Devin Nunes keeping House Intel 'in the dark' about push for Russia inquiry docs from DOJ: Democrat

 

House Intelligence Committee Chairman Devin Nunes has kept members of his panel "in the dark" as he seeks classified information regarding special counsel Robert Mueller’s Russia investigation from the Justice Department, said one of the committee's Democrats on Sunday.

 

During an interview on MSNBC, Rep. Joaquin Castro, D-Texas, said Nunes "literally has not explained to the committee either what he's looking for or the reason that he's looking for this information."

 

"He did this, I guess, about a week ago when all of us were back home in our districts. And since then, has not come in front of the committee and laid out his case about what this information is and why he needs it. So not only has he kept the American people in the dark, but he's also kept the committee in the dark," Castro said, adding the Republican has "done everything he can" to prop up President Trump at the expense of congressional oversight of the executive branch.

 

Last week, Nunes subpoenaed the Justice Department after the agency did not respond to a classified letter he sent late last month with his request regarding Mueller’s inquiry. The subpoena reportedly demanded documents related to a U.S. citizen who contributed to the probe. However, the Justice Department — backed by the White House — told Nunes in a follow-up letter that turning over the requested information would be a risk to national security.

 

Tensions between Nunes and the DOJ appeared to cool after a classified briefing that included House Oversight Committee Chairman Trey Gowdy, R-S.C., and officials from the Office of the Director of National Intelligence, DOJ, and FBI. Noting they had a "productive discussion," Nunes and Gowdy wrote, "The officials committed to holding further discussions of these matters, and we look forward to continuing our dialogue next week to satisfy the Committee’s request.”

 

A spokesman for Nunes did not return a request for comment in response to Castro, but the chairman has received support from House Speaker Paul Ryan, R-Wis., who described the request to obtain documents related to the FBI’s use of the FISA surveillance law in connection with the Russia investigation as being "wholly appropriate."

Donald Trump’s move to ditch the nuclear deal has infuriated Washington’s allies in Europe as well as China and Russia

MOSCOW: Iran’s foreign minister visits Moscow on Monday as Russia tries to keep the Iran nuclear deal alive in the wake of Washington’s pull-out, pushing it into rare cooperation with Europe.

Mohammad Javad Zarif’s diplomatic tour took him to Beijing at the weekend and will see him visit Brussels later in the week, as the international backers of the 2015 accord scrabble to save it.

After meeting his Chinese counterpart on Sunday, Zarif said he was hopeful of forging a “clear future design” for the accord.

Russian President Vladimir Putin has already spoken with Germany’s Angela Merkel and Turkey’s Recep Tayyip Erdogan about the efforts, after voicing his “deep concern” over US President’s Donald Trump’s decision.

Trump’s move to ditch the nuclear deal has infuriated Washington’s allies in Europe as well as China and Russia.

“(European) cooperation with Russia, which until recently seemed impossible because of the Skripal (spy poisoning) case, with the expulsion of diplomats and the reduction of contact, is now receiving a fresh boost,” consultant Andrei Baklitski of the PIR Center NGO said.

“The Europeans, after the withdrawal of the US from the deal, have found themselves forced to save the Joint Cooperative Plan of Action themselves,” he added.

Moscow would have to play a key role in ensuring Tehran does not resume its nuclear program, he said.

On Sunday US Secretary of State Mike Pompeo said Washington still wants to work with Europe to counter Iran’s “malign behavior.”

But while Pompeo talked up the prospect of renewed coordination with America’s allies, another top aide reminded Europe its companies could face sanctions if they continue to do business with the Middle Eastern power.

Russian efforts to save the accord will boost its role as a power-player in the Middle East, after its intervention on the side of Bashar Assad’s regime in Syria.

This, along with its diplomatic moves to orchestrate an end to the conflict, has put Moscow at loggerheads with the US and Europe, which have intervened against the regime.

Zarif will meet his Russian counterpart Sergei Lavrov, according to Iran’s foreign ministry.

Merkel is set to visit Russia and meet Putin for a working visit in the Black Sea resort of Sochi on Friday, while French President Emmanuel Macron will be in Saint Petersburg later in the month for an economic forum.

Putin will also meet Yukiya Amano, the head of the International Atomic Energy Agency in Sochi, presidential aide Yury Ushakov said.

