Pfizer Employee Stole 12,000 Files Including COVID-19 Vaccine Secrets, Lawsuit Claims

Pfizer claims that a "soon-to-be-former employee" uploaded more than 12,000 files - including "scores" with confidential information - to her personal Google Drive account and other personal devices, a lawsuit from the company claims.

The company has accused Chun Xiao Li ("Li") and five potential co-defendants of corporate espionage, saying Li "decided to leave Pfizer for a competitor believed to be Xenocor, Inc."

What's more, Li apparently gave Pfizer a 'decoy' laptop to throw internal investigators off the trail.

Per the filing:

Had Ms. Li left Pfizer honorably, she would not be named in this Complaint. But she made a different choice: on her way out the door, she transferred onto personal accounts and devices over 12,000 files, scores of which contain Pfizer confidential and trade-secret information, and tried covering her tracks repeatedly.

She went so far as to provide Pfizer’s security team a decoy laptop, leading Pfizer to believe it was the one she used to download the 12,000 files from her Google Drive account. Forensic analyses confirmed it was not, and Ms. Li (or somebody else, including potentially DOES 1-5) likely remains in possession of the actual computer that contains those 12,000 files.

The lawsuit seeks a temporary restraining order to prevent Li from using, disclosing, transmitting or altering any confidential information she stole, per Bloomberg Law.

Li's tenure with Pfizer began in 2006 at their Global Product Development Group in China, before transferring to the company's La Jolla, California campus in 2016. She had signed a confidentiality agreement as part of her employment.

Her alleged theft was first detected as part of routine tracking of employee activity on company devices in October, when she transferred 12,000 files from her Pfizer laptop, per the complaint.

New York Times Admits More Coronavirus Deaths Under Joe Biden ‘Despite Vaccines’

The New York Times delivered a dire statistic the day before Thanksgiving, admitting more people in the United States have died of the Chinese coronavirus this year, under President Joe Biden’s leadership, than last year, despite the widespread availability of vaccines.

The Times cited the Centers for Disease Control and Prevention’s (CDC) Tuesday figures, which reported 386,233 coronavirus related fatalities in the U.S. for 2021. In all of 2020, the U.S. recorded 385,343 fatalities. The former figure is only expected to rise, as there is still over one month left of the year.

Citing “experts,” the Times attributed the increased fatalities this year on a “confluence of factors,” focusing primarily on what it described as “crucially lower-than-needed vaccination rates, but also the relaxation of everyday precautions, like masks and social distancing, and the rise of the highly contagious Delta variant.”

Per the Times:

Essentially, public health experts said, many Americans are behaving as though Covid-19 is now a manageable, endemic disease rather than a crisis — a transition that will happen eventually but has not happened yet.

Yet many are also refusing to get vaccinated in the numbers required to make that transition to what scientists call “endemicity,” which would mean the virus would still circulate at a lower level with periodic increases and decreases, but not spike in the devastating cycles that have characterized the pandemic. Just 59 percent of Americans are fully vaccinated, the lowest rate of any Group of 7 nation.

However, placing the blame on “lower-than-needed vaccination rates” appears to defy logic, as the vaccine has been widely available for the bulk of the year.

The same cannot be said for 2020, when the world was just beginning to discover what the virus was and where it came from. While the Trump administration moved to get vaccine production going via Operation Warp Speed, vaccines were not widely available to the entirety of the eligible population until this year. Even so, rollout has demonstrated that vaccinated individuals can still spread and contract the virus.

The Times also attributed the increased fatalities to the “relaxation of everyday precautions” — one of the key incentives officials touted to Americans during vaccine rollout, many of whom promised that vaccines would pave a way for Americans to return to a state of pre-pandemic normalcy. However, that proved to be false, as many localities, and blue states, reintroduced restrictions, including mask mandates, regardless of vaccination status.

That aside, Florida alone challenges the assertion that lax mitigation measures are attributing the spread and increased fatalities. The Sunshine State, whose Gov. Ron DeSantis (R) came under a flurry of constant scrutiny throughout the pandemic for prioritizing personal freedom and refusing to keep the state locked down, continues to have the lowest coronavirus case rate per capita in the nation.

