This needs to be looked into. Our veterans were wrongly treated by this VA and by the court. Just because prior infections are not in the medical literature does not mean that this cannot happen. It is common sense that blood-borne pathogens can and do transmit from human to human via needles. Why on Earth would insulin pens (which are needles) be exempt? This judge's ruling is making my head spin. This is beyond sick. We absolutely must save our veterans from this kind of insane and twisted mistreatment. WTF is going on?!?

VA Exonerated In Two Negligence Lawsuits

 

"BUFFALO, N.Y. - U.S. Attorney James P. Kennedy, Jr. announced today that U.S. District Judge Elizabeth A. Wolford dismissed a negligence lawsuit seeking damages brought by plaintiff Lenray Harris against the Department of Veterans Affairs Medical Center (VA) in Buffalo. The plaintiff claimed that she suffered emotional injuries following the VA’s disclosure that several of its nurses improperly administered insulin pens during the time period that Harris received treatment at the VA following knee replacement surgery. The plaintiff was given insulin for her diabetes and claimed that she feared that she had contracted a blood borne disease.

In her decision, Judge Wolford stated, “[p]laintiff cannot support a claim for negligent infliction of emotional distress.”

In a similar ruling, U.S. Magistrate Judge Hugh B. Scott recommended dismissal of a negligence lawsuit filed by plaintiff Archie Maxwell who claimed that the VA reused insulin pens and exposed Maxwell to HIV or Hepatitis B or C. The plaintiff was treated for diabetes while an inpatient at the VA from December 29, 2011, to January 9, 2012, and from August 9, 2012, to August 14, 2012. Maxwell alleged that in February 2013, he tested positive for Hepatitis B.

In his decision, Magistrate Judge Scott stated, “There is no record of any patient, including plaintiff, being infected from use of the insulin pens, thus plaintiff fails to prove actual exposure to HIV or Hepatitis C.”

From 2012 to 2013, the Veterans Affairs Office of Inspector General (OIG), Office of Healthcare Inspections, investigated the use of insulin pens at the Buffalo VA. The OIG found no documented cases of transmitting blood borne pathogens related to the use of an insulin pen on multiple patients."

Authorities told the Buffalo News, which first published the report on its website Friday, there is a "very small risk" for the diabetic patients who may have been exposed to the reused insulin pens between Oct. 19, 2010 and November 2012.

The VA memo obtained by the News said the problem was discovered by a routine pharmacy inspection last Nov. 1.

In a statement to the Associated Press, Evangeline Conley, a VA spokeswoman, said the hospital "recently discovered that in some cases, insulin pens were not labeled for individual patients." She added that "although the pen needles were always changed, an insulin pen may have been used on more than one patient."

Conley said that once this was discovered the hospital took "immediate action" to ensure the insulin pens were being used according to pharmaceutical guidelines.

Insulin pens used by diabetics to inject insulin can be disposable or reusable with replaceable needles and cartridges. But according to the Institute for Safe Medication Practices, even reusable pens should not be used on more than one patient.

Vice President Mike Pence May Have to Cast Tiebreaking Vote on Brett Kavanaugh

 

Vice President Mike Pence may have to cast the tie breaking vote on Saturday to confirm Judge Brett Kavanaugh as an associate justice of the Supreme Court, thanks to a key Republican defection in Friday’s cloture vote to end Senate debate.

 

Sen. Lisa Murkowski (R-AK) broke ranks and voted no, meaning that only 50 Republicans voted yes. Sen. Joe Manchin (D-WV) crossed party lines to vote yes, giving cloture a thin 51-49 majority and setting up a final confirmation vote Saturday.

 

Both Sens. Jeff Flake (R-AZ) and Susan Collins (R-ME), who were previously undecided, voted yes on cloture. However, neither has yet indicated whether he or she will vote to confirm Kavanaugh. (Collins will announce her vote at 3 p.m. ET.)

