Ghislaine Maxwell on ‘fishing expedition’ for explosive evidence from Jeffrey Epstein accusers: lawyers

Ghislaine Maxwell wants to get her hands on a wide array of evidence from Jeffrey Epstein’s accusers, including a pair of cowboy boots that the sex offender bought for one young girl in the 1990s and a notorious photo of another victim with Prince Andrew, according to new court papers.

The details of Maxwell’s subpoena were revealed Friday in a Manhattan Federal Court filing by attorney Sigrid McCawley, who represents several Epstein accusers including Annie Farmer and Virginia Giuffre.

McCawley alleges in court papers that Maxwell is on an improper “fishing expedition” for evidence to back up the claim that the law firm of high-profile attorney David Boies conspired with federal prosecutors to orchestrate the British socialite’s downfall.

Maxwell seeks communications between the firm’s lawyers and the Southern District of New York, material from the out-of-court Epstein Victims Compensation Program and other evidence, according to the court filing.

She also wants a look at private information from the victims, including Farmer’s journal from when she was a teenager, and boots Epstein bought her as a young girl, the filing says.

Maxwell has also demanded photos of Farmer’s sister, Maria, on Victoria’s Secret founder Les Wexner’s property, and a photo of Giuffre with Prince Andrew and Maxwell in the early 2000s, according to the filing.

Taken together, the proposed demands highlight how explosive the Maxwell trial, currently scheduled for July, could be if Judge Alison Nathan allows evidence beyond the timeframe of Maxwell’s charges.

I'd say that there's 8-10' more ship below the water line here.

I don't see any way to move this boat except to unload it.

The only way to unload it is by heavy lift helicopter one container at a time.

This is a big boat so let's say it's carrying 20,000 units.

To move it without unbalancing the load, you'd need to take off maybe half.

5 helos working, taking off one container per hour each. (assuming none of them are loaded heavy and can't be lifted)

That's 2000 hours.

If they work 24 hours and have no delays at all, that's 83 days plus the time it takes to do any critical repairs tot eh ship and get it moving again.

If they start tomorrow, that's almost the end of June before traffic resumes.

83 days with a trade cost of around $4billion per day is a pretty good splash.

Never mind what happens if this ship is full of something besides rubber dog doo and waffle irons.

If there are critical parts on board, that's a whole other problem.

 

Now, just imagine the chaos if they sink a ship in the Malacca straits.

Then imagine that a loos ship damages the locks in the(Chinese owned) Panama canal.

Brother, Sister-In-Law Of Michael Flynn Sue CNN Over QAnon Reporting

 

The brother and sister-in-law of former National Security Advisor Michael Flynn are suing CNN over a report that they say portrays them as adherents of the QAnon conspiracy theory.

 

Jack and Leslie Flynn point to a Feb. 4 report from CNN’s Donie O’Sullivan they claim portrays them as QAnon supporters. They are seeking $75 million in damages over the reporting they allege was false and defamatory.

 

The CNN segment, which includes a short video clip Michael Flynn posted on Twitter of the extended Flynn family’s July 4, 2020 celebrations, purports to be an in-depth look at QAnon followers. Flynn has since been banned from Twitter.

 

The Flynns allege the clip of the Flynn’s Fourth of July celebrations falsely portrayed them as QAnon followers, which “exposed Plaintiffs to public scorn, ridicule and contempt, and lowered their esteem in the community, causing insult, embarrassment, humiliation and substantial injury to Plaintiffs’ reputations.”

 

They further allege CNN’s depictions of them constitute defamation per se since a later CNN report on QAnon from Anderson Cooper “repeated that QAnon espoused ideas that were based on ‘anti-Semitic, anti-Catholic tropes that have been used [by] … the Nazis.'”

 

The Flynns claim in the lawsuit they are both private citizens. Under defamation law, private citizens have a higher expectation of privacy than public figures, so it is easier for them to collect damages. CNN faced a similar lawsuit in 2019, when high school student Nicholas Sandmann filed a suit after the network aired misleadingly-edited footage purporting to show Sandmann harassing a liberal activist.

