US Supreme Court Rejects Challenge to Block Trump in 2024

The former president's eligibility to be on 2024 presidential ballot is being challenged in a number of states.

The U.S. Supreme Court on Oct. 2 declined to take a longshot challenge to former President Donald Trump's eligibility to appear on New Hampshire's ballots during the 2024 election.

John Anthony Castro filed an appeal with the Supreme Court several weeks ago and claimed that the former president should be disqualified under a reading of a section of the U.S. Constitution's 14th Amendment. Mr. Castro, a Texas lawyer who's running for president, claimed that President Trump partook in an insurrection against the federal government because of the Jan. 6, 2021, Capitol breach.

“The decision by the U.S. District Court for the Southern District of Florida dismissing Petitioner John Anthony Castro’s civil action on the grounds that he lacks constitutional standing to sue another candidate who is allegedly unqualified to hold public office in the United States pursuant to Section 3 of the 14th Amendment to the United States Constitution,” Mr. Castro wrote in a petition for a writ of certiorari (pdf).

At the same time, he asserted that because he's a Republican candidate, President Trump's name appearing on the ballot injures his ability to obtain donations. According to records from the Federal Election Commission, Mr. Castro hasn't raised any money for his campaign and appears to have given his own campaign $20 million.

His petition with the high court comes as a number of left-wing activist groups have tried to block the former president from appearing on state ballots, using a rationale similar to Mr. Castro's arguments.

For example, the left-wing group Free Speech for People wrote to the secretaries of state of Florida, New Hampshire, New Mexico, Ohio, and Wisconsin, calling on them to not include President Trump on state ballots. Six Colorado voters also filed a lawsuit in September to block him from appearing under their interpretation of the 14th Amendment, which was written in the aftermath of the U.S. Civil War in the mid-19th century.

However, even Democratic secretaries of state appear to have little appetite for blocking President Trump on those grounds. Some legal analysts have also said that the insurrection clause under the 14th Amendment was targeting individuals who fought for the Confederacy during the Civil War.

"We're not the eligibility police. We are responsible for ensuring that basic facts are met to get someone on the ballot," Michigan Secretary of State Jocelyn Benson, a Democrat who has frequently been critical of the former president, told Axios in September. She was responding to calls from pressure groups to keep the former president from being on the ballot in her state.

As for Mr. Castro, he has filed lawsuits in multiple states, including Alaska, Arizona, Idaho, Kansas, Maine, Montana, New Mexico, Nevada, North Carolina, Oklahoma, Pennsylvania, Utah, West Virginia, and Wyoming, according to a recent Newsweek interview. He also intends to submit court papers in Massachusetts and other states.

President Trump hasn't issued a public comment on Mr. Castro's claims. Several weeks ago, Trump campaign spokesperson Steven Cheung said to Newsweek about Mr. Castro, "Who's that?"

Mr. Cheung has been critical of lawsuits and efforts to bar the former president from ballots under interpretations of the 14th Amendment.

"The people who are pursuing this absurd conspiracy theory and political attack on President Trump are stretching the law beyond recognition, much like the political prosecutors in New York, Georgia, and D.C.," Mr. Cheung said in a statement to news outlets in September.

"There is no legal basis for this effort except in the minds of those who are pushing it."

The former president wrote on Truth Social in September that the 14th Amendment claims are merely "election interference" and represent "just another 'trick' being used by the Radical Left Communists, Marxists, and Fascists, to again steal an Election."

Meanwhile, retired Harvard Law professor Alan Dershowitz argued over the summer in an opinion article that President Trump can't be disqualified under the 14th Amendment's Section 3. That's because, he wrote, "The amendment provides no mechanism for determining whether a candidate falls within this disqualification, though it says that [Congress can vote to] remove such disability" with a two-thirds majority in the House and Senate.

"A fair reading of the text and history of the 14th Amendment makes it relatively clear, however, that the disability provision was intended to apply to those who served the Confederacy during the Civil War," Mr. Dershowitz wrote. "It wasn’t intended as a general provision empowering one party to disqualify the leading candidate of the other party in any future elections."

The justices rendered their action on Mr. Castro's claim on Oct. 2, the first day of their new nine-month term. However, it might not be the final time that the Supreme Court is asked to evaluate the 14th Amendment-related claims against the former president because similar litigation is playing out in lower courts.

Supervisor In Crime-Plagued Blue City Using Family’s Foundation To Bankroll Anti-Cop Groups

Democratic San Francisco Supervisor Dean Preston donated over a million dollars to a family-run trust fund and used his position as trustee and co-founder of the group to direct substantial amounts of his family’s money to anti-cop organizations over the past several years, the Fund’s website shows.

