For the good of the country, the President must make a nomination and the Senate must confirm

The time between the formal Supreme Court nomination of Sandra Day O’Connor and her final Senate confirmation was 33 days. (Aug. 19-Sep. 21, 1981).

For John Paul Stevens, the formal process took only 19 days (Nov. 28-Dec. 17, 1975).

A total of 61 SCOTUS justices have been nominated and confirmed to the Supreme Court since the turn of the last century (1900)

70% of these (43 Justices) were confirmed in under 46 days (between her death and the Nov 3 Presidential election)

Choosing not to fill a vacancy would be a historically unprecedented act of unilateral disarmament.

If a Supreme Court vacancy opens up between now and the end of the year, Republicans should fill it. Given the vital importance of the Court to rank-and-file Republican voters and grassroots activists, particularly in the five-decade-long quest to overturn Roe v. Wade, it would be political suicide for Republicans to refrain from filling a vacancy unless some law or important traditional norm was against them. There is no such law and no such norm; those are all on their side. Choosing not to fill a vacancy would be a historically unprecedented act of unilateral disarmament. It has never happened once in all of American history. There is no chance that the Democrats, in the same position, would ever reciprocate, as their own history illustrates.

Twenty-nine times in American history there has been an open Supreme Court vacancy in a presidential election year, or in a lame-duck session before the next presidential inauguration. (This counts vacancies created by new seats on the Court, but not vacancies for which there was a nomination already pending when the year began, such as happened in 1835–36 and 1987–88.) The president made a nomination in all twenty-nine cases. George Washington did it three times. John Adams did it. Thomas Jefferson did it. Abraham Lincoln did it. Ulysses S. Grant did it. Franklin D. Roosevelt did it. Dwight Eisenhower did it. Barack Obama, of course, did it. Twenty-two of the 44 men to hold the office faced this situation, and all twenty-two made the decision to send up a nomination, whether or not they had the votes in the Senate.

This is firearms combat training. Instead of double tapping each adversary, spread fire. Hit each adversary with one bullet, then go back and hit each one a 2nd time. The theory is that no adversary is left unattacked increasing the likelihood that each one will be dead or wounded in less time.

That '70s Show star Danny Masterson has appeared in Los Angeles Supreme Court to be arraigned on rape charges.

Masterson, a Scientologist, appeared in a blue suit and gray mask in the courtroom Friday where he stands accused of raping three women in separate incidents between 2001 and 2003.

The 44-year-old was arrested back in mid-June has been free on $3.3 million bail since. Masterson could face up to 45 years to life in state prison if convicted as charged.

Also at the arraignment was outspoken Scientology critic Leah Remini, who previously called Masterson's arrest 'just the beginning' of the Church of Scientology's demise.

Remini is perhaps being brought in as a former Scientologist to speak on Masterson's character at the time of her affiliation with the church.

Masterson's lawyer filed a demurrer on the arraignment delaying it to October 19.

His alleged victims were awarded a protective order and Masterson was ordered to turn in his firearms.

It took about three hours for the arraignment to get going, as Masterson arrived with an entourage of about 20 people, according to LA Times reporter James Queally.

Masterson's attorney, Tom Mesereau, accused former LAPD Chief Charlie Beck and Distric Attorney Jackie Lacey of caving to pressure from victims in filing the charges and said they are purely political.

Masterson stands accused of raping a 23-year-old woman between January and December 2001, according to the complaint.

He is also accused of raping a 28-year-old woman in April 2003 and sometime between October and December of that year of raping a woman, 23, who officials say he had invited to his Hollywood Hills home.

Last year four women filed a lawsuit against Masterson in California claiming the actor drugged, raped and sexually assaulted them in the early 2000s.

The lawsuit also names the Church of Scientology and its leader David Miscavige as defendants, claiming the women were stalked in a 'conspiracy to cover up that Daniel Masterson sexually assaulted four young women'.

Two of the women named in the suit were Masterson's ex-girlfriends - Chrissie Bixler and Bobette Riales - while the other two are listed as Jane Does.

The lawsuit states: 'When those women came forward to report Masterson's crimes the Defendants conspired to and systematically stalked, harassed, invaded their and their family's privacy, and intentionally caused them emotional distress and silence and intimidate them.'

Masterson called the lawsuit against him and the Church of Scientology a 'shameful money grab'.

