33 senators call for Hunter Biden special counsel, cite DOJ ‘politicization’

 

In the Monday letter, the 33 Republicans cited the “politicization” of the Justice Department, a lack of public trust in the authorities, and recent whistleblower allegations of a coverup within the FBI of evidence and testimony damaging to the first son.

 

“Given the politicization of the DOJ under your watch and the importance of avoiding any appearance of impropriety, the undersigned request that you provide U.S. Attorney Weiss the full protections and authorities of a special counsel,” the letter says.

WHO chief and TPLF leader Tedros silent about Tigrayan theft of World Food Program fuel

 

UN World Health Organization chief Dr. Tedros Ghebreyesus is also the world’s most prominent advocate of the Tigrayan People’s Liberation Front. He has said nothing about the TPLF’s recent theft of fuel intended for UN relief efforts in Ethiopia.

 

On the morning of August 24th, fighting in Ethiopia’s Amhara Region shattered a ceasefire in a nearly two-year war between the Ethiopian government and the Tigray People’s Liberation Front (TPLF).

 

Then, in the late afternoon of August 24th, UN World Food Program (WFP) Chief David Beasley tweeted shocking news:

 

Stéphane Dujarric, Spokesperson for United Nations Secretary-General António Guterres, had included more detail in his August 24, 2022 briefing. According to Dujarric, after the TPLF broke into World Food Programme facilities, it overwhelmed UN staffers and stolen 12 fuel tanker trucks:

 

“I was asked what the impact of the renewed fighting was having. This morning, on August 24th, a World Food Programme warehouse in Mek’ele was forcibly entered by Tigrayan forces who took 12 fuel trucks/tankers with 570,000 liters of fuel. The team on the ground unsuccessfully tried to prevent this looting.

 

These stocks of fuel were to be used solely for humanitarian purposes, with the distribution of food, fertilizer, and other emergency relief items. This loss of fuel will impact humanitarian operations in supporting communities in all of Northern Ethiopia.

 

We condemn any looting or confiscation of humanitarian goods or humanitarian premises, and we call on all parties to uphold their obligations under international humanitarian law and to respect humanitarian personnel, activities, assets, and goods.”

 

The TPLF, who control Tigray regional state, have always claimed to represent the people of Tigray, who are no doubt suffering as a consequence of the war. But the faction’s brazen heist of fuel needed for humanitarian relief operations makes it difficult to believe it actually cares about the conflict’s human toll.

 

Tedros uses his UN post to lobby for his TPLF party

 

Tedros served as the TPLF’s Health Minister from October 2005 to November 2012, and its Foreign Minister from November 2012 to November 2016, while it held power in Ethiopia’s capital Addis Ababa. Eight months after leaving the foreign ministry, in July 2017, he was appointed as the World Health Organization’s Director General and thus, beginning in 2020, the manager of the global coronavirus pandemic.

 

In 2018, a year after Tedros assumed his post at the WHO, a popular uprising ousted the TPLF from power, after which they retreated to Tigray. Ethiopia’s parliament then elected Abiy Ahmed as prime minister; he won a popular election two years later.

 

In November 2020, in a seeming bid to return to power, the TPLF attacked fellow soldiers at Ethiopia’s Northern Command Base, initiating the ongoing civil war. Prime Minister Ahmed immediately dispatched national troops to Tigray to stop the insurrection but withdrew them in July 2021. The TPLF then invaded Amhara and Afar regional states, until the Ethiopian national army and regional forces drove them back into Tigray and the Ethiopian government declared the humanitarian truce that ended on August 24th.

WHO's Tedros Overrules Own Committee To Declare Monkeypox "Global Emergency"

 

One day after the global case count top 16,000 and the US records its first cases involving children, WHO Director Tedros Adhanom Ghebreyesus declared the global spread of monkeypox a ‘Public Health Emergency of International Concern’, one level below the pandemic status assigned to COVID-19.

 

There are now more than 16,000 cases of monkeypox outside Africa, roughly five times the number when the advisers met in June and declined to formally declare it a public health emergency, the New York Times reports.

 

Tedros said after a discussion with the WHO’s emergency committee:

 

"We have an outbreak that has spread around the world rapidly, through new modes of transmission, about which we understand too little," pointing out that cases are increasingly occurring countries where it is traditionally not found, as well as the growing risk to human health, Tedros added that "for all of these reasons, I have decided that the global monkeypox outbreak represents a public health emergency of international concern."

 

The first European cases occurred almost exclusively in gay and bisexual men, with health officials noting that lesions were appearing on patients’ genitals. While it is unclear whether the current outbreak is spreading solely through sexual contact, Tedros stated that “this is an outbreak that is concentrated among men who have sex with men, especially those with multiple sexual partners.”

 

Both cases involving children in the US “are traced back to individuals who come from the…gay men’s community,” Centers for Disease Control and Prevention (CDC) Director Rochelle Walensky told the Washington Post, although she did not clarify whether these children caught the disease sexually or non-sexually.

 

At least five children in Europe have also been infected.

 

Tedros' decision also comes shortly after the first major peer-reviewed study of monkeypox infections was released, confirming, as Caden Pearson reports, that the virus is primarily being transmitted through the sexual activity of gay and bisexual men in the United States and around the world.

 

The Journal of New England Medicine on Thursday published a study that looked at monkeypox infection across 16 countries between April and June, when cases began to emerge in countries outside of Africa.

 

The study reported on 528 infections diagnosed between April 27 and June 24, of which 98 percent were in gay or bisexual men with a median age of 38. Of these cases, 95 percent of the infections were suspected to have been transmitted through sexual activity—41 percent also had HIV.

I’ve known Sadiq Khan since 2002 when he was my lawyer while I served as an Islamist political prisoner in Egypt, before he became a Member of Parliament. I’m forever indebted to him for visiting me in Mazra Tora prison, while the world gave up on me.

 

Due to this history, many in the press asked me for my view on the veracity of the “Islamist” allegations surrounding the new mayor, but I refused to make my views known until after the elections. Yes, this conversation needed to be had, but I preferred to have it only when the tribalisms of left and right, of Muslim and non-Muslim, were left firmly at the door. Election season made that almost impossible.