Preston, a self-described democratic socialist who has received criticism from even his Democratic colleagues over his left-leaning policies, gave $565,818 in stock to the Arch Community Fund (ACF) in 2018 and an additional $1.1 million worth of stock in 2019, tax documents from the nonprofit group showed. He also has served as one of the two ACF trustees since 2017, helping to direct funds toward groups that oppose incarceration, the criminal justice system and police, investigative journalist Lee Fang first reported on his Substack.

“Arch Community Fund launched in 2017 in response to the alarming rise of overt racism, xenophobia, homophobia, misogyny, religious intolerance, and corporate dominance in the United States,” the website said. “[T]he founders of the Arch Community Fund felt compelled to invest in efforts to challenge the rise of intolerance and fascism and help build a more equitable society. We are especially concerned with the rise of hateful ideologies of white nationalism in the current political climate.”

Although the ACF has donated to a wide variety of causes, it has given substantial funding to several groups that have heavily campaigned in Oakland, California, to defund the police, including $90,000 to the Anti Police-Terror Project and $125,000 to the Critical Resistance project, the fund’s website shows. Oakland’s crime has worsened since 2020, leading many residents to demand action from their local politicians to improve security in the area.

Despite donating substantial amounts of money to the group and directing where ACF funding goes, Preston does not mention his involvement with the group anywhere on his campaign website or his official supervisor page. While Preston has focused his political career on housing issues and preventing tenants from getting evicted, he has supported moves in office to reduce police funding and restrict how security guards can respond to shoplifting incidents, according to his campaign website.

Preston made headlines in September by telling residents to “not leave anything in the car” to avoid break-ins, but said the city should rely on the DA and police for “the enforcement side of it,” local station ABC7 reported.

ACF has not announced any new donations since 2022, although it pledged funding to Critical Resistance and several other activist groups through 2023, according to the fund’s website.

Preston and the ACF did not immediately respond to the Daily Caller News Foundation’s requests for comment.

ARLINGTON, Texas — A small plane had to make an apparent emergency landing in the middle of an Arlington road on Monday afternoon.

The Arlington Police Department said it was notified at about 2 p.m. that a small single-engine Cessna 172 plane made a landing in the area of East Park Row Drive and Timberlake Drive, just east of Texas 360.

Police said there were two people on board, and they both exited the plane on their own when first responders arrived at the scene. Police said the two were not seriously injured.

Helicopter footage from the scene showed the small plane lying across a lane on the road. Its wings appeared to be damaged, along with the front propeller and the nose, but the full extent of what happened was not clear.

Police told WFAA that the plane hit a chain link fence as it landed, but no other damage to property was reported.

The wreckage has been cleared, and all lanes of Timberlake Drive have been reopened as of 7 p.m. Monday, police said.

Police have notified the Federal Aviation Administration (FAA) and the National Transportation Safety Board (NTSB) – both parties will investigate the incident.

A spokesperson for Arlington Fire Department told WFAA that the pilot reported having engine failure before making the emergency landing.

Lawmakers are privy to some of the country’s most sensitive information, from domestic terrorism threats to military operations overseas, regularly receiving briefings in secure rooms in the Capitol complex from federal and military officials with high-level clearances.

But in the wake of the Jan. 6 riots at the Capitol, some are asking whether certain members of Congress, including Republican leaders of defense and intelligence panels, would meet even the minimum standards for a government official to hold a security clearance.

“Being cleared requires allegiance to the U.S. Government and Constitution of the United States at a bare minimum,” Rep. Ruben Gallego, an Arizona Democrat who serves on the House Armed Services Committee and who fought with the Marine Corps in Iraq, said in a statement to CQ Roll Call.

Unlike officials at federal agencies, lawmakers do not have security clearances per se, experts said. Rather, members of Congress are by tradition deemed inherently trustworthy by dint of the offices they hold, although they are subject to punishment under the House ethics code for revealing classified information. The maximum penalty, which would require a two-thirds vote by the House, is expulsion.

Neither their fellow lawmakers nor any president could take that fundamental presumption of trustworthiness away from them.

“If they remain Members, then they retain eligibility for access to classified information,” Steven Aftergood, a leading expert on government secrecy with the Federation of American Scientists, said in an email. “But if they engaged in constitutionally prohibited actions, then they should be expelled from Congress altogether.”

Security concern?

Seeking to overturn a free and fair election or even supporting groups or people who do, fostering lies that foment insurrection or stoking a crowd to use force would be causes for concern for a government official seeking a clearance, if not disqualifying factors, according to several observers.

“An agency employee who was involved in illegal activity or who incited others to illegal activity would almost certainly lose his clearance,” Aftergood said. “It wouldn’t even be a question of whether a crime had been committed, but rather whether the individual demonstrated rational good judgment. If he did not, he should not be handling classified information.”