It never had a statewide mask mandate in place, even at the height of the pandemic.

The Times’ own coronavirus tracker, last updated Wednesday, shows Florida reporting a daily average of 1,397 cases, or seven per 100,000 — the lowest per capita rate in the nation. Florida’s most recent figures reflect a five percent drop in cases over the last 14 days.

States that reinstituted mandates, such as Illinois, are not faring as well, reporting a daily average of 4,599 cases, or 36 per capita. That represents an increase of 73 percent over the same time period.

The Salvation Army wants its white donors to give it more than just money this Christmas season. Its leadership is also demanding they apologize for being racist.

It's part of a push by the Christian charitable organization to embrace the ideas of Black Lives Matter, an activist group working to, among other things, "dismantle white privilege" and "disrupt the Western-prescribed nuclear family structure."

The Salvation Army's Alexandria-based leadership has created an "International Social Justice Commission" which has developed and released a "resource" to educate its white donors, volunteers and employees called Let's Talk about Racism. It asserts Christianity is institutionally racist, calling for white Christians to repent and offer "a sincere apology" to blacks for being "antagonistic.. to black people or the culture, values and interests of the black community."

"Many have come to believe that we live in a post-racial society, but racism is very real for our brothers and sisters who are refused jobs and housing, denied basic rights and brutalized and oppressed simply because of the color of their skin," one lesson explains. "There is an urgent need for Christians to evaluate racist attitudes and practices in light of our faith, and to live faithfully in today’s world."

Report: 160,000 US troops struggling to feed their families even with $753B defense budget

About 160,000 U.S. service members are struggling to feed their families, despite the $753.5 billion defense budget for 2021, according to a new study by Feeding America.

The new Feeding America study, published last week and first reported by the Associated Press, estimates 160,000 active-duty military service members are having a hard time feeding their families.

The exact number of U.S. service members struggling to feed their families remains a topic of continued debate as there has been no formal study on the matter, according to the Associated Press. But Feeding America believes junior service members — particularly those between the ranks of E1 and E4 — have been struggling with the issue for years.

Feeding America estimated about 29% of service members in those junior enlisted ranks have faced food insecurity within the past year.

“It’s a shocking truth that’s known to many food banks across the United States,” Vince Hall, Feeding America’s government relations officer, told the Associated Press. “This should be the cause of deep embarrassment.”

While leaving a drive-through food bank organized by a San Diego-area Armed Services YMCA branch, Navy Petty Officer 3rd Class James Bohannon (a Navy E4), described having to pick up food donations to help feed his two daughters.

“It is what it is. You know what you’re signing up for in the military,” Bohannon said. “But I’m not going to lie. It’s really tough.”

That Food insecurity persists in the military even after Congress approved a 2021 defense budget that included $705.4 billion in discretionary spending, $10.7 billion in mandatory spending and $37.3 billion in non-Department of Defense (DoD) defense-related, for a total defense budget of about $753.5 billion for the year.

Adding to the challenges of food insecurity among military families is a Department of Agriculture rule that bars military families from accessing the Supplemental Nutrition Assistance Program (SNAP), also known as food stamps. The rule, contained in the 2008 Food and Nutrition Act, states military housing allowances count as income, which can raise one’s income calculation about the level for SNAP eligibility.

“It’s one of these things that the American people don’t know about, but it’s a matter of course among military members. We know this,” Sen. Tammy Duckworth (D-IL), a combat-wounded U.S. Army veteran said of the food stamps rule.

Frustrated drivers at gas stations stick it to Biden with ‘I did that’ decals

Consumers angry with soaring gas prices are placing stickers on gas pumps with an image of President Biden saying “I did that” as he points to the total price paid by the driver.

And stickers of House Speaker Nancy Pelosi, California Democrat, saying “I helped,” are placed right next to Mr. Biden’s “I did that” decals.

The stickers, available online in stacks of 100 to 300 and costing from $7 to $20, are reportedly springing up at gas pumps around the country and were seen by The Washington Times on pumps along I-95 and other interstates in several states between Washington, D.C., and Florida.

