New FOIA on migrants avoiding the draft could open new deportation predicate.

 

A top government accountability group will send a Freedom of Information Act (FOIA) request to the U.S. Selective Service System (SSS) for data on illegal immigrants who did not register for the draft and therefore committed a felony.

 

Oversight Project executive director Mike Howell โ€“ whose group is filing the action โ€“ underlined the move is not an illustration of any support for illegal immigrants serving in the military.

 

By law, all U.S. males aged 18-26 must register with the SSS under penalty of felony conviction and $250,000 fine under the Military Selective Service Act of 1917, Howellโ€™s group noted in their filing.

 

Additionally, the McCarran-Walter Act of 1952 makes failure to register with the SSS a deportable offense, and the SSS website clearly states undocumented aliens are required to sign up for the draft, Howell noted.

Several times during his tenure as a Congressman, Ron Paul suggested using letters of marque and reprisal to seize property and exact harm upon Osama bin Laden and other Al Qaeda officials. Offering a bill in October of 2001, Paulโ€™s suggestion would have allowed:

 

โ€œCongress to authorize the President to specifically target Bin Laden and his associates using non-government armed forces. Since it is nearly impossible for U.S. intelligence teams to get close to Bin Laden, the marque and reprisal approach creates an incentive for people in Afghanistan or elsewhere to turn him over to the [United States].โ€

 

Paul argued that the letters would be cost effective, produce motivation for locals to assist in capture, and protect liberty at home while hindering foes abroad.

 

He was mocked. He was ridiculed. He was criticized by those in his own party. His plan fell on deaf ears.

 

While commonly chided, Paulโ€™s suggestion may very well have destroyed the political impetus behind the PATRIOT Act and blocked the emergence of the Department of Homeland Security. It very well may have worked to erode the military industrial complex.

 

How is that, you may ask?

 

Without wartime policy, these policies may never have been able to be effectively sold to the American public. Without perpetual war, there is usually little justification for a national government to deprive individuals of liberty.

 

In Article I, Section 8, the Constitution provides the following power to Congress:

 

โ€œTo declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water;โ€

 

The founders had the prophetic foresight to conclude that there may be times in which the United States wished to enact retribution against enemies without the necessity of waging a costly or expansive war. As many realized, war is a menace to individual liberty and a friend of an overreaching government.

 

During the Philadelphia summer of 1787, James Madison said that war โ€œhas the tendency to render the head too large for the body.โ€ Madison concluded, โ€œA standing military force, with an overgrown Executive will not long be safe companions to liberty.โ€ Madison was not alone in this belief.

 

The argument of Madison and others illustrated the potential for letters of marque and reprisal to be used as an alternative. The letters themselves would allow for privateers (vessels which were equipped and commissioned by private individuals) to attack and capture enemy vessels, confiscate property, or engage in military hostilities. The letters served and a beneficial way to augment naval forces and produced positive results in the early stages of the republic.

 

Neither the Republicans nor the Federalists devoted much energy to attacking the policy of letters of marque and reprisal. Opponents of the Constitution did not fear their presence, understanding that it would be the power of Congress rather than the executive to propose them. In comparison to their tendency to believe that the executive would rule with unilateral war power, the letters seemed inconsequential. Supporters of the Constitution also understood their presence as a power. In The Federalist #41, Madison called the letters a โ€œpalpable necessityโ€ and wrote that they provided โ€œsecurity against foreign danger.โ€[1]

Throughout the War of Independence, privateering created a major source of commerce and employment for many states. The practice proved significant, leading to the seizure of about 300 British ships during the war.

 

During the War of 1812, Madison used such letters to oppose the British, realizing that the United States lacked a sophisticated navy to oppose a world power.

 

Under the Constitution as ratified, the President was only to become the commander of the military in times where war was declared in the explicit by Congress. Understanding these premises, Alexander Hamilton made this clear in The Federalist #69:

 

โ€œThe President is to be commander-in-chief of the army and navy of the United States. In this respect his authority would be nominally the same with that of the king of Great Britain, but in substance much inferior to it. It would amount to nothing more than the supreme command and direction of the military and naval forces, as first General and admiral of the Confederacy; while that of the British king extends to the declaring of war and to the raising and regulating of fleets and armies โ€” all which, by the Constitution under consideration, would appertain to the legislature.โ€[2]

 

This passage serves as farther proof that the President was to act in a conciliatory manner toward Congress, respecting the legislature as the body to make such regulations over wartime policy.

