What a difference it would have made if the State Legislatures had another crack at looking at all of the Fraud, Abuse, and Irregularities that have been found. The Washington Post has reported that the outgoing Capitol Police Chief, Steve Sund, believes his efforts to secure the premises were undermined by a lack of concern from House and Senate security officials who answer directly to Speaker Nancy Pelosi and Senate leader Mitch McConnell. The National Pulse can also report the Washington Post’s timeline proves it was impossible for Trump speech attendees to have made it to the Capitol in time for the breach.

The admission that House and Senate security leaders failed to provide Capitol Police with resources on the day will raise questions over their role in the day’s events.

Two days before Congress was set to formalize President-elect Joe Biden’s victory, Capitol Police Chief Steven Sund was growing increasingly worried about the size of the pro-Trump crowds expected to stream into Washington in protest.

 

To be on the safe side, Sund asked House and Senate security officials for permission to request that the D.C. National Guard be placed on standby in case he needed quick backup.

 

But, Sund said Sunday, they turned him down.

 

In his first interview since pro-Trump rioters stormed the U.S. Capitol last week, Sund, who has since resigned his post, said his supervisors were reluctant to take formal steps to put the Guard on call even as police intelligence suggested that the crowd President Trump had invited to Washington to protest his defeat probably would be much larger than earlier demonstrations.

 

House Sergeant at Arms Paul Irving said he wasn’t comfortable with the β€œoptics” of formally declaring an emergency ahead of the demonstration, Sund said. Meanwhile, Senate Sergeant at Arms Michael Stenger suggested that Sund should informally seek out his Guard contacts, asking them to β€œlean forward” and be on alert in case Capitol Police needed their help.

 

Irving could not be reached for comment. A cellphone number listed in his name has not accepted messages since Wednesday. President Trump’s speech didn’t conclude until 1:11pm, and with at least a 45-minute walk between the two locations with crowd-related delays, that would put the first people from Trump’s speech at Capitol Hill no earlier than 1:56pm – a full hour and sixteen minutes after troublemakers arrived.

 

In fact, rioters who breached the perimeter would have had to leave before Trump’s speech even began (at 12pm precisely) to make it in time for the events as they are detailed by authorities.

 

The Washington Post also states: β€œSund’s outer perimeter on the Capitol’s west side was breached within 15 minutes,” meaning the Capitol was breached over an hour before Trump speech attendees could have even begun to arrive.

 

This correlates with Sund’s interview, where he admits: β€œI realized at 1pm, things aren’t going well… I’m watching my people getting slammed.”

 

Again, 1pm would have been a full 56-minutes before any Trump speech-attendees could have begun arriving, let alone breaching the perimeter and clashing with police. Downtown Washington, D.C. roads were closed. There was no way of arriving faster, let alone before the President had finished speaking.

 

At 1:09pm, still before the President had finished speaking, Sund called the Sergeants-at-arms of the House and Senate. He told them it was time to call in the National Guard. He even said he wanted an emergency declaration. Both, however, said they would β€œrun it up the chain” and get back to him.

 

At 1:50pm the Capitol itself was breached. Still before most Trump speech attendees could have arrived.

 

What happened after this point was a back and forth over hours between D.C. officials, Army officials, and Capitol police.

 

Eventually – at past 5pm – the National Guard arrived.

 

And while Sund is quoted in the Washington Post as blaming President Trump’s speech for the violence that ensued – the timeline means that makes no sense.

 

The President’s fans are not known for leaving his speeches 5 or 10 minutes in. And by the time the Capitol was breached, those who had stayed to listen to even the first 15 minutes would not have even made it there in time.

A group of establishment Republicans released a report last week claiming to make β€œThe Conservative Case that Trump Lost and Biden Won the 2020 Presidential Election.”

 

It is not news that Joe Biden won the 2020 election. The report’s strawman-slaying title is intended to suggest that concerns about the integrity of that election are without merit. But the report itself simply goes through court decisions and recounts, listing how they turned out. It focuses on questions about β€œfraud,” rather than the significant and extremely well-substantiated concerns Republican voters have about the election.

 

β€œTheir methodology obscures the vast majority of actual material to consider if one were honestly engaging the problems,” said Capital Research Center President Scott Walter. His group has documented the significant role played by Mark Zuckerberg’s private funding of government election offices, a massive issue that the report almost completely elided.

