Supreme Court allows Trump to enforce 'Remain in Mexico' policy

The opinion reinstates the immigration policy until lower courts decide The U.S. Supreme Court on Wednesday said it will permit the Trump administration to enforce a policy requiring asylum seekers to wait in Mexico.

Due to a decision by the Ninth Circuit Court of Appeals the "Remain in Mexico" policy was slated for suspension Thursday in California and Arizona.

However, the high court ruling, to which Justice Sonia Sotomayor dissented, will allow the administration to continue with the policy as the challenge to it works through the courts.

The Trump administration warned that suspending the policy would result in scads of immigrants rushing the U.S. border.

The issue is far from arriving at a final resolution because once the president's administration files a formal appeal, the Supreme Court might not consider it until fall, and even if it chooses to grant full review the arguments would commence in 2021.

"We are gratified that the Supreme Court granted a stay, which prevents a district court injunction from impairing the security of our borders and the integrity of our immigration system," a Justice Department spokesperson said. "The Migrant Protection Protocols, implemented pursuant to express authority granted by Congress decades ago, have been critical to restoring the government’s ability to manage the Southwest border and to work cooperatively with the Mexican government to address illegal immigration."

TALLAHASSEE, Fla. — Gov. Ron DeSantis announced limitations on nursing home and assisted living facility visitations.

On Wednesday, Gov. DeSantis temporarily banned the following people from visiting nursing homes, assisted living facilities, adult family care homes, long-term care facilities and adult group homes in Florida:

Anyone infected with COVID-19 who has not received two negative tests

Anyone showing symptoms of COVID-19 (fever, cough, shortness of breath)

Anyone who's come in contact with an infected individual can't visit the above facilities within 14 days of coming in contact with that individual

Anyone who's traveled internationally must wait at least 14 days from your return before visiting the above facilities

Anyone who's traveled on a cruise ship must wait at least 14 days from your return before visiting the above facilities

Anyone who lives in a community where coronavirus has been confirmed must wait at least 14 days after exiting your community before visiting the above facilities

"These are important efforts to mitigate the risk to our most vulnerable population to COVID-19, which is our elderly population and particularly those who have underlying medical conditions," DeSantis said.

DeSantis said in addition to the limitations, all state universities in Florida must switch to online classes as soon as possible to prevent the spread of the coronavirus.

LabCorp and Quest Diagnostics can now test for coronavirus under a doctor's orders, according to Gov. DeSantis, and the state is currently identifying labs to increase the state's testing capacity.

"We're doing tests at three different state labs, Jacksonville, Tampa, and Miami," the governor said. "We have a lot of these labs throughout the state. Question is, we gotta line them up and make sure they're willing to do it."

In regards to the March 17 election, Gov. DeSantis raised concerns about certain polling locations.

"The election is going to go on. There are though in certain counties sites where people will actually vote in an assisted living facility," said the governor. "We obviously view that as problematic."

DeSantis is asking local Supervisors of Elections to allow non-assisted living facility residents to go to different polling locations to cast their ballots.

"We are deeply concerned both by the alarming levels of spread and severity, and by the alarming levels of inaction," said Dr. Tedros Adhanom Ghebreyesus, Director-General of the WHO.

A pandemic is defined as an outbreak that occurs over a wide geographic area and affects an exceptionally high number of people.

According to the White House, Florida will receive more than $27 million in federal funding to fight coronavirus. That money will be used by hospitals and county health departments to buy more COVID-19 testing kits and protective gear, and to pay for overtime for personnel, among other things.

CINCINNATI – A federal grand jury in Cincinnati has returned an indictment charging the former Cincinnati City Council president pro tem with honest services wire fraud, bribery and attempted extortion.

Tamaya Dennard, 40, was arrested and charged by criminal complaint on Feb. 25.

Dennard was elected to Cincinnati City Council in November 2017 and resigned on March 2, 2020.

According to court documents, between August and December 2019, Dennard engaged in acts and attempted acts of bribery and extortion, attempting to exchange her votes for money.

Dennard allegedly requested between $10,000 and $15,000 from an individual to pay for her personal expenses.

At the direction of and in coordination with the FBI, the individual and Dennard exchanged a total of $15,000, in increments of $10,000 and $5,000, for upcoming votes on a matter scheduled to be heard by Council.

