Judge sends Dominion’s $1.6 billion lawsuit against Fox News to trial

 

A judge in Delaware has ordered a jury trial in Dominion Voting Systems’ blockbuster lawsuit against Fox News, setting the stage for one of the most consequential defamation decisions against an American media company in decades.

 

Lawyers for Fox and Dominion faced off in court during a two-day hearing for summary judgment last week, with each side unsuccessfully arguing the court should rule in their favor and forgo a jury trial that is expected to span weeks and could further bring to light internal discussions at the network following the 2020 election.

 

Dominion is suing Fox for $1.6 billion in connection with what it alleges was the network’s airing of false information about the company’s software, claims promoted by former President Trump’s associates and allies after the election.

 

Delaware Superior Court Judge Eric Davis rejected Fox’s attempt to throw out the suit ahead of trial, and he ruled that Dominion has proven the first elements of their defamation claim: namely, that the network’s statements about Dominion and the 2020 election were false.

 

But he ruled that a jury must decide whether Fox operated with actual malice.

According to Ballotpedia, Bragg is a member of the Democratic Party. “Alvin Bragg Jr. (Democratic Party) is the Manhattan District Attorney in New York. He assumed office on January 1, 2022. His current term ends on January 1, 2026,” according to Ballotpedia.

According to The New York Post, former New York Police Commissioner Bill Bratton criticized the “$1 million donation that Hungarian-born philanthropist Soros gave to the Color of Change political action committee, which supported Bragg.”

 

“If you look at every city in America that has violent crime increases and disorder increases…what is the one common denominator?” Bratton said to The Post. “District attorneys, almost all of whom are funded phenomenally by George Soros.”

 

The New York Post reported that “Soros also donated $1 million to Alvin Bragg’s successful DA campaign in Manhattan, funneling the cash through the Color of Change political action committee.”

 

However, according to Daily Mail,Color of Change pulled back half of that money because of a “disturbing allegation” that is not detailed

UN food chief: Billions needed to avert unrest, starvation

 

UNITED NATIONS (AP) — Without billions of dollars more to feed millions of hungry people, the world will see mass migration, destabilized countries, and starving children and adults in the next 12 to 18 months, the head of the Nobel prize-winning U.N. World Food Program warned Friday.

 

David Beasley praised increased funding from the United States and Germany last year, and urged China, Gulf nations, billionaires and other countries “to step up big time.”

 

In an interview before he hands the reins of the world’s largest humanitarian organization to U.S. ambassador Cindy McCain next week, the former South Carolina governor said he’s “extremely worried” that WFP won’t raise about $23 billion it needs this year to help millions of needy people

 

“Right at this stage, I’ll be surprised if we get 40% of it, quite frankly,” he said.

 

Last year, Beasley raised $14.2 billion for WFP, more than double the $6 billion in 2017, the year he took over as executive director. That money helped over 128 million people in more than 120 countries and territories.

 

Beasley said he was able to convince the United States last year to increase its funding from about $3.5 billion to $7.4 billion and Germany to raise its contribution from $350 million a few years ago to $1.7 billion, but he doesn’t think they’ll do it again this year.

Belvedire, IL – A concert at the Apollo Theatre in Belvidere turned tragic on Thursday evening when the roof collapsed, trapping multiple attendees. The incident was reported as a Mass Casualty Incident (MCI), with multiple red patients and one declared dead on arrival.

New FBI records offer detailed insights into Route 91 mass shooting

 

The lead investigator of the 2017 mass shooting in Las Vegas criticized the FBI on Thursday after the federal agency released new documents about the gunman’s final days.

Kelly McMahill, a retired deputy chief, said it was “unprofessional” for the FBI to publish the new information without first notifying the Metropolitan Police Department.

“It will be very damaging to the 22,000 people that attended the concert, the victims of the family members that were lost and the survivors,” said McMahill, who is married to Sheriff Kevin McMahill. “There is still no known motive five years later, and LVMPD would never hide a potential motive from any of our victims.”

Sandy Breault, a spokeswoman with the FBI’s Las Vegas division, said Friday that the office could not comment on documents put out through the federal agency’s vault.

