on ABC on Sept. 10 — told us: "In 38 years of working with Joe Biden, we've had many successes and some failures. I'm always happy to share in the good results and assume my share of the responsibility for the times we've come up short."

State of play: Biden's inner circle argues that one bad night of a scratchy voice and a few mangled answers doesn't warrant ending it all. So they're unleashing the full power of the White House and top Democrats to resist the loud calls for him to give up the race.

The biggest argument will be that Biden won the Democratic primaries overwhelmingly, and that result is final.

"You guys don't get to decide,"a source close to Biden said, referring to high-profile Democrats now second-guessing Biden as nominee. "That's not how this works. We don't have smoke-filled rooms."

Based on our weekend conversationswith top officials and advisers, here's the Biden survival strategy:

Dismiss "bedwetting."The official White House and campaign line is this is much ado about nothing — that Biden works so hard it drains his young staff. This attitude is driving elected officials and donors — basically any top Democrat not on the Biden payroll — nuts. They feel it's delusional. Nonetheless, Biden allies are cranking out data and pushing out surrogates to insist he had one bad night, mostly because of a scratchy voice and over-preparation.

Squeeze polls for juice.Biden allies are circulating polls and focus group results showing the debate did little to change the dynamics of the race. They're ignoring contrarian results — like a CBS/YouGov poll out Sunday that shows a surge in voters who think Biden is not up for the job. If you're to believe the polls: Voters thought Biden lost the debate and seemed too old. But there's little evidence they're moving fast to Trump. Both seem true.

Warn of chaos.Biden allies are making plain in private conversations the perils of an open convention — and the risk of picking a Democrat even more unpopular than Biden, namely Vice President Kamala Harris. They know Biden just needs to make it to the Democratic convention in Chicago, which opens eight weeks from today. After that, unity is the only choice.

Limit dissent.Biden allies helped orchestrate the supportive tweets by former Presidents Clinton and Obama. Those happened after furious back-channeling by allies. Truth is, that was the easy part.

Keep elected leaders close.The White House knows Senate Majority Leader Chuck Schumer and House Democratic Leader Hakeem Jeffries are deeply concerned that an unpopular Biden could cost them seats on Election Day. Their members in tough races are scared, and several plan to run away from Biden. Former Sen. Tom Harkin, who served with Biden in the Senate for 20+ years, said in an email to supporters that the debate was "a disaster from which Biden cannot recover."

Get the donor class to chill.Jeffery Katzenberg and other top Biden backers are working the phones to reassure the deep pockets, while the campaign and DNC keep turning out fundraising appeals and highlighting successes. Some donors are blaming the staff — not the man on stage. John Morgan, a Florida personal-injury-law magnatewho's a top Democratic donor, tweeted Sundaythat Biden's debate-prep team is guilty of political malpractice: "Format was a disaster for him and a plus for Trump. He over practiced and was drained."

Prove vitality.Words can't capture how elated top officials were that Biden was as vigorous as he was at a rally in North Carolinathe day after the debate. They're looking for as many opportunities as possible to show that he's still on his game and not too old for the gig. They know words are useless — they need vitality in action.

Ignore/engage the media.On the one hand, Biden allies want everyone to ignore the prominent columnists who loved Biden and are now calling for his resignation. On the other, the campaign and White House are deeply engaged with reporters (like us) writing about presidential fitness.

What's next:Biden's kitchen cabinet sees a recipe for a narrow victory that includes a grand-slam speech at the Democratic convention in Chicago + a strong showing in the next second debate + positive economic news in the fall (maybe a Fed rate cut).

I listened to the oral arguments several times. John Sauer did a great job arguing for Trump. The federal attorney (they didn't us the Solisitor General, she got her ass handed to her by the young Jeff Green on Fisher vs the USA) didn't do that well. Katanji Brown appeared to side with Sauer's arguments but did mention sending it back to the Appellate Court. Sauer argued that the Constitution and the Framers said the President stands alone in the Republic and MUST HAVE immunity while conducting government (official) business. If the President would act solely (personal) for himself there is no immunity.

Japan launches advanced Earth-observing satellite on 3rd flight of H3 rocket

Japan's new H3 rocket flew for the third time ever tonight (June 30).

The H3 launched the Advanced Land Observing Satellite-4 (ALOS-4; also known as DAICHI-4) from Japan's Tanegashima Space Center tonight, rising off the pad at 11:06 p.m. EDT (0306 GMT and 12:06 p.m. Japan Standard Time on July 1).

ALOS-4 was deployed into low Earth orbit as planned about 16 minutes after liftoff, commentators said on the webcast provided by the Japan Aerospace Exploration Agency (JAXA).

The two-stage H3 was developed by JAXA and Mitsubishi Heavy Industries. It's envisioned to be Japan's workhorse medium-lift rocket, taking those reins from the H-2A, which is set to retire later this year after more than 20 years of service.

The H3's path to orbit was a bit bumpy, however. The new rocket was originally supposed to launch for the first time in 2020, but difficulties in engine development and other issues pushed that debut back to March 2023.