 

Other major issues were also downplayed or ignored, even as court cases and investigative reports vindicate some of those concerns. In just the last few weeks, the Wisconsin Supreme Court, for example, ruled that unsupervised ballot drop boxes and third-party ballot trafficking both violate state law.

Report co-author Thomas Griffith, a former federal judge whose enthusiastic support of Ketanji Brown Jackson was singled out by President Biden in his speech when he nominated her to the Supreme Court, told NeverTrump publication The Dispatch: β€œThe idea is that it’s written by conservatives, for conservatives. We recognize the people who are watching [Morning Joe and CNN] are probably not the people we’re primarily interested in.”

 

Paul Ryan’s former chief of staff David Hoppe, another co-author, admitted the group got much support for its project from volunteers at high-powered, inside-the-Beltway law firms. Still, corporate media accepted the group’s framing of itself as β€œconservative.” Even a cursory look at the list revealed that to be overly generous if not completely misleading.

 

Ted Olson served as former President George W. Bush’s solicitor general, but he is most well known for being the brains and muscle behind the legal campaign to redefine marriage to include same-sex couples. When President Trump sought to have his help to fight against the Russia collusion hoax that so undermined the country, Olson declined to help. He did go on television to publicly disparage the president after declining his request. Olson even tried to get Mitch McConnell to backtrack on his policy of not holding hearings for Justice Antonin Scalia’s replacement until after the 2016 election. Olson is routinely derided by critics as a β€œconservative attorney for sale,” and someone who has β€œalways been a hired gun.”

 

Former federal judge Michael McConnell argued on PBS in support of the second impeachment trial for President Trump.

 

Former federal judge Michael Luttig is already well known for helping out the Democrats’ Ja 6 Committee. He rather famously left the federal bench for Boeing β€” β€œtaking his toys and going home,” as some put it at the time β€” after President George W. Bush didn’t put him on the Supreme Court. The Wall Street Journal noted that his resignation letter pointedly didn’t mention the younger Bush.

 

Luttig also serves on the advisory board of β€œThe Safeguarding Democracy Project,” led by Richard Hasen, an election law professor who criticizes voter ID laws. Its mission statement claims Republicans who questioned the legitimacy of the 2020 election were acting in bad faith, and that election integrity laws passed after the 2020 election β€œthreaten the cornerstone of American democracy.”

 

Gordon Smith, one of the report’s co-authors, wasn’t even considered a conservative in the old Republican Party back when he served as a senator from Oregon from 1997-2009. Before he became a high-paid lobbyist for the National Association of Broadcasters, he was assessed the fourth most liberal GOP senator after Olympia Snowe and Susan Collins, both of Maine, and Pennsylvania’s Arlen Specter, who officially joined Democrats in 2009. By 2008, when he was defeated, Smith scored only a 33 out of 100 by the American Conservative Union. Just this year, he declined to endorse a Republican for Oregon’s gubernatorial race.

 

Former Sen. John Danforth of Missouri, another co-author, thought the Republican Party was too conservative by 2005, arguing in The New York Times that it had become a party overtaken by conservative Christians. Danforth, an Episcopal priest, was a public supporter of efforts to redefine marriage to include same-sex couples. He has said the worst mistake he ever made was supporting Sen. Josh Hawley’s political aspirations.

 

All of the report’s authors are or were Republican, including Hoppe, but they tend to inhabit parts of the old Republican Party that voters are increasingly rejecting, not just for their weak policy proposals but for their habit of cooperating with left-wing media in its unceasing attempts to undermine the new Republican Party’s political strengths.

The Man Who Lost the Decades-Long Battle for Election Integrity

 

Two days before the razor-thin 2020 presidential election, report co-author Ben Ginsberg, the long-time dean of establishment Republican election lawyers and former counsel to Bush’s presidential campaigns and Mitt Romney’s presidential campaigns, did one of the most hostile things imaginable to Trump and his voters. He went to The Washington Post to beg Americans to vote for Democrat nominee Joe Biden (β€œMy party is destroying itself on the altar of Trump.”) He and other NeverTrumpers represent exceedingly little of the Republican Party outside of the Beltway, but in an election that came down to 43,000 votes across three states, they should get at least some credit β€” or if you’re a Republican voter, blame β€” for pushing Biden and other Democrats over the finish line and bringing the country to where it is today.

