i don't like J.D Vance. The 2024 U.S. presidential and congressional elections are scheduled to take place on November 5, 2024, with early in-person voting in some states beginning in September. Recent developments such as the advancement of artificial intelligence (AI) capabilities, the continued targeting of U.S. elections by foreign actors, and the increase in threats and harassment of election workers may elevate election interference as a subject of interest for Congress. For example, during New Hampshire’s 2024 presidential primary election, the New Hampshire Attorney General’s Office received complaints of a robocall allegedly using an AI “deepfake” to unlawfully interfere in the election by spreading misinformation in an attempt to suppress voting. Members of the House and Senate responded to this incident, stating that federal action is needed to respond to this type of interference.

Several federal laws (https://www.justice.gov/criminal/file/1029066/download) prohibit interference with voting or interference with registering to vote in a U.S. election. While this Legal Sidebar does not provide a comprehensive list of all crimes that may be relevant to an election, it does provide an overview of criminal laws that prohibit election interference targeting voters, focusing primarily on those used in recent federal prosecutions. Additionally, this Sidebar discusses Congress’s constitutional authority to regulate U.S. elections and also provides considerations for Congress. For an overview of federal criminal laws prohibiting threats and harassment of election workers, refer to this CRS Legal Sidebar.

Constitutional Authority over Elections

Article I, Section 4, cl. 1, of the U.S. Constitution, known as the Elections Clause, states, “The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of [choosing] Senators.” While the states have primary responsibility for administering elections, the federal government maintains significant authority over elections, including safeguarding the safety and integrity of congressional elections.

A parallel constitutional provision addressing presidential elections, Article II, Section 1, cl. 4, provides that Congress may determine the “time” of choosing presidential electors and the day the electors shall cast their votes, with that day being the same throughout the United States. This clause does not delegate to the states any power to prescribe the time, place, and manner of electors casting votes in a presidential election. The Supreme Court has held that “[t]he importance of [the presidential] election and the vital character of its relationship to and effect upon the welfare and safety of the whole people cannot be too strongly stated” and that “Congress, undoubtedly, possesses that power … to preserve the … institutions of the general government from impairment or destruction…. ” Congress, exercising its authority under this provision, has enacted legislation establishing an Election Day. The power to appoint electors and how those appointments are made, however, belongs to the states under Article II, Section 1, cl. 2.

Congress does not have general regulatory authority over state and local elections, but it may still exercise its power over such entities in several contexts. For example, Congress has the authority to prevent unconstitutional voting discrimination in a state or local election. Congress’s authority to legislate regarding these various issues derives, in addition to its Article I powers, principally from the Fourteenth and Fifteenth Amendments. Furthermore, relying on its Spending Clause authority under Article I, Congress might also condition the receipt of federal funds for state or local elections on compliance with federal requirements.

Donald Trump Supporters Flipping to Kamala Harris: New Poll

Vice President Kamala Harris is winning oversomeof former President Donald Trump's supporters, according to a new CNN poll.

Harris is viewed as the front-runner to win the Democratic presidential nomination after President Joe Biden withdrew from the race over the weekend, following weeks of pressure from Democrats concerned about his ability to win in November and polls showing him behind Trump in key battleground states.

With Biden's endorsement, Democrats quickly rallied around Harris, who has appeared to secure enough delegates to officially become the nominee at the Democratic National Convention next month.

Harris, like Biden, has trailed Trump in the polls for months.But her supporters argue she is more capableof running a robust campaign that could win over swing voters while increasing the already mounting Democratic enthusiasm for the race. Several new polls this week suggest a tight race between Harris and Trump and that Harrismay already bepulling stronger numbers than Biden.

A CNN poll released on Wednesday found that Harris is gaining some of Trump's supporters,though the former president continues to hold a lead overall.

Thepoll showed Harris trailingthe former president by three points (49 percent to 46 percent).

Still, thepoll found that 95 percent of Biden's supporters(maybe because we make up numbers all the time) are continuing to stick with Harris, while she is winning over 5 percent of Trump's former supporters.(No fucking way, once with Trump, always with Trump)

Trump is winning over a smaller number of Biden's supporters, according to the poll.Three percent of those who previously backed Biden are now supporting Trump, who retained 92 percent of his past supporters.

