Oct 23 - The husband of Halyna Hutchins, the cinematographer who was fatally shot by actor Alec Baldwin with a prop gun on Thursday, is a corporate lawyer in Latham & Watkins' Los Angeles office.

Matt Hutchins joined Latham as an associate this year. Earlier he was an in-house lawyer at an entertainment company and practiced at Kirkland & Ellis and Skadden, Arps, Slate, Meagher & Flom, according to his LinkedIn profile.

"Our loss is enormous," Hutchins said on Twitter late Friday. Hutchins told news outlets earlier in the day that he had spoken with Baldwin and said the actor was supportive. He could not be immediately reached for comment. A Latham spokesperson declined to comment.

Halyna Hutchins was killed when Baldwin discharged a prop firearm on the set of his Western movie "Rust" in New Mexico. The Santa Fe Sheriff's Department said it is investigating the incident, which also left the film's director, Joel Souza, injured.

Baldwin posted on social media Friday that he was in shock, writing, "My heart is broken for her husband, their son, and all who knew and loved Halyna."

Hutchins, 42, who was originally from Ukraine and grew up on a Soviet military base in the Arctic Circle, once worked as an investigative reporter in Europe, according to her website.

She graduated from the American Film Institute in 2015 and was selected as one of American Cinematographer's Rising Stars of 2019, according to her website biography.

The infernal danger is that Washington and London are pushing Europe and the world towards the abyss of a nuclear with Russia.

The Anglo-Americans are running a modern-day reworking of Operation Overlord, the June 1944 military invasion plan billed to liberate Western Europe from Nazi Germany. This week, U.S. President Joe Biden showed off his overlord status when he arrogantly spoke for German Chancellor Olaf Scholz at a White House press conference. Biden was asked about the fate of the Nord Stream 2 gas pipeline from Russia to Germany in the hypothetical event of an invasion of Ukraine by Russia. Biden didn’t skip a beat to consult with the German leader. He peremptorily asserted the gas project would be terminated.

“There will be no longer a Nord Stream 2,” said Biden without hesitation. “We will bring an end to it.”

The American president was asked how this could be done given that the functioning of the Nord Stream 2 pipeline is nominally under the control of Germany, not the United States. “We will — I promise you, we’ll be able to do it,” asserted Biden without so much as a hint of seeking any kind of agreement from the German chancellor.

The assuredness of Washington’s presumed ability to over-ride European sovereignty was a revealing and disturbing display of American imperial arrogance.

It was also an excruciating display of American contempt for supposed European “allies”. Scholz, Germany, Europe, was made to look like a nonentity by Biden. Later press reports indicated that too.

Washington and London have led the ramping up of geopolitical tensions with relentless accusations that Russia is about to invade Ukraine and jeopardize European security. Cawthorn’s mere advocacy of a pro-Trump position during the aftermath of the hotly contested 2020 presidential election does not constitute participating in an insurrection, something that can trigger a constitutional bar that prevents the insurrectionist from seeking elective office, Cawthorn attorney James Bopp Jr. told The Epoch Times in an interview Feb. 14. Cawthorn, who had been sworn in as a federal lawmaker only days before, was already present in the U.S. House of Representatives fulfilling his constitutional duties before the disturbance broke out on that day 13 months ago, and his activities there did not contribute to the hours-long delay of the congressional certification of the election.

Cawthorn, 26, who was elected in November 2020, describes himself as a Christian and constitutional conservative, and is considered to be a rising star in the conservative movement. The North Carolina State Board of Elections is not currently preventing the incumbent first-term congressman from running again, but claimed in a Feb. 7 filing in federal court that it has the power to do so under Section 3 of the Fourteenth Amendment to the U.S. Constitution. The relevant part of that constitutional provision states: “No person shall be a … Representative in Congress … who, having previously taken an oath, as a member of Congress … to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same …”

The board’s claim appears in a filing in Madison v. Cawthorn, court file 5:22-cv-50. The legal complaint was filed Jan. 31 (pdf) in U.S. District Court for the Eastern District of North Carolina. The lead defendant, Damon Circosta, chairman of the North Carolina State Board of Elections, is being sued in his official capacity. Cawthorn sued in response to several challenges that had filed against his candidacy. In the document, called the State Board Defendants’ Response to Plaintiff’s Motion for Preliminary Injunction, the board stated that it “polices candidate qualifications prior to the elections” and that states “have long enforced age and residency requirements, without question and with very few if any legal challenges.” The state also “has the same authority to police which candidates should, or should not, be disqualified per Section 3 of the Fourteenth Amendment.” Bopp disputed this claim and added that those state residents who are challenging Cawthorn’s reelection bid have no credible evidence that he engaged in insurrection.

In North Carolina, the next statewide primary election is scheduled for May 17. The deadline for candidates to file to run is March 4.

“My prediction for 2022: Before the midterm election, we will have a serious discussion about whether individual Republican House Members are disqualified by Section 3 of the 14th Amendment from serving in Congress[,]” Elias tweeted. “We may even see litigation.” “It seems quite likely that one or more Republican members of Congress will be subject to this disqualification, and it is important that we start to identify them now,” Elias added three weeks later at his Democracy Docket website.

Prince Andrew settles sex abuse lawsuit

The financial terms of the settlement between the British royal and his accuser Virginia Giuffre have not been revealed

Prince Andrew, the second son of Queen Elizabeth II, has reached a settlement with Virginia Giuffre, who had accused the senior British royal of sexually abusing her when she was a teenager, according to a court filing in New York on Tuesday.