 

Unfortunately, these limitations on the President have been undermined by the War Powers Act and the incremental transferal of war powers to the executive during the 20th Century. These trends should be rejected outright. Allowing the President to unilaterally control all aspects of a warโ€™s declaration, execution, and conclusion has degraded the original understanding of the Constitution. Utilizing letters of marque and reprisal would serve to threaten this negative development and reverse these harmful shifts.

 

Understanding letters and the separation of powers doctrine, the first executives were forced to abide by this explanation.

 

During the Quasi War, John Adams took no independent action to escalate hostilities against the French. Instead, Congress passed a series of acts and Adam complied with the statues that were passed. When Adams became lenient and diverted from these guidelines, he was reprimanded by the Supreme Court when he attempted seize a vessel sailing from a French port. Congress had only allowed him to act to seize ships heading to French ports.[3] The President was admonished.

 

In the same spirit, Thomas Jefferson acted in a characteristically deferential manner when dealing with Congress in relation to the First Barbary War. After approval was given by Congress to protect American ships and citizens against aggression, Jefferson announced that he was โ€œunauthorized by the Constitution, without the sanction of Congress, to go beyond the line of defense.โ€[4] Evidently, Jefferson understood that the restrictions placed upon his power to conduct military hostilities were clearly defined during the Constitutionโ€™s ratification.

 

The founding generation and the first Presidents understood that unending war was the friend of tyranny rather than liberty. As such, they realized that letters of marque and reprisal would be an effective way to impede enemies and protect liberty at the same time. A massive amount of premonition went into these conclusions, and these perceptions made the states realize that the letters could be beneficial in a free society.

 

In todayโ€™s political environment, many are unaware of what letters of marque and reprisal are or why they were proposed. However, history is evidence to the fact that they served as an essential mechanism to avert war and punish adversaries in the absence of military aggression. Ron Paul realized that, and made an offering which would have preserved liberty and protected the states simultaneously.

 

Over 200 years since they were last used, the time is suitable for letters of marque and reprisal to find their way back into popular civic understanding. Our republic yearns for it, if only for the sake of liberty and fiscal advantages they offer.

Tesla CEO Elon Musk and Donald Trump Jr. expressed support for reviving letters of marque and reprisals to combat drug cartels.

 

On Monday, Sen. Mike Lee (R-UT) laid out a detailed plan to bring back the old tactic of privateering, in which the government would give private actors its blessing to raid enemy ships, taking part of the loot as payment. Though the practice was largely ended by the 1856 Paris Declaration Respecting Maritime Law after the Crimean War, Lee suggested reviving and modernizing it.

 

โ€œCongress could issue letters of marque and reprisal authorizing private security firms or specially trained civilians to intercept cartel operations, particularly those involving drug shipments or human trafficking across borders,โ€ Lee suggested after pointing out that the Constitution still gives it authority to issue the letters.

 

The privateers would โ€œfocus on disrupting supply lines, capturing high-value targets, or seizing assets like boats, vehicles, cash, gold, or equipment used in criminal activities.โ€

 

Lee argued that the move would allow more flexibility in combating threats from drug cartels and save taxpayer money. His proposal drew support from several of those close to President Donald Trump.

Leeโ€™s proposal largely drew praise and memes on social media, with many Trump supporters voicing their approval. Other critics were more skeptical, with some pointing out logistical problems with the plan.

 

โ€œLetters of Marque and Reprisal were effective in the past because privateers could legally sell the ships and cargo they captured. The most valuable property that drug dealers own is drugs. Would the government let the privateers sell the drugs they capture?โ€ the Cato Instituteโ€™s Alex Nowrasteh said.