Another sticker shows a shirtless, unkempt Hunter Biden, the president’s son, who is known to have struggled with drug and alcohol addiction, smoking a cigarette and saying, “Gas prices higher than Hunter Biden.”

Mr. Biden on Tuesday released 50 million barrels of oil from the Strategic Petroleum Reserve to counter the high energy prices ahead of the holiday travel season. But officials say it will be weeks before the move affects the market, and industry analysts say it likely won’t have a big impact on prices.

During his remarks, Mr. Biden refused to take the blame for his policies being the cause of high gas prices, pointing instead to profiteering in the industry.

“The price of gasoline in the wholesale market has fallen by about 10% over the last few weeks. But the price of the pump hasn’t budged a penny,” Mr. Biden said. “In other words, gas supply companies are paying less and making a lot more. And they do not seem to be passing that on to the consumers at the pump.”

Mr. Biden has an uphill battle, however, to convince Americans that he is blameless. According to a new Yahoo News/YouGov poll, over 77% of Americans say inflation is affecting their lives as they head into the holiday season — and 57% blame Mr. Biden.

“Pocketbook issues are non-partisan issues, and the ongoing pain at the pump is driving a great deal of frustration across the country,” GOP communications consultant Alice Stewart told The Washington Times. “President Biden says ‘the buck stops with me,’ that’s true, and his policies are responsible for the inflationary prices people struggle with at the gas station, grocery store, car lot, and everywhere they are paying more throughout this not-so-‘transitory’ period.”

She said, “Liberal policies have led to tremendous sticker shock for consumers. It seems appropriate for consumers to return the favor with a sticker of their own.”

Administration officials say the high inflation is primarily a result of higher demand and reduced supply of a variety of goods as the global economy emerges from the two-year-long pandemic.

The gag stickers at gas stations build off a growing anti-Biden sentiment that is seen in sports arenas where fans chant or download rap songs with the title, “F*** Joe Biden” or its G-rated cousin, “Let’s Go Brandon.”

In Sea Grove Beach, Florida, wealthy homeowner Marvin Peavey, a Georgia real estate and property management businessman, has battled the Walton County government for months for hanging two banners over the side of his multi-story condominium. One says, “Trump Won” and the other reads “Let’s Go Brandon.”

Mr. Peavey, fined $50 a day in signage regulations, told the Northwest Florida Daily News, “Fifty dollars a day ain’t a damn thing to me. … I’m not going to take it down.”

It carries 32 mutations, many of which suggest it is highly transmissible and vaccine-resistant, and has more alterations to its spike protein than any other variant.

Professor Francois Balloux, a geneticist at University College London, said it likely emerged in a lingering infection in an immunocompromised patient, possibly someone with undiagnosed AIDS.

Changes to the spike make it difficult for current jabs to fight off, because they train the immune system to recognise an older version of this part of the virus.

Can the strain dodge vaccine-induced immunity?

Scientists say the strains mutations suggest it is better able to dodge immunity from vaccines.

Some warned it 'looks like' it could be better at dodging jabs than all other variants, including the South African 'Beta' strain.

It carries mutations K417N and E484A, which are similar to those on the Beta variant that made it more jab resistant.

But it also has mutations N440K, found on Delta, and S477N, on the New York variant, that could also make it more resistant.

B.1.1.529 also carries mutations P681H and N679K which are 'rarely seen together' on a specific part of the spike protein.

Bail For Christmas Parade Killer Darrell Brooks Set at $5 Million; 6th Homicide Charge Will Be Filed Later This Week With Several Other Charges Being Reviewed

Darrell Brooks, the radicalized black supremacist who intentionally sped his SUV through the crowd at the Waukesha Christmas parade, made his initial appearance in court on Tuesday for the horrific terror attack that killed 6 people and injured 60 more.

Brooks sat hunched over, restrained by handcuffs and a suicide prevention smock, as he was charged with five counts of first-degree intentional homicide and his bail was set for $5 million.