 

Michael Flynn served as National Security Advisor to former President Donald Trump before resigning in February 2017. Trump later pardoned Flynn after he pled guilty to lying to the FBI about phone conversations he had with the Russian Ambassador. Then-Attorney General William Barr described the case as a “perjury trap.”

VIDEO: Unaccompanied Migrant Children Search for Border Patrol in South Texas

 

Breitbart Texas posted up near Mission, Texas, in the Rio Grande Valley Sector to briefly interview migrants walking trails as they searched for Border Patrol. At one point, a group of five unaccompanied alien children (UACs) stopped to share their stories.

 

Walking freely through the brush, the children ranged in ages from 9 to 17. One girl spoke on behalf of the group in near-perfect English, explaining they were traveling without adults and met each other along the journey. She was from Belize and claims to have learned English there. There were no Border Patrol agents or other law enforcement officers around to direct the children as they made their way from farm roads to an official checkpoint.

 

Border Patrol Agent Chris Cabrera, Vice President of the National Border Patrol Council, worries about the migrants, especially the unaccompanied children who are traveling through the brush as the weather begins to warm in South Texas.

 

“We’re standing where a 9-year-old died after suffering a stroke a few years back,” he said during a recent interview. “I became an EMT specifically to increase my chances of being able to help them, the dangers will only increase as the hot weather arrives in a few months,” he adds.

 

The group of children eventually reached Border Patrol and will be placed in increasingly overcrowded detention facilities.

We saw glimpses of greatness at various times. She was excellent early on in the coronavirus crisis when she was able to cut through the garbage and dig at the truth. She understood faster than others that the China coronavirus was not as bad as was being paraded on other cable news networks.

 

But at other times, Laura is lost. She gave up on President Trump as soon as the 2020 election was stolen by the Biden gang. She either didn’t have the courage to stand up to FOX Executives or she didn’t have the wits to see what was happening. But within hours Laura was already moving on with the corrupt Biden gang. Because of this, her viewership is half what it was.

 

In her interview with the President last night, she rudely cut off the President of the United States when he tried to share the facts about the election being stolen.

Concerned Delaware father Adam Bailey immediately reached out to Laurel Little League to express his concern and ask for a uniform color change or a team switch for his 5-year-old son, which was immediately denied and dismissed because the father’s request was a hindrance to Snead’s diversity activism.

Two US Spy Planes Spotted Over Syrian Government Areas In Deir Ezzor

 

On March 26, two US spy plans were spotted flying over government-held areas in the southern countryside of Syria’s Deir Ezzor.

 

The two planes, a Beechcraft MC-12W Liberty and a Beechcraft Super King Air 350, were tracked by aviation observers as they circled over the town of al-Bukamal right on the border between Syria and Iraq.

 

The MC-12W is a version of the C-12 Huron that was modified for the Intelligence, Surveillance and Reconnaissance (ISR) role for the US Air Force. Several copies of the Super King Air 350 were also modified to carry out ISR and signal intelligence missions for the US army.

 

The planes were likely spying on Iranian forces which maintain a strong presence in al-Bukamal and nearby areas in order to counter ISIS cells.

 

US-led coalition planes fly over northeastern Syria, where the Kurdish-led Syrian Democratic Forces are in control, on a daily basis. This is however the first time when US spy planes were spotted flying over the government-held part of Deir Ezzor.

 

Last month, the US carried out a series of strikes on positions of Iranian-backed Iraqi forces in al-Bukamal in repose to a rocket attack on its troops in Erbil Airport. At least one fighter of Kata’ib Hezbollah was killed in the strikes.

 

The US military may be preparing to carry out a new wave of strikes on Iranian-backed forces in Syria. This would lead to more escalation between Washington and Tehran.

Martin Nowak, a math and biology professor, will reportedly have his research center shut down but will be allowed to continue teaching after an internal review released May 2020 showedNowak had violated school security rules by giving Epstein wide access to campus.This information was released in a memo by Claudine Gay, dean of Harvard’s Faculty of Arts and Sciences, according to the Associated Press.

