As of late 2025, the military trial for Khalid Sheikh Mohammed (KSM), the self-proclaimed mastermind of the 9/11 attacks, and his co-defendants remains in the pre-trial phase at Guantanamo Bay. The case has been stalled for years and faced new delays after a federal appeals court canceled a plea deal in July 2025.

Key recent developments include:

Plea deal revoked (July 2024): After years of negotiations, KSM and two co-defendants—Walid bin Attash and Mustafa al-Hawsawi—agreed to plead guilty in exchange for life imprisonment instead of a potential death sentence. However, Defense Secretary Lloyd Austin revoked the agreement two days later, stating that such a significant decision rested solely with him.

Deal reinstated, then halted (November 2024–January 2025): A military judge and a military appeals court both ruled against Austin, reinstating the plea agreements. However, just as KSM was set to formally plead guilty, a federal appeals court in D.C. paused the proceedings to consider the government's request to rescind the deals.

Plea deal ultimately canceled (July 2025): A divided panel of the D.C. appeals court ruled in favor of the government, voiding the plea deal and sending the case back to the pre-trial litigation stage.

Key issues and context

The military commission case has been mired in legal and logistical issues for nearly two decades.

Torture evidence: The defendants were subjected to "enhanced interrogation techniques," including waterboarding, while in CIA custody. A central issue has been whether evidence obtained under torture is admissible in court.

Case venue: The case was initially slated for a civilian court in New York but was moved to a military commission at Guantanamo Bay due to congressional action.

Victim families' divide: The possibility of a plea deal has split 9/11 families. Some opposed it, preferring a full trial to uncover more truth and potentially seek the death penalty. Others supported the deal as the most realistic path to a final resolution, given the endless delays.

Mental competency: One of the co-defendants, Ramzi bin al-Shibh, was found mentally incompetent to stand trial in 2023, and his case was separated.

What happens next?

Nexperia-Linked Chip Shortages Ripple Through Global Auto Supply Chain, From Germany To Japan

One day after German tabloid newspaper Bild reported that Volkswagen had suspended production of the Golf at its Wolfsburg factory due to a worsening semiconductor shortage caused by a supply stoppage of Nexperia chips, the Dutch chipmaker, recently seized by the Netherlands government, warned Japanese automakers on Thursday that it may no longer be able to guarantee chip supply. The chip crisis spreading from Europe to Japan has set off alarm bells across the industry.

Bloomberg reports that the Japan Automobile Manufacturers Association (JAMA) has confirmed that its members, Toyota, Nissan, and Honda, have received warnings from Nexperia about chip supply woes and are working with customers to mitigate disruptions.

JAMA cautioned that chip shortages could have a "serious impact" on global auto production and urged governments to reach a "prompt and practical solution."

"The chips manufactured by the affected manufacturers are important parts used in electronic control units, etc., and we recognize that this incident will have a serious impact on the global production of our member companies," JAMA wrote in a statement, adding, "We hope that the countries involved will come to a prompt and practical solution."

Ninth Circuit Hands President Trump Sweeping Win Over Gavin Newsom — Trump Can Federalize California National Guard to Enforce Federal Immigration Law

The U.S. Court of Appeals for the Ninth Circuit has denied en banc rehearing in Newsom v. Trump, effectively upholding the earlier panel decision that sided with Trump and affirmed his authority to federalize the California National Guard to support federal immigration enforcement.

When California officials refused to cooperate with federal agents, Trump invoked § 12406(3), federalizing and deploying 4,000 members of the California National Guard to Los Angeles to secure ICE facilities and restore order.

California Governor Gavin Newsom and the State of California sued over President Trump’s order, claiming it was unconstitutional and violated state sovereignty.

Newsom wrote at the time:

“We are suing Donald Trump. This is a manufactured crisis. He is creating fear and terror to take over a state militia and violate the U.S. constitution. The illegal order he signed could allow him to send the military into ANY STATE HE WISHES. Every governor — red or blue — should reject this outrageous overreach. There’s a lot of hyperbole out there. This isn’t that. This is an unmistakable step toward authoritarianism that threatens the foundation of our republic. We cannot let it stand.”

US District Judge Charles Breyer (brother of retired SCOTUS Breyer), a Clinton appointee, granted Newsom a Temporary Restraining Order (TRO) and said Trump’s decision to federalize the National Guard was illegal.

But the appellate panel ruled that the statute clearly empowers the President to act whenever he is “unable with the regular forces to execute the laws of the United States.”

In practical terms, this means the Commander-in-Chief may call Guard troops into federal service when local or federal law-enforcement personnel cannot safely or effectively enforce the law.

After Senior Judge Marsha S. Berzon, joined by several liberal colleagues, requested a full-court rehearing, a vote of active Ninth Circuit judges failed to secure a majority, and rehearing en banc was denied on Wednesday. That denial makes the earlier Trump victory final within the circuit and binding precedent across nine Western states.

Judge Marsha Berzon’s 38-page dissent argued that the ruling “invited presidents, now and in the future, to deploy military troops… in response to commonplace, short-lived, domestic disturbances.”

Another dissenter, Judge Ronald Gould, fretted that Trump’s authority under the ruling was “almost unfettered,” dramatically warning of “profound consequences destructive to American society” and cautioning that it could lead to another tragedy like the one at Kent State University in 1970.

Yet the majority refused to rehear the case, leaving intact the panel’s decision that Trump acted within the law and that courts must afford wide latitude to the President’s factual determinations when executing federal statutes involving national defense and law enforcement.