 

If both Flake and Collins vote no, then Brett Kavanaugh’s nomination will be defeated. Likewise, if Manchin votes against confirmation. But if Flake votes yes and Collins votes no, and both Murkoswki and Manchin stay in their respective columns, then there will be a 50-50 tie and the vice president will have to be called in to cast the deciding vote. If he does, it would be the first time in the history of the Supreme Court that a vice president has cast a deciding tiebreaker vote for confirmation.

 

Pence anticipated that he might have to do so nearly a month ago, well before Christine Blasey Ford’s uncorroborated claims of sexual assault had been launhed. Riddle me this. If a veteran is initially deemed "disabled", they are assigned a percentage; IE; 10% disabled, until they are determined to be "More" disabled. It may take 10 years before the VA recognizes that the Veteran is 100% disabled.

 

The Goal then becomes to be 100% disabled because the benefits have been trickled in.

 

Shouldn't the Vet be 100% disabled and the goal be to treat them until (if possible) the percentage is lowered?

 

This isn't treatment. This is depravity.

Most people in Australia would not know that Chinese officials go into our universities to drill students on occasions when a leader might be coming so that they can stand in the way of someone who’s protesting for Tibet, for example,” Nine Network political editor, and moderator, Chris Uhlmann said.

 

“Most Australians don’t know that MSS [Ministry of State Security] agents turn up in Australia and actually threaten Australian Chinese.”

 

With Australia’s history of anti-Asian immigration policy, race is a sensitive issue for a good reason here, Lowy Institute senior fellow Richard McGregor pointed out, but it is not anti-Chinese to be critical of the ruling Chinese Communist Party.

Hypothetical post-Maduro planning has been discussed “at many levels”, Governor Rossello claimed. His comments follow Trump’s endorsement of a military coup d’état in Venezuela.

 

Puerto Rico’s governor joined regional voices backing the overthrow of the Venezuelan government Tuesday, following the visit of the fugitive ex-Mayor of Caracas, Antonio Ledezma, to the US protectorate.

 

Governor Ricardo Rossello called for the “elimination” of President Maduro, who was democratically re-elected in May for a second term with 67.7 percent of the vote in elections qualified as transparent, free, and fair.

 

“What should happen is that the dictatorship should be eliminated. We are defining what will happen afterwards, and what steps are to be taken,” stated Rossello in a press conference following the meeting with Ledezma.

 

He went on to claim that such “steps” have “already been discussed at many levels” and that they point towards “concrete results.”

 

As part of the announcements, Rossello invited Venezuela’s opposition leaders to a summit this October 20 and 21, to be held in San Juan, Puerto Rico, which will look to establish a ‘Commission for the Reconstruction of Venezuela’, with Puerto Rico acting as “the headquarters” for “logistical support” to a “transition” government in Venezuela.

 

“We want to be ready for the day after, so that Venezuela counts on a government and an ordered and adequate transition. So that you know that you have friends across the world, Puerto Rico is going to be this connector for the coordination of all of this help,” Rossello added.

 

In front of press, the Governor signed an agreement which includes hypothetical land, maritime, and air supply corridors to Venezuela.

Chip-Level Spying Has a Long History Under the Chinese Regime

 

If Chinese spy chips were found in the hardware of Apple and Amazon (they were according to a report by Bloomberg; the two companies deny their servers were compromised), this should have been expected. There’s a long history of cases like this.

 

The Senate Armed Services Committee warned of this threat in May 2012, and found over 1 million counterfeit parts in U.S. military systems—largely from China.

 

Here’s a quote from that report: “The investigation uncovered dozens of examples of suspect counterfeit electronic parts in critical military systems, including on thermal weapons sights delivered to the Army, on mission computers for the Missile Defense Agency’s Terminal High Altitude Area Defense (THAAD) missile, and on a large number of military airplanes.”

 

This was also just the tip of the iceberg. Remember in 2013 that Chinese spy chips were found in electric kettles and irons being sent to Russia. They would search for unsecured WiFi connections, then call home.

 

Also remember that in 2011, recording devices were found in all dual-plate Chinese-Hong Kong vehicles, which were installed by China’s Shenzhen Inspection and Quarantine Bureau.

 

In June 2010, Chinese-made memory cards in Olympus Stylus Tough cameras were found to be infecting computers. The same virus was found in memory cards of Samsung smartphones.