 

“Following a thorough review by the FAS, in which Professor Nowak had the opportunity to participate, Professor Nowak’s actions were found to have violated several FAS and Harvard policies,” Gay wrote, as Harvard Magazine reported Thursday. Nowak reportedly violated policies involving professional conduct, campus access, and guidelines for responding to requests for endorsements.

 

Nowak was placed on leave after the review, which found that he had given Epstein an office in Nowak’s research center along with a building key card.

 

Harvard’s review found that Epstein had visited Harvard more than 40 times after he was convicted of sex charges involving a minor in 2008, according to The New York Times. He had no official Harvard affiliation but had donated $6.5 million to the university’s Program for Evolutionary Dynamics, which Nowak ran — the largest share of the $9.1 million Epstein donated in total between 1998 and 2008, according to Harvard Magazine.

 

Epstein attempted to use Harvard and Nowak’s Program for Evolutionary Dynamics to burnish his image following his 2008 conviction of soliciting an underage prostitute. Novak was regularly mentioned in press releases issued by Epstein’s foundations. Nowak thanked Epstein for financial support in his 2011 book and several papers he published between 2009 and 2012, Buzzfeed reported.

Lobbying Firm Repping Ethiopian Regime a Major Biden Backer

 

A prominent Washington, D.C., lobbying firm and major Democratic donor is partnering with the Ethiopian regime, which has been accused of war crimes in the country's Tigray region, prompting a protest from Tigrayan advocates outside the firm's doors on Thursday.

 

Venable LLP, a law firm with a political lobbying arm, struck a contract in February with the Ethiopian government running through the end of April. Venable also made major donations to several Democratic candidates in the 2020 election cycle and did contract work for the company of freshman senator Mark Kelly (D., Ariz.).

 

Venable has financial ties to several of the Biden administration’s senior leaders. According to publicly available financial disclosures, employees of the lobbying firm gave more than $200,000 to the Biden campaign, more than $33,000 to Vice President Kamala Harris, and $14,000 to Secretary of Transportation Pete Buttigieg.

 

Activist Meaza Gidey said the protesters are concerned about the Ethiopian government using Venable’s connections to lawmakers on Capitol Hill to soften the American response to the humanitarian crisis.

 

"We are concerned because they might have connections that they have built over the past years," Gidey told the Washington Free Beacon. She said the firm could use those connections to "effectively convince American policymakers" to be more favorable to the Ethiopian regime.

 

In the 2020 campaign cycle, Venable and its employees donated a total of $339,200 to 132 Democratic lawmakers in Congress. The firm and its employees gave $114,707 to Republican candidates, less than 25 percent of its political donations. The firm’s influence also extends to prominent Senate Democrats. At least three lobbyists employed by Venable previously served on the staffs of Sens. Dick Durbin (D., Ill.), Chris Murphy (D., Conn.), and former senator Claire McCaskill (D., Mo.).

 

Venable did not respond to a request for comment on its relationship with Ethiopia, its stance on the crisis in Tigray, or its relationship with lawmakers.

 

The firm also lobbied for World View Enterprises, a company founded by Sen. Mark Kelly (D., Ariz.). According to publicly available contract data, the lobbying firm worked for World View Enterprises from June 2019 to October 2020. World View Enterprises paid Venable roughly $130,000 for its services. The firm's employees also gave $6,000 in campaign donations to Kelly’s Senate campaign in 2020, prompting questions about the relationship between Kelly and Venable. Kelly’s firm has already come under fire for its ties to a Chinese tech giant responsible for censorship within China.

 

A spokesman for Kelly said the senator left World View Enterprises in February 2019, before the company's contract with Venable.

Navy ‘Golden Ticket’ program allows former sailors to easily return to active duty

 

Petty Officer 1st Class Micheal Trendley left the Navy last year to join the private sector. Instead of working on helicopters, he would be juggling numbers. He joined an accounting firm in St. Louis and thought he was starting a new chapter of his life.