 

Ginsberg, it turns out, bears more responsibility for how the election turned out than most, and his op-ed explains why.

 

It wasn’t just that Ginsberg used his Republican pedigree in order to elevate his hatred of Trump when Republican campaigns desperately needed unity and strength. By November 2020, such tantrums were common among the Republicans who used to control the party. No, it was that he went on an absolute tirade against election integrity itself, adopting every Democrat Party talking point against Republican efforts to secure the ballot box.

 

Two days before the 2020 election had even occurred β€” and long before this report came out last week β€” his mind was made up. Proof of systemic fraud simply β€œdoesn’t exist.” He compared concerns about election integrity to a hunt for the β€œLoch Ness monster.”

 

He praised practices enabling widespread unsupervised voting, including unattended ballot drop boxes, drive-through voting operations, and third-party ballot trafficking. He belittled concerns about even weak and insufficient verification systems, such as signature matches. He said Republican lawyers fighting against such practices were engaging in β€œvoter suppression,” a common Democrat talking point.

 

Months after Ginsberg’s 2020 op-ed mocking election concerns, Time magazine itself confirmed what many Republicans suspected: the existence of a β€œconspiracy” by powerful Democrats to push through these unsupervised voting practices, creating an election system to ensure the outcome they desired. As Time wrote, it was β€œa well-funded cabal of powerful people, ranging across industries and ideologies, working together behind the scenes to influence perceptions, change rules and laws, steer media coverage and control the flow of information.”

 

The successful effort to change hundreds of laws and processes across the country to enable tens of millions of unsupervised ballots to flood the system was led by Marc Elias, the same Democrat attorney who had been behind the creation of the Russia collusion hoax, the lie that Trump didn’t win in 2016 but stole the election by colluding with Russia.

 

Democrats had been working for decades to accomplish these changes. For nearly four decades, it was Ginsberg’s job to fight them. As the Republican Party’s top election lawyer, Ginsberg was supposed to be the person responsible for pushing back against coordinated and well-funded Democrat efforts to expand unsupervised voting and to make it difficult to scrutinize the resulting ballots that were far more susceptible to fraud.

 

It’s not surprising that Republicans fared so poorly against the coordinated Democrat campaign to water down election integrity over the last 20 years given that Ginsberg was the guy supposedly leading their fight.

 

Early on in my reporting for my best-selling book on the 2020 election, I spoke with dozens of Republican attorneys at the state and federal levels who had found themselves battling this widespread and coordinated takeover of the 2020 election. I asked some of them about Ginsberg’s op-ed and work, and how he compared to Elias.

 

They told me that Elias doesn’t have much going on in his life other than his election work, and he wakes up each morning with big plans on how to manipulate elections. (A look at his active social media presence supports the characterization.) They explained to me that Elias isn’t as good of an attorney as he promotes himself to be, but he’s the type who will argue whatever he needs to for a client. If that means arguing that voting machines aren’t secure β€” as his group did in 2020 when trying to overturn the results of Rep. Claudia Tenney’s election in New York, he’ll do it. If it means mocking the idea that voting machines aren’t secure β€” as his group did in 2020 when battling Trump election challenges that same year, he’ll do that too. He takes whatever side of an issue he needs to in order to secure a favorable outcome for his clients.

These sources noted that Ginsberg, by contrast, usually managed to help Elias and other Democrats in their efforts. They said he was a decent and well-connected Beltway attorney, but he didn’t seem to care much about election integrity, relative to his Democrat counterpart’s efforts. He was a fine lawyer who tended to do a mediocre job, they said. In fact, as soon as he retired, Ginsberg’s written and spoken statements have sounded like they could have come from Elias.

 

Ginsberg even recently co-founded a group to fight election integrity efforts, claiming that such efforts to ensure transparency and accountability put election officials at risk. His co-founder David Becker, formerly with radical left-wing group People for the American Way, now runs the Center for Election Innovation and Research, one of the two groups Zuckerberg funded during the 2020 election with $419 million. Those funds enabled the private takeover of government election offices in the blue areas of swing states. With Luttig, Ginsberg serves on the advisory board of the Safeguarding Democracy Project, the group opposed to election integrity efforts.

 

So What About the Report’s Substance?

