6 State Attorneys General Warn Biden Over Potential Presidential Overreach

A coalition of state attorneys general on Wednesday sent a letter to President Joe Biden reminding him that any potentially unconstitutional executive actions or federal overreach will not go unchallenged.

The letter, signed by six attorneys general (AGs), puts the Biden administration on notice that any actions that might exceed their statutory authority, are inconsistent with constitutional tenets, or place civil liberties at risk could trigger legal action by the states.

“We stand ready to meet with your administration to discuss more how the issues below affect our States; litigation is never first option, and we would like to help your team in its important job on behalf of all Americans, consistent with the Constitution and the rule of law,” West Virginia AG Patrick Morrisey, who is leading the group, wrote in the letter addressed to the White House (pdf).

“Yet if you sign unconstitutional laws passed by Congress, it will be our responsibility and duty to challenge those laws in court. If cabinet officials, executive officers, and agencies go beyond the bounds of their statutory authority, fail to follow legally required procedures, or fall short of the bedrock Administrative Procedure Act obligation of reasoned decision making, it will likewise be our responsibility to take action.”

The Administrative Procedure Act, or APA, is a federal law that governs the process for agency rulemaking and has been frequently invoked to challenge executive branch rules and regulations.

Morrisey is joined by AGs from Arkansas, Indiana, Mississippi, Montana, and Texas.

It comes as Biden issued a series of executive orders in his first week since taking office. Some of the executive orders have overturned Trump-era policies, while others have established or expanded policies relating to climate change, racial equity, and the CCP (Chinese Communist Party) virus pandemic.

Some of the orders have already drawn widespread scrutiny, such as the decisions to rejoin the Paris Climate agreement and to cancel the Keystone XL Pipeline, which is expected to put thousands of jobs at risk and undermine the U.S. relationship with Canada. The Biden admin has also met with backlash for embracing a quasi-Marxist critical race theory in its policies seeking to prioritize certain racial groups that have historically met with disadvantage over others.

Biden Signs Whopping 40 Executive Orders In First Two Weeks, Smashing Record

President Joe Biden, during his first two weeks in office, has signed a rash of executive orders on everything from immigration to health care to the environment.

His 40 executive orders and actions set a record for the most actions signed by a president after just nine days in office.

Biden had previously made critical comments about overusing executive orders, likening it to the actions of a dictator.

In October, then-candidate Joe Biden during an ABC News Townhall did not seem to be high on the excessive use of executive actions.

On Thursday, Senate GOP Leader Mitch McConnell responded on the Senate floor by saying,”In one week he’s signed more than 30 unilateral actions. And working Americans are getting short shrift.”

According to Fox News, a White House source defended the unilateral actions, saying, “The executive actions are previews, and happening in parallel, to what he is pushing in Congress. These are things he can do instantly, but show what he is going to pursue, and in some cases, already is pursuing, in Congress.”

Many of the executive orders signed by Biden this week have been aimed at overturning many of former President Donald Trump’s policies.

White House press secretary Jen Psaki stated that, “These are steps, including overturning some of the harmful, detrimental, and, yes, immoral actions of the prior administration that he felt he could not wait to overturn, and that’s exactly what he did.”

One of the most anticipated executive orders was the canceling of permits by Biden for the Keystone Pipeline XL project.

This came as a huge blow as the cancelation means the loss of over 10,000 jobs, many of those jobs being those of union workers.

In a Fox news report, the International Labor Organization (ILO), says that globally, over 6 million jobs will be lost in the energy sector as a result of rejoining the Paris Climate Accord, which Biden also did by executive order.

Yet another executive order addressed the issue of “racial justice and equity.” White House Domestic Policy Advisor Susan Rice was instrumental in introducing these actions that will advance “racial justice and equity” that will build a “more equitable” economy that is “essential” to economic growth.

Speaking at the World Economic Forum’s virtual Davos Agenda conference on January 27, Russian President Vladimir Putin said that the current era shows parallels to the 1920s and 1930s before the “catastrophic World War II.”

Putin warned that the situation could result in “grim dystopia” if there’s no international effort to ease existing global tensions and imbalances.