Then the coronavirus happened and he lost his job.

 

Thanks to an initiative launched in 2018, Trendley was able to easily rejoin the Navy. He’s already back in uniform, serving with a San Diego-based helicopter squadron.

“It was a no brainer to come back,” said Trendley, recalling all the great experiences he had and colleagues he served with while in the Navy. “It was the most fulfilling 10 years of my life.”

 

Trendley was able to quickly rejoin the Navy because his old command gave him a so-called “Golden Ticket” before he walked out the door. The entire reentry process took less than six weeks after he entered the Navy Targeted Re-entry Program.

He was only the second sailor to take advantage of the program so far.

In short, it’s a story about Democrats aiming to seize massive power over how elections are run. Of course, you wouldn’t get any of that information from The New York Times headline or copy. In fact, funny enough, the second story on The New York Times’ politics page Thursday morning was the one headlined, “Republicans Aim To Seize More Power Over How Elections Are Run.”

 

That one’s a story about Republicans working to pull control of the elections back from judges and officials’ extra-legislative “emergency rules” and rulings. The moves, the story reports with a straight face, are “threatening the fairness that is the bedrock of American democracy.”

US President Joe Biden has invited his Russian and Chinese counterparts Vladimir Putin and Xi Jinping to a climate summit scheduled for April, in hopes of speeding up global efforts to cut carbon emissions, the White House said.

 

Putin and Xi were among the 40 leaders invited to the event, anonymous administration officials told reporters on Friday. Others on the list include some of the world’s “top climate-change sufferers, do-gooders and backsliders,” AP reported

 

“It’s a list of the key players and it’s about having some of the tough conversations and the important conversations,” the official said, speaking on background. “Given how important… this issue is to the entire world, we have to be willing to talk about it and we have to be willing to talk about it at the high levels.”

 

The presumably virtual summit is scheduled to start on April 22, also known as Earth Day. It was rumored two months ago, within days of Biden taking office and announcing the US would be rejoining the Paris Agreement his predecessor Donald Trump had repudiated.

 

Biden hasn’t personally talked to Putin and Xi about the summit but “they know they’re invited,” one member of the White House press corps tweeted on Friday.

 

The Democrat has made climate change one of his priorities in both domestic and foreign policy, blocking pipeline projects and fracking with executive orders in his first week in the White House. He also appointed John Kerry, former secretary of state and one of the architects of the Paris agreement, as his special envoy for climate change, with a seat on the National Security Council.

 

Having Biden’s first major interaction with the Russian and Chinese leaders be at a climate summit is somewhat awkward, however, considering his recent comments about both. During his first press conference on Thursday, Biden called Xi a “smart guy” who “doesn’t have a democratic bone in his body,” before going off on a tangent about the future being a struggle between autocracies and democracies.

 

China has already accused the US of being “the world’s largest polluter in history and the current largest polluter,” in the words of Foreign Ministry spokesman Zhao Lijian from January.

 

Beijing has also said that China expects the US to “make up for the four-year gap” and “submit a strong nationally determined contribution and long-term low greenhouse gas emission development strategy under the Paris Agreement as soon as possible.”

 

Meanwhile, Russia has recalled its ambassador in Washington for consultations last week, after Biden called Putin a soulless killer in a TV interview. The Russian president responded by wishing his US counterpart good health and inviting him to a live on-air conversation, which the White House declined saying Biden was “too busy.”

 

The new US administration says it wants to achieve a zero-emissions energy grid by 2035 – without nuclear power – and net carbon-neutrality by 2050, but Biden has insisted this plan is not the 'Green New Deal' proposed by some progressive firebrands prior to the 2020 election.

Google exposes nine-month counter-terror hacking op by ‘friendly’ government, raising questions about what makes an ally

 

A Google hacking team has exposed — and shut down — an expert counterterrorism hacking operation by a supposed US ally. While the report hid most details, it raised troubling questions on what constitutes an ally in cyberspace.