Court Commissioner Kevin Costello agreed with the prosecution’s request to set bail at $5 million, citing Brooks’ extensive criminal record that includes violent offenses and child sex crimes, his repeated pattern of jumping bail or resisting arrest, and the “shocking” nature of his latest offense.

All available evidence at this point shows that Brooks’ actions were in fact intentional, with detectives saying that his vehicle “seemed to swerve into individuals,” while avoiding hitting vehicles at other times. Witnesses also said he gained speed as he barreled his way down the street.

During his decision, Costello said he had never had seen a case like this one in his 40 years serving in law. He explained that even though the bail request was extremely high, it was warranted because of the severity of his heinous, intentional attack and the fact that if he is convicted on any charge he will serve the rest of his life behind bars.

Brooks should never have been out of jail in the first place, but thanks to felons-first Milwaukee DA John Chisholm, this violent felon was bailed out for just $1000.

Supreme Court to hear dispute over North Carolina voter ID law

In a surprise pre-Thanksgiving order, the Supreme Court on Wednesday added one new case to its merits docket for the 2021-22 term. In Berger v. Top Republican lawmakers in North Carolina who back the measure are seeking to intervene in defense of its constitutionality, despite the fact that the state’s attorney general, a Democrat, has already taken that position in state and federal court. Still, GOP legislative leaders contend that they too have a right to represent the state’s interest in defending the law — a claim the lower courts found unconvincing, prompting the lawmakers’ appeal to the Supreme Court.

“This is a fairly common problem we see today where a state executive (governor and/or attorney general) is a Democrat and the state legislature is controlled by Republicans, and there’s a dispute over who gets to speak for the state,” Rick Hasen, a professor at University of California, Irvine School of Law, wrote on the Election Law Blog.

The North Carolina legislature passed the state’s voter ID law in December 2018 after overriding the Democratic governor’s veto.

The law, S.B. 824, with only limited exceptions requires in-person and absentee voters to present one of 10 recognized forms of photo identification. The measure drew a swift legal challenge from the North Carolina State Conference of the NAACP and several of its affiliates.

The challengers allege that the photo ID requirement, along with provisions of the law that expand the number of poll watchers and make it easier to challenge ballots, pose a disproportionate impact on minority voters in violation of legal protections.

FCPS Reinstates Two Books, Reaffirming Commitment to Supporting Diversity in Literature

Two books that were subject to a formal challenge have been deemed appropriate for high school readers following a two-month review process and will be reinstated to Fairfax County Public Schools (FCPS) libraries.

The decision reaffirms FCPS’ ongoing commitment to provide diverse reading materials that reflect our student population, allowing every child an opportunity to see themselves reflected in literary characters. Both reviews concluded that the books were valuable in their potential to reach marginalized youth who may struggle to find relatable literary characters that reflect their personal journeys.

“Gender Queer: A Memoir” by Maia Kobabe and “Lawn Boy” by Jonathan Evison had been temporarily removed from FCPS libraries serving high schools following a challenge in September. The highly-regarded and award-winning books were questioned due to content said to be of an explicit sexual nature, and claims that they referenced pedophilia.

Per FCPS Regulation 3009

, on receipt of the formal complaint, two committees of school administrators, librarians, parents, and students were formed to consider whether the two books were suitable (as optional independent reading material) for high school students. Both books were temporarily withdrawn from FCPS library shelves during the review process.

After deliberate and lengthy discussions on the potential merits and concerns of the book as a literary work, and the potential merits and concerns associated with retaining or removing access to the book from students using school libraries, the committees unanimously recommended that the books should remain available. The final decision to reinstate them was made by the assistant superintendent, Instructional Services Department, per the process outlined in the regulation.

The committee noted the following merits of “Lawn Boy,” which appears in the catalogue of 11 FCPS high schools:

The book is an accessible examination of race, class, socio-economic struggle, and sexual identity. It paints a portrait of the substantial obstacles faced by those who are marginalized by society. It is an uplifting and humanizing depiction of navigating through setbacks with resiliency to reach goals and will resonate with students.

The themes of this book are affirming for students who will recognize that they are not alone as they experience similar systemic challenges and societal prejudices.