 

Sadiq Khan is no Muslim extremist. And it is not only his track record voting for gay rights that proves this.Having known him when I was a Muslim extremist,I know that he did not subscribe to my then-theocratic views.

 

Many conservatives who desperately opposed Khan jumped the shark when they called him a “radical Islamist,” and linked him to sensationalist headlines that declared he had a “hardcore Islamist past.” Nuance is the friend of truth.

 

On the other hand many Muslims, and those on the left, preferred to bury their heads in the sand, chastising anyone who dared to challengeKhan on his past Islamist relationships,as “racists.” See no evil, hear no evil and speak no evil. The Regressive Left’s overuse of the word racism on such matters is as unhelpful as the Populist Right’s overuse of the word “extremist.”

 

And in deference to the seriousness of the subject, and the lives lost over it, what came up about Khan’s alleged links to extremists is pertinent. Those questions needed to be asked. I cannot emphasize enough that I write as a liberal, who voted for a Liberal Democrat in this race, and not as a conservative. So now that the election is over, and London has its first Muslim mayor, let us step back and consider the smoke to this conservative fire.

 

The seeds were sown with Khan’s now-former in-laws. During London’s ’90s Islamist heyday, Khan’s brother-in-law Makbool Javaid was affiliated and listed as a spokesman to the now-banned terrorist group al-Muhajiroun, founded by the hate preacher Omar Bakri Muhammad, and then led by the infamous fanatic Anjem Choudary. I knew of Makbool back then, too. His brothers were colleagues of mine, affiliated to my former extremist organization, Hizb ut-Tahrir.

 

Through such connections Khan ingratiated himself in the London Islamist scene. In 2003, he appeared at a conference alongside Sajeel Abu Ibrahim, a member of that same banned al-Muhajiroun.

National Archives Slaps ‘Harmful Content’ Warning On Constitution, All Other Founding Documents

The National Archives issued a blanket ‘warning’ on cataloged documents, cautioning readers against ‘racist, sexist, misogynistic, and xenophobic opinions.’

 

The National Archives Records Administration placed a “harmful content” warning on the Constitution, labeling the governing document of the United States as “harmful or difficult to view.” The warning applies to all documents across the Archives’ cataloged website, including the Bill of Rights and the Declaration of Independence.

 

“NARA’s records span the history of the United States, and it is our charge to preserve and make available these historical records,” the administration said in a statement. “As a result, some of the materials presented here may reflect outdated, biased, offensive, and possibly violent views and opinions. In addition, some of the materials may relate to violent or graphic events and are preserved for their historical significance.”

 

The NARA, which is responsible for preserving and protecting documentation of American heritage, noted that so-called harmful historical documents could “reflect racist, sexist, ableist, misogynistic/misogynoir, and xenophobic opinions and attitudes; be discriminatory towards or exclude diverse views on sexuality, gender, religion, and more,” and “include graphic content of historical events such as violent death, medical procedures, crime, wars/terrorist acts, natural disasters and more.”

 

Along with committing to diversity and equity, the NARA said it would “[work] in conjunction with diverse communities, [and] seek to balance the preservation of this history with sensitivity to how these materials are presented to and perceived by users.”

 

This isn’t the first time the National Archives has catered to a leftist view of history. In June, the National Archives’ racism task force claimed that the Archives’ rotunda, which houses founding documents, is an example of “structural racism.” The task force also pushed to include trigger warnings around displays of the Declaration of Independence, the Constitution, and the Bill of Rights, which are all in the rotunda.

 

The warning is a blanket statement atop all documents in the archived catalogs that links to a “Statement on Potentially Harmful Content.”

Reporting by the New York Times and Washington Post — some from months ago — when pieced together and considered in tandem with past practices related to presidential and other governmental records, reveals this reality. The relevant reporting started no later than February of this year, when the Washington Post broke the news that the National Archives and Records Administration (NARA) confirmed in a statement, issued by the then-archivist of the United States David S. Ferriero, that in January of 2022 NARA had retrieved from Mar-a-Lago 15 boxes of presidential records, which according to sources included items such as mementos, gifts, and letters. NARA added that Trump representatives were “continuing to search” for additional records.

 

Months later, in interviewing the then-recently retired Ferriero, the Washington Post detailed the origins of the retrieval of the 15 boxes. At the conclusion of Trump’s presidency, the Post reported, Ferriero “was told by the White House Office of Records Management about a group of boxes in the White House residence that should go to the Archives.”

 

“As we were moving materials from the White House just before the inauguration, those boxes hadn’t shown up yet,” Ferriero said. The retired archivist then explained how he remembered “watching the Trumps leave the White House and getting off in the helicopter that day, and someone carrying a white banker box, and saying to myself, ‘What the hell’s in that box?’” According to Ferriero, “that began a whole process of trying to determine whether any records had not been turned over to the Archives.”

 

During the spring of 2021, NARA reportedly “discovered some high-profile documents missing, such as correspondence with North Korean’s leader Kim Jong Un, that Trump once described as ‘love letters,’” the letter President Barack Obama had left for Trump, and a map of Hurricane Dorian that had been altered with a black marker by Trump. And according to Ferriero’s congressional testimony, NARA “began talking with Trump’s people right after they left office” about “presidential records.”

 

Here, an aside is necessary to understand the concept of “presidential records” and NARA’s involvement.

 

The Presidential Records Act Provides the Backstory

 

The Presidential Records Act provides that documents created or received by the president or his immediate staff, such as memos, letters, notes, emails, and other written communications, related to a president’s official duties, constitute “presidential records” and must be preserved. The act further declares that the United States shall “retain complete ownership, possession, and control of Presidential records.” And at the conclusion of a president’s term in office, the “Archivist of the United States” “assumes responsibility for the custody, control, and preservation of, and access to, the Presidential records.”

 

In contrast, “personal records” remain the property of the outgoing president and include diaries, journals, or personal notes “not prepared or utilized for, or circulated or communicated in the course of, transacting Government business.” Likewise, “materials relating to private political associations” or “relating exclusively to the President’s own election to the office of the Presidency” and not related to the duties of the president, qualify as personal records and not “Presidential Records.”

 

NARA maintained that letters with North Korean leader Kim Jong Un and other documents qualified as “presidential records” that the United States owned. And by working with Trump representatives, NARA arranged to retrieve from Mar-a-Lago 15 boxes of presidential papers in January of 2022.