 

The Daily Beastโ€™s Janna Brancolini called the proposal โ€œcrazy.โ€ She said the primary reason for letters of marque in the United Statesโ€™s case was to compensate for the lack of a sizeable navy โ€” in stark contrast to the military power the U.S. is today.

 

Monday wasnโ€™t the first time Lee floated the idea โ€” he first mentioned the power in a 2011 Conservative Political Action Conference speech. However, the speech was less a proposal than a history lesson.

 

He explained that letters of marque are โ€œessentially a hall pass issued by Congress that entitles the bearer to act in the United Statesโ€™s name and engage in state-sponsored acts of piracy on the high seas.โ€

 

โ€œAnd so, help me, if itโ€™s the last thing I do โ€ฆ Iโ€™m going to get a letter of marque of reprisal,โ€ he said, drawing laughter. โ€œIโ€™m going to get a ship and an eyepatch, and Iโ€™m going to be a pirate, and youโ€™re all invited to join me!โ€

 

Leeโ€™s Monday proposal also resembles the more modern filibustering, in which people would gather private armies to invade Latin American countries with the intention of setting up their own governments, sometimes with the tacit blessing of the U.S. government.

Lee has proposed that the government return to issuing letters of marque. For those of you not versed in pirate lore (meaning anyone who does not have the same weird fascination with it as I do, which is likely everyone), a letter of marque was a document issued by a government to privateers to loot and plunder ships belonging to enemy nations. The crews or, more likely, the owners got a cut of the take. Many privateers also engaged in piracy, although one of the most famous pirates in history, Henry Morgan, despised being called a pirate and considered himself a one-time privateer and a loyal subject to the British crown.

 

The U.S. has used letters of marque in the past. Congress issued them to merchant ships during the American Revolution to harass and plunder enemy vessels, and lo and behold, they worked.

 

In a series of posts on X, Lee noted that, believe it or not, Congress still has that power under Article 1, Section 8 of the U.S. Constitution. He argues that while we haven't used it in a while, it might be time to dust it off and leverage it against the drug cartels. He sees the move as a good one, given the threats by the cartels against the U.S. for returning criminals to their countries of origin.

 

Lee explained:

 

Using letters of marque could be a novel but effective response to unique threats posed by drug cartelsโ€”especially in response to threats by the cartels to target U.S. planes returning illegal immigrants to their countries of origin.

 

Congress could issue letters of marque and reprisal authorizing private security firms or specially trained civilians to intercept cartel operations, particularly those involving drug shipments or human trafficking across borders.

 

The focus would be on disrupting supply lines of trafficked drugs and people. Assets like boats, gold, cash, and equipment would be seized. Obviously, the government would handle any drugs involved and the trafficked persons.

 

Lee asserts that issuing letters of marque would be cheaper for the U.S. taxpayer and easier logistically since said privateers could respond to cartels with more agility and could adapt their tactics faster than government troops. He also commented that it would be a preferable alternative to going to war with our southern neighbors.

 

He also acknowledged that while the U.S. does not want to declare war, the threat posed by the cartels cannot be ignored. One responder on X raised a point: if a company or group has a letter of marque, what would prevent them from harassing or stealing from private citizens, innocent bystanders, or the victims themselves? Some vetting process would be necessary, and since Trump created the Space Force, perhaps he could create the U.S. Department of Privateering. That's a tough one since, traditionally, issuing letters of marque is a job for Congress. But then again, who wants The Squad raising a pirate army?

What is a Letter of Marque?

 

A letter of marque is a formal document which issued by a government to a citizen to allow him or her to seize goods or citizens of other nations. These letters have historically been used as political tools, both to allow people to deal with private disputes and to engage with another nation without openly declaring war. Some countries still allow letters of marque to be issued, although most do not use the privilege; in other nations, they are no longer legal. The United States is one nation in which they are permitted, under the terms of the Constitution.

 

Essentially, a letter of marque creates a legal pirate. A citizen with such a letter was historically allowed to outfit a ship for the purpose of piracy, taking that ship beyond national waters and attacking enemy shipping. Attacks on a nation's merchant marine can be very powerful politically, and the holder of the letter can sell any goods confiscated, while captured citizens could be used as sources of information or bargaining chips. One famous holder of a letter of marque was Sir Francis Drake, a British Vice Admiral who attacked Spanish shipping.