The book has literary value as a narrative representing the perspective of a significant portion of students in Fairfax County Public Schools with a variety of backgrounds.

There is no pedophilia present in the book.

The committee noted the following merits of “Gender Queer,” which appears in the catalogue of seven high schools:

The book is a well-written, scientifically based narrative of one person’s journey with gender identity that contains information and perspective that is not widely represented. Soldiers Who Refuse Vaccination Can Still Serve, But Their Careers Are Over

Army officials are telling soldiers who refuse to get vaccinated against COVID-19 that they aren't getting booted immediately, but they can't stay in the service for a career.

In a memo to the force last week, Army Secretary Christine Wormuth said active-duty soldiers, reservists and Guardsmen who refuse the vaccine will be "flagged," meaning they will be barred from reenlistment, promotions and potentially most schools.

But soldiers won't be outright removed automatically. Hypothetically, a soldier with years left on their contract can still serve, but will see no progress in their career and will not be allowed to serve beyond that contract. They could leave with an honorable discharge.

The deadline to be vaccinated is Dec. 15 for active-duty soldiers and June 30 for Reserve and Army National Guard troops.

"At this time, the secretary has not authorized any separations with the sole basis being refusal to follow the COVID-19 vaccination order," Lt. Col. Gabriel Ramirez, an Army spokesman, said in a statement Monday.

The consequences vary for more senior ranks. Sergeants major, first sergeants and officers who refuse inoculation face possible relief of duty.

The Army's decision not to discharge unvaccinated soldiers is a departure from most of the Defense Department. All other service branches have issued guidance to start removing troops who refuse inoculation. Last month, the Air Force booted 40 new recruits for refusing COVID-19 vaccinations.

Wormuth's new guidance comes amid a standoff between the Oklahoma National Guard and the Pentagon after the state's adjutant general, Brig. Gen. Thomas Mancino, made a move to overrule the Defense Department's vaccine rules, issuing a memo notifying troops they won't be required to take the COVID vaccine.

The Guard is mostly under control of the state's governor unless federally activated, making the Pentagon's authority on the matter murky. Multiple governors are considering following Oklahoma's lead, including Texas, as Republican officials are increasingly resistant to vaccines and COVID-19-related mandates.

There is little evidence of widespread anti-vaccine sentiment in the military. As of last week, 92% of active-duty soldiers are fully vaccinated, far outpacing the general U.S. population, which is at 59%, according to data from the Centers for Disease Control and Prevention.

At the annual Association of the United States Army conference last month, Sergeant Major of the Army Michael Grinston, the force's top enlisted leader, urged soldiers to get vaccinated, likening shots to body armor.

"Imagine I had really good body armor and you said, 'I don't want it,'" Grinston said. "Would you be able to call the family member and tell them you had that kit and didn't make them wear it? That's how I feel about it."

Keeping it 100%: Nearly All Active-Duty Sailors Vaccinated Against COVID-19

As the deadline approaches for active-duty sailors and Marines to be fully vaccinated against COVID-19, the U.S. Navy is closing in on 100% compliance, with fewer than 70 sailors not yet having received a dose.

According to data provided Wednesday by the Navy, 97% of the service's roughly 343,000 sailors are fully immunized, while an additional 2.8% have received at least one dose. Six sailors have received permanent medical exemptions, and none has gotten a waiver for religious reasons.

Meanwhile, the Marine Corps faces an uphill battle in meeting the Nov. 28 deadline set by Navy Secretary Carlos Del Toro: As of Wednesday, 94% of Marines had received at least one dose of the vaccine and 91% were fully vaccinated – the lowest rates of any of the Defense Department's service branches.

That means roughly 10,800 Marines have ignored the deadline or are seeking exemptions.

The Corps has not released data on religious or medical waivers, but a spokesman said Wednesday that all requests are being reviewed on a case-by-case basis.

"Each request will be given full consideration with respect to the facts and circumstances submitted in the request," noted a statement released by Capt. Andrew Wood, a communications strategy officer for Headquarters Marine Corps.