 

The report was presented as an exhaustive look at what happened in the 2020 election. In fact, it only really looked in a cursory fashion at a limited set of lawsuits officially raised by Trump attorneys in the days and weeks after the election.

 

The report’s co-authors admitted to The Dispatch that the information in the report wasn’t new. Indeed, it’s seemed mostly to be a summation of what law associates might find in Lexis-Nexis β€” a recitation of legal cases and brief mentions of a few reports and audits in six battleground states. It did not dig deep into any of them, merely restating the circumstances by which cases were dismissed or resolved. And it doesn’t even do a good job with that.

 

For instance, it characterizes a report from the Wisconsin Institute for Law and Liberty as finding, β€œno evidence of widespread voter fraud and no evidence of significant problems with voting machines β€” in fact, they found that Democratic candidates performed worse than expected in areas with Dominion machines.” Of course, β€œwidespread voter fraud” and β€œvoting machines” are red herrings, intended to divert people from dealing with what actually happened to control the election outcome in Wisconsin.

 

Contrast the report’s summation of the issue in Wisconsin with the actual first statement from the Wisconsin Institute for Law and Liberty on its website for election integrity, which says, β€œIt is almost certain that in Wisconsin’s 2020 election the number of votes that did not comply with existing legal requirements exceeded Joe Biden’s margin of victory.” The Supreme Court of Wisconsin has shown that claim isn’t even up for debate, and while that is not β€œvoter fraud,” per se, many Americans would describe the efforts to enable illegal voting methods as β€œwidespread election fraud.”

 

The Wisconsin Institute for Law and Liberty’s report was a particularly modest account. Other independent analysts and econometricians analyzing Wisconsin have found that Zuckerberg’s meddling had a far greater impact than they realized. Here’s what a team of academics wrote about the Center for Tech and Civic Life’s takeover of government election offices in Wisconsin’s biggest cities:

 

Without CTCL involvement in Wisconsin in 2020, Wisconsin would be a solidly red state. We estimate that CTCL’s investment in seven Wisconsin counties resulted in 65,222 votes for Biden that would not have occurred in CTCL’s absence. That’s more than three times as big as the final 20,800-vote margin between Biden and Trump in 2020.'

 

Private funding of elections overwhelmingly went to Democrat areas of swing states, produced skewed results, and violated legal requirements prohibiting partisan effects to nonprofit work. The situation in Wisconsin was so bad that leftist activists funded by the Zuckerberg operation led to multiple resignations of local officials in protest.

 

The report barely mentions, and therefore fails to adequately deal with, Zuckerberg’s funding and what it paid for, merely mentioning that some legal challenges had cited it. This is despite its central role in the outcomes for multiple swing states, including Pennsylvania, Arizona, and Georgia.

 

The report does a poor job dealing with Georgia as well. In its opening paragraph on Georgia, the report’s authors write, β€œGeorgia Secretary of State Brad Raffensperger, a conservative Republican, conducted a full manual recount of the five million ballots cast, confirming Biden’s victory. At Trump’s request, election officials then conducted a post-certification recount, which also confirmed Biden’s victory. Secretary Raffensperger, with the assistance of the Georgia Bureau of Investigation, evaluated and rejected numerous claims of fraud.”

There are multiple major problems with this characterization of Georgia. The report authors didn’t seem to understand, or failed to accurately convey, the situation with the Trump lawsuit filed there. To take just one example from that lawsuit, it alleged a serious problem with illegal voting. Shortly after the election, voting data expert Mark Davis noticed a problem of 40,000 votes cast by people who had registered to vote in a county different from the one they had claimed to move to. It was one of the dozens of categories mentioned in the Trump lawsuit, and in the intervening months, it has been confirmed that more illegal votes were cast in this manner than comprises the margin of victory for the race.

 

One could perform a recount a thousand times and not detect, much less deal with, that problem. A recount would simply recount the ballots, whether they were legal or not legal. As for the suggestion that Raffensperger took seriously, much less rejected, claims of illegal voting, the evidence does not support the claim. He fiercely fought the campaign’s efforts to determine the precise number of illegal votes during the time they needed the information for their lawsuit. After The Federalist reported on this issue last year, and a television station confirmed the existence of the problem, his office was cagey about whether they were going to investigate, much less do anything about it. His office also made excuses for the illegal voting, suggesting it was not a major concern for his office.

