Pope Francis has at this point spent over a week in the hospital in Rome, battling pneumonia in both lungs, and in the last 24-hours there have been reports that his condition is stable and has seen slight improvement.

The 88-year old Pontiff entered the hospital on Feb. 14 with worsening bronchitis, leading doctors to eventually diagnose pneumonia, and reports in the initial days were dire.

The American people just voted to end racial discrimination under the guise of ‘equity,’ yet the health care clerisy continues to act as if nothing changed on Nov. 5.

The left often manages to act in such an absurd way as to parody itself. One of those instances recently came to light via a publication by Health Affairs, which purports to craft an agenda for the new administration.

Spoiler alert to Health Affairs and its readers: Few if any of the people in these agenda-crafting efforts will get anywhere near the new administration. And they shouldn’t — if for no other reason than that the people involved with creating these policies appear to have absolutely no sense of politics or an understanding of the electorate.

Forthcoming (Marxist) Policy Proposals

The week of the inauguration, Health Affairs launched its 2025 “Vital Directions” agenda with an online introduction describing and summarizing six commissioned essays to be published in the journal’s next issue. But one doesn’t need to have a subscription to the journal, or to read the six essays when they are published, to recognize that these policies directly oppose not just President Trump’s agenda but what the American people voted for in November when they elected him.

For starters, the introductory article uses the word “equity” or some variation thereof (e.g., “equitable”) no fewer than 17 times in a roughly 3,300-word piece. Seventeen times.

Heck, “equity” is a subject of one of the essays — namely, “addressing the impact of climate change on health and equity.” Here’s how the online introduction describes the essay:

Climate change presents an unprecedented threat to human health and well-being in the United States and worldwide. … These effects are already disproportionately affecting socially and economically disadvantaged communities, exacerbating health disparities. … The authors call for a transition to clean energy sources by halting new fossil fuel infrastructure, repealing fossil fuel subsidies, and increasing funding for zero-carbon energy sources.

Translation: The American people — including those in “economically disadvantaged communities” — should pay higher prices at the pump, not to mention the grocery store, so the woke crowd can virtue-signal about how it’s promoting “equity.” So much for the electorate using their votes to affect the inflation crushing their families!

It goes on from there, generally promoting Green New Deal-type concepts couched in the language of health policy. About the only surprise comes from one of the authors of this paper: Bill Frist, former Senate Majority Leader, R-Tenn. I’ve lived in Washington long enough to remember when he was considered a serious contender for the Republican presidential nomination. Thank God that didn’t happen.

Another essay comes from (among others) Donald Berwick, who proposes a “bold transformation of the US health care system,” one where “racial and ethnic health disparities are eliminated,” which will require “investing in health equity.” For those who don’t remember — and how could you forget? — Berwick is the technocrat who briefly headed the Medicare and Medicaid programs under Barack Obama but never got confirmed because the Democrats running the Senate at the time refused to bring him up for a vote. A supporter of socialized medicine with views so radical as to fail to advance in a Democratic-controlled Senate is not exactly the type of person Health Affairs should look to when crafting a politically feasible agenda.

Read the Room, People!

That pretty much sums up the whole Health Affairs endeavor in a nutshell: a group of academics proposing policies that have little chance of getting enacted. Granted, long lead times for a peer-reviewed publication may mean the articles in question were written well before the election.

But publishing these types of articles in the current environment looks politically tone deaf — because it is politically tone deaf. The American people just voted to end racial divisiveness and discrimination under the guise of “equity” and hold accountable the people responsible for years of Covid lockdowns and all that resulted from them. Yet this health care clerisy continues to act as if nothing changed on Nov. 5 and that lawmakers will readily double down on an agenda voters have rejected — the policy equivalent of “more cowbell!”

The old saying holds that there is no educational value in the second kick of a mule. But if the health policy “experts” keep acting like election results don’t matter, and that voters are mere pawns that elites may order around as they please, it may take more than one election “kick” for this group to craft policies and messaging that can win broad bipartisan support.

Moscow Demanded US-NATO Withdraw Forces From Eastern Europe In Riyadh Talks

A fresh report in Financial Times has revealed that during US-Russia talks in Saudi Arabia on Tuesday, Moscow demanded that NATO and American forces are withdrawn from eastern Europe as a condition for "normalizing relations."