The Air Force and Space Force faced the earliest deadline of all branches Nov. 2. As of Wednesday, 97.1% of all airmen and Guardians had received at least one dose 600 more than in the days immediately following the deadline.

According to the Air Force, 7,874 members remain unvaccinated, including 4,756 who have requested a religious exemption, 1,993 who "haven't started the series" or had their vaccines properly documented, and 1,125 who have simply refused to get the shots.

Air Force officials have said those who refuse to comply with the mandate will face counseling and disciplinary action for disobeying a lawful order. The Air Force already took action against 40 basic and military trainees who refused the shot, dismissing them from the service.

On Monday, the service added a new restriction on its vaccine refusers: not issuing them orders for new assignments.

According to what appeared to be a memo released Tuesday by Lt. Gen. Brian Kelly, the service's deputy chief of staff for manpower, personnel and services, and posted to Facebook, airmen who have refused the vaccine, as well as those waiting for a decision on exemption requests, will not receive any permanent change of station orders starting Nov. 29.

"This restriction will remain in place until the member is either fully vaccinated against COVID-19 or receives an approved medical exemption or religious accommodation," Kelly wrote.

Only those unvaccinated and partially vaccinated personnel who already have processed out of their base or shipped their household goods or vehicles by Nov. 29 will be allowed to proceed to their next duty station.

According to the Air Force, the new policy will be good for a year.

Soldiers have several weeks before they must be fully vaccinated, although they would have needed to complete the series of two shots by Nov. 24 to be considered fully immunized by the Army’s Dec. 8 deadline.

Army officials said Wednesday that, as of Nov. 19, 95% of active-duty soldiers had received at least one dose, including 92% who are fully vaccinated.

The service has approved two permanent medical exemptions and no religious exemptions, Army spokesman Lt. Col. Terence Kelley told Military.com.

Army leadership said last week that soldiers who refuse the vaccine may stay in the service under certain circumstances but will be barred from reenlistment, promotion and school opportunities.

In a memo to the force, Army Secretary Christine Wormuth said soldiers would not be dismissed from the service, but their records would be "flagged," signaling that they are non-promotable.

Navy officials have said they will separate all sailors who refuse the vaccines and do not have an exemption. But Del Toro said last week that all will be counseled and given a chance to comply before being forced out of the military.

"We're going to … offer them an opportunity to change their mind," he said during a call with reporters.

As of Wednesday, there have been 253,989 cases of COVID-19 among U.S. service members and 75 deaths, according to the Defense Department.

By Amelia Pollard (Bloomberg) –The journey of Tonka’s Mighty Dump Truck toy from its Asian factory to U.S. stores offers a window into what it takes for a small toymaker to survive 2021.

What used to cost $2 to transport the classic toy by boat from China to Los Angeles is now up to $12, representing half the sticker price. That’s eating into profits for its manufacturer, Basic Fun, a Florida-based midsize firm that’s been preparing for battle this holiday season.

“We’re not getting a break at a single step,” Chief Executive Officer Jay Foreman said in an interview. “We have to monitor every single stage of the supply chain.”

The final months of the year are crucial for toymakers of all sizes, but smaller companies are staring down an existential crisis in navigating the world’s worst traffic jam.

Basic Fun — also known for Lincoln Logs and K’Nex building sets as well as Care Bears — created two “war rooms” in Hong Kong and Boca Raton, Florida, where 18 employees are working in shifts around the clock. The teams are coordinating every step of the once humdrum logistics process, from picking up orders at a factory in China to ensuring they make it out of warehouses in Los Angeles and New Jersey to retailers’ shelves.

This year, each hub is moving with extra urgency to secure spots on containers and ships that make the journey across the Pacific over the course of 15 to 20 days. The teams haven’t received all their shipments into the U.S. yet and are still pulling containers out of the yard to fill orders.

It’s a daunting task in normal times, but especially heightened this year as the $37 billion industry — as measured by market research firm NPD Group — experiences some of the greatest demand for toys in modern history. In September, the dollar amount of toys, games and sporting-goods imports to the U.S. was only eclipsed by shipments of pharmaceuticals and cellphones in the consumer goods category. Playtime heavyweights Hasbro Inc. and Mattel Inc. say they’ll be able to keep up, thanks in part to their ability to expand shipping capacity and secure access to additional ports.