Iran has said it is preparing to resume “industrial-scale” uranium enrichment “without any restrictions” unless Europe can provide solid guarantees that it can maintain trade ties despite renewed US sanctions.

After long negotiations, Iran had agreed in July 2015 to freeze its nuclear program in return for the lifting of punishing international sanctions.

The deal was negotiated between Iran and the five permanent members of the UN Security Council — Britain, China, France, Russia and the United States — plus Germany.

Russia and Iran once had difficult relations but have seen ties improve since the end of the Cold War.

While Tehran was shunned by the international community in the 1990s, Moscow agreed to resume the construction of the Bushehr Iranian nuclear plant that Germany had abandoned.

Russia and Iran also sought to strengthen their business ties long before the 2015 agreement, despite international sanctions in place.

Analysts have suggested Russia could benefit economically from the US pull-out, as it is less exposed to the consequences of renewed sanctions than Europe.

Congress wants to cancel secrecy of missile tests

 

Members of Congress have gone on record saying they want to cancel the secrecy of missiles tests, reports Joseph Farah’s G2 Bulletin.

 

The sentiment appears in a new National Defense Authorization Bill for 2019 on which the Subcommittee on Strategic Forces recently met.

 

“This section would also require that [officials] make the quarter and fiscal year for execution of planned flight tests unclassified,” it explains.

 

The section is titled “Improvements to Research and Development and Acquisition Processes of Missile Defense Agency.”

 

Steven Aftergood of the Federation of American Scientists explained the longtime practice has been to disclose information publicly about planned flight tests of ballistic missile defense systems.

 

But this year the Department of Defense said that information was being classified.

 

The subcommittee’s markup of the proposed spending plan suggested the secrecy was unacceptable, “at least with respect to the test schedule,” the report said.

Is Neil Gorsuch slowing down the Supreme Court?

 

Supreme Court is turning its blockbuster docket of cases into a cliffhanger, as it's been slow to release decisions this year and will likely cram the major cases into June, and some say Justice Neil Gorsuch might be part of the reason why.

 

When the justices meet for their public nonargument session Monday fresh from a two-week break, they’ll be returning to the court having decided 23 cases — the fewest cases decided by this point in the term since 1900, according to Empirical SCOTUS.

 

Adam Feldman, who is behind Empirical SCOTUS, attributes the slow pace in part to the acclimation of Gorsuch to the Supreme Court, who was sworn in as the newest justice last year, and a certain level of disagreement among the justices.

 

This term, Feldman found, there have been seven five-vote majorities in the first 23 signed decisions, the most five-vote majorities the Roberts Court has issued at this point in the term.

 

Dan Epps, an associate law professor at Washington University School of Law and co-host of the Supreme Court podcast “First Mondays,” agreed that Gorsuch’s presence on the bench could be playing a role in the court’s pace of releasing opinions.

 

“It does seem like it’s starting to become clear that Justice Gorsuch’s penchant to write is partly probably explaining part of it,” he said. “I find it hard to believe it’s explaining all of it, because he’s only one person, but we are starting to see lots and lots of separate opinions by him.”

 

Gorsuch’s desire to write separate opinions can “slow things down,” Epps said, since it creates another opinion for the other eight justices to respond to.

 

But he also noted that the number of high-profile and divisive cases the court heard early in the term could also be a driving force behind the Supreme Court’s speed.

 

The first case the justices heard this term, for example, examines whether class action waivers in employee agreements are lawful. The justices have yet to hand down a decision in that case, Epic Systems Corp. v. Lewis.

 

The Supreme Court also heard arguments in October in a partisan gerrymandering case in which the lines of Wisconsin’s legislative districts were challenged. The case marked the first time since 2004 the justices will weigh in on the issue.

 

They heard a second partisan gerrymandering case in March addressing a single congressional district in Maryland. During those arguments, the justices didn’t seem close to finding agreement on a way to address partisanship in redistricting.

 

“People are just putting a lot of energy into those and that’s sucking up a lot of the energy that would otherwise be getting out the more trivial opinions,” Epps said.

But while much attention has been paid to how slowly the court seems to be moving, Pratik Shah, the co-head of the Supreme Court and Appellate Practice at Akin and Gump, doesn’t believe the court’s pace this term is indicative of a sudden change.