Critics argue those are essentially the behaviors that numerous members of Congress have engaged in for many weeks, a campaign of disinformation and rabble-rousing that fueled the Jan. 6 attack and then, hours later, included voting to block certified Electoral College ballots.

Such a vote was entirely legal, but casting it helped cement the widespread and false impression that the fair election was fraudulent.

Some members went even further, riling up the Jan. 6 mob with tweets and speeches about combating their allegedly corrupt fellow lawmakers — fighting words that were often expressed in religious terms.

John Berry, another veteran practitioner of security clearance law, suggested the actions of some members of Congress would raise eyebrows, at a minimum, if they occurred in a typical security clearance review.

“If any government official was found to have tried to thwart a constitutional process such as certifying an election or incited a mob or engaged in the misuse of social media to spread false information, it would raise significant security clearance concerns,” Berry said via email. “The same standard should apply to members of Congress, even though they do not, strictly speaking, have security clearances.”

House Speaker Nancy Pelosi, at a Jan. 8 news conference, called for accountability for Republicans who “promoted the extreme conspiracy theories that provoked the violence, encouraged the mob and who, after desecration of the Capitol, went back to the House floor and continued to push the falsehoods that underpinned this assault on our democracy.”

It is not yet clear, though, what consequences might be coming, if any, for those members.

Rep. Cori Bush of Missouri and 46 other Democrats have backed a resolution calling for an Ethics Committee investigation into whether those lawmakers violated their oath of allegiance to the Constitution.

There are also calls for the House to censure certain members.

But restricting their access to classified information is not going to be one of the congressional responses because, short of expulsion, there is nothing Congress can do.

Americans will soon be able to add shrimp to the list of high-risk meat products getting slipped into the increasingly toxic United States food supply, thanks to an Israeli company that just raised $8.25 million from a group of venture capitalists to start administering oral, RNA-based "vaccine" drugs to the marine life food chain.

Since shrimp are bottom feeders, everything that eats them, including humans, will end up intaking these RNA chemicals through the muscle tissue, or meat, of these animals. Once ViAqua, as the Israeli venture capital operation calls itself, gets its RNA-based vaccine product into ocean life as planned, Americans and the world will have one less safe meat product to consume.

According to reports, ViAqua's RNA-based vaccine, which is still in development, uses ribonucleic acid interference (RNAi) to manipulate the genetic profile of shrimp, essentially turning the sea creatures into living genetically modified organisms (GMOs).

"RNAi is a biological process where RNA molecules are used to inhibit gene expression or translation by neutralizing targeted mRNA molecules," reports Epoch Health about the Frankenfood technology.

(Related: Scientists at MIT have confirmed that RNA vaccines are absorbed through the stomach lining and intestines – this would seem to include mRNA vaccines in animal meat.)

Instead of using needles to inject each and every shrimp – because that would be silly, eh? – ViAqua's mad scientists are planning to "inject" the RNAi poison into the food that shrimp consume. A specially coated feed supplement designed to resist white spot syndrome virus (WSSV) – or so we are told – will be added to farmed shrimp feed in an attempt to stymie the loss of $3 billion worth of shrimp every year.

We are told that 15 percent of the world's shrimp production is lost every year to WSSV, which is what ViAqua says it wants to stop by mass-vaccinating shrimp with RNAi drugs.

Also known as a "nanovaccine," ViAqua's RNAi drug was supposedly found in a 2022 "proof-of-concept" study to be 80 percent effective against WSSV in vivo (in living organisms). At the very same time, the study did not assess the potential long-term impact of creating GMO shrimp – not to mention the long-term impact of what will become of humans who eat them as "food."

"Oral delivery is the holy grail of aquaculture health development due to both the impossibility of vaccinating individual shrimp and its ability to substantially bring down the operational costs of disease management while improving outcomes," proudly announced Shai Ufaz, the CEO of ViAqua.

"We are excited to bring this technology to market to address the need for affordable disease solutions in aquaculture."

The first GMO shrimp from ViAqua is expected to be produced starting in India in the year 2024.

Another company called Genvax Technologies also recently launched a startup to develop mRNA "vaccines" for other animals, having secured $6.5 million in funding to develop a self-amplifying mRNA (saRNA) platform to rapidly develop herd- or flock-specific vaccine injections for all sorts of animal species.

Genvax's approach involves inserting a specific "transgene" or "gene of interest" based on the matched variant strain of a virus or disease. The saRNA portion of the technology then generates an antibody response, we are told, without requiring the entire pathogen to be matched to a given circulating disease strain.

Over 277,000 'Vaccinated' COVID-19 Cases Hidden By CDC In 2021: Newly Obtained Files Show

Some 144,349 cases among partially vaccinated people were reported by 32 jurisdictions to the CDC across three months in 2021, according to some of the files, which were acquired by The Epoch Times through the Freedom of Information Act.

