FBI misses deadline to provide docs to Judiciary Committee probing whistleblower raid

The Justice Department and FBI have missed a Wednesday deadline to provide information about the government's mysterious raid on a former FBI contractor-turned-whistleblower's home last month.

Sixteen FBI agents on Nov. 19 raided the home of Dennis Nathan Cain, who reportedly gave the Justice Department's Inspector General (IG) documents related to the Uranium One controversy and potential wrongdoing by former Secretary of State Hillary Clinton.

The documents in question allegedly showed that federal officials failed to investigate possible criminal activity related to Clinton, the Clinton Foundation and Rosatom, a Russian nuclear company. Its subsidiary purchased Canadian mining company Uranium One Uranium One in 2013.

Senate Judiciary Committee Chairman Chuck Grassley, R-Iowa, whose panel has oversight of the Justice Department, penned a letter to FBI Director Christopher Wray and Justice Department IG General Michael Horowitz, requesting information on the justification for the raid. Grassley gave Wray and Horowitz until Dec. 12 to respond to his request.

That deadline has come and gone, and neither the FBI nor DOJ has produced any documents or response.

"We have not yet received answers to the chairman's questions on this matter," a Judiciary Commitee spokesperson told Fox News late Thursday.

The FBI consistently has refused Fox News' request for comment on the whistleblower raid and the Judiciary Committee's requests. On Thursday, an FBI spokesperson told Fox News the agency would respond only to inquiries from the entity that requested the documents – in this case, the Judiciary Committee.

Taylor Swift used airport-style facial recognition on concertgoers

Taylor Swift used the same type of facial scanning tool on concert attendees that federal law enforcement officers based at airports rely on to verify the identities of international passengers. Swift's team used the software and kiosks to take pictures of every attendee's face at her Rose Bowl concert in Los Angeles in May to learn if a stalker was in attendance.

As the more than 118,000 people entered the venue, a video of Swift rehearsing was playing on a screen next to the ticketing booth. As each person stopped to watch as they passed through, a camera inside the screen took a picture of that person's face. "Everybody who went by would stop and stare at it, and the software would start working," Mike Downing, chief security officer of Oak View Group, told Rolling Stone. Downing attended the concert as a guest of the machines' manufacturer and watched as unknowing attendees were photographed.

That image was then processed by the software and the person's facial biometrics, or unique measurements of their face, were pulled from the picture and sent electronically to the software company's headquarters in Nashville, according to Downing, whose company advises concert venues on security procedures. That data was checked against images of Swift's known stalkers. In April, one of the pop singer's stalkers was found sleeping inside her New York home. In another spring incident, a man arrested outside her Beverly Hills home was found with a knife, rope, and ammunition. It's not clear how Swift used the information gathered by the facial recognition technology.

More than 30 U.S. airports have implemented facial scanning machines to check passengers' identities when boarding or returning from international flights. Customs and Border Protection uses airline manifest information to then pull existing photos from government databases, such as passport and visa images. It creates a photo gallery of the passengers it expects to see depart or return on a flight. At the inspection booth coming back from a flight, the cameras take a live image of the passenger and in less than two seconds match it to the images of people expected to come through. Following that process, passengers speak with CBP officers in an interview and photos are deleted from CBP files. CBP identified 1,300 visa overstayers through the use of this software in 2017.

Republicans examine accusations of ‘pay to play’ at Clinton Foundation, amid plunge in donations

Republicans on the House Oversight Committee on Thursday examined accusations of "pay to play" at the Clinton Foundation while Hillary Clinton was secretary of state, as Democrats dismissed the Capitol Hill hearing as a partisan exercise.

North Carolina GOP Rep. Mark Meadows, the chairman of the House Oversight and Government Reform Subcommittee on Government Operations, opened Thursday’s hearing by expressing concern over recently reported tax documents showing donations to the Clinton Foundation plunged in the wake of Hillary Clinton's loss to Donald Trump in the 2016 presidential election.

The filings showed that the foundation took in $26.6 million in 2017, a 58 percent drop from the $62.9 million it received the previous year.

>“Now several reports suggest that the decrease in donations could reflect a 'pay to play' activity in the years prior to the decline in donations,” Meadows said.

The Clinton Foundation has repeatedly denied all allegations of "pay to play."

Meadows added that the committee sought to have U.S. Attorney John Huber, the prosecutor appointed to investigate the foundation, testify at Thursday’s hearing. But Meadows said the Justice Department did not accept the invitation.

“Mr. Huber was asked to join us this afternoon and update the committee on the operations and progress of his investigation, and unfortunately, DOJ has been unwilling to make him available,” Meadows said. “I find this not only frustrating for me, but frustrating for the American people.”

Meadows told Fox News last week three people have come forward with hundreds of pages of evidence of potential wrongdoing by the Clinton Foundation, including misappropriation of funds and allegations of quid-pro-quo promises made to donors during Hillary Clinton's tenure as secretary of state.

Then-Attorney General Jeff Sessions appointed Huber to lead the evaluation into issues involving the FBI, the Clinton Foundation and the sale of Uranium One, amid calls from some conservatives to appoint a special counsel.

The top Democrat on the subcommittee, Virginia Rep. Gerry Connolly, ripped into Republicans at the beginning of the hearing, accusing them of recycling attacks on the Clintons. He asked why the committee wasn’t investigating conflicts in the Trump administration, and referenced other scandals, like former Trump lawyer Michael Cohen being sentenced to prison for a variety of crimes.

Still, the committee had a slate of other witnesses – Tom Fitton, the president of Judicial Watch, Phillip Hackney, a law professor at the University of Pittsburg, Lawrence Doyle of DM Income Advisors and John Moynihan of JFM Associates – appear to discuss the Clinton Foundation and laws governing non-profits.

Fitton referenced reports of the Clinton Foundation receiving “staggering sums” of money from Saudi benefactors, estimated between $18 million and $50 million, he said. Fitton added: “While Mrs. Clinton was secretary of state, Bill Clinton gave two speeches in Saudi Arabia earning a total of $600,000.”

“There is enough evidence to warrant serious investigations of the Clinton Foundation,” Fitton said.

Fitton, a conservative whose group frequently sues for public records from government agencies, also dinged agencies inside the Trump administration for not doing more to turn over documents.

“It’s unfortunate that even the Trump administration doesn’t want to divulge the full truth about this,” he said.

According to a committee notice, the purpose of Thursday’s hearing was to discuss the management of 501(c)(3) nonprofit organizations, using the Clinton Foundation as a case study.

The committee advisory said these organizations are “not permitted to be organized or operated for the benefit of any private individual and are only permitted to engage in minimal political activity” and added that when “a nonprofit organization violates these terms, defrauds contributors, or engages in impermissible political activity, the IRS may revoke its tax exempt status.”