The newly released records provided some additional insight into Stephen Paddock’s mindset and gambling habits before he fatally shot 60 people and injured hundreds more at the Route 91 Harvest festival on the Strip.

But the FBI records — which are being widely reported for the first time just days after a shooter in Nashville, Tennessee, killed three adults and three children at a private Christian elementary school — do not identify a particular motive.

One gambler told the FBI that Paddock, who opened fire on concertgoers in a 10-minute-long rampage, was “very upset at the way casinos were treating him and other high rollers.” Names, including the gambler’s, were redacted in the FBI records.

 

The stress could “easily be what caused Paddock to ‘snap,’” the gambler speculated, noting that casinos had reduced the number of perks they gave to VIP customers in the years leading up to the shooting.

The Oct. 1, 2017, attack ended when Paddock, who was positioned inside a Mandalay Bay hotel suite across from the country music festival, killed himself with a revolver. At least 50 mass shootings have occurred on U.S. soil since, but the Las Vegas shooting remains the worst in modern American history.

 

Metro, which conducted a joint investigation of the shooting with the FBI, wrote in a statement Thursday that the documents don’t add anything of substance to the case, and “speculating on a motive causes more harm to the hundreds of people who were victims that night.”

According to the FBI records, the 64-year-old Paddock had lost thousands of dollars gambling. About a month before the shooting, he lost $38,000 in two days at the Tropicana Las Vegas, one employee told authorities.

HARRISBURG, Pa. (AP) — Pennsylvania Sen. John Fetterman has left Walter Reed National Military Medical Center after six weeks of inpatient treatment for clinical depression, with plans to return to the Senate when the chamber resumes session in mid-April, his office said Friday.

Dr. Martin Luther King Jr. is assassinated

Just after 6 p.m. on April 4, 1968, Martin Luther King Jr. is fatally shot while standing on the balcony outside his second-story room at the Lorraine Motel in Memphis, Tennessee. The civil rights leader was in Memphis to support a sanitation workers’ strike and was on his way to dinner when a bullet struck him in the jaw and severed his spinal cord. King was pronounced dead after his arrival at a Memphis hospital. He was 39 years old.

 

In the months before his assassination, Martin Luther King became increasingly concerned with the problem of economic inequality in America. He organized a Poor People’s Campaign to focus on the issue, including a march on Washington, and in March 1968 traveled to Memphis in support of poorly treated African-American sanitation workers. On March 28, a workers’ protest march led by King ended in violence and the death of an African American teenager. King left the city but vowed to return in early April to lead another demonstration.

 

On April 3, back in Memphis, King gave his last sermon, saying, “We’ve got some difficult days ahead. But it really doesn’t matter with me now, because I’ve been to the mountaintop … And He’s allowed me to go up to the mountain. And I’ve looked over, and I’ve seen the Promised Land. I may not get there with you. But I want you to know tonight that we, as a people, will get to the promised land.”

 

One day after speaking those words, Dr. King was shot and killed by a sniper. As word of the assassination spread, riots broke out in cities all across the United States and National Guard troops were deployed in Memphis and Washington, D.C. On April 9, King was laid to rest in his hometown of Atlanta, Georgia. Tens of thousands of people lined the streets to pay tribute to King’s casket as it passed by in a wooden farm cart drawn by two mules.

Conservatives call for charges against Biden after Trump indictment

 

WASHINGTON — Thursday’s indictment of former President Donald Trump has set a precedent enabling Republican prosecutors to seek criminal charges against President Biden, conservative legal experts told The Post Friday.

 

“All bets are off. You can expect grand jury indictments of leftist politicians like Biden, [former House Speaker Nancy] Pelosi and [Senate Majority Leader Chuck] Schumer as surely as night follows day,” said Tom Fitton, president of the conservative legal group Judicial Watch.

 

“You can be sure that there are prosecutors across Florida and Texas right now who are looking for a state law hook into the Biden family,” he added. “And if they’re not, they’re not doing their jobs.”