 

The issue isn’t even addressed in the report, and discussions of the lawsuit and how it was handled are completely inadequate and erroneous. The problem with the lawsuit β€” which did not allege fraud and which had many substantiated claims β€” was that it could not get a hearing before Jan. 6. The problems the campaign’s legal team had getting a hearing were Kafka-esque, and the report doesn’t seem to understand what the issues were, much less how they were handled.

 

Other major issues are neglected in the report. Because of the limited scope and lack of depth to the report, it doesn’t even acknowledge, much less give credit, to a 2022 Pennsylvania court decision ruling that all no-excuse mail-in voting in the commonwealth is unconstitutional. In its discussion of the Arizona audit, which found large and systematic problems in election administration, it quotes the response from the hostile Maricopa County Board of Supervisors as definitive. Likewise, it quotes news articles from the Associated Press, Washington Post, New York Times, and other left-wing media outlets as definitive responses to election concerns. This is laughably unserious.

 

Reports Like This Harm the Republic

 

When Luttig went to the one-sided Jan. 6 star chamber, he concluded his remarks by saying that Trump and his supporters were β€œa clear and present danger to American democracy” because of their ongoing concerns about election security.

 

The report repeatedly asserts that the reason why there is a lack of trust in elections is because of Trump and his supporters. In fact, one of the most important reasons to fight the coordinated campaign to weaken election integrity is that the lack of controls that make fraud easier to commit and more difficult to detect is responsible for the lack of trust in elections.

 

Following the contentious 2000 election, former President Jimmy Carter and Republican James Baker co-chaired the bipartisan Commission on Election Reform. Its 100-plus-page report was called β€œBuilding Confidence in U.S. Elections,” and it treated election integrity as vitally important to that goal.

 

Rather than mocking or dismissing concerns about election integrity as unimportant, the Carter Commission stressed the problems caused by bloated and inaccurate voter rolls, nonexistent or faulty voter-identification procedures, and unsupervised voting. It said these practices threaten elections and democracy, as do misconduct by partisan election officials, the use of inconsistent procedures in different precincts, and an overall lack of transparency. The report noted that mail-in balloting is associated with higher risk of fraud and could also undermine faith in elections.

 

Making sure that voting is fair is one of the most important issues in the country. That’s why it remains a top concern to Republican voters, even as Washington, D.C., rolls out every member of the establishment to try to force them to fall in line with weak and insecure voting provisions.

 

If they want to convince voters outside their bubble, they should try far harder than they did with this report.

Armed assailant attacks Lee Zeldin with a knife at campaign event

Antifa Summer Camp In Portland Teaches Anarchy To Children

 

A summer camp in Portland, Oregon, is offering children the opportunity to become budding social justice warriors (SJW) while β€œreflecting on white supremacy” and learning Black Lives Matter (BLM) chants about putting β€œkiller cops in jail.”

 

The Budding Roses camp in August for fourth through eighth graders is a project of the Black Rose Anarchist Federation, a political organization promoting the tenets of anarchy that some would argue led to the Portland riots of 2020.

 

In June 2021, the Portland Police Association issued a press release announcing that the Portland Police Bureau Rapid Response Team resigned from their voluntary positions due to the β€œpolitical venom” of local politicians who not only failed to support but demonized the team during the Portland riots that began in 2020 and continued through 2021.

 

The resignation is a step toward what Budding Roses teaches children in the chant, β€œCops and borders, We don’t need them.”

 

As with many SJW goals, the camp’s curriculum appears to be inflicting children with race obsession and graphic sexual concepts, as can be seen in a BLM coloring book espousing transgender affirmation and in a chant that compares the government to a rapist.

The camp also has a class on β€œWhy Writing People in Prisons and Jails Matters” to instruct children on writing to incarcerated felons.

Josh Hawley Grills TSA Head For Letting Illegals Use Arrest Warrants To Board Planes

 

Republican Missouri Sen. Josh Hawley grilled the head of the Transportation Security Administration (TSA) Thursday for allowing migrants to use arrest warrants as a form of identification when flying across the country.

 

The TSA allows migrants to use the warrants as a form of identification while traveling through U.S. airports, according to a letter exclusively obtained by the Daily Caller News Foundation in January. Under 1,000 migrants have used the civil arrest warrants or deportation notices as identification at airports, TSA Administrator David Pekoske told Hawley.