Harris is winning 94 percent of Democrats, while Trump is winning 91 percent of Republicans. (Make this clear, not 94% dems, 94% of dems that voted Bidan, but that’s highly doubtful also and Bidan approval rating was down to 36%, whereas it was at 65-70% in 2020, so kamala only has about 1/2 of all Bidan 2020 voters, “or ballots”) However, he continues to hold a narrow lead among independent voters (46 percent to 43 percent).

Several other polls have shown a tight race after Biden dropped out.

Called the Iris Nebula, NGC 7023 is not the only nebula to evoke the imagery of flowers. Still, this deep telescopic image shows off the Iris Nebula's range of colors and symmetries embedded in surrounding fields of interstellar dust. Within the Iris itself, dusty nebular material surrounds a hot, young star. The dominant color of the brighter reflection nebula is blue, characteristic of dust grains reflecting starlight. Central filaments of the reflection nebula glow with a faint reddish photoluminescence as some dust grains effectively convert the star's invisible ultraviolet radiation to visible red light. ROME — Secretary of State Mike Pompeo recently published a sharp letter excoriating the Vatican’s plans to renew an agreement with the Chinese government on Church operations in China. He promoted the article in a tweet, concluding, “The Vatican endangers its moral authority, should it renew the deal.”

An indignant Vatican took the article more as a calculated affront than a diplomatic gesture. The friction broke into the open on Wednesday as Mr. Pompeo arrived in Rome and met with prelates and others who are hostile to Pope Francis, while the Vatican denied him a meeting with the pontiff and rebuffed his efforts to derail the deal with China.

“Pompeo asked to meet” the pope, who turned him down because Francis had “clearly said that he does not receive political figures ahead of the elections,” Cardinal Pietro Parolin, who, as secretary of state, is the Vatican’s second-ranking official, told reporters.

But to some observers on both sides of the tensions between the Roman Catholic Church and the Trump administration, Mr. Pompeo’s visit is as much about the coming presidential election as about China policy. Mr. Pompeo dismissed that suggestion as absurd, but intended or not, his trip signals that President Trump is on the side of those conservative American Catholics who worry about the church’s direction under Francis and think he is soft on China.

Francis and Mr. Trump, who have exchanged sharp words in the past, present starkly different visions on issues ranging from the environment to immigration to the threat of populism. In appealing to the Vatican’s support for religious freedom as a reason to drop its China agreement, Mr. Pompeo seemed to seek common ground, but in a way that upset the pope’s chief allies and delighted his chief critics.

Cardinal Parolin said Mr. Pompeo’s article had caused “surprise” at the Vatican, because this visit to Rome by the secretary and the meetings with high officials at the Holy See had already been in the works and would have been a “more opportune” forum for airing grievances. He added that Mr. Pompeo’s choice to publish in First Things, a conservative Christian magazine that has called Francis a failure as Pope, also mattered.

NASA’s Hubble Space Telescope captured this image of Saturn and its colossal rings on July 4, 2020, during summer in the gas giant’s northern hemisphere.

Two of Saturn’s icy moons are also clearly visible: Mimas at right, and Enceladus at bottom.

The light reddish haze over the northern hemisphere seen in this color composite could be due to heating from increased sunlight, which could either change the atmospheric circulation or remove ices from aerosols in the atmosphere.

Another theory is that the increased sunlight in the summer months is changing the amounts of photochemical haze produced.

Conversely, the just-now-visible south pole has a blue hue, reflecting changes in Saturn’s winter hemisphere.

This image was taken as part of the Outer Planets Atmospheres Legacy (OPAL) project.

OPAL is helping scientists understand the atmospheric dynamics and evolution of our solar system’s gas giant planets.

DoD Announces Publication of 2024 Arctic Strategy

Today, the Department of Defense (DOD) released its 2024 DOD Arctic Strategy. This is the first update to DOD's approach to the region since 2019.

"The Arctic region of the United States is critical to the defense of our homeland, the protection of U.S. national sovereignty, and the preservation of our defense treaty commitments," said Deputy Secretary of Defense Kathleen Hicks. "Our Arctic strategy will guide the Department's efforts to ensure that the Arctic remains a secure and stable region."