 

A ship outfitted under a letter of marque was sometimes known as a private man-o-war, in a reference to the fact that it was used to supplement a national navy. Such ships were also known slangily as privateers, as were their captains and crews. In France, where these letters were also known as lettres de course, these ships were called corsairs. Most nations discerned between privateers and pirates; as privateers operated with the legal blessings of their government.

 

Initially, letters of marque were designed to allow people to redress personal wrongs. Marque in Old French meant โ€œseizureโ€ or โ€œreprisal.โ€ For example, the property of a French merchant might be stolen in Italy, and the merchant would apply for a letter of marque which would allow him or her to intercept an Italian merchant's goods to make up for the loss. Many governments respected these letters because they wanted to be able to use them as tools themselves.

 

Over time, politicians began to realize the potential of a government warrant which would allow someone to confiscate goods from citizens of another nation. A ship using a letter of marque would be expected to outfit itself, and as a gesture of appreciation for the letter, it would surrender some of the confiscated goods to the government. Governments could therefore ensure that foreign shipping would be interrupted without having to bear the financial burden, and they would often come out ahead.

Mysterious Wildfires Breakout Near North Carolina Towns Destroyed by Hurricane Helene

Three wildfires have erupted near North Carolina towns that were severely impacted by Hurricane Helene last year.

 

The first wildfire, called the Crooked Creek Fire, started in McDowell County on Wednesday. It burned nearly 250 acres and was only 55% contained.

 

A second wildfire, the North Fork Fire, started hours after the Crooked Creek Fire burned 60 acres and is 0% contained.

 

The McDowell County Emergency Services stated, โ€œLocal fire departments are on scene and working in coordination with the U.S. Forest Service to provide structure protection and monitor fire behavior.โ€

 

โ€œEmergency personnel will continue to remain on-site throughout the day to monitor the situation and ensure further containment of the fire,โ€ added fire officials.

 

There have been no fatalities or injuries from the wildfires as of Thursday morning.

 

'Per CBS:

A second wildfire has erupted in western North Carolinaโ€™s McDowell County, an area that was ravaged by Hurricane Helene just four months ago, nearly to the day, officials said. The fire, dubbed the North Fork Fire, comes a day after the Crooked Creek Fire suddenly arose in the countyโ€™s town of Old Fort, a town of just 800 people.

 

McDowell County Emergency Services said Thursday morning that they are actively monitoring the North Fork Fire, which has so far grown to 60 acres and is 0% contained. At this time, the department said, โ€œthere is no imminent threat to structures.โ€

 

โ€œLocal fire departments are on scene and working in coordination with the U.S. Forest Service to provide structure protection and monitor fire behavior,โ€ the department said. โ€œCrews will continue containment efforts throughout the day.โ€

 

The North Fork Fire, which is in the town of Marion, arose just hours after the Crooked Creek Fire developed in Old Fort. Originally, McDowell emergency officials described Crooked Creek as โ€œout of control.โ€ In their latest update just before 7 a.m. local time on Thursday, they said that the fire had grown to an estimated 250 acres and was 55% contained and that โ€œsignificant progressโ€ had been made overnight.

 

โ€œWinds diminished and relative humidity increased leading to lower fire activity,โ€ officials said, adding that the progress meant that evacuation orders for affected areas would be lifted at 8 a.m. local time. โ€œEmergency personnel will continue to remain on-site throughout the day to monitor the situation and ensure further containment of the fire.โ€

President Donald Trumpโ€™s appointees have initiated a major shake-up of the FBIโ€™s top ranks through reassignments and demotions and appear to be taking steps toward an even broader overhaul of the bureauโ€™s personnel, said three people familiar with the moves who are not authorized to speak publicly.

 

The moves are impacting senior managers in some of the FBIโ€™s largest field offices as well as those who oversee some of the most critical branches at FBI headquarters in Washington.

 

The initial personnel actions appear aimed at leaders and agents who played roles in the investigations most closely associated with Trump himself โ€” including the nationwide manhunt for members of the mob that attacked the Capitol on Jan. 6, 2021, as well as the two criminal investigations of Trump led by special counsel Jack Smith.