 

Trump, 76, is the first former president to face criminal charges as he seeks a 2024 rematch against Biden. The sealed indictment reportedly stems from a novel document-falsification theory pushed by Manhattan DA Alvin Bragg regarding Trump’s 2016 hush-money payment to porn star Stormy Daniels.

 

“Republicans need to learn how to take off the gloves and put on the brass knuckles and break glass jaws — politically and legally, not physically,” Mike Davis, a former chief counsel for nominations on the Senate Judiciary Committee and president of the Article III Project, told The Post.

 

“If New York can turn a routine settlement of a business dispute seven years ago into a felony, I think our Republican AGs and DAs should get creative,” added Davis, who briefly worked as a federal prosecutor before clerking for Supreme Court Justice Neil Gorsuch. “Two wrongs don’t make it right, but it makes it even.

 

“You just need probable cause. A grand jury can indict a ham sandwich. We just saw that in New York. And the Bidens actually committed real crimes. These are real crimes that the Bidens committed. There is smoking gun evidence that the Bidens were corruptly and illegally on Chinese and Ukrainian oligarchs’ payrolls.”

 

The recognition of the likely fallout from the Trump charges — and the sea change to US legal norms — spanned the political spectrum.

 

“The Republicans will be furiously seeking revenge and may try to pin Biden with something,” predicted left-wing social commentator Noam Chomsky, a professor emeritus at MIT, though the 94-year-old added that some cases — such as war crimes charges — would still be considered off-limits to partisans.

 

Trump ally Joe Arpaio, the former sheriff of Maricopa County, Ariz., said he believes the legal system has a “double standard” against Republicans such as Trump, who in 2017 gave his first pardon to the controversial lawman in a criminal contempt case.

 

“The criminal justice system is not always fair, believe me, and this is an example,” Arpaio said.

 

“This sets a little precedent,” said the ex-sheriff of America’s fourth-most-populous county. “Now the word is out that you can go and indict an ex-president and a current president and they opened another door. But now everybody’s going to flex their muscles and use this case. So now we’re gonna threaten all presidents or ex presidents.”

 

Arpaio predicted that prosecutors wouldn’t actually bring a case against any president or ex-president “unless his name is Donald Trump,” but said the he could imagine finding enough evidence to charge Biden or even former President Barack Obama, whose Hawaii birth certificate Arpaio notoriously claimed was a “computer-generated forgery.”

 

Davis, who oversaw federal judicial and prosecutor nominations on the Senate Judiciary Committee between 2017 and 2019, laid out specific ideas for a Biden prosecution.

 

“I understand the Bidens may have had some oil and gas deals that deal with Texas. I think maybe Texas Attorney General Ken Paxton should start looking at this long and hard … and Louisiana with [Republican state Attorney General Jeff] Landry,” Davis said.

 

“Paxton and Landry, they need to look at this,” he added. “And if you can find a conspiracy and any of the overt acts of a conspiracy are committed in any of those states, you can bring charges.”

 

An October 2017 email from first son Hunter Biden’s laptop identifies Joe Biden as a participant in a call about Chinese energy company CEFC’s attempt to purchase US natural gas in an effort that appears to have had corporate links to both Louisiana and Texas.

 

Trump is expected to present himself for arrest and arraignment next week in Manhattan. Additional criminal charges could follow as a result of an investigation by Special Counsel Jack Smith of the former president’s alleged mishandling of classified records after leaving office, as well as investigations of his efforts to challenge the results of the 2020 election.

Biden, 80, is preparing to launch a re-election campaign as early as next month and, like Trump, faces a federal special counsel investigation of his apparent mishandling of classified records at his Delaware home and post-vice presidency DC office amid GOP congressional investigations of his role in his son Hunter and brother James Biden’s international business dealings.

 

Hunter Biden reportedly is under criminal investigation by the US attorney’s office in Delaware for possible tax fraud, illegal foreign lobbying, money laundering and lying about his drug use on a gun-purchase form.

 

Hunter wrote in documents retrieved from his abandoned laptop that he paid as much as “half” of his income to his father, whom he often involved in his business relationships during and after his vice presidency.