Sources in Romania's government revealed the request, which was rejected by the team led by Secretary of State Marco Rubio. But NATO countries along the alliance's so-called Eastern flank are still worried: "Cristian Diaconescu, the Romanian president’s chief of staff and adviser for defense and national security, said on Wednesday that the US delegation had rejected Moscow’s demand, but that therewere no guarantees that Washington would not eventually make this concession to Vladimir Putin," FT reports.

Of course, NATO militarization right to up Russia's doorstep, a historic trend which reaches back to 1990s, when Moscow demanded not one more inch east, remains a key Kremlin justification for the Ukraine war.

Given this week's anti-Zelensky rhetoric coming out of the US administration, the European allies are worried Trump will give away more (after already declaring that Ukraine won't become a NATO member). This concern was expressed to FT as follows:

"As far as I understand, the situation can change from hour to hour or from day to day," Diaconescu told Antena3 television, in a reference to US President Donald Trump’s scathing criticism of the Ukrainian leader and his concessions made to Russia even before talks began.

Diaconescu stressed that the Russian delegation to the talks in Riyadh earlier this week "failed to convince the Americans" on a Nato withdrawaland that further visits by the leaders of the UK and France to Washington next week would seek to persuade Trump not to give in to this demand.

No real details on specifically what the Russians requested as a condition for fully restoring and improving US relations has been revealed by the US side. However, staff at each of their respective embassies are being restored.

The New York Times has written of Rubio based on a phone call with European diplomats after the Riyadh meeting, "The Secretary of State sought to reassure nervous European allies that the talks [in Riyadh]did not represent an abrupt departure from American policies, as many feared."

In December 2022, just before Russian forces poured across the Ukraine border later in February, President Putin told a news conference, "You promised us in the 1990s that [NATO] would not move an inch to the East. You cheated us shamelessly."

But the Kremlin is signaling it believes the Trump White House understands its positions well. FM Sergey Lavrov had also hailed the Riyadh meeting as "very useful" and that talks will continue."I have every reason to believe that the American side understands our position,"Lavrov had said.

Just one year after signing a ground-breaking trilateral agreement, the Deep Space Advanced Radar Capability partnership is completing facilities construction at the first of three sites that will host a global network of advanced ground-based sensors.

DARC is a partnership between the United States, the United Kingdom, and Australia, designed to create an all-weather, global system to track very small objects in geosynchronous orbit to protect critical U.S. and allied satellite services.

The trilateral Memorandum of Understanding was signed Sept. 27, 2023, will last 22 years, and is a practical example of what the partners can achieve when working together to enhance mutual defense capabilities in the Indo-Pacific region.

Construction of the first site, in Western Australia, was completed in December 2024, three months ahead of schedule, with mission system integration and test activities now underway.

“The collaboration between all parties for the DARC project has been outstanding and is an example of what can be done when we work with our partners on a common goal for the advancement of Space Domain Awareness across our three nations,” said Michael Hunt, assistant secretary Space Systems Branch for the Australian Department of Defence, who also serves as the Australian representative on the DARC steering committee.

Allied partnerships in space are increasingly critical given emerging threats from adversaries and pacing challengers, noted Lt. Col. Nicholas Yeung, chief of Capabilities Development for Space Systems Command’s International Affairs office.

DARC is just one of several key partnership efforts facilitated by SSC’s IA office, and it’s particularly critical as it addresses innate challenges in GEO coverage.

At 22,236 miles above the Earth, an object in geosynchronous orbit takes 24 hours to orbit the planet. This keeps the satellite “parked” in the same spot, appearing stationary to ground sensors.

This makes GEO important “real estate” for several satellites, but because GEO is so far above the Earth, it’s more difficult to monitor space debris and/or adversarial actions that could potentially disrupt or deny space-based capabilities in that orbit.

Yet another challenge is that the U.S. can only cover a limited portion of the sky based on its geography, which is one of the reasons international partnerships are so important.

The DARC program demonstrates how allied partnerships can overcome both technical and geographic challenges while accelerating the delivery of advanced space technology in support of combined operations.

Commodore Dave Moody, head of Space Capability for U.K. Space Command, said, “DARC leverages the geography and commitment of key partner nations to deliver persistent, comprehensive space domain awareness.”