“Nowadays, such a heated conflict is not possible, I hope,” Putin noted. “Because it will mean the end of our civilization.”

“But I’d like the reiterate that the situation might develop unpredictably and uncontrollably if we sit on our hands doing nothing to avoid it. There’s a possibility that we might experience an actual collapse in global development that might result in a fight of all against all.”

This situation, he warned, would result in a “grim dystopia.”

“The coronavirus pandemic has become a major challenge to mankind, and it has accelerated structural changes, the preconditions for which were already in place,” he added. “We have every reason to believe that the tensions might be aggravated even further.”

“International institutions are weakening, regional conflicts are multiplying, the global security system is degrading,” Putin said. “We need [to] ensure development following a different path—one that is positive, balanced, and constructive.”

According to Putin, “the use of trade barriers, illegitimate sanctions, restrictions in the financial, technological and information spheres—such a game without rules is dramatically increasing the risks of the unilateral use of military force, which is very dangerous.”

The Russian leadership demonstrates that it is well aware of the current global trends and is working to prevent the most negative scenario. The problem of the current international situation is that far from everybody ready to work in the same direction.

Florida's Palm Beach is conducting a legal review of former US President Donald Trump's residency, as some question the legality of his intention to permanently live at Mar-a-Lago, CNN reported Friday.

"This matter is under legal review by our Town Attorney, John 'Skip' Randolph," Palm Beach Town Manager Krik Blouin told CNN in an e-mail statement, adding that "Mr. Randolph is reviewing the Declaration of Use Agreement and our Code of Ordinances to determine if former President Trump can live at Mar-a-Lago."

The Trump residency at Mar-a-Lago is under review as he previously turned the property into a members-only social club, according to reports, signing an agreement with the city that indicated that he, as with other club members, could not spend more than seven consecutive days on the palatial grounds.

The Trump team has claimed, however, that "there is no document or agreement in place that prohibits President Trump from using Mar-A-Lago as his residence", according to CNN.

The former president switched his permanent residency in 2019, choosing Mar-a-Lago over his Trump Tower in New York City, complaining of bad treatment from city and state authorities.

Arriving to Palm Beach following Joe Biden's inauguration, Trump received a lukewarm reception, as, apart from well-heeled locals questioning his residency, he was also met with taunting banners flown in the sky above the swanky resort that pointedly described as him as "pathetic loser" and the "worst president ever".

Reports also emerged that members were cancelling their Mar-a-Lago membership in large numbers, unwilling to have any connection with Trump, criticising the food and slamming the club as "dispirited".

During an event sponsored by the National Education Association (NEA), Dr. Anthony Fauci reportedly told attendees that President Biden’s goal of opening most schools in 100 days is in jeopardy:

“The President is taking very seriously the issue … both from the student standpoint and from the teacher standpoint,” Fauci said during a virtual event sponsored by the National Education Association.

“He really wants to and believes that the schools need to reopen in the next 100 days, essentially all the K to 8 schools, within 100 days. That’s the goal. That may not happen because there may be mitigating circumstances, but what he really wants to do is everything within his power to help get to that.”

The degree to which schools are open varies across the country. In some states, elites like California Governor Gavin Newsom have no problem sending their children in-person to private school programs. However, state and city leaders let unions and destructive public policies like lockdowns deprive millions of other people’s children of the same opportunity.

Chicago Public Schools threatened to dock the pay of teachers who did not return to the school. The teachers voted to go on strike rather than return. School administrators and unions are at odds in many districts across the country, and parents get frustrated. A video of a father in Virginia having an angry outburst over continued school closures went viral last week.

In other areas of the country, schools are open and using common-sense mitigation efforts. In Georgia, some school districts have been open since August, without a comprehensive testing requirement. Open schools have reverted to distance learning when the number of staff required to quarantine due to an exposure exceeded the district’s ability to staff classrooms. These periods have generally been short. The quarantine requirements are strict in many districts, requiring individuals to isolate for 14 days after exposure to an asymptomatic person with a positive test, even if masking is present.