Sajeel ran a camp in Pakistan that trained the 7/7 bomber Mohammad Sidique Khan. Speaking there, too, was one Yasser al-Siri, who had been convicted in Egypt over a political assassination attempt that left a young girl dead.

 

In 2004, Khan gave evidence to the House of Commons in his capacity as the chair of the Muslim Council of Britain’s legal affairs committee. This is the same Muslim Council of Britain that chose to condole the recent Ahmedi murder victim in Glasgow, by declaring Ahmedis not Muslim.

 

In his MCB capacity, Khan argued in Parliament that the Muslim Brotherhood cleric Dr. Yusuf Al-Qaradawi “is not the extremist that he is painted as being.”

 

This is Qaradawi who, among other things, authored a book called The Lawful and Prohibited in Islam,in which he justifies wife beating and discusses whether homosexuals should be killed.

 

Infamously, Qaradawi also issued a fatwa advocating suicide bombings against Israeli civilians, a view which has seen him join the likes of Omar Bakri Muhammad in being denied entry to the U.K.

 

Khan’s relationships with extremists ran so deep in fact, that he attended events for the jihadist rights group Cage,and wrote a foreword for one of their reports. Cage has since declared ISIS executioner ‘Jihadi-John’ to be a beautiful man live on the BBC.

Khan’s defence of such a prolific flirtation with Islamism is that he was a human-rights lawyer. However, most of these events were not attended in his capacity as a lawyer at all. One suspects he was simply trying to gain votes.

 

By 2010, with increasing grassroots popularity among highly organized Islamists and fundamentalists, but carrying the burden of the Labour Party’s War on Terror record, Khan’s bid to get re-elected in his home-base of South London’s Tooting was facing challenges from another Muslim. For unlike the Labour Party, this Muslim’s party had opposed the invasion of Iraq.

 

Khan’s rival was Liberal Democrat Nasser Butt. Liberal Democrat opposition to the Iraq war posed a serious challenge to Khan and his Muslim power base in Tooting. British South Asian Muslims—myself included—overwhelmingly opposed that war. “Luckily” for Khan, Nasser happened to be an Ahmadi Muslim. Yes, this is as relevant as Sadiq Khan being a Sunni Muslim. In other words not at all, in a perfect world. Alas, Khan’s world was far from perfect. Ahmedis are perhaps the most persecuted minority sects among Sunni Muslims.

 

Khan knew this, and yet this fact didn’t stop his campaign working closely with Tooting Mosque to stir up anti-Ahmedi sectarian hatred in order to secure the Sunni vote for his victory. For many of my fellow Sunni Muslims Nasser Butt being an Ahmedi was a doctrinal “offence” for which he was personally responsible, while Khan was too junior of an MP at that time to have much to do with the invasion of Iraq. By now, Khan’s religious writing was clearly on the mosque wall.

The Leaks Begin — And So Does the Witch Hunt

 

As noted above, Ferriero confirmed for the press in February 2022 that the 15 boxes of material had been retrieved by the NARA. Then in a February 10, 2022, article, the Post reported two significant leaks: first, that within the material returned to NARA were documents marked as classified, and second, that “archives officials asked the Justice Department to look into the matter…”

 

By March 2022, NARA was reportedly in “‘consultation’ with the Justice Department,” and by April 7, 2022, according to leaks to the Post, the DOJ had launched an investigation into Trump related to the 15 boxes of material retrieved by NARA. Another DOJ leaker reportedly told Newsweek that in late April 2022, “a federal grand jury began deliberating whether there was a violation of the Presidential Records Act or whether President Trump unlawfully possessed national security information,” and that “the grand jury concluded that there had been a violation of the law.”

 

Further leaks revealed that the DOJ by springtime had issued a subpoena to Trump purporting to seek “additional documents that it believed may have been in his possession.” The grand jury reportedly also issued subpoenas to obtain “surveillance footage from Mar-a-Lago, including views from outside the storage room” where Trump has stored documents from his presidency.

 

According to the New York Times, in response to the grand jury subpoena, a top counterintelligence official for the Justice Department met with Trump’s lawyers on June 3 at Mar-a-Largo and reportedly “left with additional material marked classified.” Leakers also claimed, in the latest of the ever-changing justifications for the raid, that around the same time as the visit to Trump’s Florida home, one of his lawyers provided a declaration “attesting that all the material marked classified in the boxes had been turned over.” Then, after a “confidential human source” reportedly told the FBI that Trump continued to hide classified documents, even providing “the location of those documents,” according to “two senior government officials,” the DOJ moved to obtain the search warrant.

‘Classified’ Is a Red Herring

 

Shortly after news broke of the raid, and as the public backlash to the apparent political targeting of a former president of the United States began to swell, DOJ leakers took to their PR teams at the New York Times and Washington Post to spin the search as a drastic response to a dire problem: Trump’s supposed possession of documents about nuclear secrets.

 

“Classified documents relating to nuclear weapons were among the items FBI agents sought in a search of former president Donald Trump’s Florida residence on Monday, according to people familiar with the investigation,” ran the Washington Post’s lead in its coverage of the developing story. The New York Times repeated the storyline, claiming Trump was seeking to “deflect attention from reports that the classified documents he had kept in his Florida home might have contained materials related to nuclear weapons…”

 

Rather than prompt the public’s concern, however, the country, whose memory of the Times and Post’s peddling of the Russia-collusion hoax remained fresh, ridiculed the posited justification — that Trump had stolen nuclear secrets — for the raid. The focus of coverage, nonetheless, remained on the supposed “classified” nature of the materials stored at Mar-a-Lago, especially after the release of the inventory list that documented the seizing of classified documents.

 

Trump and his defenders countered these claims by stressing that as president, he had declassified all of the documents he had removed from the White House — something within his constitutional authority as the commander-in-chief. However, a close look at the search warrant reveals the “classification” question is a red herring: None of the three criminal statutes relied upon by the DOJ to justify the search required the material sought to be classified.