“One year on, the talent harnessed between the nations has begun to field a more capable technology that will protect and defend the international ways of life,” Moody said.

“Alongside the United States and Australia, the United Kingdom will continue to take deliberate steps that ensure DARC enables a collective ability to operate decisively in space.”

DARC is a unique collaboration between the three countries to get after first-of-its-kind capability that can do something that not only is needed from an operational perspective but has never been done before.

One of the main benefits of radar is that it operates 24 hours a day, in all weather and can make observations through clouds and during the daytime – something optical telescopes cannot do.

An ongoing challenge of radar versus telescope, however, is that the further out your radar goes, the larger the power required to transmit and the bigger the receiver arrays must be.

This ground-breaking concept was initially demonstrated by the USSF through its DARC technology demonstration at White Sands Missile Range in 2021.

“The completed DARC system will enhance our Space Domain Awareness enterprise architecture by adding a critical element,” said Brig. Gen. Chandler Atwood, deputy commander of Space Operations Command.

Construction of the first site in Exmouth in Western Australia began in October of 2023. The site infrastructure has been completed, including the radar power plant.

Spectrum licenses and airspace approvals for the Australian site also have been completed, as well as the first receiver and transmitter antennas.

The first open-air transmit of the first antenna was completed in September 2024 and the Australian site is expected to become fully operational in 2027.

The speed at which the DARC construction and commissioning has occurred could only have been achieved through an open and collaborative relationship between the three nations and Australian industry.

The construction site in Exmouth is remote and austere with difficult conditions for the workforce to operate in. Despite the challenges, the respective teams have adopted an attitude that focuses on delivery of capability at speed.

SSC recently awarded Northrop Grumman a contract for the second site currently proposed to be located at a U.K. Ministry of Defense site in Pembrokeshire, Wales.

Environmental assessments and town planning processes are underway for this site which are required for the final siting approval.

A third site will be located in the Continental United States, at a to-be-determined location, pending the completion of environmental and air space studies. The entire DARC system is currently expected to be complete by 2032.

Drones and AI take center stage in Navy-led Middle East exercise

MANAMA, Bahrain — A recent U.S.-led maritime exercise in the Middle East shifted its focus to building artificial intelligence and drone capabilities as the Navy and its partners work to address increasingly sophisticated threats in the region.

The emphasis represents a change at this year’s International Maritime Exercise, which normally focuses on mines and explosive ordnance disposal, among other training.

It also comes as the Navy and other nations in the region prioritize adaptation to technology used by Iran and its proxies in Lebanon, Yemen and other countries, service officials say.

For example, Iran-backed Houthi militants in Yemen have launched swarm drone attacks against ships in the Red Sea in the past year.

The U.S. and its partner navies in the region also are defending against cyberattacks on their systems, Vice Adm. George Wikoff, commander of U.S. Naval Forces Central Command/U.S. 5th Fleet, said Thursday.

“Cyberattacks are a great example of where AI can make a real impact,” Wikoff said, adding that it has “great promise” as a cyber protection tool. AI also is becoming a bigger factor in stopping adversaries, Wikoff said.

Information picked up by Navy sensors in the sea regarding such activity as drug or weapons smuggling can be evaluated more efficiently using AI, which allows a better understanding of what is happening in regional waterways, he said.

“Our ability to get through that data and find what’s really important is always a challenge, and AI is helping accelerate that,” Wikoff said.

He noted that Task Force 59, a Bahrain-based unit focused on testing and deploying drones and using AI, has played an important role in leading Navy security efforts at sea.

Wikoff made the comments as the 12-day IMX25 ended Thursday. The exercise also included noncombatant evacuation, search and seizure, vessel defense, search and rescue, and mass casualty response, the Navy said.

It was linked to Cutlass Express, an exercise in eastern and southern Africa led by U.S. Naval Forces Europe-Africa. Together, there were about 30 countries and 5,000 personnel participating in the exercises, the Navy said.

CBS News chaos worsens as new presenters trigger ratings 'disaster' at woke network

CBS News is in the midst of a ratings crisis brought on by its new 'Evening News' format, former executives and producers have said.

'It's a disaster,' a former CBS News exec told DailyMail.com of the new dual-anchor set-up they framed as 'going to two anchors.'