In statement to DailyMail.com, the Church of Scientology called the lawsuit 'baseless' and the claims 'ludicrous and a sham'.

'It's a dishonest and hallucinatory publicity stunt. Leah Remini is taking advantage of these people as pawns in her moneymaking scam.'

Ho for the Supreme Court short list. What is disturbing about this development is that Judge Ho has an extensive public record as an activist on behalf of Birthright Citizenship, the current practice whereby any child born on American soil is automatically considered a US Citizen, even if both parents are here illegally.

Here is a representative passage from Judge Ho’s defense of Birthright Citizenship and anchor-baby policy titled “Defining ‘American.'”

For them, being merely subject to our laws meant that one was subject to our “partial” or “territorial” jurisdiction. It was a jurisdiction applicable to “temporary sojourners” — what we today call temporary visitors. It was not the kind of jurisdiction that was codified in the 14th Amendment. Yet those who framed and ratified the Constitution also believed that in times of crisis, the executive might need leeway to hold suspects without answering to a court."

So now on to the constitution - which ACB cites as her reasoning - Articl 1 Section 9 which provides that "The privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it." Seems pretty clear right? WRONG! This clause LIMITS CONGRESS POWER - NOT POTUS POWER - Proof? LOOK AT THE TITLE OF THIS SECTION WHICH READS:

Article 1 - The Legislative Branch

limits on congress! NOT POTUS. NOWHERE in the Constitution is POTUS historical power to suspend habeus corpus limited or made subject to Congress. Well what does SCOTUS have to say about this? NOT MUCH! The case taught in law scholl for the ACB position is Ex Parte Merriman - and it is true that case is cited for that proposition - but here is the catch - that was part of the legal confrontations in the runup to civil war - and decided by only ONE DISTRICT COURT JUDGE not SCOTUS - and BTW LINCOLN ignored it. As a result of this prelim dust up Congress voted to grant POTUS the power to suspend habeus corpus but only for the duration of the civil war. So that long expired law does not address the current status of the matter.

Well after 9-11 Congress passed more national security laws including the detention of enemy combatants (sound familiar?) A litigation ensued with the court of appeals making the following decision:

To further point out the legal mumbojumbo that counts for SCOTUS opinions, consider this statement: "…we have made clear that, unless Congress acts to suspend it, the Great Writ of habeas corpus allows the Judicial Branch to play a necessary role in maintaining this delicate balance of governance." OK so does this ("unless") means that if Congress DOES suspend habeus under Article 1 Clause 9 (public safety) the court CANNOT review it? Doubtful but clear as mud - and SCOTUS has made clear that they can and will review excercise of POTUS power to suspend habeus - in either event the ACB logic fails as badly as SCOTUS.

OK so SCOTUS sticks to its principle that whatever Congress or POTUS do is always subject to judicial review - however - here is the reason they gave: "…. the Judiciary must not defer to the executive with respect to detentions. Instead the constitution empowers the judiciary to act as a check on executive power in this realm"

OK but once again - whose power is being reigned in? THE EXECUTIVE. Not Congress. There are other cases that do little to clear up this question. As always the law is an utter confusion and mess, with power politics playing the major role in every case. Bottom line though, is this - If I were WH counsel I would NEVER concede the power to suspend habeus to Congress - NEVER - Lincoln was right and we won. ACB just accepts this milk toast "CON LAW" with no thought at all.

The US Is Deploying More Troops to Syria

Increase in troop presence comes after US confrontations with Russian and Syrian forces

The US is sending additional forces into Syria after a series of incidents between US and Russian troops in the country, according to three unnamed Pentagon officials speaking to NBC News. The force will consist of six Bradley Fighting Vehicles and fewer than 100 soldiers, who will be operating in northeast Syria on a 90-day deployment.

The US-led anti-ISIS coalition Operation Inherent Resolve said that the Bradley Fighting Vehicles arrived in eastern Syria on Friday.

The unnamed officials told NBC that the additional soldiers and vehicles will serve as a “show of presence” to discourage Russia from entering the eastern security zone where US forces and the Kurdish-led Syrian Democratic Forces operate.

US troops have had multiple encounters with the Syrian government and Russia inside Syria throughout the year. Some of the more serious confrontations occurred last month.

One incident took place on August 17th at a Syrian army checkpoint and resulted in US attack helicopters firing on the position, killing at least one Syrian soldier. A few days after the checkpoint incident, US and Russian military vehicles collided, injuring at least seven US soldiers.