 

The tech giant’s Project Zero and Threat Analysis Group hacking teams uncovered and ultimately put an end to a counter-terrorism operation being run by a US ally, according to MIT Tech Review, which detailed the internal struggle at Google over whether to publicize the incident and what it implied for future cyber-espionage (apparently, all’s fair in love, war, and malware attacks).

 

Both Project Zero, which uncovers and exposes security vulnerabilities, and Threat Analysis Group, which tracks hacks believed to be run by governments, helped take down the “friendly” malware attack, which weaponized 11 zero-day vulnerabilities in the course of nine months. A zero-day vulnerability is a flaw that the software’s creator and user are unaware exists, a security issue that can be used as a backdoor and otherwise exploited until it is discovered.

 

Cropping up 11 times in nine months – more frequently than a typical zero-day exploit – the attack targeted devices powered by iOS, Android, and Windows. The exploits were innovative (MIT described them as “never-before-seen techniques”) and used infected websites as “watering holes” to deliver malware to unfortunate visitors. The infection process had been ongoing since early 2020.

 

MIT revealed on Friday that the hackers running the scheme were “actually Western government operatives actively conducting a counter-terrorism operation,” an unusual revelation given that tracing hacks to state-level actors is not the easy-to-grasp, cut-and-dried operation that US cybersecurity firms like CrowdStrike and FireEye like to describe when they speak with reporters.

 

Indeed, while Google’s Threat Analysis Group attributes hacks to states, Project Zero does not, though private security companies have been working on the capability to reliably “link hostile actions with foreign actors” for the last decade – an ability that has recently become more reliable, according to a RAND Corporation paper published in September.

 

Indeed, Google seems to have only been told it was a counter-terror op in an effort to convince it to allow the hack to continue. Instead, the Google teams went ahead and squelched the attack, in a move that reportedly “caused internal division at Google,” as well as “rais[ing] questions inside the intelligence communities of the United States and its allies.”

 

While Google managed to get the hack shut down, its announcement released vanishingly few details about the attack itself – who was responsible for the hack, who was the target, and certain technical aspects of the malware and its hosting were left out in a manner that is considered highly atypical for a release by the Google teams, whose work is relied-on and revered across the industry.

USA Today’s “Race and Inclusion” Editor Hemal Jhaveri has been fired for anti-white racist tweets following the Colorado mass shooting.

Of course, it was not a white man, but Ahmad Al Aliwi Al-Issa, an Islamic Arab man who was responsible for gunning down ten white people.

 

Jhaveri announced her firing in a whiny post on Medium.

 

 

“By Tuesday morning, after the shooter was identified as Ahmad Al Aliwi Alissa, several high profile alt-right Twitter accounts picked up the tweet as an example of anti-white bias and racism against whites. You can guess what happens next,” she wrote.

 

“There was social media outrage, threats and harassment towards me, and by the end of the day, USA TODAY had relieved me of my position as a Race and Inclusion editor,” the post continued.

 

Jhaveri took no responsibility for her racism, claiming the tweet was “a challenge to white supremacy” that was weaponized by “bad faith actors.”

 

“This is not about bias, or keeping personal opinions off of Twitter. It’s about challenging whiteness and being punished for it,” she moaned.

 

USA Today stood by their decision to fire the racist.

DOJ Charges 474 With COVID-Related Fraud in the Past Year

 

The Department of Justice announced it has charged nearly 500 people with engaging in COVID-19 scams worth hundreds of millions of dollars.

 

“The Department of Justice (DOJ) has led a historic enforcement initiative to detect and disrupt COVID-19 related fraud schemes,” Attorney General Merrick Garland said in a news release on Friday, referring to the disease caused by the CCP (Chinese Communist Party) virus. “The impact of the department’s work to date sends a clear and unmistakable message to those who would exploit a national emergency to steal taxpayer-funded resources from vulnerable individuals and small businesses.”

 

The agency charged 474 defendants with engaging in criminally fraudulent schemes and attempted to obtain over $569 million from the federal government as well as unsuspecting victims.

 

“We are committed to protecting the American people and the integrity of the critical lifelines provided for them by Congress, and we will continue to respond to this challenge,” said Garland.