Dennard is charged by indictment with three counts of honest services wire fraud (up to 20 years in prison), two counts of bribery concerning programs receiving federal funds (up to 10 years in prison) and two counts of attempted extortion under color of right (up to 20 years in prison).

Today, DEA has disrupted CJNG’s operations, and there is more to come as DEA continues its relentless attack on this remorseless criminal organization.”

“Project Python marks the most comprehensive action to date in the Department of Justice’s campaign to disrupt, dismantle, and ultimately destroy CJNG,” said Assistant Attorney General Brian A. Benczkowski of the Criminal Division. “When President Trump signed an Executive Order prioritizing the dismantlement of transnational criminal organizations, the Department of Justice answered the call and took direct aim at CJNG. We deemed CJNG one of the highest-priority transnational organized crime threats we face. And with Project Python, we are delivering results in the face of that threat for the American people.”

The Justice Department and its law enforcement partners are committed to fulfilling the President’s Executive Order 13773 to identify, interdict, disrupt and dismantle transnational criminal organizations. The department designated CNJG as one of the top transnational criminal groups targeted as part of carrying out this executive order, and DEA instituted Project Python to support this ongoing effort.

CJNG is one of the fastest growing transnational criminal organizations in Mexico, and among the most prolific methamphetamine producers in the world. It is responsible for a significant proportion of drugs entering the United States, and elevated levels of violence in Mexico. With methamphetamine abuse and overdose deaths on the rise, Project Python aims to disrupt CJNG’s ability to distribute methamphetamine and other drugs throughout the United States by attacking the group at all levels.

Federal law enforcement has taken a number of steps to degrade CJNG’s ability to operate in the United States. Today, the Justice Department and DEA announced a superseding indictment on charges of alleged continuing criminal enterprise against Nemesio Ruben Oseguera Cervantes, also known as “El Mencho,” the undisputed leader of CJNG. Last month, El Mencho’s son, Ruben Oseguera Gonzalez, also known as “Menchito,” and second in command of CJNG, was extradited from Mexico to the United States on charges of alleged drug trafficking and firearm use in relation to drug trafficking activities. On Feb. 26, 2020, El Mencho’s daughter, Jessica Johanna Oseguera Gonzalez, was arrested in the United States on financial charges related to her alleged criminal violation of the Foreign Narcotics Kingpin Designation Act.

Additionally, DEA has worked with its interagency partners to apply further pressure to CJNG. The U.S. Department of Treasury has designated El Mencho as a “specially designated narcotics trafficker” pursuant to the Foreign Narcotics Kingpin Designation Act, and the U.S. Department of State has issued one of the largest narcotics rewards ever – $10 million – for information leading to the arrest of El Mencho.

The efforts highlighted in the more than 600 arrests nationwide are illustrative of the significant reach the CJNG has in manufacturing, importing, and distributing a wide array of illegal narcotics within the United States and the negative impact on the fabric of our local communities. The proceeds from the local distribution of these narcotics are repatriated back to Mexico and further fuel transnational organized criminal organizations such as the CJNG. The Department of Justice and its law enforcement partners will continue to vigorously fight this scourge against the United States.

US carries out nationwide arrest blitz on 'remorseless' CJNG cartel

Federal prosecutors and agents in Washington, D.C., announced a major coordinated arrest blitz Wednesday against members of the the dangerous Mexican cartel, Cártel Jalisco Nueva Generación.

Across the nation, federal agents and police served more than 100 search warrants on 250 targets and the confiscation of 600 kilograms of drugs Wednesday as part of "Project Python," an ongoing mission to disrupt and dismantle CJNG, Uttam Dhillon, acting administrator of the U.S. Drug Enforcement Administration, told reporters during a news conference.

So far this week, law enforcement arrested more than 700 CJNG associates, secured 350 indictments and intercepted a "signifcant" amount of drugs and drug money following six months of investigating the cartel's global crimes, he said. During the DEA-led operation, federal officials have intercepted 2,000 kilos of various drugs and seized more than $22 million in money and assets.

"Project Python is the single largest strike by U.S. authorities against CJNG to date, but it's only the beginning," Dhillon said. He call the cartel a "remorseless criminal organization," which profits off America's addiction epidemic.

CJNG's leader, Rúben Oseguera Cervantes, is a top U.S. target with a $10 million reward for help capturing him.

“When President Trump signed an Executive Order prioritizing the dismantlement of transnational criminal organizations, the Department of Justice answered the call and took direct aim at CJNG," said Assistant Attorney General Brian A. Benczkowski of the Criminal Division.