US commanders blame the encounters on Moscow and Damascus, but while the US maintains its presence in the country against the will of the Syrian government, confrontations are bound to happen. These additional forces will only make similar incidents more likely.

The U.S. Defense Intelligence Agency (DIA) is getting ready for the “next battlefield” and counting on the expertise of private concerns, like Booz Allen Hamilton, to implement what it calls Machine-assisted Analytic Rapid-repository System, or MARS for short. MARS is a critical data management system for “military targeting” and operation planning.

MARS is currently the DIA’s top priority, and according to DIA director Lt. Gen. Robert P. Ashley Jr., the aim is to replicate “the commercial Internet that everybody uses every day,” with the added functionality of providing a “foundational intelligence picture […] at speed and at scale.”

Terry Busch, chief of DIA’s integrated analysis and methodologies division, highlights the difference between the MARS program he manages and the old “stovepipe” data management technologies it is meant to replace: “What comes out of MARS at the end is not data, it’s analysis. It’s finished intelligence.”

Which kind of intelligence, specifically, will be assessed dynamically by the machine’s algorithms in a new kind of database management system using AI functionality. It will revolutionize the way data is received and acted-upon. Christy Smith declined to vote on bill easing punishment for statutory rape, among others

California state legislator Christy Smith (D.) has made a habit of abstaining from controversial votes as she campaigns to unseat GOP congressman Mike Garcia.

The Democrat on August 31 refused to vote on Senate Bill 145 (SB145), which eases criminal penalties for adults who have sexual relations with minors. When confronted over the abstention by a constituent on Facebook, Smith claimed that "in the CA Legislature ‘not voting' counts as a no." California legislative records show Smith was not counted as voting "no" and was instead marked as "no vote recorded."

Smith also abstained from voting on an August 24 amendment that would have repealed Assembly Bill 5 (AB5), a 2019 labor law that experts say impedes the state's economy by limiting employers' ability to classify workers as independent contractors. Roughly two months prior, the Democrat abstained from voting on Assembly Bill 2501 (AB2501), which aims to provide mortgage and rent relief during coronavirus.

State records show that Smith was present during all three legislative sessions in question and voted on dozens of other pieces of legislation, including a "menstrual equality" bill that requires companies to disclose ingredients found in tampons, pads, and other period products. While that legislation passed the state assembly unanimously on June 15, the bills Smith refused to take a position on likely would have opened her up to criticism amid her race against Garcia.

SB145 allows judges to decide whether to place someone on the sex offenders' list who engages in anal and/or oral sex with a minor within a 10-year age difference. Proponents of the bill argue that it ends discrimination against LGBTQ youth, as such discretion was already granted to those who have vaginal intercourse in the state. The bill was supported by California LGBTQ groups, including Equality California, which praised the bill for treating "all Californians fairly and equally—regardless of who they are, what they look like, or whom they love." Smith has received $20,000 from Equality PAC since December 2019.

Opponents of the bill argue that the legislation aids sexual predators. Democratic assemblywoman Lorena Gonzalez railed against the bill during its August 31 floor debate, saying "give me a situation where a 24-year-old had sex with a 14-year-old, any kind of sex, and it wasn't predatory."

Stephen F. Cohen, an eminent historian whose books and commentaries on Russia examined the rise and fall of Communism, Kremlin dictatorships and the emergence of a post-Soviet nation still struggling for identity in the 21st century, died on Friday at his home in Manhattan. He was 81.

His wife, Katrina vanden Heuvel, the publisher and part owner of The Nation, said the cause was lung cancer.

From the sprawling conflicts of the 1917 Bolshevik revolution and the tyrannies of Stalin to the collapse of the Soviet Union and Vladimir V. Putin’s intrigues to retain power, Professor Cohen chronicled a Russia of sweeping social upheavals and the passions and poetry of peoples that endured a century of wars, political repression and economic hardships.

A professor emeritus of Russian studies at Princeton University and New York University, he was fluent in Russian, visited Russia frequently and developed contacts among intellectual dissidents and government and Communist Party officials. He wrote or edited 10 books and many articles for The Nation, The New York Times and other publications, was a CBS-TV commentator and counted President George Bush and many American and Soviet officials among his sources.