Partially vaccinated has been defined by the CDC as a person who received at least one dose of a vaccine. People were described as fully vaccinated if at least 14 days had elapsed since they completed a primary series.

The Moderna and Pfizer primary series consisted of two doses while Johnson & Johnson's consisted of one dose.

The cases were recorded in California, Maryland, New York, Texas, and 28 other jurisdictions in April, May, and June 2021 and reported to the CDC.

The CDC never disclosed the numbers to the public.

"These data on partially vaccinated persons were not reported publicly but rather, were collected to ensure that that they were being appropriately excluded from the numbers of vaccine breakthrough cases as described as a best practice on the CDC website," staffers at the CDC's National Center for Emerging and Zoonotic Infectious Diseases told The Epoch Times in a letter.

On a webpage advising state and local officials on how to analyze patterns of COVID-19 by vaccination status, the CDC recommends excluding people who only received one Moderna or Pfizer dose or analyzing them separately.

The exclusion is recommended "because only people that have received all of the recommended primary series doses and have had the required duration of time to form a protective immunological response after vaccination (14 days, per the definition) would be expected to receive the full benefit of the COVID-19 vaccination," the CDC said. "In general, the immunological response to a primary vaccination series usually takes 2–4 weeks. Only partial protection is provided to partially vaccinated persons."

Stopped Reporting

The CDC stopped reporting post-vaccination infections among the fully vaccinated, or breakthrough cases, in May 2021, after disclosing that 10,262 breakthrough infections were reported to the agency by 46 jurisdictions through April 30, 2021.

The CDC said that 995 of the cases resulted in hospitalization and 160 resulted in death.

The CDC said it shifted to only reporting breakthrough cases that resulted in hospitalization or death "to help maximize the quality of the data collected on cases of greatest clinical and public health importance."

It's not clear how many infections in the partially vaccinated that the CDC did not disclose before led to hospitalization or death.

Former President Donald Trump has further solidified his lead in the Republican presidential primary, following the second GOP debate at the Ronald Reagan Presidential Foundation and Institute in Simi Valley, California.

“63% of potential Republican primary voters support Donald Trump for the GOP’s 2024 presidential nomination, up from 58% in our survey released Monday ahead of the latest primary debate,” Morning Consult said in its survey released on Sept. 29.

Former Vice President Mike Pence lost one percentage point and is at 5 percent. Meanwhile, Sen. Tim Scott (R-S.C.) did not see any change after the debate, remaining at 2 percent.

“This data reinforces our view that Trump is in the driver’s seat of the Republican primary, and that Trump-less debates aren’t having much of an impact on the other candidates’ national support, and may in fact be helping the former president,” the survey concludes.

In August, Morning Consult found that the support for President Trump went unchanged at 58 percent after he skipped the first GOP presidential debate in Milwaukee. Instead of attending the debate, the former president aired a pre-recorded interview he did with former Fox News host Tucker Carlson.

The second debate, which was aired on Fox News Channel and Fox Business, drew 3.5 million fewer viewers than the first debate.

Even with the absence of President Trump, the seven GOP presidential contenders did not make a breakthrough in the second debate, as they argued over topics including China, the border crisis, crime, fentanyl, and education.

Mr. Ramaswamy finished third with 18 percent saying they were more likely to support him, ahead of Mr. Pence with 16 percent, former New Jersey Gov. Chris Christie with 15 percent, and Mr. Scott with 14 percent.

Following the second debate, Chris LaCivita, a senior adviser to President Trump’s 2024 campaign, urged the Republican National Committee (RNC) to cancel future debates.

“Tonight’s GOP debate was as boring and inconsequential as the first debate, and nothing that was said will change the dynamics of the primary contest being dominated by President Trump,” Mr. LaCivita said on Sept. 27.

Mr. LaCivita added, “The RNC should immediately put an end to any further primary debates so we can train our fire on Crooked Joe Biden and quit wasting time and money that could be going to evicting Biden from the White House.”

According to Mr. LaCivita, Mr. Trump has no plans to attend future GOP presidential debates, after skipping the first two. The third debate is set to take place in Miami on Nov. 8.

The former president is scheduled to host the Iowa Commit to Caucus event in Ottumwa, Iowa, on Oct. 1.

“Just landed in the Great State of Iowa,” President Trump wrote on his Truth Social account on early Sunday. “Remember, I got the farmers 28 Billion Dollars from China. Nobody else would have even thought of doing that, and if they did, wouldn’t have been able to get it done!”

The former president was also in Iowa on Sept. 20, when he told supporters in Dubuque that he would use troops to secure the southern border if reelected.