 

Executive assistant directors who lead the FBIโ€™s National Security, Criminal, Cyber, Response and Services, Science and Technology, Information and Technology, and Human Resources branches were notified earlier this week that they would be demoted, according to a fact sheet obtained by POLITICO that was circulated by House Judiciary Democrats to the broader caucus.

 

An FBI spokesperson declined to comment on the personnel changes.

 

It was not immediately clear whether FBI personnel were formally fired or whether there are efforts underway to challenge the personnel moves.

 

Some of the senior FBI officials affected are choosing to retire rather than accept โ€œsummary reassignments,โ€ according to one lawyer advising people involved. The process of firing an FBI agent normally takes at least six to nine months and requires the bureau to show some sort of serious misconduct by the agent, the attorney said.

 

โ€œIf true, these outrageous actions by acting officials are fundamentally at odds with the law enforcement objectives outlined by President Trump and his support for FBI Agents,โ€ the FBI Agents Association said in an unsigned statement. โ€œDismissing potentially hundreds of Agents would severely weaken the Bureauโ€™s ability to protect the country from national security and criminal threats and will ultimately risk setting up the Bureau and its new leadership for failure.โ€

 

The shake-up comes a day after the confirmation hearing for Kash Patel, Trumpโ€™s choice to lead the bureau, who did not signal knowledge of plans for sweeping changes to the bureauโ€™s rank-and-file.

 

FBI Director Christopher Wray resigned last month after Trump indicated plans to appoint Patel to the directorโ€™s post.

 

โ€œThe American people delivered an overwhelming verdict on the question of whether or not we need to clean ranks in our law enforcement and intelligence communities and ensure that the partisan weaponization of our justice system ends,โ€ senior White House aide Stephen Miller told reporters Friday afternoon.

Ukrainian MP calls for Putinโ€™s murder at Council of Europe

Such rhetoric would supposedly help Kiev get more aid from its Western backers, Aleksey Goncharenko believes

 

Ukrainian MP Aleksey Goncharenko has openly called on EU lawmakers to support the idea of assassinating Russian President Vladimir Putin and of promoting it among ordinary people. On Friday the legislator published a video on Telegram of himself making controversial statements at the Parliamentary Assembly of the Council of Europe (PACE).

 

According to Goncharenko, Kiev could ramp up support for its cause in the West amid a continuing conflict with Moscow by appealing to the most basic and easily understandable urges of people. To do this, Ukraine needs to draw a clear parallel between the Russian leaderโ€™s demise and the benefits each and every EU citizen could get from it, he claimed.

 

โ€œWe need to show people why we need to do this,โ€ a member of the European Solidarity faction in Kievโ€™s parliament can be heard telling the PACE in English. โ€œThis is not just our revenge or something. This the best possible investment we can do.โ€

 

โ€œWe are looking for great investments. The best possible investment in the world today is to kill Putin,โ€ he stated.

 

It is unclear when Goncharenko made his statements. He currently chairs the Committee on Migration, Refugees and Displaced Persons in the Parliamentary Assembly of the Council of Europe. The rows behind him are almost empty with very few delegates apparently present during his speech, the clip he posted on social media shows.

 

The PACE has not commented on the Ukrainian MPโ€™s statements. Moscow has so far not provided any comment on it either. The lawmaker claimed in a follow-up Telegram post that heโ€™d received โ€œa lot of questionsโ€ about his speech on social media, and doubled down on his rhetoric.

 

According to the MP, Kiev had been telling Europeans โ€œfor ten yearsโ€ about โ€œthe fight for human rights, about freedom, about independence, about rules and international treaties.โ€ It did receive backing from the West, โ€œbut not the kind we would like,โ€ he added. Now, the lawmaker suggested a change of communication tactics that would include abandoning โ€œinflated speechโ€ and focusing on topics โ€œthat everyone understands.โ€

 

โ€œThat is, Putinโ€™s death is not only beneficial to us, but it is also beneficial to every German, Frenchman, Hungarian, Pole, Bulgarian. All this will affect their wallets. I think this message is clearer and simpler,โ€ he said.