 

And similar embedded threats were found in Chinese-made TomTom GPS systems and other devices that were being sold at places including Best Buy, Target, and Sam’s Club. A list of cases could go on for a while.

 

Among the more serious cases was the “Zombie Zero” threat that was uncovered in 2014 by TrapX.

 

TrapX found that a Chinese company had installed spy software in handheld scanning devices used for global shipping.

 

The infected devices in the “Zombie Zero” case gave Chinese spies access to all corporate financial data, customer data, and shipping data on the infected systems and also complete situational awareness of global shipping and logistics operations.

 

The U.S. government tried addressing the threat of embedded breaches in the supply chain through a law passed in the 2014 U.S. federal budget that requested a review of products purchased by federal agencies.

 

China’s Ministry of Commerce of course didn’t like this very much. It released a statement soon after saying the U.S. policy would “have a negative effect on Chinese companies, besides harming the interests of U.S. firms.”

 

Chinese state news outlet Global Times even claimed the United States should “correct its mistaken ways” after the law was passed.

 

A similar program was passed in the private sector around the same time, called the Open Trusted Technology Provider Standard Accreditation Program, but was likely sabotaged in attempts to appease the Chinese regime.

 

Included in its 422 members were 11 groups based in China, where most of these threats originated.

 

They likely knew this as well. This followed the Armed Services Committee report that said “China is the dominant source country for counterfeit electronic parts that are infiltrating the defense supply chain.”

 

The same Senate report said, “The Chinese government has failed to take steps to stop counterfeiting operations that are carried out openly in that country.”

 

Going by the recent case, it doesn’t look like the public or private program did much good.

 

The list of threats like this could go on for some time. What we’re seeing with threats from Chinese chip makers is an ongoing problem that the U.S. government and major companies are aware of, yet have not properly addressed.

Saudi Arabia’s Crown Prince Mohammed bin Salman says his relationship with US President Donald Trump remains good, calling Trump’s claim that Saudi Arabia wouldn’t last for two weeks without the US a “misunderstanding.”

 

The crown prince told Bloomberg’s Senior Executive Editor for Economics Stephanie Flanders and five other Bloomberg journalists on Wednesday that Trump’s demand that Riyadh pay up for the military support it receives was a misunderstanding that happens between friends.

 

“Well, you know, you have to accept that any friend will say good things and bad things. So you cannot have 100 percent of friends saying good things about you, even in your family,” he said.

 

Bin Salman also noted that the two-week timeframe was “not accurate,” as Saudi Arabia existed long before the United States of America was a country. “Saudi Arabia needs something like around 2,000 years to maybe face some dangers,” he quipped.

 

Saudi Arabia “will pay nothing” for its security, as all the arms it had purchased from the US for that purpose have been paid for, he noted. According to the Saudi armament strategy for the next 10 years, which was adopted after Trump became president, more than 60 percent of its arms are to be supplied by or manufactured in partnership with the United States.

 

“We’ve created $400 billion in opportunities, armaments and investment opportunities, and other trade opportunities. … Also included in these agreements are that part of these armaments will be manufactured in Saudi Arabia, so it will create jobs in America and Saudi Arabia, good trade, good benefits for both countries and also good economic growth,” the crown prince added.

California Is Making It Illegal for Devices to Have Shitty Default Passwords

 

A new California law will require unique, secure passwords for all devices sold in the state that come with pre-programmed passwords by 2020. The law sets out a number of requirements aimed ensuring all new internet-connected devices in the state are equipped with “reasonable security features.” It was passed by the state legislature in August and signed into law by Governor Jerry Brown last week.

 

“The lack of basic security features on internet connected devices undermines the privacy and security of California’s consumers, and allows hackers to turn everyday consumer electronics against us,” state senator Hannah-Beth Jackson, who authored the bill, said in a press release. “This bill ensures that technology serves the people of California, and that security is not an afterthought but rather a key component of the design process.”