 

The Criminal Codes in the Search Warrant Don’t Care About Classification Status

 

Specifically, the search warrant specified that the “property to be seized” included “all physical documents and records constituting evidence, contraband, fruits of crime, or other items illegally possessed in violation of 18 U.S.C. §§ 793, 2017, or 1591.” Material need not be classified to fall within any of those criminal code provisions.

 

Rather, for instance, under Section 793, also called the Espionage Act, it is a crime for a person with “unauthorized possession of” documents or information “relating to the national defense,” that the possessor “has reason to believe could be used to the injury of the United States or to the advantage of any foreign nation,” to “willfully retain[] the same and fail[] to deliver it to the officer or employee of the United States entitled to receive it.” Documents and information could be “related to the national defense” without being “classified,” and an intelligence community desperate to convict Trump of something could easily frame the material as providing an “advantage” to a foreign nation. Further, given the Presidential Records Act, Trump arguably has “unauthorized possession” of the material, although if it is a copy the issue is dicier.

 

The second statute cited, Section 2017, criminalizes the removal, destruction, or concealing of government records, which would include presidential papers, and again that provision of the criminal code does not require the documents to be classified. And the third statute, Section 1591, addresses “Obstruction of Justice,” but before moving there, the warrant’s reference to Section 2017, read in light of the leakers’ comments, proves informative to understand the latest targeting of Trump.

 

Newsweek’s “exclusive” report on the supposed confidential human source that prompted the search of Mar-a-Lago claimed that “the road to the raid began a year-and-a-half ago, when in the transition from the Trump administration to that of President Joe Biden, there were immediate questions raised by the National Archives and Records Administration (NARA) as to whether the presidential records turned over to the federal agency for historical preservation were complete or not.”

Leakers Gave Away the Game

 

The DOJ leaker reportedly told Newsweek that NARA “believe[ed] that the former White House was stonewalling and continued to possess unauthorized material” and that the National Archive then, earlier this year, “asked the Justice Department to investigate.” The same leaker claimed a grand jury had “concluded that there had been a violation of the law.” Further, according to Newsweek and its “intelligence source,” “the affidavit to obtain the search warrant” “contained abundant and persuasive detail that Trump continued to possess the relevant records in violation of federal law, and that investigators had sufficient information to prove that those records were located at Mar-a-Lago — including the detail that they were contained in a specific safe in a specific room.”

 

Putting aside for a moment the DOJ’s reliance on “Obstruction of Justice,” this leak reveals the raid of Mar-a-Lago resulted from the criminal investigation into Trump’s compliance with the Presidential Records Act, prompted by NARA under the leadership of then-Archivist Ferriero. And for three reasons, Americans can safely conclude the DOJ’s launching of a criminal investigation — and its use of a grand jury — to target former president Trump was a political witch hunt.

 

First, NARA handled its discovery of Hillary Clinton’s violation of the equivalent “Federal Records Act” vastly differently. In September of 2015, in response to questions from Sen. Chuck Grassley, R-Iowa, about the former secretary of state’s use of a non-governmental email account, Ferriero informed Grassley of NARA’s normal response to allegations of “unauthorized destruction or removal of federal records.” “NARA will write a letter to the agency asking it to report back to NARA within 30 days and open a case file on the matter.” At that point, NARA and the agency would work together to recover any missing documents or to reconstruct them if needed.

 

NARA then explained that upon learning of Clinton’s use of a non-governmental email account in March 2015, it “immediately acted In accordance with our regulations by sending a letter to the State Department, setting off the process described above.” Significantly, while noting that the use of the non-government email may result in a separate DOJ investigation, in the case of Clinton, “NARA has not Initiated an ‘Investigation’ of Secretary Clinton’s email practices; rather, as noted above, we have been communicating with the State Department on this matter, and are deferring to the State Department’s review (and any other agencies conducting Investigations).”

 

In contrast, in the case of Trump, NARA referred the matter of documents stamped “classified” to the DOJ, which promptly opened an investigation into Trump and used a grand jury to subpoena Trump and others.

 

Numerous public statements by Ferriero, who at the time of the referral to the DOJ served as the country’s archivist, suggest a partisan goal underlying the referral. First was Ferriero’s bizarre overreaction to “watching the Trumps leaving the White House and getting off in the helicopter” while someone was “carrying a white banker box.” “What the hell’s in that box?,” Ferriero claimed he asked himself.

 

Then there was Ferriero’s admission that he decided to retire at the end of April 2022 “because he is worried about the political future.” “It’s important to me, that this administration replace me,” Ferriero said, adding, “I’m concerned about what’s going to happen in 2024. I don’t want it left to … the unknowns of the presidential election.”

 

That’s quite a strange statement for an archivist to make, suggesting as it does that politics matter in the performance of his role.

 

Third, Ferriero’s comments during a post-retirement interview discussing Jan. 6, suggest he holds an anti-Trump bias. “On his office television, David S. Ferriero, the archivist of the United States, had watched outgoing President Donald Trump whip up the right-wing crowd near the White House,” the Post reported. Ferriero said he recalled watching “this angry mob … really angry, angry people” and thinking to himself, “if these people realize what’s in this building they’re passing, we’re at risk here.” The former archivist called January 6, 2021, “the worst day of his tenure as the keeper of the nation’s collective memory,” and “the worst day of my life” — “the absolute worst.”

It is not merely NARA’s referral to the DOJ and Ferriero’s apparent bias that suggests a political motive, however: It is the reality that even if the documents were classified, Trump has the right to access them and NARA could have worked with the former president to set up a secure location for his presidential papers, which is precisely what Ferriero and the NARA did with Barack Obama.

 

In 2016, before President Obama left office, he rented a private facility in Hoffman Estates to serve as a storage place for his presidential papers, and by October of 2016, while he was still in office, shipments of artifacts from his presidency began arriving at the suburban Chicago storage facility. A year later, the Chicago Tribune reported that after the National Archives and Records Administration had worked with the former Democrat president to ship his documents to the Chicago suburb, where they were stored and kept secured, Obama decided not to retain a paper archive at his presidential museum, “meaning they would be shipped back to Washington once a decision [was] made on where to keep them permanently.”