In Florida, the governor ordered all schools to open in the fall for in-person instruction. The state-level guidelines do not require comprehensive testing. It does not appear that the state requires masking, either. Schools work with county departments of health to create their mitigation plans. The state guaranteed full funding for needed increases in staff and programs aimed at closing the educational gaps that occurred due to shutdowns in the spring of 2020.

Two recent studies have supported these approaches, showing transmission in the school environment to be very low. In a large North Carolina study, most of the infections in staff and students could be traced to community spread outside the school. Across 11 school districts, the in-school transmission was almost all in the special education environment where mitigation, like masking, is challenging.

The schools were all in the ABC Science Collaborative to share best practices. The mitigation measures discussed in the study were masking, social distancing, and hygiene. There is no mention of comprehensive testing, facility upgrades, or installation of barriers. The state’s Department of Health provided an initial surge of personal protective equipment and other tools like touchless thermometers. Students and staff received approximately five reusable cloth masks. Replenishment is now done by the schools directly.

Wood, who gained notoriety in recent months for repeatedly alleging that the 2020 election was rigged—and who at one point infamously called for the execution of then-Vice President Mike Pence—told the Atlanta Journal-Constitution that the Georgia State Bar's order would, if followed, "violate [his] First Amendment right to free speech."

“And if they do that and this harms me, then I will strongly consider suing them, and it will be a significant lawsuit," he added.

The Georgia bar's handbook stipulates that, upon finding "that an attorney may be impaired or incapacitated to practice law due to mental incapacity or substance abuse," the bar may "make a confidential referral of the matter to the Lawyer Assistance Program for the purposes of confrontation and referral of the attorney to treatment centers and peer support groups."

The bar also says that, of the lawyers under its jurisdiction, "want of a sound mind, senility, habitual intoxication or drug addiction, to the extent of impairing competency as an attorney … shall constitute grounds for removing the attorney from the practice of law."

White House Press Secretary Jen Psaki on Thursday evaded the question when a reporter asked about Joe Biden’s record number of executive orders.

“Since Biden has gotten into office, he’s been acting largely unilaterally. I mean we saw record breaking number of executive orders, he has not yet met with lawmakers on Capitol Hill – we are not even quite sure who he’s talking to on Capitol Hill…does the White House believe this is the best way to make policy…?” the reporter asked.

Many corporations, once known for their opposition to raising the federal minimum wage, have reversed course in recent years, raising their own wages to $15 per hour and lobbying the federal government to legislate an increase. While larger corporations have determined they could benefit from such a reversal, studies continue to show a federal minimum wage hike will crush small business.

“The small business economy is very fragile right now,” National Federation of Independent Business (NFIB) Vice President of Federal Government Relations Kevin Kuhlman told the Daily Caller News Foundation. “And anything that hampers that small business recovery should be avoided.”

“More than doubling the federal minimum wage is one of the policies that would threaten the fragile small business economic recovery,” he said.

Kuhlman said corporations are able to afford minimum wage increases because of their larger profit margins. Lobbying for minimum wage increases also puts corporations at a competitive advantage over their small business competitors who cannot afford the added costs.

The New York Times‘ perspective on illegal migration matches George W. Bush’s “Any Willing Worker” strategy, said Mark Krikorian, director of the Center for Immigration Studies:

It is the business perspective that the level of immigration should be set by market conditions, that there are no limits. The desires of business and of the immigrants are the two things that determine how many immigrants come here, not the American people’s elected representatives.

The same claim was loudly made in 1990 when Sen. Ted Kennedy (D-MA) and President George H. Bush doubled the inflow of legal immigrants and visa workers in the 1990 immigration expansion act.

Nonetheless, 5.5 million illegal migrants moved into the United States from 1900 to 2000, doubling the illegal population to seven million, according to a report by the Department of Homeland Security.

That illegal inflow happened even though Congress also created the blue-collar H-2A and H-2B visa worker programs in 1986 and allowed the J-1 program to quadruple during the 1990s.

The New York Times report also downplays the civic and economic value of automating and mechanizing lower-skilled jobs, claiming that “Demographers say a shortage of blue-collar workers highlights the need for immigrants, in ever larger numbers, to perform low-skilled jobs.”