CJNG is the most well-armed cartel in Mexico with more than 100 meth labs in Mexico with major hubs in Los Angeles, New York, Chicago, Houston and Atlanta, Benczkowski said.

But they're also in small towns — including Louisville, Lexington and Paducah, according to findings from a nine-month Courier Journal investigation.

The Courier Journal profiled El Mencho and CJNG in a special report last year that highlighted how the fast-growing cartel made its way into small-town America, including cities across Kentucky. The investigation found the cartel operating in at least 35 states and the territory of Puerto Rico.

"Mexican drug cartels pose a serious threat to communities right here in Kentucky, and CJNG is perhaps the most violent and ruthless of them all," Todd Scott, special agent in charge of DEA’s Louisville Field Division, said Wednesday.

“DEA will not stop until CJNG is destroyed and its members face justice."

The cartel leader's son, Rubén Oseguera Gonzalez, who once stood to inherit the throne of a drug dynasty from his billionaire father in Mexico, was extradited last month to the U.S. "Menchito," or "Lil' Mencho," was brought before a federal judge in D.C. on drug and weapons charges and pleaded not guilty. His sister, Jessica Johanna Oseguera Gonzalez, known as "La Negra," also was charged in D.C. on charges of associating with several businesses that launder money for the cartel.

But the most sought after target, their father, has remained on the run for eight years, surrounded by heavily-armed mercenaries. DEA agents believe he is likely in the mountains or jungles of the Western Mexican states of Nayarit, Jalisco, where the cartel is headquartered, or Michoácan, where Mencho was born.

The new safety measures come on the heels of the spreading coronavirus pandemic that has been linked to six deaths at a Seattle nursing home.

An exclusive 5 On Your Side investigation reviewed the most recent inspection reports for Ohio's 958 nursing facilities and found more than one-third, 383, were cited for failure to provide and implement infection control measures.

"We are taking this very seriously, " said Peter Van Runkle, Executive Director of the Ohio Health Care Association that represents nursing homes across the state.

But Van Runkle also says while "infection control is the number one cited deficiency," it does not mean patients are getting sick.

"Infection control encompasses a broad range," says Van Runkle, " so the notion that someone was cited–that one its patients got sick or that there was an infection that was rampant in the facility–is not accurate."

Instead, he says the vast majority of violations are related to paperwork, rules and procedures.

Still, infection control is being dramatically stepped up in nursing home across the state.

"One is keeping the infection from coming from the outside," says Van Runkle, "the second is preventing the spread of the infection within the facility."

In addition, the federal coronavirus task force is dispatching thousands of inspectors to nursing homes in Ohio and nationwide.

The task force, headed up by Vice-President Mike Pence, is "raising standards for every nursing home with regard to infectious disease and deploying 8,000 inspectors in every state."

Charles K. Edwards, a former acting inspector general for the Department of Homeland Security (DHS), has been charged in a scheme from 2014 to 2017 to steal government proprietary software and information from confidential databases as part of a larger scheme to defraud the government.

A federal grand jury returned a 16-count indictment against Edwards, 59, on Friday, according to a Department of Justice (DOJ) press release. Edwards left his DHS position in December 2013, but allegedly used his continued connections in the department to facilitate his scheme.

Edwards, along with fellow DHS employee Murali Yamazula Venkata, 54, and others, are alleged to have participated in a scheme to defraud the government by stealing confidential and proprietary software from DHS Office of Inspector General (OIG). They also reportedly accessed government databases containing personal identifying information of DHS and USPS employees in what the DOJ believed was an effort by Edwards’ company, Delta Business Solutions, to enhance the DHS-OIG’s software and sell a version of it to the Office of Inspector General for the U.S. Department of Agriculture, for a profit.

The DOJ assessed that Venkata and other remaining DHS employees helped Edwards steal the software, and further assisted him in configuring his computer to accept the software, as well as to set up a home server with which he could continue to modify the stolen technology into the version he planned to pass off to the Department of Agriculture. That stolen software also reportedly contained the logs of personal identifying information for the DHS and USPS employees.

As he worked on the project, Edwards reportedly retained Indian software developers. It was not clear from the DOJ press release if those foreign nationals would have been able to access and view the personal information of U.S. government employees compromised by Edwards alleged scheme.