 

Since Congress passed the $2 trillion CARES Act last year, the agency has investigated claims related to COVID-19-related scams, including ones that bilked the Paycheck Protection Program, the Economic Injury Disaster Loans, and unemployment insurance out of money. Then-Attorney General William Barr instructed federal prosecutors investigate and prosecute fraud claims.

 

“We will not allow American citizens or the critical benefits programs that have been created to assist them to be preyed upon by those seeking to take advantage of this national emergency,” said Acting Assistant Attorney General Brian M. Boynton of the Justice Department’s Civil Division in the release. “We are proud to work with our law enforcement partners to hold wrongdoers accountable and to safeguard taxpayer funds.”

 

The DOJ focused on one case in Texas involving an alleged fraudster, Dinesh Sah, who applied for 15 Payment Protection Program loans using 11 different companies before receiving more than $17 million in government loans, which were used to buy property, jewelry, a Bentley convertible, and other items. Sah has since pleaded guilty.

 

“To anyone thinking of using the global pandemic as an opportunity to scam and steal from hardworking Americans, my advice is simple—don’t,” said acting Assistant Attorney General Nicholas McQuaid of the DOJ’s Criminal Division. “No matter where you are or who you are, we will find you and prosecute you to the fullest extent of the law.”

 

In another instance, eight people in California applied for 142 Payment Protection and Economic Injury Disaster Loans seeking more than $21 million using fake identities and fake companies. They then laundered the fund via web bank accounts and purchased jewelry, securities, and real estate, according to the DOJ.

Two people familiar with the group said they envision it becoming a conservative version of the American Civil Liberties Union, which filed 400 legal challenges against the Trump administration during the former president’s four years in office.

 

Miller has been putting America First Legal together with guidance from former Sen. Jim DeMint’s Conservative Partnership Institute and Clinton-impeachment lawyer Ken Starr, who also served on Trump’s first impeachment defense team. Gene Hamilton, a former Justice Department lawyer, has also been involved and is expected to oversee the group’s legal work since Miller himself is not a trained attorney, while former White House chief of staff Mark Meadows, currently a senior partner at CPI, will serve on its board.

 

Three people familiar with the planning said Miller is eyeing a formal rollout in the next few weeks and had recently approached a number of individuals for potential funding, including Chicago Cubs co-owner Todd Ricketts. A person close to Ricketts said he had offered no commitment in order to avoid a potential conflict given his current role as finance chair for the Republican National Committee.

 

Miller declined to comment for this story.

 

Some Trump allies cautioned that Miller’s reputation and the existence of numerous other groups with similar missions could hinder the new organization’s success. Miller became notorious during the Trump years for clashing with other administration officials over the restrictive immigration policies he would pitch to Trump — including the former president’s Muslim travel ban — and his efforts to fast-track rule changes or circumvent normal bureaucratic processes. Miller was also a primary architect and defender of the Trump administration’s forced family separations at the U.S.-Mexico border.

 

“I think this is an important endeavor but the question is whether Stephen Miller being the face of the fight against federal overreach will turn out to be a wise strategy,” said a former Trump White House official, adding that Miller could encounter fundraising difficulties “since many donors won’t want the potential exposure of backing something affiliated with him.”

 

One of the people directly involved with the group rejected the idea that Miller would occupy a public-facing role. Despite occasional TV appearances, this person said Miller planned to operate mostly behind the scenes — leaning on his connections inside the conservative movement and existing relationships with GOP attorneys general to turn AFL into a major player during the Biden era and beyond.

 

Less than 100 days into his first term, Biden is already facing a series of Republican-led lawsuits led by state attorneys general. In January, Texas Attorney General Ken Paxton sued the new administration to stop Biden from placing a 100-day moratorium on the removal of some undocumented immigrants, claiming the executive order violated the Constitution and an existing agreement between Texas and the Department of Homeland Security. Earlier this month, Paxton filed another lawsuit alongside Montana Attorney General Austin Knudsen over Biden’s executive order halting construction of the Keystone XL Pipeline. And on Wednesday, a 14-state coalition sued the Biden administration over its attempt to pause new oil and gas leases on public lands.