Maurice DuBois and John Dickerson have since replaced longtime host Norah O'Donnell, leading to a more magazine-style, less headline-driven format noticeably different from the days of Walter Cronkite.

'It's been critically panned, ratings down week by week and from this time last year,' the source added.

'[Executive Producer] Bill Owens is also overstretched and feeling the pressure with this lawsuit from Donald Trump,' the insider said, days after the abrupt exit of CBS News and Stations' President of Editorial and Newsgathering Adrienne Roark.

The longtime 60 Minutes boss was enlisted to help oversee Evening News last summer. He was brought on by Wendy McMahon, the CEO said to be next on the chopping block amid a parade of exits.

It has also spawned a ratings slump that has raised alarm bells across the industry.

'I would say it's a five-alarm fire,' a veteran television news exec told Status on Friday about ratings seen last week.

'It's mind boggling,' a veteran producer who spent a decade at the network further said of the strategy. 'They took the "news" out of the "Evening News!" It's not surprising the audience is leaving in droves.'

Sure enough, statistics released by Nielsen last week supported the seasoned staffers' theories - with the exec who spoke to DailyMial.com pointing out how the show's total viewership is down 14 percent year-over-year.

'We expected this,' a person close to leadership, however, argued to Status's Oliver Darcy Thursday night. 'We are in this for the long term and are confident in our long game.'

But ratings - and accounts from TV veterans - perhaps indicate a collapse that can be traced to the recent implementation of the new format, which is now structured more similarly to 60 Minutes and even shows like Access Hollywood.

For the week of February 10, Evening News saw a 24 percent drop in the 25-54 demographic when compared to the same period as last year, Nielsen statistics show.

'That demographic is very important to advertisers,' the former exec who spoke to the DailyMail.com explained. 'The experiment is failing.'

The 'veteran' television exec who spoke to Status said more of the same, as numbers for CBS's evening competitors ABC World News Tonight and NBC Nightly News both slightly up.

'It's almost impossible to build it once you've lost it. So to have a drop off like that suggest that this asset… is circling the drain,' they said of the viewership.

'Why did McMahon and Owens decide to try to reinvent the "Evening News" in this challenging moment?' the industry insider went on to ask. 'Any excuse you give the audience to change their habit is a massive risk.'

'The habits are so fragile in this new media landscape. So if you give them an excuse to stop watching, they will.'

The former CBS exec who spoke to the newsletter echoed that opinion, calling the past several months 'one of the most consequential periods for news in years.'

'And [yet] they are often minimizing the biggest story of the day to 20 seconds.'

Evening News staffers had a similar reaction after the iconic show devoted just 22 seconds to Elon Musk and Donald Trump's Oval Office appearance last week.

Employees at CBS Broadcast Center in Manhattan told Puck how they were left 'confused' - and in some cases, 'upset' - by the decision, at a time where hard-hitting news was coming out of Washington at a record rate.

All major news stations led with the story and offered extensive coverage - while O'Donnell's replacements Dickerson and DuBois instead focused on lengthy features about the US education system, the flu and discovery of a rarely seen fish.

The historical importance of the White House appearance made the still-young strategy stand out all the more, spawning an overall sense of confusion.

'You have to try really hard to ignore huge stories,' the former CBS producer told Status, after Evenings buried their coverage of the Musk appearance in a roundup of the day's events seven minutes in.

Hegseth addresses strengthening military by cutting excess, refocusing DOD budget

During a recorded, on-camera address from the Pentagon today, Defense Secretary Pete Hegseth discussed his priorities of strengthening the military by cutting fiscal fraud, waste and abuse at DOD while also finding ways to refocus the department's budget.

Hegseth began his remarks stating the Defense Department owes the American people transparency related to steps DOD is taking to accomplish its mission while being good stewards of taxpayer dollars.

"We shoot straight with you. We want you, the American people — the taxpayers — to understand why we're making the decisions that we're making here," Hegseth said, adding that DOD is working as quickly as possible to execute the priorities of achieving peace through strength by rebuilding the military, restoring the warrior ethos and reestablishing deterrence.

Prior to getting in-depth on issues related to the department's finances, Hegseth cautioned viewers to take anything they've heard and/or read on the topic with a "gigantic grain of salt."