There is growing evidence that labor migration reduces pressure on investors to redirect their profits back into the productivity-boosting training, innovation, automation, and robotics that can keep lower-skilled Americans and America rich, stable, and more equal, amid growing worldwide competition.

Democrats this week called for the expulsion of first-term Congresswoman Marjorie Taylor Greene of Georgia for repeating anti-Semitic tropes and amplifying dangerous – and discredited – QAnon conspiracy theories.

False allegations of mass election fraud — disinformation that Greene perpetuated — helped fuel the deadly Capitol insurrection.

"President Trump did not cause the attack on the Capitol on January 6th," Greene said at a town hall on January 28.

For his part, former President Trump has sidestepped QAnon, claiming he knows little about a movement at the core of his support.

"I've heard these are people that love our country," Mr. Trump said in August 2020.

Disinformation reached new heights in 2020. A recent study showed Facebook users interacted with deceptive posts more than 1 billion times in October, November and December — about twice the total leading up to the 2016 election.

"That even when people were increasing their news consumption overall online, their consumption of the set of information from the deceptive sites was even greater," said Karen Kornbluh, who leads German Marshall Fund's Digital New Deal project.

The QAnon world is rooted in a belief Mr. Trump can save society from a cabal of Democratic pedophiles running a global child trafficking ring.

"It was a drug. It was absolutely a drug," said Jitarth Jideja, a former QAnon believer who said he lost almost two years of his life to the cult.

"You should be really scared, these guys are dangerous. they're more dangerous than white supremacists," Jideja said.

Robinhood drew millions from bank credit lines as well as raising more than $1 billion from its existing investors.

New York markets had just fired up, and the investing world was tuning in for Thursday’s episode of the continuing drama: legions of Robinhood Markets investors versus hedge-fund Goliaths.

But within minutes, a shock wave invisible to the outside world rattled the mechanics of Wall Street — sending Robinhood rushing to raise more than $1 billion of additional cash. The stock market’s central clearing hub had demanded large sums of collateral from brokerages including Robinhood that for weeks had facilitated spectacular jumps in shares such as GameStop Corp.

The Silicon Valley venture with the wildly popular no-fee trading app came to a crossroads. It reined in the risk to itself by banning certain trades and unwinding client bets — igniting an outcry from customers and even U.S. political leaders. By that night, word was emerging that Robinhood had raised more than $1 billion from existing investors and drawn hundreds of millions more from bank credit lines to weather the storm.

“Look, it is not negotiable for us to comply with our financial requirements and our clearinghouse deposits,” Robinhood Chief Executive Vlad Tenev said in defending his firm’s decisions on Thursday in a Bloomberg Television interview. “We have to do that.”

The capital injection is “a strong sign of confidence from investors that will help us continue to further serve our customers,” a Robinhood spokesperson later said in an emailed statement. The money will allow the firm to “continue to invest in record growth.”

When the history of this month’s stock mania is written, it may be a story of how retail traders set out from Reddit message boards to challenge Wall Street’s status quo — and ended up battering their beloved brokerage too.

For weeks, Robinhood, with a mission “to democratize finance for all,” has been their trading platform of choice as they inflicted billions of dollars of losses on hedge funds by sending stocks that those firms had shorted into the stratosphere — a sort-of populist crusade into the staid world of finance.

Robinhood’s trading restrictions made virtually nobody happy Thursday, except perhaps the hedge funds. In a surreal scene, political archenemies Alexandria Ocasio-Cortez and Ted Cruz found common ground in lashing the firm’s decisions. Conspiracy theories erupted online.

The question is whether such critics will dig into the industry’s inner workings, where pressure mounted on Robinhood and other firms to limit certain trades. That would put a rare spotlight on arcane parts of the market designed to prevent catastrophe, such as the Depository Trust & Clearing Corp.

NOT ‘NEFARIOUS’

One key consideration for brokers, particularly around high-flying and volatile stocks like GameStop, is in the money they must put up with the DTCC while waiting a few days for stock transactions to settle. Those outlays, which behave like margin in a brokerage account, can create a cash crunch on volatile days, say when GameStop falls from $483 to $112 as it did at one point during Thursday’s session.

