Bulker Reports Explosion in Cargo Holds Off North Carolina Coast

The UK-flagged bulker Anglo Marie Louise (114,727 dwt) has returned to an anchorage off Virginia after reports that the bulker suffered an explosion on November 27. There are no indications of injuries to the crew and the vessel remained seaworthy, although according to the report it has suffered damage.

 

“It is reported that the vessel has sustained damage to the No.1 and No.2 cargo hatches as a result of the explosion,” writes claims consultant WK Webster in its report of the incident.

 

The bulker, which was built in 2011 at China New Times Shipyard, departed Baltimore, Maryland on November 23. The explosion occurred while the vessel was approximately 150 nautical miles east of North Carolina on November 27. The vessel has now anchored off Virginia Beach near the entrance to Chesapeake Bay.

 

The same ship was also involved in an incident in March 2024 when it blacked out while maneuvering on the Mississippi River near New Orleans. A dispatcher from Moran tugboat company detailed the incident in a social media posting reporting the Anglo Marie Louise careened out of control on the river and was heading for the Nashville Avenue wharf. Two tugs were able to intercept the vessel before it hit another docked vessel or the wharf.

 

Previously, the ship was cited for issues during port state inspections in the early 2020s. Its most recent inspections however reflected no problems.

 

The vessel is registered in the UK and managed by Anglo Shipping in London. It is 837 feet (255 meters) in length.

What is a pardon?

 

A presidential pardon excuses a person who has committed a crime from serving punishment. A pardon does not expunge, or erase, a criminal record or a finding of guilt. However, if any civil rights were lost due to the criminal conviction, those rights will be restored.

 

What are the limitations of presidential pardons? Can a pardon be overturned?

 

The pardon power has two limitations:

 

The President cannot overturn Congress' power of impeachment.

The President cannot pardon individuals for the state crimes they committed. This power lies with state governors.

Pardons given out by the President cannot be overturned by the courts or Congress.

 

Can the President pardon him or herself?

 

The concept of a Presidential self-pardon has been around since Richard Nixon's presidency. During that time, a memo from the Department of Justice's Office of Legal Counsel held the position that a president could not self-pardon, "Under the fundamental rule that no one may be a judge in his own case, it would seem that the question should be answered in the negative."

 

However, this is merely a legal opinion and not actual law. Nixon did actually receive a presidential pardon, but it was from his former vice president, Gerald Ford. Nixon received a pardon for crimes that he "committed or may have committed or taken part in during January 20, 1969 through August 9, 1974." Based on the exact wording of this specific pardon, Richard Nixon was essentially given immunity from criminal charges stemming from Watergate.

 

Does timing of presidential pardons matter?

 

No, the timing of a pardon does not matter. In Ex parte Garland, the Supreme Court ruled that a president can issue a pardon at any time after commission of a crime. This means that a person does not even have to be officially charged with a crime before receiving a pardon.

 

What is the difference between a pardon and a commutation?

 

The president can also grant a commutation, which is different from a presidential pardon. A commutation is a reduction of a person's punishment, resulting in either a reduced fine or reduced time in prison. For commutations, one's civil rights (the right to vote, for example) are not restored. But those rights are typically restored with a pardon.

 

While most of us won't need a presidential pardon any time soon, you may have specific legal questions that you'd like to have answered.

Senate Select Committee on Intelligence member Mike Rounds doesn’t sound too enthusiastic about Kash Patel in the role of FBI director. In an interview this morning on ABC, the Republican senator from South Dakota said President Trump has the right to nominate Mr Patel, and the Senate will consider the “consent” from there. Several people are wondering if current FBI Director Chris Wray will resign. It’s a very unusual dynamic and the internal pressure will likely be on Director Wray to force President Trump to fire him, especially if the House and Senate are in session and there’s no possibility at the time for President Trump to appoint an “acting” replacement.

 

A lot can happen with President Trump announcing Kash Patel “will serve as” FBI Director, while a current FBI Director is still in place.Without the ability to appoint an “acting” replacement, the Deputy FBI director would take Wray’s place even if Wray was fired. No that's not how that works. The in cases of impeachment clause means he can't pardon someone being impeached to stop it or cancel them being removed from office. Common Interpretation

 

Treason is a unique offense in our constitutional order—the only crime expressly defined by the Constitution, and applying only to Americans who have betrayed the allegiance they are presumed to owe the United States. While the Constitution’s Framers shared the centuries-old view that all citizens owed a duty of loyalty to their home nation, they included the Treason Clause not so much to underscore the seriousness of such a betrayal, but to guard against the historic use of treason prosecutions by repressive governments to silence otherwise legitimate political opposition. Debate surrounding the Clause at the Constitutional Convention thus focused on ways to narrowly define the offense, and to protect against false or flimsy prosecutions.

 

The Constitution specifically identifies what constitutes treason against the United States and, importantly, limits the offense of treason to only two types of conduct: (1) “levying war” against the United States; or (2) “adhering to [the] enemies [of the United States], giving them aid and comfort.” Although there have not been many treason prosecutions in American history—indeed, only one person has been indicted for treason since 1954—the Supreme Court has had occasion to further define what each type of treason entails.
