So NJ lifelong resident here, I was sick as a dog in December 2019 so much so that I went to the doctor and got meds and cough medicine (prescription strength) to help with symptoms. Knocked me on my ass for about 2 weeks but didn't want to be sick for Christmas and I fully recovered. In another scenario, my Aunt who has cancer and is in a sort of remission has chemo treatments once a week for 6 to 8 weeks a few times a year was very ill with what they called a "viral lung infection" and had to quarantined in the hospital for over a week, face masks and all when she was released and told to stay home. She also recovered and is back to her treatments. I swear I had this Covid thing back then……just an fyi….

Next week, the Supreme Court will hear lawyers argue the president’s claim that he has absolute immunity while in office.

 

On Tuesday, the U.S. Supreme Court is scheduled to hear one of the most consequential cases ever considered on executive privilege. Trump v. Vance concerns a subpoena issued by the Manhattan district attorney to President Trump’s accountants demanding the release of tax returns and other financial documents to a grand jury.

What is at stake is no less than the accountability of a president to the rule of law.

Mr. Trump claims that a president has β€œtemporary absolute immunity,” meaning he cannot be criminally investigated while in office. Indeed, in oral argument before the U.S. Court of Appeals for the Second Circuit in New York, his lawyers said that if the president were to shoot someone on Fifth Avenue, he could not be investigated or indicted until after he left office.

If the justices endorse this extreme view, they will make it impossible to hold this president, and all future presidents, answerable in courts for their actions.

Mr. Trump’s legal position contradicts clear Supreme Court precedent. In U.S. v. Nixon, a unanimous Supreme Court ordered President Richard Nixon to turn over Oval Office tapes subpoenaed by the Watergate special prosecutor, Archibald Cox. In Clinton v. Jones, a unanimous court held that a sitting president can be forced to testify in response to a subpoena in civil litigation. Taken together, these cases make it clear that the president is not immune from investigation, whether criminal or civil, while he is in office.

 

Mr. Trump’s claims of absolute immunity are even weaker than the assertions by Presidents Nixon and Bill Clinton. The subpoena was issued by a state, rather than a federal prosecutor. The 10th Amendment to the U.S. Constitution allows states a certain degree of autonomy in investigating and prosecuting crimes. Although grand jury proceedings are secret, Mr. Vance is probably also investigating whether the president’s company, the Trump Organization, falsely accounted for hush-money payments made in the run-up to the 2016 election to two women who claim they had affairs with Mr. Trump. One was caught red-handed engaged in nepotism. Another, a lawyer no less, admitted to shoplifting at a Marine barracks store. A third leaked sealed court information to the news media. And a fourth engaged in fraud by turning a government garage into a personal repair shop.

 

Four cases, all solved in the past month, with suspects who cost taxpayers hundreds of thousands of dollars and significant breaches of public trust.

 

But these weren’t your everyday perps.

 

All were U.S. Department of Justice (DOJ) employees who are supposed to catch other criminals while working for the FBI, the Drug Enforcement Administration (DEA) and U.S. attorneys’ offices. Instead, they broke the law or violated the rules. And all managed to escape prosecution, despite their proven transgressions.

 

Recent Justice Department disciplinary files tell an undeniable story.

 

Under the leadership of Inspector General (IG) Michael Horowitz, DOJ’s internal watchdog is doing an outstanding job of policing bad conduct inside America’s premier law enforcement agency.

 

And DOJ is doing a poor job of punishing its own.

 

In cases closed in the past month, more than a half-dozen FBI, DEA, U.S. attorney and U.S. marshal officials were allowed to retire, do volunteer work, or keep their jobs as they escaped criminal charges that everyday Americans probably would not.

 

In most instances, the decisions were made by federal prosecutors who work with the very figures impacted by or committing the bad conduct. In local law enforcement, that go-easy phenomenon is known as the β€œthin blue line.”

 

Spokespersons for the Justice Department and FBI did not respond to a request for comment.

 

The troubling pattern of weak punishment emerges as DOJ heads into one of its most ambitious internal affairs probes in recent history. Attorney General William Barr, Horowitz and special U.S. Attorney John Durham are investigating whether the FBI and other intelligence agencies violated the law with the Trump-Russia investigation.