 

“I don’t think this is some seismic shift or some big anomaly this term,” said Shah, who has argued 14 cases before the justices. “If you look at the steady trend, the court has been taking fewer and fewer cases, and with that, they’ve been taking more and more time to issue the decisions. It seems their trajectory has been fewer decisions and spending more time on each decision.”

 

Feldman found that prior to this term, the slowest pace for the Supreme Court with issuing opinions was last term, which began in October 2016. That term, though, the court had eight justices following Antonin Scalia’s death, which helped explain the “low output and slow pace,” Feldman wrote.

 

Like Epps, Shah said this term has been replete with high-profile cases, which “are naturally going to spawn multiple opinions.”

 

But he also pointed to the relatively light calendar for the court at the start of the term, a change from the early days of the Roberts Court when Chief Justice John Roberts would “frontload” the term with more cases in October and November. Doing that, Shah said, allowed the court to hear fewer cases in March and April and devote more time to writing opinions.

 

This past October and November, for example, the justices heard arguments in a total of 15 cases, fewer than the number heard in the terms beginning in October 2016 and October 2015.

 

“It was a combination of fewer cases in October and November, and the cases were hard, polarizing cases,” Shah said.

 

The Supreme Court wrapped its argument calendar for the term in April, ending with the case challenging Trump’s travel ban.

 

Now, the justices will devote the remainder of the term of reviewing petitions and writing opinions for the 39 cases that remain on its docket.

I had to work my way through hostility that I felt towards the forced multi cultural hell that my neighborhood has become over the last 10 years to find a place of understanding…. I felt frustrations with the large number of south American migrants that were being crowded in the local nearby farming communities around us and causing our local culture and heritage to disappear, and the large population of blacks with with lots of domestic confusion and contention among their family units who begin to move into our neighborhood via the section 8 housing that was constructed about 3 minutes up the road from us….I really did not understand why all these different groups with their various cultures and ways of living were all coming together in this way. It seemed so forced and unnatural, as people tend to choose to live among those like themselves when given the choice… It was after reading culture of critique I began to see all the tension and division was intentional…(((the powers that be))) wanted us all to be forced in this small community together with the desire to create this hostile low trust environment where none of us from any of this trail mix of groups is happy. A typical rundown situation in baseball showing a baserunner for the Texas Rangers as he attempts to evade the Chicago Cubs defense.

A rundown, informally known as a pickle or the hotbox, is a situation in the game of baseball that occurs when the baserunner is stranded between two bases and is in jeopardy of being tagged out. Some members of the House Armed Services Committee want the Pentagon’s Missile Defense Agency to return to its previous practice of publicly disclosing information about planned flight tests of ballistic missile defense (BMD) systems and components.

 

Earlier this year, the Department of Defense said that information about BMD flight tests, objectives and schedules was now classified, even though such information had routinely been made public in the past. (DOD Classifies Missile Defense Flight Test Plans, Secrecy News, March 5, 2018).

 

But in their initial markup of the FY2019 National Defense Authorization Act, members of the House Armed Services Strategic Forces Subcommittee said that the new secrecy was unacceptable, at least with respect to the test schedule.

 

They directed that “Together with the release of each integrated master test plan of the Missile Defense Agency, the Director of the Missile Defense Agency shall make publicly available a version of each such plan that identifies the fiscal year and the fiscal quarter in which events under the plan will occur.”

 

The pending provision would “require that MDA make the quarter and fiscal year for execution of planned flight tests unclassified.” (h/t Kingston Reif)

 

Aside from the merits of the House language, it represents a noteworthy legislative intervention in national security classification policy.

 

Under other circumstances, the executive branch might consider it an intolerable infringement on its authority for Congress to require information to be unclassified over and against an agency’s own judgment or preference.

 

But in the context of the context of the ambitious and contentious defense authorization act — which among other things would establish a new U.S. Space Command under U.S. Strategic Command — this particular dispute over classification authority recedes into comparative insignificance.

 

Somewhat relatedly, the Joint Chiefs of Staff have updated DoD doctrine on space operations, with an expanded discussion of natural and man-made threats.

 

“Our adversaries’ progress in space technology not only threatens the space environment and our space assets but could potentially deny us an advantage if we lose space superiority.”