“It’s not really Robinhood doing nefarious stuff,” said Bloomberg Intelligence analyst Larry Tabb. “It’s the DTCC saying ‘This stuff is just too risky. We don’t trust that these guys have the cash to be able to withstand settling these things two days from now, because in two days, who knows what the price could be, it could be zero.’”

The trouble on Thursday began around 10 a.m., when after days of turbulence, the DTCC demanded significantly more collateral from member brokers, according to two people familiar with the matter.

A spokesman for the DTCC wouldn’t specify how much it required from specific firms but said that by the end of the day industrywide collateral requirements jumped to $33.5 billion, up from $26 billion.

MYANMAR'S leader Aung San Suu Kyi and other figures in the ruling party have been detained, a party spokesman said on Monday, after days of escalating tension with the powerful military had stirred fears of a coup.

Here is a timeline of some key events in Myanmar's recent turbulent history:

November 2015: The National League for Democracy (NLD) wins a general election by a landslide and Suu Kyi assumes power in a specially created role of state counsellor. She vows to resolve the country's myriad ethnic conflicts, attract foreign investment and continue reforms started by former general Thein Sein.

October 2016: Rohingya militants attack three police border posts in Rakhine State, killing nine police officers. Myanmar's military then carry out a security operation, resulting in some 70,000 people leaving the area for neighbouring Bangladesh.

Aug. 25, 2017: Rohingya militants launch attacks across Rakhine, triggering a military-led campaign that drives more than 730,000 Rohingya into Bangladesh. The United Nations says the campaign of mass killing, rape, and arson was carried out with "genocidal intent", which Myanmar denies. Suu Kyi says "terrorists" are behind an "iceberg of misinformation".

January 2019: New fighting begins in Rakhine between government troops and the Arakan Army (AA), an insurgent group seeking greater regional autonomy that recruits from the mostly Buddhist Rakhine ethnic minority. Suu Kyi urges the army to "crush" the rebels.

Nov. 11: Mostly Muslim Gambia files a genocide case against Myanmar at the International Court of Justice (ICJ) over its expulsion of the Rohingya.

Dec. 11: Suu Kyi appears at the ICJ in the Hague and rejects accusations of genocide against the Rohingya as "incomplete and misleading" but says war crimes may have been committed.

September 2020: The novel coronavirus sweeps Myanmar, which had previously been mostly spared. The government locks down Yangon, the commercial capital, and other areas but insists a Nov. 8 election will go ahead.

Sept. 22: Thomas Andrews, the U.N. human rights investigator to Myanmar, says polls will fail to meet international standards because of the disenfranchisement of hundreds of thousands of Rohingya. Of at least a dozen Rohingya who apply to run as candidates in the election, six are rejected.

Oct. 17: Myanmar's election commission cancels voting in vast swathes of Rakhine State, where fighting with the AA has killed dozens and displaced tens of thousands. Some areas "are not in a position to hold a free and fair election", the commission says.

Nov. 3: Army chief Min Aung Hlaing says the civilian government is making "unacceptable mistakes" in the run-up to the election, the second warning in two days about potential bias in the vote. Suu Kyi calls for calm in a Facebook post and urges voters not to be intimidated.

Nov. 9: The NLD claims a resounding victory in the parliamentary election. NLD spokesman Myo Nyunt says expects the NLD to exceed the total of 390 seats it took in its 2015 landslide win.

Nov. 11: The main opposition, the military-backed Union Solidarity and Development Party (USDP), demands a re-run of the election and calls for military help to ensure fairness, alleging irregularities.

Nov. 13: The NLD said it would seek to form a government of national unity after official election results showed it had comfortably won enough parliamentary seats to form the next administration.

Jan. 26, 2021: Army military spokesman Brigadier General Zaw Min Tun warns it will "take action" if the election dispute is not settled and declined to rule out staging a coup, asking the election commission to investigate voter lists it said contained discrepancies.

Jan. 28: The election commission rejects allegations of vote fraud, saying there were no errors big enough to impact the credibility of the vote.

Legal experts don’t think Robinhood has much to fear from the class-action lawsuit filed after it restricted buying access to GameStop stock on Thursday.

Securities and Exchange Commission is going to have a hard time proving that the millions of retail investors who forced a short squeeze on GameStop stock violated any laws, the experts said.