The 61-year-old Duke of York agreed to pay a confidential financial sum to Giuffre, both parties announced in a joint statement attached to the court document. Andrew will also make a "substantial donation" to a charity that supports "victims' rights."

The settlement comes weeks before Prince Andrew was set to be required to participate in a deposition under oath, during which he would have been questioned by Giuffre's lawyers about her accusations. The joint statement from Prince Andrew and Giuffre reportedly says that the British royal does not admit to any of the accusations against him.

The court documents also show the prince claiming that he "regrets his association" with convicted billionaire sex offender Jeffrey Epstein. "Prince Andrew has never intended to malign Ms Giuffre's character, and he accepts that she has suffered both as an established victim of abuse and as a result of unfair public attacks," the linked statement said, adding that the Briton "regrets his association with Epstein, and commends the bravery of Ms Giuffre and other survivors in standing up for themselves and others."

“He pledges to demonstrate his regret for his association with Epstein by supporting the fight against the evils of sex trafficking, and by supporting its victims,” the filing adds.

Andrew’s legal team had tried to get the lawsuit thrown out on a technicality by claiming a previous deal between Giuffre and Epstein meant that she was barred from pursuing a case against the royal. However, US District Judge Lewis A. Kaplan rejected this, allowing the case to proceed to trial. Following the court's refusal to dismiss the suit, Buckingham Palace announced that Prince Andrew had returned his "military affiliations and royal patronages" to Queen Elizabeth and would "continue not to undertake any public duties."

Invoking the Emergencies Act is a shocking admission of failure

‘Protests and blockades could and should already have been resolved by good intelligence, smart planning, and effective coordination among police forces.’

Many will cheer the Trudeau government’s decision to invoke the Emergencies Act to deal with border blockades and the occupation of Ottawa. They’re fed up with the protests and that’s entirely understandable.

But we will not join the cheering. Federal emergency powers may now be necessary as a last resort, but going that route is a shocking admission of failure by governments at all levels.

This was and remains a policing issue. Right from the start, even before the truckers’ convoy rolled into Ottawa, there were laws on the books adequate to deal with this.

The situation could and should already have been resolved by good intelligence, smart planning, and effective coordination among police forces.

But in Ottawa, in particular, we’ve seen none of that over the past two and a half weeks. Instead, we’ve seen dithering and buck-passing all round. Indeed, until a couple of days ago the federal government’s position was that local authorities had “all the tools and resources they need” to deal with the occupation.

But now, all of a sudden, the federal government is taking the extraordinary measure of invoking the Emergencies Act for the first time since the law was passed in 1988. Even if those powers will be, as Prime Minister Justin Trudeau said on Monday, time-limited, geographically targeted, and don’t involve actually bringing in the military.

So what changed? Listening to the prime minister, it wasn’t entirely clear. He said the occupation and border blockades are illegal and economically damaging; that’s true, but it was true last week and the week before as well.

Indeed, effective and coordinated police action ended the blockade of the Ambassador Bridge over the weekend — without any need for federal emergency powers. And on Monday, RCMP arrested 13 people near the border crossing in Coutts, Alta., and seized weapons, also without those powers.

The problem was not a lack of powers or resources. Once authorities decided to act, they were effective.

But in Ottawa, the failure of local leadership has been total. Ottawa police botched the situation from the get-go; the chief almost immediately admitted his force was outmatched and helpless.

By the weekend, even the federal government (through Emergency Preparedness Minister Bill Blair) said the Ottawa police’s paralysis was “inexplicable.” And local people were taking matters in their own hands by organizing counter-protests.

So how will invoking the Emergencies Act actually change the situation on the ground? Ministers mentioned giving police powers to declare prohibited zones for protests, designating sites like border crossings as essential, allowing RCMP officers more ability to enforce municipal bylaws, and requiring some services (such as tow trucks) to put themselves at the service of authorities.

The government also announced steps to crack down on the money behind the protests, including through crowd-funding sites like GoFundMe. Trucking companies could also find their accounts frozen and their assets (including their trucks) seized. Those measures sound useful, but it’s not clear the Emergencies Act was needed to go down that road.

Now we’ll see how quickly these new powers stop the blockades and bring the occupation in Ottawa to an end.

The City of Ottawa declared a state of emergency on Feb. 6, and Ontario did the same last week. Simply invoking emergency powers is clearly no solution on its own; it all depends how those powers are used, and how effectively police bring them to bear.

Perhaps the hope is that this dramatic move will stiffen the spine of police and finally make them enforce the law. The Trudeau government should certainly hope so, because it now truly owns this crisis.

To use port knocking, a machine that wants to know another machine's address first "knocks in a pattern" e.g., send a single packet to ports A, B, C, D each in less than 5 seconds of each other, and then port E opens for 5 seconds for the first machine to then connect to and give credentials, then port F is open for it to do a DNS query on, which closes after 5 seconds.

There are current unconfirmed reports that Ukraine government websites may be experiencing a hack or cybersecurity threat. According to Russia's TASS news agency, "Ukraine's cybersecurity center says websites of the Defense Ministry, Privatbank and Oshadbank are under DDOS attack".

Others attempting to log onto Ukraine's defense ministry website have said they received a notification saying, "The site is under maintenance".

Regional pundits are reporting that "Ukraine state-controlled Centre for Strategic Communications and Information Security confirms DdoS attack against a Ukrainian bank, as well as the websites of the Ministry of Defense and the Armed Forces." Some local sources are calling it a "significant" attack.