 

An ally of former president Pyotr Poroshenko, Goncharenko has repeatedly attracted controversy with his statements and actions. He had previously called on the government to acquire nuclear weapons at all costs. โ€œWe should disregard everything and everyone and make the bomb,โ€ he said.

 

Earlier in January, Turkish TRT World TV channel axed an interview with him over his refusal to cover up a T-shirt displaying an insult to Putin. The MP then took to social media to slam the broadcaster over the move.

 

The Council of Europe (COE) was established in 1949 by several Western European countries, with a mission to promote โ€œdemocracy, human rights and the rule of law.โ€ Russia joined the organization in 1996. In 2014, its parliamentary assembly declared Crimeaโ€™s reunification referendum illegal. The Russian delegation was also stripped of its voting rights that year over the move and was only reinstated in 2019.

 

In February 2022, 42 out of 47 COE members voted to suspend Moscowโ€™s membership, citing the Ukraine conflict. Russia condemned the decision as โ€œopenly politicalโ€ and left the organization in March of the same year. In the past two years, PACE has also adopted a resolution declaring Russian President Vladimir Putin โ€œillegitimate,โ€ and called for the โ€œdecolonizationโ€ of Russia. In September 2024, Russian lawmaker Andrey Lugovoy proposed banning COE as a Western pressure tool.

Six Out Of Seven Executive Assistant Directors and 25 Special Agents in Charge Out at FBI According to FBI Whistleblower

While incoming FBI Director Kash Patel sat in front of a Senate subcommittee for his hours-long confirmation hearing yesterday, the housecleaning at the FBI was well underway.

 

According to a CNN report, โ€œAt least six FBI leadersโ€ have been removed or told to resign by Monday.

 

This adds to the purge that took place this week at the Department of Justice, the National Labor Relations Board (NLRB), and the Equal Employment Opportunity Commission (EEOC).

 

At least a dozen employees at the DOJ were fired on Monday, mainly those involved in the political prosecutions levied against President Trump during โ€œthe Pauseโ€ between his administrations.

 

At the NLRB, President Trump fired both General Counsel Jennifer Abruzzo and Gwynne Wilcox, the Democrat board member appointed by Joe Biden.

 

Commissioners Charlotte Burrows and Jocelyn Samuels at the EEOC were fired as well, the first firing by a President since the boardโ€™s creation under the 1964 Civil Rights Act.

 

A missing seat already leaves just two members, falling short of a quorum and rendering the commission ineffective.

 

FBI whistleblower Kyle Seraphin revealed last night that the purge went beyond the six Executive Assistant Directors; it also included 25 Special Agents in Charge.

 

According to Seraphin, there are three individual leadership positions at the top of the FBI: the Director, the Deputy Director, and the Associate Deputy Director.

 

Below that, there are seven โ€œbranch headsโ€ known as Executive Assistant Directors, while the Special Agents in Charge (SACs) lead each of 56 field offices across the country.

 

One of those SACs, according to Seraphin, was Special Agent in Charge Spencer Evans, who led the field office in Las Vegas, Nevada, and who recently spearheaded the investigation into the alleged suicide of a Green Beret who blew up a Tesla Cybertruck outside of the Trump Hotel on New Yearโ€™s Day.

 

He was also the SAC that denied Seraphin his religious exemption from the COVID vaccine, which in part led to his indefinite suspension.

 

Seraphin also mentioned the widespread terminations of a group of former agents known as โ€œThe Suspendables,โ€ which include former agents Steve Friend and Garrett Oโ€™Boyle.

 

Oโ€™Boyle was suspended in September 2022 after he blew the whistle on the FBI using threat tags to target pro-life individuals after Roe v. Wade was overturned.

 

Friend blew the whistle over the exaggeration of statistics regarding the threat of domestic terrorism, as well as the overzealous tactics used against Jan 6 protesters by the bureau.