 

The Obama documents — both classified and unclassified — remained in Hoffman Estates well into 2018, as evidenced by a letter of intent executed between Ferriero on behalf of the National Archives Trust Fund and the Obama Foundation. Among other things, the letter of intent memorialized the Obama Foundation’s agreement to “transfer up to three million three hundred thousand dollars ($3,300,000) to the National Archives Trust Fund (NATF) to support the move of classified and unclassified Obama Presidential records and artifacts from Hoffman Estates to NARA-controlled facilities that conform to the agency’s archival storage standards for such records and artifacts.”

 

The only difference between the Hoffman Estates’ storage of the Obama presidential records that began in 2016 and the Mar-a-Lago storage of Trump’s presidential records was that the documents were technically within the possession of NARA. But even though the documents were legally the property of NARA, Obama still had the right to access the records, including the classified documents.

 

So if upon receiving the 15 boxes of documents back from Trump, NARA had legitimate concerns about the security of Mar-a-Lago — a strange worry to hold given that the Secret Service must safeguard the location to protect Trump and his family — a bureaucracy committed to the country and safeguarding her artifacts would have worked to arrange for the documents to be preserved under the auspices of NARA control in a location chosen by Trump, as it had done with Obama.

It’s the Grand Jury, Stupid

 

But the presidential records were never the concern; nor were the documents with classified markings, which remained secured along with the Trump family. The goal was always to get Trump, which is why NARA referred the matter to the DOJ, which then used a grand jury to investigate the former president of the United States. And once the grand jury began the case, under the apparent auspices of a violation of the Presidential Records Act — if the sources are believed — the DOJ teed up the possibility of an “Obstruction of Justice” charge for anything less than full cooperation in the mind of the FBI.

 

Whether Trump’s lawyer signed a declaration that inaccurately claimed Trump had no documents marked as classified is unknown. If so, it would appear an obstruction charge will be forthcoming, but then so will a fight over whether Trump’s lawyer meant Trump had not retained any “classified” documents since they had all been declassified and the marking just not fixed. Or maybe that’s all the declaration stated — that Trump did not possess any classified documents.

 

An Espionage Act charge would likewise face a high hurdle given the DOJ would need to establish that Trump had “reason to believe” the national defense information “could be used to the injury of the United States or to the advantage of any foreign nation.” Further, to the extent the Biden administration would seek to charge Trump with mishandling classified material, that theory would fail given Trump’s absolute declassification authority.

 

That leaves (at least at this point — the creativity of the deep state remains untapped) Section 2017, which criminalizes the removal, destruction, or concealing of government records. But Trump did not remove the records and likely did not designate the records for shipment by GSA. And even if he did, Section 2017 seeks to protect government property, and if what Trump possessed consisted of mere copies of government records, there should be no violation of this criminal provision.

 

Given these problems with the underlying legal theories, targeting a political enemy and former president of the United States with a search warrant represents an unforgivable lapse in judgment. And as for the claim that the DOJ needed to recover these vital national security documents, the shifting stories spread by leakers suggest this rationale is simply a pretext.

 

After all, within the course of one week, the justification for the search went from “nuclear secrets” to classified documents, to videos suggesting the documents were not secure, to videos suggesting the Trump team was serendipitously moving the documents, to a confidential human source claiming Trump continued to possess presidential records, to a supposed lie by Trump’s attorney that there were no documents present at Mar-a-Lago marked classified.

 

No matter the excuse provided for the raid, however, the reality remains that the Biden administration launched an unnecessary grand jury criminal investigation into Trump based on a referral from a partisan archivist. And all Americans of goodwill see the obvious difference in the government’s treatment of Clinton, Obama, and Trump, proving the purpose of the investigation was “to get” Trump and not the documents.

Americans Will See Right Through Biden’s Economic Falsehoods — and Vote Accordingly

 

You simply cannot tell the public that there is no inflation when prices for food, groceries, electricity, natural gas, and cars are rising sharply.

 

As we’ve said many times, Americans are smarter than President Biden thinks they are. No matter how many displays of cognitive dissonance from Mr. Biden, or falsehoods, or — to use a phrase I don’t like to apply to presidents, but must in this case — outright lies, Americans see right through it.

 

You simply cannot tell the public that there is no inflation when prices for food, groceries, electricity, natural gas, and cars are rising sharply. Even with the recent drop in gasoline prices, they’re still up 26 percent over the past year.

 

As a result, working people have been forced to take a 3.4 percent pay cut during that period.

 

That’s why I don't blame the railroad union workers for demanding higher wages. They’re just trying to catch up to higher prices. They don’t control the government spending and monetary spigots. They are victims of very bad policies.

 

Mr. Biden’s zero-inflation “celebration” on the White House lawn was a slap in the face of these people. When he says he “inherited” an economic crisis and turned it into a “resurgence,” it’s just factually wrong.

 

People know this. The fact is, he inherited a V-shaped resurgence from President Trump, and turned it into a crisis. No number of James Tayler songs is going to change that.

 

The economy was growing at roughly 6.5 percent in the first quarter of 2021, with about 1.5 percent inflation. So far this year, the economy has contracted into negative territory. And more may be coming.

 

The Atlanta Fed’s GDP tracker has been marked down for the third quarter to just 0.5 percent from 2.6 percent. The CPI is rising 8.3 percent ahead of a year ago, and of course people feel this in their bones and their budgets. The Cleveland Fed’s median CPI, which is a very useful measure of core inflation, is now up to 6.7 percent after rising month after month. And, as the economy sinks into recession, we are experiencing a price-wage spiral that is embedded into the economy.

 

Milton Friedman called this “inflationary recession.” Nowadays we call it “stagflation.”

Instead of opening up all the energy spigots, or reducing taxes, or removing business regulations, the Bidens are closing the spigots, raising taxes, and marching toward big-government socialism with their massive central-planning regulatory assault.

 

For now, the supply side is dead, while Democrats scratch every radical, progressive programmatic itch they can. Think of it this way: The economy has no oxygen. Its veins are completely clogged.

 

Mr. Biden continues to say this isn’t so. But the facts clearly speak otherwise. Again, Americans are not stupid.

 

There are lots of issues in the air, but none will be as dominant come November as America’s economic descent.

 

Let me end on an optimistic note. Mr. Biden’s failed policies will be changed. Why? Because the vast majority of people know they must be changed. Men and women of good faith and common sense are going to change them simply because people know change is absolutely essential to making America great again.