"Ever since I've taken this position, the only thing I've cared about is doing right by our service members — Soldiers, Sailors, Marines, Airmen and Guardians," Hegseth said. "In short, we want the biggest, most badass military on the planet."

Hegseth then touched on three areas related to the Pentagon's finances.

First, Hegseth said to tackle excess spending and address the issue of fraud, waste and abuse within DOD, the department would be relying on the recently established Department of Government Efficiency.

"[DOGE is] here, and they're going to be incorporated into what we're doing at DOD to find fraud, waste and abuse in the largest discretionary budget in the federal government," Hegseth said.

He added that DOGE would be given access to systems — with proper safeguards and classifications — to first find redundancies and identify previous priorities not core to the department's current mission and then get rid of them.

"With DOGE, we are focusing as much as we can on headquarters and fat and top-line stuff that allows us to reinvest elsewhere," Hegseth said.

He then pivoted to the topic of reorienting the defense budget inherited from the previous administration.

Hegseth said beginning immediately, the Pentagon will pull 8% — or roughly $50 billion — from nonlethal programs in the current budget and refocus that money on President Donald J. Trump's "America First" priorities for national defense.

"That's not a cut; it's refocusing and reinvesting existing funds into building the force that protects you, the American people," Hegseth said.

He also said there are certain areas where funds will not be refocused — border protection, fighting transnational criminal organizations, nuclear modernization, submarine programs, missile defense, drone technology, cybersecurity, core readiness and training and the defense industrial base among them.

The secretary then turned to his third topic: the reevaluation of the Defense Department's probationary workforce.

Hegseth pushed back on recent reports that DOD would do across-the-board cuts of all probationary employees.

He said leaders are reevaluating probationary employees "carefully and smartly," and future manning decisions would be based, in part, on quality of performance.

"We're starting [cuts] with the poor performers among our probationary employees because it's common sense that you want the best and brightest," Hegseth said.

"So, when you look at headcount, we're going to be thoughtful; but we're also going to be aggressive up and down the chain to find the places where we can ensure the best and brightest are promoted based on merit," he continued.

Hegseth added DOD will implement a hiring freeze to take time to identify better hiring practices as they relate to finding the most "hard charging" employees that are central to the department's core warfighting mission.

The secretary finished his remarks by returning to the topic of transparency and the value he sees in communicating directly to the people.

"Our warfighters and taxpayers deserve no less, and we'll keep reporting back to you from time to time on what we're seeing," Hegseth said.

"We appreciate your support as we move out … on making our military once again into the most lethal, badass force on the planet to keep our country safe."

President Donald Trump’s legislative agenda is a mess right now.

Senate Republicans are on the cusp of advancing a budget that would tee up national security legislation, hoping to spend quickly on border security and defense while postponing action on the thorny topic of tax cuts. Yet Trump hasn’t signed off on senators’ plan.

The president largely favors the approach in the House, where the GOP is trying to kick off votes next week on a budget setting up both massive tax cuts that still need to be negotiated and national security spending. House Republican leaders can’t afford to lose more than a single vote on their budget, and plenty of their members are balking.

That’s left Senate Republicans both skeptical that the House can pass its plan and worried that the other chamber’s budget framework falls short of Trump’s vision. In addition to whacking at Medicaid, senators suspect the House approach will fall short of permanently extending Trump’s 2017 corporate tax cuts.

To make matters worse, the House and Senate have bickered about the right strategy for well over a month and are way behind the pace that both parties set the last time that each controlled Congress and the White House, in 2017 and 2021. Several GOP sources said this week they fear the party’s agenda will remain rudderless unless Trump gets more intimately involved after weeks of deference to the squabbling House and Senate.

“I have no clarity,” Sen. Josh Hawley, R-Mo., told Semafor about the path forward. “Let’s stop playing the game of chicken. Let’s get on one page here. It’s clear we need to sit down and have really substantive negotiations.”

Hawley is raising alarm at the prospect of big Medicaid cuts called for by the House’s template, harmonizing with some moderates whose leeriness of safety net cuts could derail the chamber’s budget. At the same time, some Senate Republicans are antsy about their own leaders’ decisions, given that Trump swiped at their strategy on Wednesday.