Foreman doesn’t have those strings to pull. Control of about 80% of the global shipping market and 95% of the transpacific routes is concentrated in the hands of nine companies based mainly in Asia and Europe, according to S&P Global Platts, and they exert near-total control over the prices. It currently costs $10,000 to $15,000 in the spot market to ship a 40-foot container from China to the West Coast, more than five times the pre-pandemic rate.

“It’s sort of like when it rains in New York City and you’re trying to get a cab or an Uber. The rates go up and it’s harder to get them,” Foreman said. “But if you’re Goldman Sachs, and you have an account with a black car company, you can call them and they’ll be there.”

Congestion at U.S. ports isn’t easing up, forcing some like Connie Gee, a logistics specialist for San Francisco-based University Games, to change tactics. She’s pivoted shipments from Los Angeles to Prince Rupert and Vancouver in Canada because these ports are less likely to experience delays, even though it takes as much as five days longer to get the toys to the company’s distribution center in Memphis, Tennessee. And since University Games is struggling to find workers in the tight U.S. labor market, the company’s president, Bob Moog, flew his entire sales team out there in mid-November to label packages by hand.

The manufacturing sector has been struggling in China, where 83% of toys globally are made, according to Richard Gottlieb, founder and chief executive officer of the consultancy firm Global Toy Experts. Local conditions are worsening amid higher price components, according to the industry’s latest reading. Labor shortages aren’t helping either, and inventory levels and delivery times continue to deteriorate.

“Christmas is not going to move to January,” said Joel Berger, executive vice president of Tara Toy Corp. in Long Island, New York. “It’s sort of like a cliff. You’ve got to get this done before you fall off.”

But this holiday season might be different. Basic Fun’s Foreman said he anticipates a “huge” January as customers cash in on gift cards and try to snag whatever they couldn’t get by the 25th. His staff will be working 24/7 through the end of the year to get everything shipped or received before 2022.

China’s Covid Zero Policy Towards Seafarers Escalates Supply Chain Crisis

By K. Oanh Ha and Jack Wittels (Bloomberg) —China’s increasingly extreme Covid Zero policies are standing in the way of a full recovery for the shipping industry and prolonging a crisis that’s snarled ports and emptied shelves worldwide.

In its attempts to keep the virus out, China’s continued to prohibit crew changes for foreign crew and recently imposed as much as a seven-week mandatory quarantine for returning Chinese seafarers. Even vessels that have refreshed their crew elsewhere have to wait two weeks before they’re allowed to port in China.

To comply, shipowners and managers have had to reroute ships, delaying shipments and crew changes, adding to the supply chain crisis. “China’s restrictions cause knock-on effects,” said Guy Platten, the secretary general of the International Chamber of Shipping, which represents shipowners and operators. “Any restrictions to ship operations have an accumulative impact on the supply chain and cause real disruptions.”

The world’s biggest exporter, China is a key hub for the shipping industry. It is also the last country to hew to a Covid Zero policy, with increasingly radical measures. In recent weeks, authorities locked in 34,000 people at Shanghai Disneyland for mandatory testing. A Beijing school held primary school children overnight after a teacher tested positive. The definition of “close contact” now extends to people separated by as much as a kilometer.

Around the world, factories, shipping and consumers are still adjusting for a pandemic that’s not going anywhere. Supply shortages are showing signs of easing in the U.S. but worsening in the U.K. Some ports in Asia are getting less congested, but in California, loaded vessels are still piling up.

Ship managers and operators are calling for China to relax its restrictions and governments to prioritize seafarers and shipping, or risk continued disruptions that may go deeper as mariners bear the brunt of the toll.

The latest restrictions at China’s ports target Chinese crew, requiring them to quarantine for three weeks before their return to China, then another two weeks at the port of arrival, and two more weeks in their province before they can reunite with their families, according to Terence Zhao, managing director of Singhai Marine Services, one of the biggest Chinese crew supply agents.