Former DNI Ratcliffe: FBI Seized Misclassified Documents in Trump Raid

 

There will be questions not only about whether documents that the FBI seized in its Aug. 8 raid of former President Donald Trump's Florida home were privileged attorney-client details but also about whether some of them should have been tagged with top security clearance at all, former White House Director of National Intelligence John Ratcliffe said Sunday.

 

"The FBI took 11,000 documents from Donald Trump's home, and they claim that there are reports of hundreds of documents that have classified markings," Ratcliffe said on Fox News' "Sunday Morning Futures," telling show host Maria Bartiromo that while he was in office, he'd seen several documents himself that had questionable classification levels.

 

"I saw hundreds, if not thousands, of documents related to Christopher Steele, things like the Alpha Bank connections … there is a question if they are marked top-secret whether they are top-secret," said Ratcliffe. "All of these things were no more top-secret than your children's creative writing assignments for their homework."

 

Brooklyn Senior Judge Raymond Dearie, the special master named to oversee the review of the documents, will lead a process that must determine if there was any national security information of any value in what was being stored in Florida, he added, "but "I can tell you that many of those Russia-gate documents were not top-secret, although they were marked that way."

 

Radcliffe said that one of the documents he'd declassified on his way out the door related to Igor Danchenko, the Russian national who will go on trial next month under the charges brought by special counsel John Durham, who is investigating the origins of the investigation into Russia and Trump's 2016 campaign.

 

"He is facing trial next month because he lied repeatedly to the FBI," said Ratcliffe. "In January 2017 he admitted to the FBI that much of what was in the Steele reporting was in conversation over beers with friends at a bar or word-of-mouth hearsay.

 

"He didn't know whether any of the information in the Steele dossier was accurate and it was put together at the request of Hillary Clinton and her campaign."

 

Ratcliffe said the document he declassified was an annex to an assessment that then-FBI Director James Comey insisted on including and reporting to the American people that all the information in the Steele dossier should be included in the investigation when they knew from their conversations with Danchenko that it was all false.

 

"This is an example of one of many documents that were initially marked as top-secret, but were all a bunch of garbage," he said.

 

Meanwhile, the FBI paid Danchenko as an informant up until the 2020 election, said Ratcliffe.

 

"At the time that John Durham with the Department of Justice is investigating and getting ready to bring charges against him for lying, the FBI was paying him," he said.

 

And now, the American people have lost faith in the FBI, and even agents are coming forward as whistleblowers to contend the agency is too political, said Ratcliffe.

 

"The FBI thinks the FBI has become politicized," he said. "Poll after poll this summer shows less than half of Americans have faith and trust in the FBI. There are real problems."

California workers won't have to worry about being fired, or not hired, for off-the-clock marijuana use

It will soon be illegal for California employers to let workers' offsite and outside-of-work marijuana use be a factor in hiring or firing decisions, according to a new state law.

 

Gov. Gavin Newsom on Sunday signed into law a bill that makes California the seventh state in the United States that does not allow employers to discriminate against workers who smoke weed "off the job and away from the workplace." The new law goes into effect Jan. 1, 2024.

 

The law prohibits employers from making hiring, firing or other employment decisions based on a drug test that finds "nonpsychoactive cannabis metabolites" in someone's hair or urine, which do not indicate current impairment, but that someone consumed cannabis recently, up to weeks prior, according to Assembly Bill 2188 that Assemblymember Bill Quirk (D-Hayward) sponsored.

 

“Urine tests are a highly offensive invasion of workers’ personal bodily privacy,” said Dale Gieringer, director of California's NORML chapter, which advocates for progressive marijuana policies, about the bill after it passed. “Workers should have the same right to use cannabis as to use other legal substances off the job.”

 

"No employee deserves to feel stigmatized and unsafe at work because of an outdated testing method," Araby said. "There are much more accurate, modern-day cannabis testing methods, like oral swabs, that are able to detect recent use and increase workplace safety.”

 

The new law provides for exceptions for people working in building and construction, as well as people applying for or working in roles that require a federal background clearance.

 

The law still allows employers to require drug screening as a condition of employment, as long as the tests "do not screen for nonpsychoactive cannabis metabolites." After using cannabis, the chemical compound that can cause psychoactive effects, tetrahydrocannabinol, or THC, becomes a non-psychoactive cannabis metabolite, which can remain in the system for weeks. That metabolite does not indicate current impairment.

 

Newsom signed the employment discrimination bill Sunday along with nine other cannabis policy changes, including one that would seal old cannabis-related criminal convictions and creates a process for interstate cannabis business transactions.

“The hewn cave was square in form with a central supporting pillar. Several dozens of intact pottery and bronze artifacts were lain out in the cave, exactly as they were arranged in the burial ceremony, about 3,300 years ago. These vessels were burial offerings that accompanied the deceased in the belief that they would serve the dead in the afterlife.”

 

Officials did not report if any bones or other human remains were among the artifacts, which included pottery and bronze items.

 

The cave has been dated to the era of King Rameses II, “the Pharaoh associated with the Biblical Exodus from Egypt,” officials said.

DARPA launches new program to let small innovators behind the classified curtain

For a lot of would-be defense contractors, the world of classified contracts is a bit of a Catch-22. You can’t get classified work without a security clearance, and you can’t get a security clearance without a contract that demands classified work.

 

The Defense Advanced Research Projects Agency is looking to solve that problem with a new initiative it calls “BRIDGES.” The basic idea is to give small firms a chance to show they’ve got the technical acumen or creativity to solve the sorts of problems DARPA’s working on in the classified arena. If it looks like the answer is yes, the agency itself will sponsor them for a security clearance.

 

Greg Kuperman, the DARPA program manager heading the BRIDGES effort, said it sprang from a recognition that an extremely sizable percentage of U.S. innovation base could, in theory, be figuring out the answers to the agency’s toughest R&D problems, but cut out of the process solely because of clearance issues.

 

“They’re new startups, really passionate folks, but they’re not DoD companies. And the challenge is I can’t even express to them what our real problem is so that they can go think about it, because it’s classified,” Kuperman said in an interview. “We’ve been kind of dancing around this for over a year, and finally I said there’s got to be a better way.”