And it’s increasingly likely that even if the House succeeds in passing a budget next week, it won’t survive the Senate unscathed. In addition to unease about Medicaid cuts, Republican senators don’t like the House’s trigger that lowers the ceiling for tax cuts if Congress can’t come up with massive spending cuts.

Senate Finance Committee Republicans say they won’t support anything that doesn’t make the 2017 tax cuts permanent, a bar they see the House resolution as failing to meet.

“There’s a lot of stuff in it that makes it really, really complicated over here,” said Senate Majority Leader John Thune, R-S.D., who signed onto a letter to Trump about the tax concern.

Vice President JD Vance told Senate Republicans on Wednesday that Trump is OK with the Senate’s approach, despite the president’s endorsement of the House approach.

But on Thursday,Vance told the CPAC conference that Trump deemed it “very rare” to pass two party-line bills in the same Congress (notably, the Democrats did it in 2021 and 2022).

During the GOP’s last period of full Washington control in 2017, Medicaid politics dominated the party’s attempt to repeal Obamacare. Many conservative states rely heavily on the program, which provides health care to lower-income Americans.

Trump has sent mixed signals on Medicaid cuts, both saying he won’t touch the program and also supporting a House budget that almost certainly will cut it. Hawley’s been the loudest warning about Medicaid, telling Semafor: “I don’t want a whole bunch of Medicaid cuts.”

A large swath of Senate Republicans are likely to heavily scrutinize any changes to Medicaid, even as House Republicans hunt for spending cuts.

“I’m from a state that is heavily reliant on Medicaid. And, you know, I always look at it with a more focused eye,” said Sen. Shelley Moore Capito, R-W.Va. She said if the House passes its budget and sends it to the Senate, then “I think we’ll change it.”

Despite their vast differences on strategy and policy, Republican leaders in both chambers are trying not to publicly alienate each other. In the end, each chamber will have to adopt the same budget blueprint in order to unlock the power to evade Democratic filibusters of their party-line bills.

Which is why Senate Budget Committee Chair Lindsey Graham, R-S.C., is keeping close tabs on House Speaker Mike Johnson. The two spoke on Wednesday, Graham told Semafor.

Though Graham said the House budget resolution’s “tax provisions would have a hard time right now” in the Senate, he’s trying to stay publicly upbeat and encouraging the House to try its way first

After claiming their disagreements were merely tactical, Republicans are now more openly disagreeing on policy, too.

The two chambers of Congress are led by Thune and Johnson, who share affable approaches and are both relatively new to their jobs — which leaves room for Trump to play the heavy to get his agenda done.

It’s just not clear he has any interest in doing so.

Even as rifts open on multiple fronts and Kentucky Sen. Rand Paul opposes the Senate GOP’s plan, some Republicans argued that everything would come together.

“We’re completely united on where we want to get to. We want to prevent this huge $4 trillion tax increase. We want to secure the border. We want to have American peace through strength, and we want to unleash American energy,” Senate Majority Whip John Barrasso, R-Wyo., said on Thursday.

NATO’s Standing Naval Forces have conducted a major demonstration of unmanned surface vessels (USVs) in the Baltic Sea, with exercises taking place near Denmark from 17 to 20 February, according to a press release.

The event, involving Standing NATO Maritime Group 1 (SNMG1) led by HNLMS Tromp, was designed to integrate unmanned technology into ongoing NATO operations and serves as a lead-up to the Dynamic Messenger series exercise scheduled for September.

Ships from the Royal Danish Navy and the German Navy joined SNMG1 for tactical manoeuvres, live-fire drills, and counter-UXV (uncrewed systems) training.

Organisers also tested the interoperability of USVs with manned naval assets, advancing NATO’s drive to “trial and integrate unmanned systems into the networked operational environment,” as Vice Admiral Mike Utley, Commander of Allied Maritime Command (MARCOM), stated in the press release.

“Operational output is the requirement. These trials enable learning and insights to deliver greater speed and scale of integration, further building the military advantage of the Alliance.”

The demonstration was organised collaboratively by NATO’s Allied Command Transformation (ACT) and MARCOM, part of broader efforts to exploit “emerging and disruptive technologies, including autonomous systems and artificial intelligence,” says NATO.

Task Force X, an ACT initiative drawing on lessons from the US Navy’s Task Forces 59 and 66, fielded the unmanned vessels.