 

NBC News published a story regarding โ€œThe Suspendablesโ€ yesterday claiming that โ€œsome former officials [are] concerned about the potential injection of partisan politics at the top of an agency that has traditionally had only one political appointee: the director himself.โ€

 

Seraphin told NBC that incoming director Kash Patel keeps up to date with โ€œThe Suspendables.โ€

 

โ€œThereโ€™s a potential that Kash Patel could be the most loved FBI director by the actual people of the FBI; he could be the real thing that Jim Comey pretended to be,โ€ Seraphin told NBC.

 

During the podcast, Seraphin alluded to Patel already being in charge of the FBI, but acknowledged Brian Driscoll as the acting Director.

Former Senior Adviser for the Federal Reserve Indicted on Charges of Economic Espionage

WASHINGTON โ€“ John Harold Rogers, 63, of Vienna, Virginia, a former Senior Adviser for the Federal Reserve Board of Governors (FRB), was arrested today on charges that he conspired to steal Federal Reserve trade secrets for the benefit of the Peopleโ€™s Republic of China (PRC).

In furtherance of the conspiracy, Rogers allegedly made false statements to the Federal Reserve Board Office of Inspector General, and those false statements had a material impact on its investigation.

The indictment, unsealed today, was announced by U.S. Attorney Edward R. Martin, Jr., FBI Assistant Director in Charge David Sundberg of the Washington Field Office, and John T. Perez, Special Agent in Charge, Headquarters Operations, Office of Inspector General for the Board of Governors of the Federal Reserve System and Consumer Financial Protection Bureau (FRB-CFPB OIG).

โ€œPresident Trump tasks us with protecting our fellow Americans from all enemies, foreign and domestic. As alleged in the indictment, this defendant leveraged his position within the Federal Reserve to pass sensitive financial information to the Chinese government, a designated foreign adversary,โ€ said U.S. Attorney Martin. โ€œLet this indictment serve as a warning to all who seek to betray or exploit the United States: law enforcement will find you and hold you accountable.โ€

According to the indictment, Rogers, a U.S. citizen with a Ph.D. in Economics, worked as a Senior Adviser in the Division of International Finance of the FRB from 2010 until 2021, where he was entrusted with confidential FRB information. The confidential information that Rogers allegedly shared with his Chinese co-conspirators, who worked for the intelligence and security apparatus of China and who posed as graduate students at a PRC university, is economically valuable when secret.

China holds a large amount of U.S. foreign debt (approximately $816 billion as of October 2024). The data Rogers shared with his co-conspirators could allow China to manipulate the U.S. market, in a manner similar to insider trading. Gaining advance knowledge of U.S. economic policy, including advance knowledge of changes to the federal funds rate, could provide China with an advantage when selling or buying U.S. bonds or securities.

The indictment alleges that from at least 2018, Rogers allegedly exploited his employment with the FRB by soliciting trade-secret information regarding proprietary economic data sets, deliberations about tariffs targeting China, briefing books for designated governors, and sensitive information about Federal Open Market Committee (FOMC) deliberations and forthcoming announcements. He passed that information electronically to his personal email account, in violation of FRB policy, or printed it prior to traveling to China, in preparation for meetings with his co-conspirators. Under the guise of teaching โ€œclasses,โ€ Rogers met with his co-conspirators in hotel rooms in China where he conveyed sensitive, trade-secret information that belonged to the FRB and the FOMC.

In 2023, Rogers was paid approximately $450,000 USD as a part-time professor at a Chinese university.

On February 4, 2020, in response to questioning by the Office of the Inspector General for the Federal Reserve Board, Rogers lied about his accessing and passage of sensitive information and his associations with his co-conspirators.

Rogers is charged with conspiracy to commit economic espionage and with making false statements. Conspiracy to commit economic espionage carries a maximum statutory penalty of 15 years in prison, and a maximum fine of $5 million. Making false statements carries a maximum statutory penalty of five years in prison.

This case is being investigated by the FBIโ€™s Washington Field Office and the Federal Reserve Board Office of Inspector General. It is being prosecuted by Assistant U.S. Attorney Kimberly Paschall of the U.S. Attorneyโ€™s Office, and Trial Attorneys Nicholas Hunter and Stephen Marzen of the National Security Divisionโ€™s Counterintelligence and Export Section.