 

Even before the recent spate of closed inspector general investigations, questions surfaced about DOJ’s willingness to punish its own. That’s because fired FBI Deputy Director Andrew McCabe was recommended for prosecution more than 15 months ago for lying about news leaks, and so far has faced no criminal charges.

 

To put that into perspective, it took special counsel Robert Mueller just a few months to bring charges against multiple figures associated with President Trump’s campaign accused of lying or other process crimes.

 

It’s still possible that McCabe could face prosecution. But the recent spate of fresh wrongdoing inside DOJ doesn’t portray a compelling pattern of enforcement or punishment.

 

Take, for example, the DEA executive who just this week was found to have engaged in nepotism by routing hundreds of thousands of dollars to contractor jobs for his son and retired colleagues or friends.

 

Horowitz spared few words for the egregious scheme. β€œThe senior DEA official wasted and misused hundreds of thousands of dollars in taxpayer funds and engaged in misconduct when he took actions to get his son and former colleagues contractor positions and that his actions constituted misconduct in violation of federal ethics regulations, the DEA Standards of Conduct, and the Federal Acquisition Regulation,” he reported this week.

The official also engaged in a β€œlack of candor,” the investigative file showed.

 

Despite the established wrongdoing, criminal prosecution β€œwas declined” and β€œthe senior DEA official retired from his position.” In short, he kept his retirement benefits.

 

Likewise, the inspector general had harsh words for the FBI special agent in charge (SAC) who used the bureau’s official garage to perform repairs on his and other employees’ personal vehicles, calling it, among other things, a β€œdereliction of supervisory responsibility,” and a misuse of tax dollars for β€œprivate gain.”

 

β€œThe SAC took advantage of the SAC’s official position for personal benefit by arranging to have the SAC’s personal vehicle repaired by an FBI employee in exchange for compensation, in violation of federal regulations regarding standards of conduct for federal employees and FBI policy,” the investigative file concluded. β€œThe OIG also found that the SAC was derelict in the SAC’s supervisory responsibilities by allowing use of the FBI repair facility to conduct repairs and maintenance on personal vehicles belonging to FBI employees.”

 

And then there was the FBI lawyer who got caught in an embarrassing criminal act at the Marine Corps barracks (MCB) commissary in Quantico, Va.

 

β€œThe FBI attorney admitted to placing numerous cosmetic items, valued at $257.99 and belonging to the MCB Quantico Exchange, into her purse without the intention to pay for them and did not pay for them before leaving the store. The FBI attorney further admitted that between February 2016 and her arrest in February 2018 she had shoplifted at the MCB Quantico Exchange one to two additional times, and at other private retailers in the area on two to three occasions,” the inspector general reported on May 14.

 

The investigation concluded her conduct violated federal criminal law and FBI policy regarding unprofessional conduct. But here was the outcome: β€œCriminal prosecution was deferred pending the FBI attorney’s completion of 125 hours of community service, after which all charges were dismissed.”

 

A few weeks of community service, and she was still in her job at the time the IG issued its report.

 

Two weeks ago, another DOJ official, an assistant U.S. attorney, escaped charges even after it was documented that he violated federal laws by possessing, transporting and consuming marijuana-laced edibles that he claimed he needed to treat back pain. He also was caught lying about his wrongdoing and 'fessed up only when his estranged wife threatened him during their divorce proceedings. Nonetheless, β€œcriminal prosecution by federal and state authorities was declined,” the IG reported May 30.

 

One of the internal affairs cases that stunned members of Congress this month directly grew out of the interwoven Hillary Clinton email and Russia collusion investigations in 2016, during then-FBI Director James Comey’s tenure.

 

The IG concluded that an FBI deputy assistant director engaged in multiple improper news media leaks while those investigations were ongoing, including one that violated a sealed court order, and accepted an improper gratuity from the news media. But prosecution was declined, yet again. FBI officials say they are considering discipline against the supervisor.

 

Records I reviewed indicate that more misconduct eerily similar to that already uncovered is being investigated. For example, the IG fraud unit opened a case in March and began interviewing whistleblowers about a new contract fraud matter inside the DEA, emails show.

 

It used to be that those who were entrusted to enforce the law were held to the highest standards.