In Moscow he was befriended by the last Soviet leader, Mikhail S. Gorbachev, who invited him to the May Day celebration at Red Square in 1989. There, at the Lenin Mausoleum, Professor Cohen stood with his wife and son one tier below Mr. Gorbachev and the Soviet leadership to view a three-hour military parade. He later spoke briefly on Russian television to a vast audience about alternative paths that Russian history could have taken.

Loosely identified with a revisionist historical view of the Soviet Union, Professor Cohen held views that made him a controversial public intellectual. He believed that early Bolshevism had held great promise, that it had been democratic and genuinely socialist, and that it had been corrupted only later by civil war, foreign hostility, Stalin’s malignancy and a fatalism in Russian history.

Another Commander Of Russian-Backed 5th Corps Survived Assassination Attempt In Daraa

On September 18, another commander of the Russian-backed 8th Brigade, a unit of the Syrian Arab Army (SAA) 5th Corps dedicated for former rebels, survived an assassination attempt in the eastern Daraa countryside.

Unidentified gunmen reportedly opened fire at the commander, “Yasser Hamed al-Zoubi,” as he was passing on a road linking the towns of al-Jeezah and Elemtaih. The commander survived the gunmen’s attack without sustaining serious wounds.

Al-Zoubi was a fighter in the al-Sunnah Youth Forces, a Free Syrian Army faction, before the 2018 Daraa reconciliation agreement.

According to local sources, al-Zoubi was among the first fighters to join the reconciliation process. Later, he enlisted in the 8th Brigade and became a field commander in the Russian-backed unit.

A day earlier, an attack with an explosive device targeted Ali Ahmed al-Sabah al-Miqdad, Deputy-Commander of the 8th Brigade and Qassem al-Sabah al-Miqdad, a financial director of the unit, in eastern Daraa. The attack failed.

No group has claimed responsibility for the recent attacks on the 8th Brigade commanders, yet. ISIS, however, remains the main suspect. The terrorist group’s cells are active in the eastern Daraa countryside.

Thailand fails to block massive night protest near Grand Palace

espite light rain, Bangkok on Saturday night saw by far its largest demonstration since a coup in 2014 installed a military government and put a lid on free speech. Police claimed that only about 18,000 people turned up, while organizers said the figure was well above what authorities told media. "About 100,000 attended," Panusaya Sithijirawattanakul, a key student leader, told reporters. "The turnout is proof of people's support for our demands," she said.

The turnout was expected to take the temperature of political activism, and provide an indication of the depth of support for political reform. By most accounts, the rally exceeded another of about 20,000 on Aug. 16 at Democracy Monument close to the administrative heart of Bangkok, stepping up critical pressure on the military-backed government of Prime Minister Prayuth Chan-ocha.

Protesters in recent weeks have openly called for a free debate on bold pro-democracy reforms – including for the first time the role of the formerly sacrosanct monarchy. The protest started early afternoon ahead of schedule with two trucks parked on Thammasat University's soccer pitch serving as a temporary stage for a succession of speakers. As with the Aug. 16 demonstration, older people also participated. Thanyathorn Pipitthanakajornchai, 55, told the Nikkei Asian Review that it was her first time at a protest. She said she was not against the monarchy but fed up with the present government. The prime minister keeps blaming everyone else," she said. "The economy is awful, but it is not just because of COVID-19."

At around 3:45 p.m., people led by Panupong Jadnok started moving away from the university soccer field to Sanam Luang outside the university's main gate. Police from nearby Chanasongkram police station arrived and ordered the crowd to disperse within an hour since the gathering was illegal under section 10 of the 2015 public assembly act and had not been notified to the authorities in advance. The police took no further steps at that time, but could charge organizers later.

Political use of Sanam Luang which has the dazzlingly illuminated Grand Palace at its southern end is normally not allowed, but local media had reported that it would be permitted on this occasion providing protesters did not come within 150 meters of royal property.

The organizers said they would stay overnight on the 12 hectare expanse that is used for major royal cremations and other ceremonies. A March to Government House on Sunday morning was also originally planned, but organizers said this had been changed without giving any details.

The United Front of Thammasat and Demonstration, or UFTD, an activist group at Thammasat University, scheduled the protest for Saturday afternoon despite officially being denied access to Thammasat University's historic Tha Phra Chan campus located between Sanam Luang and the Chao Phraya river.

At a press conference ten days ago, the organizers said a turnout of 50,000 to 100,000 was expected. The government had predicted a much smaller turnout, with security forces preparing for 20,000 protesters.