The 2024 DOD Arctic Strategy lays out steps DOD will take, working alongside our Allies and partners, to preserve the Arctic as a secure and stable region in which the U.S. Homeland is defended and our vital national interests are safeguarded. It builds upon guidance laid out in the 2022 National Security Strategy and 2022 National Defense Strategy and is part of DODs effort to implement the 2022 National Strategy for the Arctic Region.

"This strategy is very action oriented, which distinguishes it from previous Arctic Strategies" Deputy Assistant Secretary for Arctic & Global Resilience Iris Ferguson said. "We unpack where we need to sustain our investments, especially in critical capabilities. What do we have to see? How do we communicate? Do we have the right equipment to operate in the region? My office exists to champion these capabilities, which are vital to the successful implementation of our strategy."

The Arctic region is undergoing rapid change, both strategically and physically. The People's Republic of China (PRC), which remains DOD's pacing challenge, seeks increasing access and influence in the Arctic, while Russia remains an acute threat in the region despite its losses in Ukraine. Increasingly, these two competitors are collaborating in the Arctic with implications for the security of the United States and our Allies and partners. At the same time, Finland and Sweden's historic decision to join NATO brings all like-minded Arctic states into the NATO Alliance and presents new opportunities for collaboration and cooperation. All of this is underscored by the impact of climate change on the Arctic, which is warming at least three times faster than the rest of the world and increasingly opening to more human activity.

To address this dynamic security environment, DOD will adopt a "monitor-and-respond" approach to the Arctic, supported by robust domain awareness cooperation with our highly capable Allies and partners, and underpinned by the deterrent value of DOD's ability to deploy the Joint Force globally at the time and place of our choosing. The ways DOD will execute this approach are grouped into three main lines of effort:

DOD will enhance its capabilities to campaign in the Arctic especially its domain awareness, communications, and intelligence, surveillance, and reconnaissance capabilities.

DOD will engage with Allies and partners to uphold defense and deterrence in the Arctic, build interoperability, and increase its understanding of how to operate in the region.

DOD will exercise calibrated presence in the Arctic by regularly training in the region and conducting routine operations critical to upholding deterrence and homeland defense.

Engineering teams with NASA and Boeing recently completed ground hot fire testing of a Starliner reaction control system thruster at White Sands Test Facility in New Mexico. The test series involved firing the engine through similar in-flight conditions the spacecraft experienced during its approach to the space station, as well as various stress-case firings for what is expected during Starliner’s undocking and the deorbit burn that will position the spacecraft for a landing in the southwestern United States. NASA astronauts Butch Wilmore and Suni Williams arrived at the orbiting laboratory on June 6, after lifting off aboard a United Launch Alliance Atlas V rocket from Space Launch Complex-41 at Cape Canaveral Space Force Station in Florida on June 5. Since their arrival, the duo has been integrated with the Expedition 71 crew, performing scientific research and maintenance activities as needed.

The FBI conducted a pre-dawn raid on the $3.5 million Long Island home ofLinda Sun, a former deputy chief of staff to Gov. Kathy Hochul.

FBI accusing Russia to ‘divert attention’ from its failures – Moscow

Claims that Moscow is trying to interfere with US elections are false, Ambassador Anatoly Antonov has said

The FBI is using a supposed ‘threat’ to American democracy from Russia as a diversion to draw public attention away from the bureau’s own failures, Russian Ambassador to the US Anatoly Antonov claimed on Thursday.

He was responding to allegations made by FBI Director Christopher Wray, who claimed before Congress on Wednesday that Moscow had been attempting to interfere in the US “election cycle after election cycle,” in particular, during the current race for the White House.

“We assess that the Russian government continues to want to influence and in various ways interfere with our democracy, with our electoral process,” Wray told lawmakers, claiming that investigators had recently uncovered a “significant disruption of a generative AI-enhanced social media” of Russian origin, which was “designed to be an influence operation.”

Antonov dismissed Wray’s allegations, describing them as “yet another unsuccessful example of blame-shifting.” He said this was a policy that is often utilized by both the FBI director and other American officials.

“These are obviously yet more attempts to play the ‘Russian card’ to justify their own failures,” he stated, adding that “it is understandable” that representatives of the US administration “want to divert the attention of ordinary citizens from their mistakes and the numerous internal contradictions in America.”