 

Today, however, there is a troubling pattern of officers being held to a lower standard inside a department where critics fear there is a dual system of justice.

Honduran national Kristian Jonas Gamez Trejo, 25, was convicted of felony sex with a minor in 2016, has been arrested by San Francisco law enforcement six times, but keeps being released despite ICE efforts to hold him.

 

Trejo has been on ICE’s Most Wanted list for years, and was arrested again on April 28, but the city would not hand him over, Breitbart reports.

 

β€œOnce again, I am waiting for San Francisco officials to tell me how not turning over Mr. Gamez made our community safer. San Franciscans deserve better,” ICE San Francisco Field Office Director David Jennings said in a statement. β€œThere is no reason this convicted child predator should have been turned loose into our community. Even California’s misguided SB54 sanctuary policy allows local authorities to turn over to ICE any criminal aliens convicted of felony crimes of sexual exploitation or crimes endangering children.”

 

The pedophile rapist first entered the U.S. illegally prior to April 2014 before he was deported months later in June, the Breitbart report explains. He illegally entered the country again the following year and was deported in December 2015.

 

β€œIn August 2016, after again illegally entering the U.S., Gamez was arrested in San Francisco, California, for felony sex with a minor. San Francisco officials released Gamez from jail despite a request by ICE that he be turned over to the agency,” the report says.

It was β€œMad Men” with security clearances, but some skilled female spies rose high in the ranks.

 

A few years ago, four veteran CIA officers, with more than a 100 years of collective experience over four decades, were asked to speak frankly about serving in the agency as women. The taped conversations, used for internal review by the CIA, reveal encounters with male attitudes from the officers’ early years that aren’t surprisingβ€”it was indeed a Mad Men world, albeit with security clearances. The transcripts, part of a trove of recently declassified CIA documents, also contain wry, Peggy Olson-esque recollections in which being a woman proved an assetβ€”and hardly in the β€œfemme fatale” vein of intelligence gathering.

 

β€œYou could always tell them by their socks,” said Meredith, then-deputy chief of the CIA’s European Division, about spotting foreign agents. (All last names in the document are redacted.) She joined the agency with her husband in 1979 as a β€œcontract wife,” a spouse sent abroad by the CIA with her agent-husband to provide secretarial-type support work for low pay. When dressing to blend in with the crowd, Meredith recalled, undercover agentsβ€”on all sidesβ€”tended to overlook shoes and socks. β€œThat would never occur to my husband to look at.”

 

β€œWomen…were much better at detecting surveillants on foot,” agreed Patricia, who joined the agency in 1973 and was awarded the CIA’s Distinguished Career Intelligence Medal when she retired in 2004. β€œI always put that down to women [being] more sensitive [to] who’s near or in their space, for physical protection.” That included in stores, she said, β€œbecause surveillants don’t shop well; they just can’t fake it.”

 

Carla, who joined the agency in 1965 and was Deputy Chief of the Africa Division by the time she retired in 2004, recalled a time when male higher-ups in the agency warned that women would be ineffective for recruiting agents and gathering intel abroad. She recounted a successful assignment debunking that notion:

 

I never actually had to pitch the guy. I [played] sort of the β€œDumb Dora” personality, and β€œGolly” β€œGee!” and β€œWow!” He would tell me, β€œI just love talking to you because you’re not very bright.” And I would just sit like this [makes an innocent expression]. The recruitment ended because he told me about a plot to go bomb the embassy in [redacted] and we arrested him and his gang of merry men as they crossed the border. He just told me everything and I got tons of intel out of him because I was just a woman who wasn’t very bright.

 

An internal survey from 1953 dubbed β€œThe Petticoat Panel” shows that while women accounted for 40 percent of the agency’s employees at the timeβ€”better than the overall US workforce then, which was 30 percent femaleβ€”only one-fifth of those women were above the midlevel GS-7 on the government’s salary grade, which went to GS-18. Meanwhile, 70 percent of men in the CIA were higher than G-7, and 10 percent topped GS-14, a grade no women had reached at the time. That was despite the fact that women had proven essential to American intelligence just years prior as high-ranking operations officers and data analysts with the WWII-era Office of Strategic Services (OSS), the precursor to the CIA.