 

The precise mechanics of exactly how BRIDGES — short for “Bringing Classified Innovation to Defense and Government Systems” — will work are still being ironed out. The agency plans to issue a draft solicitation in the coming weeks to gather companies’ feedback on its initial plans.

 

But as of now, DARPA envisions running the project through a government-operated consortium, most likely with administrative help from a non-profit organization or federally-funded research and development corporation (FFRDC). Inside that consortium, officials will be able to reveal classified information, and the agency wants to keep the administrative cost of admission very low. Firms will just need to make a convincing case, via a short whitepaper, that they can solve problems in a particular topic area DARPA’s identified.

 

If, in the agency’s judgement, they’ve made their case, DARPA will start the process of bringing them into the consortium where they can see the nitty-gritty classified details and start to work on the problem.

 

Vendors will still need to get through the Defense Counterintelligence and Security Agency’s facility security clearance (FCL) process, which takes between three and six months. But DARPA will sponsor that clearance. And that FCL is key to the entire process, Kuperman said.

 

“A lot of these small companies already have hired people that have Top Secret clearances in anticipation of trying to do government work. The problem is without a facility clearance — and without a need to know — I can’t read them into my special access programs or give them sensitive compartmented information,” he said. “But as soon as [their company has] a facility clearance, I can then, overnight, turn them on to those different things. So we can onboard those folks immediately. And if you have people who are not cleared, they will typically have their clearances submitted simultaneously, and hopefully in three to six months, they can pop out with at least a secret clearance.”

The Demos’ Martha’s Vineyard Smokescreen

 

“The border is secure!” Just kidding.

 

Last week, Florida Gov. Ron DeSantis called Joe Biden’s border bluff, flying about 50 illegal immigrants to Martha’s Vineyard Island, a leftist enclave playground for the rich and famous, including Barack Obama. Consequently, the Leftmedia talkingheads and scribes have been sparing no lie portraying the reception the immigrants received from MVI residents before being booted off the island as soon as buses could be arranged.

 

There have been breathless media reports about how the Venezuelan immigrants endured the dangerous trip to our southern border, paying human traffickers to ensure they could take advantage of Biden’s intentional and dangerous open-border policy invitation. On Biden’s watch, more than two million illegal immigrants have flooded into our country, most swamping the towns and resources of border states resulting in a deadly humanitarian crisis. The surge across our “secure” border, as Border Czar Kamala Harris called it last week, set new records in August, and there are many more who cross undetected. That surge includes criminals who are bringing record amounts of deadly fentanyl into the country, resulting in record deaths of American citizens.

 

With that backdrop, among many other media sources obscuring the MVI immigrant arrival with a political smokescreen, CNN reported, “Donations poured in and volunteers rushed to help: Here’s how Martha’s Vineyard communities responded to the arrival of migrants.” In another article, CNN profiled how Vineyard residents gave the immigrants a warm reception — until they could deport them to Cape Cod. Local man Sean O'Sullivan claimed, “We’re used to dealing with people in need and we’re super happy — like they enriched us, we’re happy to help them on their journey.”

 

Reality check: I have friends who were in Edgartown on MVI where the immigrants were detained for 44 hours. They report that the newcomers were cordoned off by police in a one-block area and not allowed to leave that area until arrangements could be made to get them bused off the island. While people were kind, as we all would be, there were no leftist celebrities opening their homes or making any attempt to keep them on the island, despite the fact that there are plenty of fine accommodations available. Additionally, there are “Now Hiring” and “Help Wanted” signs in every business window given that seasonal high school and college kids have departed, but no jobs for the immigrants — as soon as funding was available, they were deported.

 

Instead, laughably, Martha’s Vineyard officials declared a “humanitarian crisis,” prompting DeSantis to respond: “The minute even a small fraction of what those border towns deal with every day is brought to their front door, they go berserk. … Their virtue-signaling is a fraud. Now what would be best is for Biden to do his damn job and secure the border.”

 

“Humanitarian crisis”?

 

For the record,Martha’s Vineyard has an off-season population of 17,000 — more than 90% of whom are white privilege residents, and 90% of them voted for Biden. However, its summer seasonal population accommodates 180,000 visitors, which means that in September, when the 50 immigrants arrived, the island had abundant capacity to provide housing and resources.

To put this “humanitarian crisis” into perspective, National Review’s Brittany Bernstein notes, “More than 24,000 illegal immigrants would need to arrive on the island for it to equally share the burden faced by Del Rio, Texas, on the U.S.-Mexico border.” That same comparison is applicable with many other border state towns.

 

Finally, Biden protested: “Republicans are playing politics with human beings, using them as props. What they’re doing is simply wrong. It’s un-American. It’s reckless.” Actually, Biden is the nation’s most notorious “human trafficker,” and the Democrats’ deceitful open-border policy is “simply wrong … un-American … reckless.”

 

In 2021 alone, Biden authorized almost 1,000 large charter “ghost flights” to many U.S. locations, including planes loaded with children — most under cover of darkness. (I have videos of them arriving at an FBO in Chattanooga, Tennessee, last summer.) Notably, Biden sent 70 flights to Florida.

 

Political analyst Katie Pavlich observed, “The White House is actually trying to argue sending illegal immigrants to Martha’s Vineyard is far more cruel than emboldening a $1 trillion trafficking and smuggling cartel industry that thrives under Biden’s open border policies.”

 

Footnote: DeSantis has been accused of inhumanely luring immigrants onto the MVI flights with promises of housing and jobs, accusations he has completely debunked, noting, “What’s not humane, is what Biden is doing. He’s given a false promise, the border’s open, luring people to come here for political purposes, and then basically cutting these people loose and leaving them high and dry.”

Former Wisconsin Supreme Court Justice Michael Gableman to Represent Whistleblower Harry Wait Charged With Election Fraud

 

Harry Wait, a Wisconsin whistleblower who is now being prosecuted for election fraud crimes that he exposed and reported to law enforcement, and after initially representing himself, is now being represented by former Wisconsin Supreme Court Justice Michael Gableman–at least temporarily.

 

Wait appeared in court earlier this month, and was put under a gag order by Scott Walker appointed Judge Robert Repischak, following that proceeding.