 

β€œSo we aren’t looking at whether a person is legal or illegal in the country,” Pekoske told Hawley at the Senate Homeland Security committee hearing for his re-nomination.

 

Hawley asked Pekoske for a reason for disregarding one’s legal status when screening migrants through TSA.

 

β€œBecause our role is to make sure that people that might pose a risk to transportation that’s significant enough to either require enhanced screening or to not allow them to fly,” Pekoske responded.

 

β€œSo your position is someone who is known to have violated the laws of the United States … you’re not concerned about the person’s security?,” Hawley asked.

 

Pekoske replied that there are travelers flying every day who have broken U.S. laws, but that the agency looks at what relates to transportation security.

 

β€œAnd you don’t think someone who is by definition, somebody who presents a warrant for arrest, you don’t think that that necessitates screening?,” Hawley questioned.

 

However, TSA argues that migrants are properly screened for potential national security threats.

 

β€œTo confirm the identity of an individual and ensure they are not on the no-fly list or pose a known threat to public safety or national security, TSA verifies the identity of every traveler before they are permitted to enter the secure area of an airport. Noncitizens without a standard form of identification may instead present certain DHS-issued forms to a TSA officer,” a TSA spokesperson told the DCNF.

 

β€œThese forms are civil immigration violation documents, do not include criminal arrest warrants, and are not indicative of a threat to public safety or national security. TSA confirms the identity of the individual by verifying the personally identifiable information found on these forms using DHS’s CBP Oneβ„’ Mobile Application,” the spokesperson added.

 

Hawley’s office didn’t respond to the DCNF’s request for comment.

Fact Check: Bennie Thompson Falsely Claims Police β€˜Killed’ in Capitol Riot

 

CLAIM: President Donald Trump failed to stop rioters who were β€œsavagely beating and killing law enforcement officers.”

 

VERDICT: FALSE. While some rioters attacked police, they did not kill any; the only person killed was a fellow rioter.

 

The January 6 Committee held its eighth public hearing on Thursday, and its second in prime time. The event was billed as a crucial moment, the last scheduled hearing and one in which damning evidence would be revealed about Trump’s role.

 

Rep. Bennie Thompson (D-MS), the chair of the committee, opened proceedings by addressing the hearing remotely, since he was recently diagnosed with COVID-19. He claimed that Trump was indifferent to the β€œbeating and killing” of police officers:

 

For 187 minutes on January 6th, this man of unbridled destructive energy could not be moved. Not by his aides, not by his allies, not by the violent chants of rioters, or the desperate pleas of those facing down the riot. And more tellingly, Donald Trump ignored and disregarded the desperate pleas of his own family, including Ivanka and Don Jr. Even though he was the only person in the world who could call off the mob he sent to the Capitol [sic] he could not be moved to rise from his dining room table and walk a few steps down the White House hallway into the press briefing room, where cameras were anxiously and desperately waiting to carry his message to the armed and violent mob savagely beating and killing law enforcement officers revenging the Capitol and hunting down the Vice President and various members of Congress. Thompson’s claim is false. Of the five people killed in connection with the riot, only one, Air Force veteran Ashli Babbitt, was killed, shot by a law enforcement officers as she tried to climb through a broken window into the House of Representatives.

 

Three were protesters who died of unrelated causes. One Capitol Police officer, Brian Sicknick, passed away after the Capitol riot, but his death was not caused by the riot, as the media initially claimed, but rather by natural causes. Thompson is wrong.

 

Thompson also claimed that Trump β€œsent” the mob to the Capitol, though it has long been clear that the riot began before he told the crowd at his β€œSave America” rally, roughly a mile away, β€œto peacefully and patriotically make your voices heard.”

 

And though Thompson β€” and vice chair Rep. Liz Cheney (R-WY) β€” claimed that the rioters were β€œarmed,” very few were, in fact, armed; there were very few arrests of rioters that involved firearms, and no firearms were discharged by rioters that day.

 

Thompson objected to the certification of the vote from Ohio in the 2004 presidential election, the very act that he and his colleagues on the committee have described as an attempt to overturn democracy, and insurrection against the Constitution.