And that initial liftoff didn't go well: The H3's upper-stage engine failed to ignite, and the rocket's payload — the Advanced Land Observing Satellite-3 (ALOS-3, or DAICHI-3) — was lost.

The H3 bounced back on its second flight, which occurred in February of this year and carried a 5,900-pound (2,600 kilograms) mass simulator as its main payload.

The rocket reached orbit successfully and also deployed two small Earth-observation satellites, called CE-SAT-IE and TIRSAT, that were along for the ride.

The 3-ton ALOS-4 is an advanced successor to Japan's ALOS-2 satellite, which has been studying Earth using synthetic aperture radar since its 2014 launch.

"JAXA and its prime contractor, Mitsubishi Electric Corporation, are developing the satellite aiming at achieving both high resolution and a broader observation swath," JAXA officials wrote in an ALOS-4 mission description.

"Unlike observations by an optical sensor, radar images can be acquired day and night as it does not require sunlight," the agency added.

"Moreover, since radio waves can penetrate cloud, the images can be obtained regardless of weather condition.

The ALOS-4 will leverage these merits for observing and monitoring disaster-hit areas, forests and sea ice."

Asteroid Day Revelation: Explore the Massive Meteor Crater in Arizona From Space

JUNE 30, 2024

For Asteroid Day (June 30), the Copernicus Sentinel-2 mission takes us over the Meteor Crater, also known as the Barringer Meteorite Crater.

Formation of the Crater

Around 50,000 years ago, an iron-nickel meteorite, estimated to be 30-50 m (100-165 feet) wide, smashed into North America and left a massive hole in what is today known as Arizona.

The violent impact created a bowl-shaped hole of over 1200 m (4000 feet) across and 180 m (600 feet) deep in what was once a flat, rocky plain.

During its formation, millions of tonnes of limestone and sandstone were blasted out of the crater, covering the ground for over a kilometer in every direction with a blanket of debris.

Large blocks of limestone, the size of small houses, were thrown onto the rim.

Crater’s Unique Shape and Context

One of the crater’s main features is its squared-off shape, which is believed to be caused by flaws in the rock which caused it to peel back in four directions upon impact.

The wide perspective of this image shows the crater in context with the surrounding area.

The impact occurred during the last ice age, when the plain around it was covered with a forest where mammoths and giant sloths grazed.

Crater Preservation and Importance

Over time, the climate changed and dried. The desert that we see today has helped preserve the crater by limiting its erosion, which makes it an excellent place to learn about the process of impact cratering.

Impact craters are inevitably part of being a rocky planet. They occur on every planetary body in our solar system – no matter the size.

By studying impact craters and the meteorites that cause them, we can learn more about the processes and geology that shape our entire solar system. Over the past two decades, ESA has tracked and analyzed asteroids that travel close to Earth.

ESA’s upcoming Flyeye telescopes will survey the sky for these near-Earth objects, using a unique compound eye design to capture wide-field images, which will enhance the detection of potentially hazardous asteroids.

Future Missions and Asteroid Deflection

ESA’s Hera spacecraft, launching later this year, will closely explore asteroids, improve our understanding of these celestial bodies, and help us better prepare for potential future asteroid deflection efforts.

In the latter case, the President’s authority is sometimes “conclusive and preclusive.” Id., at 638 (Jackson, J., concurring). When the President exercises such authority, Congress cannot act on, and courts cannot examine, the President’s actions. It follows that an Act of Congress—either a specific one targeted at the President or a generally applicable one—may not criminalize the President’s actions within his exclusive constitutional power.Neither may the courts adjudicate a criminal prosecution that examines such Presidential actions. The Court thus concludes that the President is absolutely immune from criminal prosecution for conduct within his exclusive sphere of constitutional authority. Pp. 6–9.

(2)Not all of the President’s official acts fall within his “conclusive and preclusive” authority. The reasons that justify the President’s absolute immunity from criminal prosecution for acts within the scope of his exclusive constitutional authority do not extend to conduct in areas where his authority is shared with Congress. To determine the President’s immunity in this context, the Court looks primarily to the Framers’ design of the Presidency within the separation of powers, precedent on Presidential immunity in the civil context, and criminal cases where a President resisted prosecutorial demands for documents. (i) The Framers designed the Presidency to provide for a “vigorous” and “energetic” Executive. The Federalist No. 70, pp. 471–472 (J. Cooke ed. 1961) (A. Hamilton). They vested the President with “supervisory and policy responsibilities of utmost discretion and sensitivity.” Nixon v. Fitzgerald, 457 U. S. 731, 750. Appreciating the “unique risks” that arise when the President’s energies are diverted by proceedings that might render him “unduly cautious in the discharge of his official duties,” the Court has recognized Presidential immunities and privileges “rooted in the constitutional tradition of the separation of powers and supported by our history.” Id., at 749, 751, 752, n. 32. In Fitzgerald, for instance, the Court concluded that a formerPresident is entitled to absolute immunity from “damages liability for acts within the ‘outer perimeter’ of his official responsibility.” Id., at 756.