 

“You’re looking at the Foreign Corrupt Practices Act, bribery, tax evasion, gun charges, conspiracy, obstruction, espionage with using stolen classified records from the Obama White House for his Ukrainian and Chinese deals,” Davis said of potential charges against Joe Biden.

 

“Biden was broke when he was a senator. He was broke when he left. And all of a sudden he’s very wealthy. It’s not because of his brilliance or his charm. How did he make that money?”

 

The Post exclusively reported in October 2020 that Hunter’s laptop included a May 2017 email from associate James Gilliar proposing that the “big guy” get 10% of proceeds from the partnership with CEFC. A whistleblower, former Hunter Biden associate Tony Bobulinski, says that he met with Joe Biden the same month to discuss the CEFC arrangement and both Bobulinski and Gilliar have identified Joe Biden as “the big guy.”

 

Hunter and James Biden ultimately received at least $4.8 million in 2017 and 2018 from CEFC — a since-defunct arm of Beijing’s foreign-influence “Belt and Road” initiative — according to the Washington Post’s review of laptop records.

 

Joe Biden also met as vice president with his relatives’ associates from Mexico, Kazakhstan, Russia and Ukraine — and Hunter’s boss from a different Chinese business venture called BHR Partners.

 

“Maybe these states have a long-arm statute when you’re dealing with foreign corruption. Who knows? Maybe New York and Florida and places like that can start looking into this,” Davis said before suggesting state tax fraud charges as another possible avenue.

 

“If you are making money in a state and you’re liable for state taxes, you’re not paying them — sure,” he said. “These Republican state attorneys general and Republican DAs and Republican prosecutors need to make sure that any and all allegations against the Bidens get a full and fair consideration.”

 

The Manhattan indictment against Trump is expected to include charges for falsifying business records linked to the 2016 payment to Daniels, whom Trump says was extorting him, and another payment the same year to former Playboy model Karen McDougal. That charge ordinarily is a state misdemeanor with a two-year statute of limitations, but under Bragg’s reported theory it would be elevated into a felony by alleging it was done in commission of a federal campaign finance violation.

 

Even if the Trump case emboldens Republican prosecutors in some deeply conservative areas, it’s unlikely Delaware prosecutors would go after Joe Biden, who was the state’s senator for 36 years.

 

Attorney John Garey, a Republican who served as Delaware’s deputy attorney general from 1987 to 2003, told The Post that “as it relates to Delaware, I don’t believe that that’s going to happen.”

 

“In Delaware, we don’t have local DAs, we have a state attorney general who handles the local state prosecutions,” explained Garey, meaning “we don’t have an elected county DA” equivalent to Bragg, who was elected from one of the deepest-blue counties in America.

 

“Delaware is different and we pride ourselves on being different,” Garey added. “And I don’t believe we would ever get to a point where there would be any type of prosecution for purely political motivations.”

But elsewhere in the country, charges aren’t beyond conception.

 

“Obama is going to go down in history as the last US President not to be indicted after leaving office,” tweeted George Mason University law professor Eugene Kontorovich.

 

Davis said Republican retribution should amount to a “dead chicken strategy” — recounting a story that he said Supreme Court Justice Clarence Thomas once told him over lunch.

 

“[Thomas] talked about growing up on the farm in Georgia. When dogs killed chickens, you would wrap those dead chickens around the dog’s necks. And as those chickens rotted around those dogs’ necks, those dogs lost the taste for chicken,” Davis said.

 

“We need to do the same thing to the Democrats on politicized and weaponized bogus charges against Trump and Republicans. We need to give Democrats a healthy dose of their own medicine so they stop doing this.”

 

The White House declined to comment.

Misspellings Matter

 

Trump misspells INDICTED as INDIC[A]TED. The letter [A] is inserted. This points to drop 3371 (“Vindicated as a hero”) and drops 995 and 988, which contain [A]pril and April[A].

 

On drop 995: April 3 + [1 day] = April 4, the day Trump arranged for his arrest confirming the relation to drop 995.

 

The reference to hero reminds us he is on The Hero's Journey and this sham arrest is perhaps the "decisive crisis"