“The ports’ main focus is on quarantine and health matters,” he said at an online industry forum Monday. “The regulations change very often, depending on the local Covid situation.”

Even seafarers with emergency medical needs aren’t allowed to get care in China, ship managers said. An Anglo Eastern chief officer with a severe tooth abscess couldn’t get off his vessel for treatment. He had to wait until the ship got to South Korea before he could see a dentist.

“China is a major issue,” said Bjorn Hojgaard, chief executive officer of ship manager Anglo-Eastern Univan Group and the chairman of the Hong Kong Shipowners Association. “They are doing a good job at keeping Covid at bay but at the cost of not letting seafarers in–even Chinese seafarers sometimes can’t get back into China.”

Operating in China has become challenging even for the biggest operators, including Cargill Inc.

“We’ve had vessels that ran into demurrage” — late fees — “we’ve had instances where we had to deviate, either before we call China, or after,” said Eman Abdalla, global operations & supply chain director at Cargill. “There are instances where the delays are within hours, but there are also instances where the delays could go on to days.”

Euronav NV, one of the world’s largest owners of oil supertankers, has spent an estimated $6 million handling disruptions related to the crew change crisis, including the likes of deviations, quarantines and higher travel costs.

“In the past, it was pretty nice to do crew rotation when we were in China,” said Chief Executive Officer Hugo De Stoop. “And now basically it’s not possible.”

The industry has largely absorbed the extra costs with some of the highest container rates on record due to demand, capacity constraints and port congestion. At $9,146 per 40-foot container at the end of the week on Nov. 18, rates have soared six-fold compared to the five-year average through 2019. Rates for oil tankers and bulk carriers have not risen nearly as much.

==US Navy Opens Seabee Base To Help Relieve LA Port Congestion

The U.S. Navy is opening facilities in Port Hueneme, which is located less than 100 miles north of the Port of Los Angeles. The opening is in direct support of decreasing port congestion. Port Hueneme is the West Coast homeport of the Navy’s famous construction battalion, the Seabees.

A standing Joint Use Agreement with Naval Base Ventura County (NBVC) and the Oxnard Harbor District (OHD), allows the Navy to support commercial supply chain logistics when activated for emergency use.

“Naval Base Ventura County recently welcomed a large cargo vessel,” said Daniel J. Herrera, assistant program director for port operations, NBVC. “Ports of America already off-loaded a large number of forty-foot containers into lot 22 onboard Port Hueneme which is merchandise expected to have direct impact with helping to support holiday supply demands.”

The Navy entered into the joint agreement with local authorities in 2002, authorizing commercial use of a wharf at the Naval base plus approximately 21 acres of contiguous land, two buildings, and if available, overflow land.

Jason Hodge, President of the OHD which owns the Port of Hueneme (POH), stated that commercial business at the port has increased significantly over the past year and when it comes to moving cargo, the Port’s flexible “Can Do” attitude is similar to the Navy Seabees’ “Can Do” motto of completing a task no matter the condition or situation.

“The Port appreciates the partnership with NBVC and locating additional space to accommodate excess holiday shipments coming through the Port,” Hodge said. “We are delighted to come together to meet the challenge of providing a solution to help keep essential goods moving. Our long-standing history of partnership continues with this call-to-action to address the national supply chain challenge.”

The US Navy has not mentioned opening other ports in California but approximately 100 miles south is US Naval Base San Diego which is the second largest surface ship base operated by the United States Navy. There is also no mention of the Navy activating the US Maritime Administration’s (MARAD) extensive Ready Reserve Fleet or US Navy Military Sealift Command ships capable of moving containers up and down the coast in a process called short sea shipping.

“The opening of NBVC is a small step. The navy is making just one berth available for ships with gear to offload,” said maritime expert Dr. Sal Mercogliano, who suggested activating the ready reserve fleet last month in a YouTube segment titled How to Clear the Ports of Los Angeles. “The problem is that the ports of LA/LB offloaded less cargo in October than they did last October. The number of containers dwelling is not falling at any consistent rate and the number of ships waiting to offload is at record levels. The use of Hueneme is a step, but not enough to clear the backlog.”