The flurry of activity has raised questions among some Trump allies about the need for a group like America First Legal when top law enforcement officials in red states already appear to be organizing legal challenges to Biden.

 

“If you look back at the Obama administration, the Republican AGs were extremely well organized, and I have no reason to believe they aren’t on that same trajectory now based on the people currently occupying those offices and the early litigation they’ve already filed,” said a prominent leader in conservative legal circles.

 

But others said Miller is filling a much-needed void following Biden’s aggressive use of executive orders to dismantle Trump-era policies or sidestep potential legislative hurdles.

 

“I do think that a number of the policies that the Biden administration has taken are probably ripe for some legal challenges in the sense that they were taken down pretty abruptly or they were changed pretty abruptly,” said former acting DHS Secretary Chad Wolf.

 

“What we saw during the Trump administration was numerous lawsuits because we didn’t go through the formal process. So if that was the case the last four years, I think you can look to that as guidance for what to expect now,” Wolf added.

 

Miller isn’t the only former Trump official using his executive branch experience to add a new entity to the conservative political landscape. Two other top White House policy aides, former domestic policy adviser Brooke Rollins and National Economic Council director Larry Kudlow, are assembling their own outfit that will focus on promoting Trump’s policy legacy, while former Office of Management and Budget Director Russ Vought created the Center for American Restoration, a new think tank centered around cultural issues that Trump placed at the forefront of the GOP during his time in office.

Federal government approves changes to Colorado standardized testingThe U.S. Department of Education approved most of Colorado’s plans to amend standardized testing this year, meaning most students will only be tested in one subject.

 

Schools and districts are now required to administer Colorado Measures of Academic Success, or CMAS, assessments in English language arts to students in 3rd, 5th and 7th grade, according to an announcement from the state Department of Education. Assessments in math are required for students in 4th, 6th and 8th grade.

 

Federal officials did not approve the state’s ask to cancel all science assessments, instead requiring them for 8th-graders while waving them for 5th and 11th-graders. Social studies tests, which are only mandated by state law, will not be given this year, the announcement said.

 

“In the spirit of collaboration,Colorado educators, school districts, advocacy organizations, legislators, and the department of education came together to create a solution that serves students, and provides some relief after a challenging academic year,” Gov. Jared Polis said in a statement.

 

The changes to standardized testing come as a result of a bill passed through the Colorado legislature earlier this month. Education officials are now preparing a waiver request to pause federal accountability requirements for another year, which they expect to submit in April.

The House Intelligence Committee and its chairman Adam Schiff have not shown legal precedents that justify hiding their subpoenas for a reporter's phone records during the Trump impeachment inquiry, a federal appeals judge said Wednesday.

 

The U.S. Court of Appeals for the D.C. Circuit grilled the committee's lawyer at a hearing on its decision to publish only certain subpoenas on the committee website. Conservative watchdog group Judicial Watch is seeking the public release of subpoenas to phone companies that targeted private individuals, including reporter and Just the News founder and CEO John Solomon.

 

Todd Tatelman, principal deputy general counsel for the House of Representatives, argued that the Constitution's "speech or debate clause" shields the committee from being dragged into court to divulge the scope of its subpoenas.

 

"What's your authority for what you just said?" Judge Karen Henderson responded. "I have not found any case that upholds the speech or debate clause immunity with regard to the common law right of access" to public records. Tatelman admitted he didn't know of any.

 

The judge also found it "noteworthy," if not "ironic," that Tatelman justified hiding the subpoenas to protect the privacy of irrelevant individuals whose personal information could be exposed. Judicial Watch's entire case is about the committee claiming an "unlimited" power to invade the privacy of individuals, Henderson said.

 

Judicial Watch is seeking to have the case remanded to trial court to further develop the factual record. Schiff and the committee insist that the Constitution shields them from precisely this sort of litigation to expose their "legislative documents."
