Cass Sunstein on the First Amendment

In his book Democracy and the Problem of Free Speech Sunstein says there is a need to reformulate First Amendment law. He thinks that the current formulation, based on Justice Holmes' conception of free speech as a marketplace "disserves the aspirations of those who wrote America's founding document."[28] The purpose of this reformulation would be to "reinvigorate processes of democratic deliberation, by ensuring greater attention to public issues and greater diversity of views."[29] He is concerned by the present "situation in which like-minded people speak or listen mostly to one another,"[30] and thinks that in "light of astonishing economic and technological changes, we must doubt whether, as interpreted, the constitutional guarantee of free speech is adequately serving democratic goals."[31] He proposes a "New Deal for speech [that] would draw on Justice Brandeis' insistence on the role of free speech in promoting political deliberation and citizenship."

Cass Sunstein on fighting 'Conspiracy Theories'

Sunstein co-authored a 2008 paper with Adrian Vermeule, titled "Conspiracy Theories," dealing with the risks and possible government responses to conspiracy theories resulting from "cascades" of faulty information within groups that may ultimately lead to violence. In this article they wrote, "The existence of both domestic and foreign conspiracy theories, we suggest, is no trivial matter, posing real risks to the government's antiterrorism policies, whatever the latter may be." They go on to propose that, "the best response consists in cognitive infiltration of extremist groups",[36] where they suggest, among other tactics, Government agents (and their allies) might enter chat rooms, online social networks, or even real-space groups and attempt to undermine percolating conspiracy theories by raising doubts about their factual premises, causal logic or implications for political action."

Supreme Court Justice Sonia Sotomayor echoed Chief Justice John Roberts’ condemnation of President Donald Trump’s rhetoric on the judiciary in a recent public appearance.

 

Sotomayor told an audience Friday at Duquesne University in Pittsburgh that the justices do not belong to a political cause or a president but “to something very different, and much more important to us, and that is to the rule of law.”

 

The justice has had sharp words for the Trump administration before. After the Supreme Court upheld the president’s travel sanctions in June, Sotomayor published a dissent comparing the decision to Korematsu, the notorious 1944 ruling in which the justices upheld Japanese internment. Sotomayor read her dissent from the bench, a rare move the justices reserve for cases in which they strongly disagree with the majority.

 

Trump derided a federal judge in California for blocking enforcement of his new asylum rules as he left the White House on Nov. 21, prompting a rare rebuke from the chief justice.

 

“This was an Obama judge,” Trump told reporters. “And I’ll tell you what, it’s not going to happen like this anymore.”

 

“We do not have Obama judges or Trump judges, Bush judges or Clinton judges,” Roberts said in response. “What we have is an extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them. Goldman Sachs throws in towel on four Fed hikes in 2019. But there are still some holdouts

As financial markets now price in the likelihood that the Federal Reserve will only lift interest rates one time next year, Goldman Sachs has succumbed to the idea that the central bank won’t hike interest rates every quarter.

 

The Federal Reserve will pause from raising interest rates next March, and as a result will only tighten three times next year, said Jan Hatzius, chief economist at Goldman Sachs, in a note to clients.

 

“We think the probability of a move in March has now fallen to slightly below 50%,” Hatzius said.

 

Part of the reason for fewer Fed rate hikes is the stock market’s SPX, +0.26% recent weakness, he said. Financial markets have already delivered restraint, meaning the Fed doesn’t have as much work to do in pushing up the funds rate, he said.

 

The Dow Jones Industrial Average DJIA, +0.23% had its worst week last week since March 23, losing 4.5%, and has dropped for the three of the last four weeks.

 

Fed officials “tend to downplay this link” to markets in their public commentary because they don’t like talk of a “Fed put” or the idea that Fed officials let the stock market dictate policy, he said.

 

“Nevertheless, we think they do — and should— respond to the economic implications of material and sustained changes in financial conditions by adjusting the funds rate path,” he said.

 

Hatzius said he disagreed with the market’s forecast of less than one full hike in 2019, saying the economy will continue to grow above trend for most of the year.

 

The likelihood of sizable rate cuts or a recession “remains quite low,” he said.

 

Goldman was not alone in its four-rate-hike call. JP Morgan Chase and Barclays believe the Fed will stick to the one-rate-per-quarter pace.

 

“I think the economy looks fine. The labor market continues to tighten and we think that is going to persist. Inflation is going to firm a little from here,” said Michael Feroli, chief economist at JP Morgan Chase.

 

Jonathan Millar, senior economist at Barclays, agreed: “We don’t think the Fed has changed its fundamental approach. We suspect there will be more substantial declines in the unemployment rate” than the Fed has forecast, he said.

Highlights

During this semiannual reporting period, the Office of Audit issued 56 products. The office also identified $130,668 in monetary benefits. Work by the Office of Investigations resulted in 33 arrests, 35 indictments, and 21 convictions. Some of our more significant results for the period are described below:

 