“These people may just be stupid. But there are a bunch of them and they’re encouraging each other. It’s not a crime to be stupid,” University of Michigan Law professor Adam Pritchard told the Daily Caller News Foundation.

A class-action lawsuit filed against the investing app Robinhood on Thursday just hours after it prohibited its users from purchasing GameStop stock is unlikely to be successful in court, legal experts told the Daily Caller News Foundation.

And federal regulators with the Securities and Exchange Commission are going to have a hard time proving that the millions of retail investors from the Reddit forum WallStreetBets who forced a monumental short squeeze on GameStop, causing the company’s price to skyrocket nearly 1,500% in January, violated any securities laws, the experts said.

“They may be ganging up, but it doesn’t seem like there are a lot of material misrepresentations being made. And the SEC’s standard modus operandi is to go after people who are making material misrepresentations,” University of Michigan Law professor Adam Pritchard told the DCNF. “These people may just be stupid. But there are a bunch of them and they’re encouraging each other. It’s not a crime to be stupid.”

GameStop’s price explosion in January was made possible because hedge funds and other institutional investors had shorted 140% of the company’s existing shares. When an investor shorts a stock, they’re betting that the security will decrease in value. Short sellers stand to double their investment at best if the stock loses all value.

Exclusive: Dozens of former Bush officials leave Republican Party, calling it 'Trump cult

(Reuters) - Dozens of Republicans in former President George W. Bush's administration are leaving the party, dismayed by a failure of many elected Republicans to disown Donald Trump after his false claims of election fraud sparked a deadly storming of the U.S. Capitol last month.

These officials, some who served in the highest echelons of the Bush administration, said they had hoped that a Trump defeat would lead party leaders to move on from the former president and denounce his baseless claims that the November presidential election was stolen.

But with most Republican lawmakers sticking to Trump, these officials say they no longer recognize the party they served. Some have ended their membership, others are letting it lapse while a few are newly registered as independents, according to a dozen former Bush officials who spoke with Reuters.

"The Republican Party as I knew it no longer exists. I’d call it the cult of Trump," said Jimmy Gurulé, who was Undersecretary of the Treasury for Terrorism and Financial Intelligence in the Bush administration.

Kristopher Purcell, who worked in the Bush White House’s communications office for six years, said roughly 60 to 70 former Bush officials have decided to leave the party or are cutting ties with it, from conversations he has been having. "The number is growing every day," Purcell said.

Their defection from the Republican Party after a lifetime of service for many is another clear sign of how a growing intraparty conflict over Trump and his legacy is fracturing it.

The party is currently caught between disaffected moderate Republicans and independents disgusted by the hold Trump still has over elected officials, and Trump’s fervently loyal base. Without the enthusiastic support of both groups, the party will struggle to win national elections, according to polling, Republican officials and strategists.

The Republican National Committee referred Reuters to a recent interview its chair Ronna McDaniel gave to the Fox Business channel. “We’re having a little bit of a spat right now. But we are going to come together. We have to,” McDaniel said, predicting the party will unite against the agenda of President Joe Biden, a Democrat.

Representatives for Trump did not respond to a request for comment.

A representative of former President Bush did not respond to a request for comment. During the Trump presidency Bush made clear he had “retired from politics."

'IT'S APPALLING'

More than half of the Republicans in Congress - eight senators and 139 House representatives - voted to block certification of the election just hours after the Capitol siege.

Most Republican Senators have also indicated they would not support the impeachment of Trump, making it almost certain that the former president won't be convicted in his Senate trial. Trump was impeached on Jan. 13 by the Democratic-led House of Representatives on charges of "incitement of insurrection," the only president to be impeached twice.

The unwillingness by party leaders to disavow Trump was the final straw for some former Republican officials.

"If it continues to be the party of Trump, many of us are not going back," Rosario Marin, a former Treasurer of the U.S. under Bush, told Reuters. "Unless the Senate convicts him, and rids themselves of the Trump cancer, many of us will not be going back to vote for Republican leaders."

Two former Bush officials who spoke to Reuters said they believe it is important to stay in the party to rid it of Trump’s influence.