"We flatly reject insinuations against Russia. Our country has never interfered in democratic processes. Moscow has always respected and will always respect the choice of the American people."

Antonov suggested that, in order to find those responsible for the problems within the US, Wray and other Washington officials “should look at their reflection in the mirror.”

Wray’s testimony on Wednesday was largely focused on the investigation into the assassination attempt on former US President and Republican nominee for this year’s election, Donald Trump. The attempt on Trump’s life during a rally in Butler, Pennsylvania on July 13 caused public outcry, with Republicans lambasting the US Secret Service for failing to protect the presidential nominee. Secret Service Director Kimberly Cheatle was forced to resign earlier this week, having admitted that Trump’s attempted assassination was “the most significant operational failure at the Secret Service in decades.”

Wray is not the first Washington official to make allegations of Russian interference in the US electoral process. NASA’s ICON Mission Ends with Several Ionospheric Breakthroughs

NASA’s ICON mission studied the outermost layer of Earth’s atmosphere called the ionosphere.

ICON provided critical insights into interplay between space weather and Earth’s weather.

The mission gathered unprecedented detail of airglow, showed a relationship between the atmosphere’s ions and Earth’s magnetic field lines, and provided the first concrete observation to confirm Earth’s long-theorized ionospheric dynamo.
Nearly a year after ICON accomplished its primary mission, communication was lost in November 2022 for unclear reasons.

NASA formally concluded the mission after several months of troubleshooting could not regain contact.

After contributing to many important findings on the boundary between Earth’s atmosphere and space — an area where space weather can interfere with both satellites and communications signals — NASA’s ICON (Ionospheric Connection Explorer) mission has come to an end.

The mission launched in October 2019 and completed its two-year mission objectives in December 2021, before going on to operate as an extended mission for another year.

“The ICON mission has truly lived up to its name,” said Joseph Westlake, heliophysics division director at NASA Headquarters in Washington.

“Not only did ICON successfully complete and exceed its primary mission objectives, it also provided critical insights into the ionosphere and the interplay between space and terrestrial weather.”

The ICON spacecraft orbited in a part of our planet’s outermost layer of the atmosphere, called the ionosphere, where it studied what events impact the ionosphere, including Earth’s weather from below and space weather from above.

The ionosphere is the lowest boundary of space, located between 55 miles to 360 miles above Earth’s surface.

It is made up of a sea of particles that have been ionized: a mix of positively charged ions and negatively charged electrons called plasma.

This frontier of space is a dynamic and busy region, home to many satellites — including the International Space Station — and is a conduit for radio communications and GPS signals.

Both satellites and signals can be disrupted by the complex interactions of terrestrial and space weather, so studying and understanding the ionosphere is crucial to understanding space weather and its effects on our technology.

The ICON mission captured unprecedented data about the ionosphere with direct measurements of the charged gas in its immediate surroundings alongside images of one of the ionosphere's most stunning features — airglow.

ICON tracked the colorful bands as they moved through the ionosphere. Airglow is created by a process similar to what creates the aurora.

However, airglow occurs around the world, not just at the northern and southern latitudes where auroras are typically found.

Although airglow is normally dim, ICON’s instruments were specially designed to capture even the faintest glow in order to build a picture of the ionosphere’s density, composition, and structure.

By measuring Doppler shift, ICON’s sensitive imagers also detected the motion of the atmosphere as it glowed.

“It’s like measuring a train’s speed by detecting the change in the pitch of its horn — but with light,” said Thomas Immel, ICON mission lead at the University of California, Berkeley.

The mission was specifically designed to perform this technically difficult measurement.

A New Ionospheric Perspective

The ICON mission’s comprehensive view of the upper atmosphere provided valuable data for scientists to unravel for years to come.

For instance, its measurements showed how the 2022 Hunga Tonga-Hunga Ha’apai volcanic eruption disrupted electrical currents in the ionosphere.

“ICON was able to capture the speed of the volcanic eruption, allowing us to directly see how it affected the motion of charged particles in the ionosphere,” Immel said.

“This was a clear example of the connection between tropical weather and ionospheric structure. ICON showed us how things that happen in terrestrial weather have a direct correlation with events in space.”