Independent public accounting firms, working under contracts with and supervised by of our Office of Audit, issued unmodified opinions on the Department of the Treasury’s (Treasury) consolidated financial statements and the Gulf Coast Ecosystem Restoration Council’s financial statements for fiscal year 2017. Treasury’s Office of Budget and Travel potentially violated the Antideficiency Act by disbursing more than the Departmental Office’s available fund balance with Treasury; incurring obligations and expenditures prior to the respective reimbursable agreements being signed; and using fiscal year 2016 funds for fiscal year 2015 costs related to reimbursable services provided to Departmental Office customers. Two funds in Arkansas’ Seed and Angel Capital Network venture capital program, New Road Ventures, LLC and Virtual Incubation Company Investor Network, misused a total of $130,668 of State Small Business Credit Initiative funds on four investments because the investments were in violation of conflict of interest rules in place at the time they were made. Our joint investigation with Internal Revenue Service Criminal Investigations, revealed a repeat offender involved in a sovereign citizen scheme who opened a bank account and attempted to deposit a fictitious $300 million “Indemnity Bond” purported to be a valid instrument issued by Treasury. The suspect was indicted for Fictitious Obligations. Our investigation revealed the theft of $37 million in Treasury checks from the U.S. Postal Service. The checks were stolen by contract employees, hired by the post office. To date, the investigation has identified 24 subjects. Two arrest warrants and a search warrant have been executed. Our investigation determined that a former Office of the Comptroller of the Currency Bank Examiner and two co-conspirators engaged in a scheme to defraud a movie financing company. The Vice President of a bank, a former Bank Examiner, used his position to assist two subjects with stealing $2.5 million from the company by depositing funds into escrow accounts. The three subjects were sentenced from 30 weekends to 30 months in prison, 12 to 36 months of probation, and to a total of more than $1.5 million in restitution, forfeiture, and fines.

14 Israelis suspected of running child sex trafficking ring in Colombia

 

Fourteen Israelis are suspected by Colombian authorities of running a child sex trafficking ring which marketed tour packages from Israel to the Latin American country aimed at businessmen and recently discharged soldiers, according to reports on Monday.

 

Eight suspects are in custody, including two Colombian nationals, with international arrest warrants issued for the remaining individuals. According to a report by Hadashot, one of the Israelis is also being held on suspicion of murder and others are also suspected of money laundering.

 

Colombian authorities said Israeli tourists would stay at hotels and take yacht trips and go to drug and alcohol-fueled private parties where women and minors were offered as “sex slaves.”

 

The children and teens were paid $63-126 for each “meeting” with Israeli tourists, and were forced to join a WhatsApp group called “Purim,” presumably named for the drunken celebrations that take place around the Jewish holiday, the Ynet news site reported.

 

All of the suspects were wanted by international police agency Interpol on suspicion of pimping and soliciting minors for prostitution.

 

Authorities raided a number of properties including a spa in Santa Marta, a hostel in Bogota, and a building known as “Casa Medellin.” The suspects were arrested in a number of locations around the country, and property worth around $45,000 was seized as part of the investigation.

 

The office of the Colombian attorney general posted a tweet with a video of what it said were properties used by the ring.

 

Members of the network established tourism sites and hotels throughout the country, giving the operation an outward veneer of respectability. However, at the same time, they targeted boys and girls who came from troubled homes or had a background of financial difficulties, and forced them into sex work.

 

Proceeds from the trafficking ring were then reinvested into property and companies.

 

Prosecutors said the investigation began in June 2016 with the murder of Israeli national Shai Azran in Medellin, who was thought to have been killed in a hit arranged by another Israeli due to a dispute over a property sale, Ynet reported.

 

The main suspect, Assi Ben-Mosh, was deported from Colombia in November 2017 on suspicion of drug offenses, soliciting children for prostitution and tax offenses.

 

The Israeli had allegedly been running a resort hotel near the northern Colombian town of Santa Marta, where he had set up a drug and sex crime ring. The Hotel Benjamin, in the fishing village of Taganga, was an attraction for many Israelis on their post-army travels but was unpopular with local residents due to the activities associated with it. His operations also extended into Ecuador, Brazil and Mexico, local media reported.

 

Ben-Mosh and his partners were suspected of drug-dealing, forcing minors into prostitution, and tax evasion, Hebrew media reported when the expulsion order against him was issued. Ben-Mosh had tried unsuccessfully to prevent his deportation from Columbia, including by applying to become a resident.

 

In August, Colombia issued an international arrest warrant for Ben-Mosh on suspicion of involvement in a child sex trafficking ring. Authorities in Bogota suspect he was involved remotely in a suspected sex trafficking ring that they broke up in raids, Colombian media reports said at the time.

 

Police in Colombia arrested 18 people in a raid on Hotel Benjamin hostel in Cartagena in July. The suspects are accused of running a sex ring, recruiting young girls from Colombia and Venezuela and forcing them to work as sex slaves. Reuters reported that more than 250 girls between 14- and 17-years-old were forced to have sex with locals and tourists.

CNN's "Reliable Sources" anchor Brian Stelter said on Sunday that President Donald Trump's pick to replace U.N. Ambassador Nikki Haley is not qualified for the job.

 

Trump announced on Friday that he would replace Haley with Heather Nauert, who currently serves as State Department spokeswoman. Nauert was a journalist for ABC News and a "Fox & Friends" anchor before joining the Trump administration.

 

"Moving now to the longtime Fox host who joined the State Department as a spokeswoman a year and a half ago. She's now nominated to be U.S. ambassador to the U.N.," Stelter said. "What do we do? She's not qualified for this job. She's qualified for a lot of other jobs. She's not qualified to be U.N. ambassador."

 

Stelter didn't state the reasons why he believes Nauert lacks the qualifications to be the next U.N. ambassador.

 

Stelter bemoaned the number of Fox News employees who have joined the Trump administration.

 

"Let's put our graphic on the screen. This merger, it is effectively a merger, may be good for Trump but not America," Stelter said.

 

Media reporters often complain about the relationship between Fox News and the Trump administration and the number of people in the administration that previously worked for Fox News.

 

Reporters going from news networks into a presidential administration is not new, however. During the Obama administration, The Atlantic compiled a list in 2013 of 24 reporters who went to work in the Obama administration.

Stelter didn't have the same hangups when it came to the possibility of a daytime talk show host running for president. When Oprah Winfrey was being considered a possible 2020 candidate, Stelter appeared to approve the idea and didn't say she was "not qualified" despite her not having any prior government experience.