 

Wait conducted his own citizen-sting operation into the state’s absentee ballot requesting system by ordering ballots other peoples’ names to his address off the MyVoteWI.com website. Wait received some of the ballots in the mail and took the evidence to the Racine County Sheriff. Two requests made without consent were in names of elected officials, Wisconsin Assembly Speaker Robin Vos (R) and Racine, and WI Mayor Cory Mason , eight other requests were people he knew and had received permission from to conduct the sting.

 

Justice Gableman was previously hired by Speaker Vos to conduct an investigation into statewide fraud in the 2020 election but was fired by Vos immediately following Vos’s victory over Trump-endorsed primary challenger Adam Steen.

 

Today, representing Wait in court, Gableman asked Judge Repischak for more time for Wait to hire an attorney for his defense. Repischak granted an extension for the preliminary hearing to October 7.

 

WISN reports “Gableman, who is now an attorney at the Thomas More Society, said he has not received clearance yet to represent Wait throughout the case but he will at least assist in helping to find him counsel.”

 

“I want to make sure all of his legal rights are safeguarded, and whether that’s me or another lawyer, I think it’s very wise for him to decide to seek counsel,” Gableman said.

President Obama still remembers what the queen did with brooch from Michelle

Former President Barack Obama remembered Queen Elizabeth II, in a video tribute released on Monday, the day the queen was laid to rest. In the video, he said the queen reminded him of his grandmother,and he spoke about a moment of kindness from her toward him and Former First lady Michelle Obama.

 

Mr. Obama said the first time he met the queen while visiting London, it surprised him that she reminded him very much of his grandmother, Madelyn Dunham, who helped raise him. She reminded him "not just in appearance, but also in manner," he said, adding that she was very gracious, but also no-nonsense.

 

"[She had a] wry sense of humor and she could not have been more kind or thoughtful to me and Michelle," he said.

 

He remembered a time when Michelle went back to England with their daughters, Malia and Sasha, and Queen Elizabeth II invited his wife and daughters to tea.

 

"She then offered the girls to drive in her golden carriage around the grounds of Buckingham Palace," the former president remembered. "It was the sort of generosity and consideration that left a mark in my daughters' lives that is still there."

 

He said the queen was an excellent listener, with a genuine curiosity, "although she was impatient to get to the point."

 

Mr. Obama also shared a moment of kindness from the queen, after a state dinner at Buckingham Palace in 2011.

 

The queen was dressed up quite a bit for the state dinner.– It was a little bit concerning for Michelle, because as a gift to her majesty,

Michelle had selected a small,modestbrooch of nominal value," he said. –

 

The next night, the former president and first lady hosted their own dinner at the American Embassy. "The one thing we immediately noticed is that [the queen] was wearing the brooch the Michelle had given her," he said. "It was an example of the subtle thoughtfulness that she consistently displayed. Not just to us, but everybody who she interacted with."

 

He also said the queen was mindful of guests overstaying their welcome — and as a guest, she was thoughtful of the same. "She looked at her watch at a certain point and said, 'I think we need to wrap this up,'" Mr. Obama said.

Biden Admin To Continue Draining Oil From Strategic Reserves Through Election Day

 

The Biden administration announced Monday that it is auctioning 10 million barrels of oil from the Strategic Petroleum Reserve (SPR) which it will deliver throughout November, according to a Department of Energy (DOE) notice of sale.

 

The DOE announced that it will extend the period in which it aims to sell 180 million barrels of crude oil by auctioning 10 million barrels from Sept. 19 to Sept. 27 and delivering the oil from Nov. 1. to Nov. 30, according to the notice. The deliveries of the reserves, which aim to bring down gas prices, will take place during the same month as the midterm elections that take place on Nov. 8.

 

White House Press Secretary Karine Jean-Pierre said on Sept. 14 that gas prices had fallen for 90 straight days, touting Biden’s efforts to bring down prices at the pump after gas prices peaked at over $5 per gallon in June 2022. The White House is eager to continue lowering gas prices ahead of the midterm elections as it believes prices at the pump most directly affect voters’ everyday lives and their perception of the economy.

 

The average national gas price is $3.68 per gallon, which is 49 cents higher than it was in September 2021, according to AAA data. Biden’s Energy Secretary Jennifer Granholm said on Sept. 8 that the administration may continue to auction off oil barrels from the SPR past October to ward off increasing fuel prices in late 2022.

 

Biden has released 155 million barrels of oil so far, and the November sale will bring the total to 165 million barrels out of the 180 million barrels that he sought to sell from March to October. The emergency reserve fell to its lowest level since Nov. 1984 on Sept. 6 after consistent monthly releases of crude, according to DOE data.

 

SPR oil is sold to the highest bidder, and some of the businesses entitled to make bids are foreign companies. Biden announced in late March that he would approve SPR sales to bring down gas prices and increase the global supply of oil that is being disrupted by “Putin’s price hike,” according to a White House press release.

 

The DOE did not immediately respond to the Daily Caller News Foundation’s request for comment.

Two decomposed bodies found in ex-Rhode Island mayor’s home: report

 

Two decomposed bodies were found in the home of a former longtime Rhode Island mayor on Monday, according to a report.

 

The shocking discovery was made by police in the city of Woonsocket, according to WJAR, where an elderly man and elderly woman were found in the home of ex-Woonsocket mayor Susan Menard.

 

Menard served as the city’s leader for more than a decade, beginning her tenure in 1995 before she left office in 2009, according to the city. Her time as mayor is apparently the longest in the city’s history.

 

It’s not yet known if Menard is one of the two bodies that was found in the home, the television station reported.

 

Police reportedly said the bodies were “badly decomposed” and are being investigated by the medical examiner. Authorities also said there was no sign of criminal behavior at this point, WJAR reported.

 

Further information, including how long the bodies were there, wasn’t available Monday evening.

 

Woonsocket is home to more than 40,000 residents and is less than 20 miles from Providence.

Biden reveals how he threatened China over Russia

The US president claims he told his Chinese counterpart that Beijing would pay a heavy price for violating anti-Russia sanctions

 

US President Joe Biden has said he tried to pressure China early in the Russia-Ukraine conflict, warning President Xi Jinping that it would be a “gigantic mistake” to ignore the West’s anti-Moscow sanctions.
