Louisiana judge convicted of sex crimes against underage girls

A Louisiana judge has been convicted of several sex crimes involving three underage girls, including one who had been best friends with one of his daughters, according to a report.

A jury found St. John Parish Judge Jeff Perilloux, 53, guilty Saturday of three felony counts of indecent behavior with a juvenile, NOLA.com reported. Ad hoc Judge Dennis Waldron also found him guilty of a fourth count of misdemeanor sexual battery.

Two of the three felony charges stemmed from Perilloux’s actions against a 15-year-old girl who had been one of his daughters’ best friends, according to the news outlet.

She testified that the pervy jurist committed the crimes during two back massages, in May and June 2017. During one, he reached over and held a hand over her breast for about 20 seconds, she testified.

A 14-year-old girl told investigators that in June 2017, Perilloux rubbed sunscreen all over her body against her wishes after she had told him repeatedly that she could do it herself.

The girl told police that he had grabbed her shorts while he held a running water hose that he tried shoving down her shorts — though she testified that she couldn’t remember whether he’d actually touched her shorts.

The sexual battery conviction stems from the testimony of a woman who said she was 17 when Perilloux, standing in his underwear with no shirt in his kitchen, applied Vick’s VapoRub across her breasts after she had applied it to her throat, according to NOLA.com.

Censoring Scott Atlas Should Be The Last Straw For Big Tech's Censorship

Google-owned YouTube removed video of a presidential advisor discussing COVID-19 lockdowns. Anti-trust action and legislation must cap this abuse of power.

If the coronavirus pandemic has proved anything it is that most Americans and their leaders are more concerned with their safety than with preserving their freedom.

Six months into the coronavirus era, most, though not all Americans may be willing to continue granting extraordinary powers to the government to deal with a threat to public safety. But the questions that they should also be considering is whether that same deference should be extended to big tech companies to censor discourse about the pandemic and what, if anything, can they do to prevent international monopolies from shutting down free speech.

The latest instance of censorship is so extreme and arbitrary that concern over the willingness of companies like Google, YouTube, Facebook, and Twitter to shut down speech they don’t like ought to transcend the political differences that divide Americans. Or at least it would if the question of what can or cannot be said about the pandemic wasn’t bound up with partisan politics and the presidential election.

Regardless of whether you agree with Dr. Scott Atlas about whether the cost in terms of lives lost and damage down to the country of lockdowns justifies them, Google’s ability to remove him from the virtual public square ought to make reining the power of big tech monopolies a national priority….

Fort Worth Texas police chief arrested, accused in the sexual abuse of a child

The police chief in Hamilton was arrested over the weekend and faces a charge of sexually abusing a child, according to an official with the Texas Department of Public Safety.

Anthony “Tony” Yocham was taken into custody Saturday by the Texas Rangers, and he was later released out of the Johnson County Jail in Cleburne after posting $500,000 bond. Hamilton is about 100 miles southwest of Fort Worth.

Yocham, who lost the Republican nomination for Somervell County sheriff, in April faces a charge of continuous sexual abuse of a child, according to KXXV-TV.

Authorities did not provide any details on the alleged crime which was reported in Somervell County. The county is near the city of Hamilton, where Yocham is the police chief.

Detectives with the Somervell County Sheriff’s Office asked the Texas Rangers to investigate the allegation, said Texas DPS Lt. Lonny Haschel in a Monday email to the Fort Worth Star-Telegram.

This same CEO, whose company hosts APD’s connectabq.org website, was at the center of a massive National Security Agency (NSA) intelligence gathering operation in violation of the Foreign Intelligence Surveillance Act, according to BlueLeaks documents leaked by the hacking group Anonymous in June 2020 and documents leaked by Edward Snowden in 2013.

As we reported previously, since 2006 APD has operated a retail and property crime intelligence gathering operation called ARAPA, in which private sector retailers upload information to a secure police website. APD has said publicly that this operation is small in scope and that access to the data is limited to a small number of local law enforcement agencies. But documents released as part of the BlueLeaks hack show that ARAPA is much larger than APD claims, collecting information unrelated to retail and property crime, and giving intelligence access to hundreds of law enforcement officers, including federal agents from various Department of Homeland Security directorates—including ICE—in an apparent violation of the City’s sanctuary policy. President Donald Trump’s campaign is scaling back its television advertising spending and in some cases abandoning it altogether for now in key states, facing a cash crunch brought on by huge investments in staff and operations.

From May 12 until June 29, 1865, a military commission sitting in Washington City (as Washington, D.C., was then known) heard evidence against seven men and one woman. All were charged with conspiring to murder President Abraham Lincoln. All were found guilty. Four were sentenced to hang (and were executed on July 7) and three were sentenced to life imprisonment; only one defendant received a relatively light punishment—six years in jail.

But while there was sufficient evidence to find them guilty—and almost all historians today believe that the eight defendants were guilty of conspiring to harm the president, albeit to varying degrees—the legal significance of their trial by military commission was that the proceedings were unfair.

Trial by military commission—rather than in a civilian court—was assured after U.S. Attorney General James Speed issued a legal opinion stating that the conspirators not only could be, but must be, tried by a military commission. This is what Secretary of War Edwin Stanton and the Army’s judge advocate general, Brig. Gen. Joseph Holt, wanted because of the many advantages that a commission offered the prosecution.

First, and most importantly, there was no right to appeal the verdict of the military commission. President Andrew Johnson appointed the members of the commission and directed them to try the case. Johnson then approved the findings and the sentence.

Since the Supreme Court had ruled in 1864 in Ex parte Vallandigham that federal courts had no jurisdiction over military commissions (because they were not “courts”), there was no danger that the conspirators could escape justice by appealing to an Article III judge.

Second, a majority vote was all that was needed to convict the defendants (as opposed to a unanimous verdict in civilian court). Additionally, only two-thirds of the commission members had to vote yes for the death penalty to be imposed.

Third, there was no presumption of innocence and very relaxed rules of evidence. Generally, the prosecution was permitted to introduce any evidence that it determined was relevant and probative to the guilt of the eight conspirators—including hearsay testimony.

Fourth, Judge Advocate General Holt and his assistant prosecutor, John A. Bingham, participated in deliberations with the nine Union officers who sat as the fact-finders in the case. While these two prosecutors did not vote, they did argue for findings of guilty for all the defendants and suggested that hanging was the only proper sentence for all the conspirators. And since only one of the nine Union officers voting was a lawyer or had any legal training, what Holt and Bingham said during these deliberations almost certainly carried considerable weight. The defense counsel, of course, were excluded from participating in the commission’s deliberations.

Fifth, Holt (probably in concert with Stanton) personally selected the nine Union officers—seven generals and two colonels—who served as jurors. All were “shooting” officers who had seen combat and had little sympathy for the South or the Confederacy. As Lincoln had approved their commissions, they almost certainly felt a strong sense of loyalty to him and the Union.

A final important point: There was little doubt that the government could not achieve the results it wanted—a swift verdict of guilty and hanging for the defendants—if it tried them in civilian court. There were few Union men in Washington City; they were in the Army. The white men who would have heard the evidence against the conspirators would almost certainly have been Southerners and had Confederate sympathies. The possibility of jury nullification was too high to take the risk.

Today, the unfairness of the military commission proceedings continues to overshadow the question of guilt or innocence—demonstrating once again that the process is as important as the results in a criminal trial.