A company owned by a family which has donated $300,000 to the re-election campaign for New York Governor Kathy Hochul has been paid $637 million by the state over the past eight months to manufacture at-home COVID tests, and the entire arrangement has gone on without either party ever signing a contract.

 

According to the Times Union, Digital Gadgets LLC, owned by New York City businessman Charlie Tebele, has manufactured approximately 52 million at-home COVID tests since late November and sold them to the state of New York for either $13 or $11.50 each. Though the price per test appears to be reasonable, the state did not consider any other bids from competing manufacturers.

 

Nor did it seal the specifics of their agreement with a contract. The office of the state comptroller Tom DiNapoli issued almost 240 separate payments to Digital Gadgets between December 30 and March 25, but those transactions have been considered individual "purchase orders." DiNapoli's spokesperson denied that his office ever reviewed or approved them.

 

He didn't have to. When Hochul declared a state of emergency last November to combat the omicron variant surge, some New York finance laws were suspended, including laws regarding competitive bidding and comptroller oversight of state contracts, as a result.

 

But members of the state Republican Party aren't buying that explanation.

 

β€œI’m calling on Governor Hochul, and the department of health, to turn over all of their communications with the Tebele family and Digital Gadgets,” said state Republican Party Chair Nick Langworthy. β€œNew Yorkers need to know who our government spoke to and when they spoke to them, and what was discussed.”

 

Langworthy claimed that he will soon file a Freedom of Information Act request to uncover more particulars about the transactions between the governor's office and Digital Gadgets and that he will ask a U.S. attorney to investigate the issue as well.

 

Despite the appearance of impropriety, however, Hochul has denied doing anything untoward. Hochul said that the state received test samples from several companies but that Digital Gadgets was the only manufacturer which could produce the number of tests needed by January 2022.

 

β€œThe fact that there was someone who could meet that need at the time allowed us to deliver critically important test kits when nobody else, including the federal government, could get their hands on them,” Hochul said. β€œAs a result we got kids back in school in January as opposed to them sitting home another semester.”

 

She also denied knowing that the Tebeles had donated so generously to her campaign.

 

β€œI was not aware that this was a company that had been supportive of me,” Hochul said. β€œI don’t keep track of that.”

 

The executive order for the state of emergency has been extended until August 13, but it may be extended again if Gov. Hochul deems it necessary.

The worst line I ever wrote as a pundit β€” yes, I know, it’s a crowded field β€” was the first line I ever wrote about the man who would become the 45th president: β€œIf by now you don’t find Donald Trump appalling, you’re appalling.”

 

This opening salvo, from August 2015, was the first in what would become dozens of columns denouncing Trump as a unique threat to American life, democratic ideals and the world itself. I regret almost nothing of what I said about the man and his close minions. But the broad swipe at his voters caricatured them and blinkered me.

 

It also probably did more to help than hinder Trump’s candidacy. Telling voters they are moral ignoramuses is a bad way of getting them to change their minds.

 

What were they seeing that I wasn’t?

 

That ought to have been the first question to ask myself. When I looked at Trump, I saw a bigoted blowhard making one ignorant argument after another. What Trump’s supporters saw was a candidate whose entire being was a proudly raised middle finger at a self-satisfied elite that had produced a failing status quo.

 

I was blind to this. Though I had spent the years of Barack Obama’s presidency denouncing his policies, my objections were more abstract than personal. I belonged to a social class that my friend Peggy Noonan called β€œthe protected.” My family lived in a safe and pleasant neighborhood. Our kids went to an excellent public school. I was well paid, fully insured, insulated against life’s harsh edges.

 

Trump’s appeal, according to Noonan, was largely to people she called β€œthe unprotected.” Their neighborhoods weren’t so safe and pleasant. Their schools weren’t so excellent. Their livelihoods weren’t so secure. Their experience of America was often one of cultural and economic decline, sometimes felt in the most personal of ways.

 

It was an experience compounded by the insult of being treated as losers and racists β€”clinging, in Obama’s notorious 2008 phrase, to β€œguns or religion or antipathy toward people who aren’t like them.”

 

No wonder they were angry.

 

Anger can take dumb or dangerous turns, and with Trump they often took both. But that didn’t mean the anger was unfounded or illegitimate, or that it was aimed at the wrong target.