Another scientific breakthrough was ICON’s measurements of the motion of ions in the atmosphere and their relationship with Earth’s magnetic field lines.

“It was truly unique,” Immel said. “ICON’s measurements of the motion of ions in the atmosphere was scientifically transformational in our understanding of behavior in the ionosphere.”

With ICON’s help, scientists better understand how these interactions drive a process called the ionospheric dynamo. The dynamo, which lies at the bottom of the ionosphere, remained a mystery for decades because it is difficult to observe.

ICON provided the first concrete observation of winds fueling the dynamo and how this influences space weather.

Unpredictable terrestrial winds move plasma around the ionosphere, sending the charged particles shooting out into space or plummeting toward Earth.

This electrically charged tug-of-war between the ionosphere and Earth’s electromagnetic fields acts as a generator, creating complex electric and magnetic fields that can affect both technology and the ionosphere itself.

“No one had ever seen this before,” Immel said. “ICON finally and conclusively provided experimental confirmation of the wind dynamo theory.”

An Iconic Legacy

On Nov. 25, 2022, the ICON team lost contact with the spacecraft. Communication with the spacecraft could not be established, even after performing a power cycle reset using a built-in command loss timer.

Though the spacecraft remains intact, other troubleshooting techniques were unable to re-establish contact between the ICON spacecraft and mission operators.

“ICON’s legacy will live on through the breakthrough knowledge it provided while it was active and the vast dataset from its observations that will continue to yield new science,” Westlake said.

“ICON serves as a foundation for new missions to come.”

As FBI Director Chris Wray performed his usual smarmy stonewalling in Congress Wednesday, a damning report on his $10 billion agency’s “cult of narcissism” was delivered to the House Judiciary Committee by an alliance of retired and active-duty agents and analysts.

The same group gave us the scathing DEI report last year about the FBI’s degraded recruitment standards and coddling of physically unfit, mentally ill, drug-taking or generally useless agents to satisfy diversity requirements at the expense of merit and experience.

This time they have assessed the entire bureau and drawn several worrying conclusions, including that local law enforcement partners have developed a “disturbing loss of trust in the FBI” and are therefore reluctant to share information, with alarming consequences for national security and public safety.

“Police officers and sheriff’s deputies on patrol and detectives investigating illegal activity in their jurisdictions have unparalleled visibility into street-level crime. … When this information is not immediately shared with the FBI, the FBI is left to address complex, evolving threats facing the United States with an unacceptably vast and debilitating ‘blind spot’ because [it] does not have enough personnel and resources to see into every corner of the country.”

Loss of trust

While Wray testified that the FBI is facing a “complex threat environment” that is unprecedented in his experience,the loss of trust in the bureau on his watch only exacerbates the risks, which include terrorist suspects flooding over the southern border.

Republican members of Congress questioning Wray reflected a widespread distrust of the FBI’s investigation of the assassination attempt against former President Donald Trump.

The whistleblower report draws on testimony from more than30 “independent, highly credible law enforcement sources and sub-sources” across the country who “do not trust the FBI becausethey believe the FBI in recent years has been operating as a ==partisan federal agency motivated by a political agenda.=

“They are not only reluctant to work with the FBI but reportedly =have decided to no longer share actionable, substantive information on criminal and other intelligence-related activity with the FBI.”==

Most concerning is what the alliance of ==whistleblowers calls a “crisis of confidence” in FBI-led task forces where relationships with local cops=• have deteriorated to the point of “imploding” in some cases because of “poor management and ineffective leadership by the FBI.”

Local cops said their precipitous loss of trust in the FBI was triggered by its excessive response to the Capitol riot of Jan. 6, 2021, followed by the raid on Trump’s Mar-a-Lago residence in Florida.

One source, a25-year veteran sergeant in the Major Crimes Divisionof a large police force in a Western state, said they“cannot understand why the FBI is not going after [far-left militant group] Antifa, BLM and pro-Palestinian rioters with the same vigorthe FBI brought to bear against” J6 participants.

Another source, a 15-year veteran cop from a Southern state, said =many local law enforcement officers “believe they could be targeted by the FBI and the DOJ because of their love for the United States of America== and may be perceived as domestic terrorists because of how they may vote.”