“Task Force X is intended to be employed alongside Enhanced Vigilance Activities in support of ACO, to further reassure Allies and deter acts of vandalism against critical undersea infrastructure in the Baltic Sea,” remarked Admiral Pierre Vandier, NATO Supreme Allied Commander Transformation.

“This collaborative effort will fill gaps in surveillance, particularly in areas not covered by existing systems … and improve our ability to detect vessels that may be operating without identification.”

Outcomes from the demonstration will inform NATO’s operational integration of USVs in the Baltic Sea and across the Euro-Atlantic region.

In parallel, the Alliance is preparing for the Dynamic Messenger series exercise in September, which will involve additional trials to refine and expand the use of unmanned systems throughout NATO’s maritime forces.

Justices rule out “commingled funds” theory in Hungarian Holocaust survivors’ compensation suit

A unanimous Supreme Court on Friday threw out a ruling by a federal appeals court that allowed a lawsuit brought by survivors of the Hungarian Holocaust to go forward. The survivors contended that their claims fell within an exception to the general presumption that foreign governments cannot be sued in U.S. courts because Hungary and its national railway confiscated their property, sold it, and mixed it with their other funds to do business in and with the United States. But allegations that a foreign government has commingled the funds from confiscated property are not, Justice Sonia Sotomayor explained for the court, enough on their own for a case to proceed.

More than 560,000 people were killed in the Hungarian Holocaust, which Winston Churchill reportedly characterized as “probably the greatest and most horrible crime ever committed in the history of the world.” Collaborating with Nazi Germany, the Hungarian government nationalized the property of Hungarian Jews and sent them on cattle cars to death camps; MAV, the national railway, took property from them before they boarded the trains.

A group of survivors and their heirs filed a lawsuit against Hungary and MAV in 2010. Although the Foreign Sovereign Immunities Act generally prohibits lawsuits against foreign governments in U.S. courts, they relied on an exception to that rule for cases involving property taken in violation of international law. That exception, known as the “expropriation exception,” applies when the confiscated property or any property “exchanged for it” – is either located in the United States in connection with a commercial activity or owned or operated by an agency or instrumentality” of the foreign country that engages in commercial activity in the United States.

The U.S. Court of Appeals for the District of Columbia Circuit agreed with the survivors that their case could go forward. Even if they did not contend that any of the property that Hungary and MAV confiscated during World War II is now located in the United States or owned by the railroad, the court of appeals reasoned, it was enough that Hungary and MAV commingled the funds from the sale of the property with other government funds that they used to do business with and in the United States – for example, to issue bonds and buy military equipment and to maintain an agency that sells train tickets in this country.

On Friday the Supreme Court rejected that rationale. Simply alleging that funds from the sale of confiscated property were deposited in a government account, and that funds from that account were eventually used for commercial purposes in the United States, Sotomayor reasoned, does not show – as the FSIA requires – that the funds are “present in the United States.” “To conclude otherwise requires accepting an attenuated fiction that commingling funds in an account, even if done decades earlier, means the account today still contains funds attributable to the sale of expropriated property.” This is particularly unlikely, Sotomayor suggested, when a foreign government has used commingled funds “for commercial and governmental operations all over the world, as is the case here.”

A more expansive interpretation of the expropriation exception, Sotomayor continued, would allow more lawsuits against foreign governments in U.S. courts. And that could lead to “retaliatory or reciprocal actions” against the United States in foreign courts, she observed.

The court pushed back against the survivors’ contention that because money is fungible, a ruling for Hungary will allow foreign governments to easily circumvent the expropriation exception by selling confiscated property and then depositing it in their general treasury accounts.

Friday’s decision, Sotomayor emphasized, means only that plaintiffs like the survivors “cannot rely on a commingling theory alone” to show a commercial connection to the United States. It does not, she wrote, rule out other scenarios in which – for example – “commingling allegations may be part of broader allegations that collectively satisfy” the commercial nexus requirement.

And more broadly, the court stressed, the fact that “a particular claim cannot satisfy the expropriation exception means only that it cannot be brought here, not that it cannot be brought in any forum.As the Government correctly recognizes, ‘the moral imperative has been and continues to be to provide some measure of justice to the victims of the Holocaust, and to do so in their remaining lifetimes.’”