 

Trump voters had a powerful case to make that they had been thrice betrayed by the nation’s elites. First, after 9/11, when they had borne much of the brunt of the wars in Iraq and Afghanistan, only to see Washington fumble and then abandon the efforts. Second, after the financial crisis of 2008, when so many were being laid off, even as the financial class was being bailed out. Third, in the post-crisis recovery, in which years of ultralow interest rates were a bonanza for those with investable assets and brutal for those without.

 

Oh, and then came the great American cultural revolution of the 2010s, in which traditional practices and beliefs β€” regarding same-sex marriage, sex-segregated bathrooms, personal pronouns, meritocratic ideals, race-blind rules, reverence for patriotic symbols, the rules of romance, the presumption of innocence and the distinction between equality of opportunity and outcome β€” became, more and more, not just passΓ©, but taboo.

It’s one thing for social mores to evolve over time, aided by respect for differences of opinion. It’s another for them to be abruptly imposed by one side on another, with little democratic input but a great deal of moral bullying.

 

This was the climate in which Trump’s campaign flourished. I could have thought a little harder about the fact that, in my dripping condescension toward his supporters, I was also confirming their suspicions about people like me β€” people who talked a good game about the virtues of empathy but practice it only selectively; people unscathed by the country’s problems yet unembarrassed to propound solutions.

 

I also could have given Trump voters more credit for nuance.

 

For every in-your-face MAGA warrior there were plenty of ambivalent Trump supporters, doubtful of his ability and dismayed by his manner, who were willing to take their chances on him because he had the nerve to defy deeply flawed conventional pieties.

 

Nor were they impressed by Trump critics who had their own penchant for hypocrisy and outright slander. To this day, precious few anti-Trumpers have been honest with themselves about the elaborate hoax β€” there’s just no other word for it β€” that was the Steele dossier and all the bogus allegations, credulously parroted in the mainstream media, that flowed from it.

 

A final question for myself: Would I be wrong to lambaste Trump’s current supporters, the ones who want him back in the White House despite his refusal to accept his electoral defeat and the historic outrage of Jan. 6?

 

Morally speaking, no. It’s one thing to take a gamble on a candidate who promises a break with business as usual. It’s another to do that with an ex-president with a record of trying to break the Republic itself.

 

But I would also approach these voters in a much different spirit than I did the last time. β€œA drop of honey catches more flies than a gallon of gall,” noted Abraham Lincoln early in his political career. β€œIf you would win a man to your cause, first convince him that you are his sincere friend.” Words to live by, particularly for those of us in the business of persuasion.

Many of the people will not go to the stations to vote. They are used to this system. The SOS sent out 63,000 incorrect ballots I’m pretty sure on purpose. What happens when some or many of the voters have already sent them in? And the get to duplicate vote because they send out 63,000 more, will there be duplicate votes?

 

The system is the way it is, until it can be changed.

Pennsylvania Lawmaker Issues Report Detailing 'Myriad Of Election Issues'

 

More than two months after Pennsylvania’s May 17 primary election, the Department of State still has not certified the election results. It’s an administrative failure that undermines confidence in the state’s election system, according to Republican state Rep. Seth Grove, chairman of the State Government Committee.

 

That is one of numerous examples Grove described at the state capital building in Harrisburg during a July 19 press conference in which he released a 186-page report (pdf) with the long title, β€œElection Reform in Pennsylvania: Missed Opportunities and Continued Chaos-an Interim Report on The Status of Elections in the Commonwealth of Pennsylvania After the Veto of House Bill 1300.”

 

Grove is still advocating for something like HB 1300, which Gov. Tom Wolf vetoed in June 2021. It was a package of election reforms that called for voter identification and provided for early in-person voting; moved the voter registration deadline back from 15 days to 30 days before the election; established a state bureau of election audits; allowed for pre-canvassing of mailed ballots; and would have made it easier for older and disabled voters by moving them to the front of the line or providing curbside voting so they could remain in their car.

 

The bill also introduced stiffer fines and longer possible prison terms for election tampering.

 

But Wolf didn’t go for it.

 

β€œThis bill is ultimately not about improving access to voting or election security, but about restricting the freedom to vote,” Wolf said in a statement about the veto. β€œIf adopted it would threaten to disrupt election administration, undermine faith in government, and invite costly, time-consuming, and destabilizing litigation.”