Plummeting morale

Thepressure placed on local law enforcement to assist with J6 casesin their areas “has impacted morale within these agencies” and led to a belief that the FBI has been contaminated by a “partisan, political agenda.”

The presumptive Democratic presidential nominee is showing signs of momentum in the days since President Biden decided not to run for a second term.

But strong fundraising, a well-attended rally, and endorsements from virtually every major Democrat not named Barack Obama haven’t translated to faith among the general public that Kamala Harris can win — at least not yet.

In a poll of 1,605 people (1,435 of whom are registered voters) YouGov conducted between July 21 and 23 — a period that encompasses Biden’s announcement not to run and the quick coalescence of Democratic elites around Harris — only 31% think the vice president has what it takes to earn a promotion this year.

And there’s no gender gap in pessimism about Harris’ prospects — that 31% applies to both males and females.

Conversely, 52% of respondents see Trump as the likely winner.

Democrats, predictably, give Harris whatever boost she can claim in this metric, with 67% of people in her own party saying the veep will win, another 14% predicting a Trump victory and the rest unsure.

GOP registrants are much more sold on their candidate’s viability.

Just 3% of Republicans surveyed expect Harris to win, while 91% think the race in November is Trump’s to lose.

Independents also seem to think Trump is inevitable, with 53% of unaligned voters believing he’ll emerge victorious, versus just 23% of indys who believe Harris will win.

One significant cohort believes Harris has what it takes, though — and they just happen to be, historically, the key to Democratic chances in national elections.

Forty-five percent of black respondents believe Harris will win, while just 33% predict a Trump triumph.

While voters may not believe Harris can win, it doesn’t mean they aren’t supporting her.

When asked about “presidential vote intent,” 41% of those polled back Harris — putting her just 3 points behind Trump, well inside the +/- 3.3% margin of error and tracking with polls from NPR and Marist that likewise show a race that is too close to call.

When it comes down to the other 15% in the YouGov survey, a third of them aren’t sure who they back, a third back Robert F. Kennedy Jr., and the rest are dispersed among a smattering of marginal candidates.

Trump has effectively consolidated Republican respondents in this survey, taking 92% of them, with 3% backing Kennedy and 2% backing Harris.

Democrats are still more diffused for the time being.

While Harris has a respectable 86% support level in her own party, 5% aren’t sure who they back, while Kennedy takes 3% and Trump takes 2% of Dems.

Independents are still up for grabs, but YouGov’s sample says Trump holds serve — taking 37% of them to Harris’ 32%. Of the remainder, 11% support Kennedy and 9% are still undecided.

Harris has majority support among black voters (63% to 14% for Trump), Hispanics (44% to 40%) and — in a potentially important metric that could swing battleground states — self-described “moderates,” with a 41% to 31% lead over Trump.

As Democrats might hope, a gender gap is also emerging in the preference poll.

Taxpayerresources have been lavished on a new “wellness center” for yoga and meditation= at the academy instead of teaching trainee agents the value of “humility and a higher sense of service and professionalism==” when working with local law enforcement.

The FBI Academy has become so politicizedthat at one point, a group ofconservative students held up handwritten signs displaying the word “STOP” in response to the instructor’s constant political denigration of Trump and Republicans.

The report also backs up whistleblower documents obtained earlier this month by Empower Oversight that revealed that theFBI’s Security Division has been abusing the security clearance process to purge conservatives from its ranks.

The FBI has suspended or revoked clearances for employees whoexpressed support for Trump or objections to the COVID-19 vaccinationin answer to a series of improper and intrusive questions.

Intrusive questions

Wray testified Wednesday that the intrusive questions were simply a one-offby an outside contractor who has been terminated.

But FBI whistleblower Steve Friend and others immediately disputed his claim, pointing out that these sorts of inappropriate questions were routine and “asked all the time in interviews.”

Wray also claimed the FBI was not lowering its standards for new employees, which flies in the face of the group’s revelations about the effect of disastrous DEI recruitment policies.

Ultimately the whistleblower group says the only way to restore the FBI’s reputation andrepair the damage is to force the resignation of Wray as “an extreme measure of last resort. (First resort, he allowed it, another cheatle)

“… At stake are no less than the public’s safety and America’s national security.”