 

As the internet of things grows, more and more everyday home items are connected to the internet, from microwaves to baby monitors. And as soon as a device is connected to the web, it becomes vulnerable to hacking. Many of these devices have lackluster security (or no security at all), banking instead on the expectation that your average hacker isn’t interested in messing with some random family’s microwave or fridge. But there have been many reports of average Americans having their IoT devices hacked, and in 2016, hackers leveraged millions of insecure, internet-connected devices to create the largest botnet in history. As the number of IoT devices we have in our homes increases, so does our risk of attack.

 

There are things you can do to better protect yourself, but a lot of people are either unaware or don’t bother. A recent survey by the website Broadband Genie found that 82 percent of respondents had never bothered to change the default password on their home router. Often, default passwords are the same on every device a manufacturer sends out, which makes them even less secure than your average crappy password.

 

Under the new law, all new internet-connected devices made or sold in California with a default password will be required to make that password unique and secure for every single device. That means no more devices shipped with username/password combos of “admin/admin,” for example. It’s far from a panacea—and really, why aren’t you using a password manager already—but it’s a step towards at least a minimal baseline of security in our internet-of-things addled future.

Daniel Ek and Martin Lorentzon Cash Out $100MM+ In Spotify Shares

 

Daniel Ek and Martin Lorentzon may have netted a large sum from their shares in Spotify.

 

Last May, Sony cashed out 50% of its Spotify shares, earning a cool $760 million. Less than a week later, Warner Music Group revealed it had dumped 75% of its shares in the streaming music service, netting $400 million. Warner later sold all of its shares in August, earning slightly over $100 million more. Finally, Merlin cashed out 100% of its shares in Spotify, pledging to pass the sale through to its members.

 

They’re not the only ones. According to a new report, Spotify founders Daniel Ek and Martin Lorentzon have sold significant shares in the company.

So, how much are your shares in Spotify worth?

 

A Securities and Exchange Commission (SEC) filing obtained by Di Digital reveals Ek and Lorentzon have sold their shares for over kr 1 billion ($110 million) each in recent months. Daniel Ek, Spotify’s CEO, received the most from the recent sales, reportedly earning kr 1.2 billion ($132 million).

 

For the period of July to September 2018, Ek sold 336,213 shares for kr 560 million ($61.6 million). Di Digital states he plans to sell more shares for kr 600 million ($66.1 million).

 

Lorentzon, meanwhile, sold 317,800 shares between July and September for kr 530 million ($58.3 million). He also stated his intention to sell more shares for kr 288 million ($31.7 million).

 

Speaking with the Swedish publication, Sofie Grant, a Spotify representative, confirmed the sale.

 

“Daniel will sell a small share of [company] shares in the next nine months as part of his long-term financial strategy. This sale of shares will constitute a minimal part of his holding in the company.”

 

Despite the sizable sales, Ek and Lorentzon clearly don’t want to lose control of the company.

 

The company reportedly had a market valuation of $31.5 billion at close on Thursday. Both still own a large percentage in Spotify.

 

Following the sales, Ek’s total holding in the company has dropped from 8.8% to 8.3%. Lorentzon now owns 11.8% of the company, down from 12.2%. He remains the company’s largest shareholder, followed by Tencent – which owns 10% – and Ek. Since the company’s IPO launch in April, Ek and Lorentzon’s holdings have decreased just half a percentage point.

 

According to Di Digital, both Ek and Lorentzon have the opportunity to extend their voting rights via special certificates. These would cover about 80% of all votes in Spotify.

WASHINGTON — Next month the United States will remove several Patriot air and missile defense batteries from four countries in the Middle East, according to the Wall Street Journal, citing multiple U.S. military officials.

 

The Defense Department will remove two batteries from Kuwait, and one each from Bahrain and Jordan, as the U.S. military shifts its focus to adversaries like Russia and China, as well as Iran. The batteries will be taken offline and returned to the U.S. to be refurbished and upgraded before being relocated. According to an official, there are no plans to replace the systems.

 

Despite this realignment, the U.S. military says it is maintaining its commitment to allies in the region.

 

“U.S. Central Command is strongly committed to working with our allies and partners to promote and provide regional security and stability,” said Capt.
