Philippine court comes down hard on child-abusing momNovember 20, 2023

32-year-old woman gets four life terms for sexually abusing 6-year-old son,1-year-old girl online for profit

A court in the Philippines has sentenced a 32-year-old mother to four life terms in prison for exploiting her six-year-old son and one-year-old girl for profit in one of the strongest penalties against online sexual abuse of children.

The conviction is another “testament to the government’s relentless effort” in ending trafficking and online sexual abuse of children, said regional prosecutor Janet Grace Dalisay-Fabrero.

The court decision, dated Oct. 16, was made public on Nov. 15 by the International Justice Mission (IJM), a non-governmental organization that deals with online child abuse in the country.

Live-streaming sex content using children is reported to be prevalent in the Catholic-majority Philippines because of its active underground sex industry, robust remittance infrastructure, inexpensive internet access, and English language proficiency, reports say.

Until November this year, police rescued 1,198 victims, arrested 372 suspects, and convicted 212 for child sex abuse, according to local media reports.

Nearly 500,000 children were sexually abused online in the Philippines last year, with nearly 250,000 adults perpetrating it, media estimates show.

Traffickers are often relatives of the children — parents, family members, or close friends. 

Child rights activists say general society and the government need to work together to end online sex abuse of children.

On Aug. 23, 2022, the government said it had chalked out a “comprehensive approach” to address the problem.

The government has partnered with telecommunications companies and internet service providers to filter the payment for sex abuse content.

According to IJM, its partnership with the authorities has “led to a dramatic decrease” in the trafficking of children in bars and brothels by up to 30 percent in some cities.

The Catholic church in the country has dedicated a Sunday as the National Day of Prayer and Awareness against Human Trafficking.

In Oakland, California, the Roman Catholic Cathedral of Christ the Light is difficult to miss. Towering over Lake Merritt in the heart of the city, its modernist glass dome reflects the East Bay sun in all directions.

The building, which was completed in 2008 and financed by the Roman Catholic diocese of Oakland, cost $175m. But that price tag confounds Joseph Piscitelli.

In the 1970s, Piscitelli attended a Catholic high school in nearby Richmond, where, from the age of 14, he experienced repeated sexual abuse at the hands of his vice-principal, an ordained priest. For decades, Piscitelli experienced nightmares and panic attacks. Friends who had also been abused turned to drugs and alcohol, and several took their own lives.

In 2003, Piscitelli sued the Salesian College Preparatory high school and the Salesian order, and won. While the cases were decided in his favor in 2006, they had not held leaders at the top accountable. So, in 2020, he filed a new suit, this time against the Oakland diocese.

Then, to Piscitelli’s dismay, the diocese declared bankruptcy in May. As a result, his case was put on an indefinite hold.

“Oakland could get together enough money to build a $200m cathedral not too long ago, but they can’t get the money together to pay the child victims whom they raped for decades,” Piscitelli said. “They’re morally and ethically bankrupt, but they’re not financially bankrupt.”

One by one, various arms of the Catholic church across California have declared bankruptcy, citing an inability to pay damages from large numbers of sexual abuse lawsuits. The dioceses of Santa Rosa and Oakland filed in the spring. The archdiocese of San Francisco followed suit in August, and the diocese of San Diego has shared its plan to do the same in November. The lawsuits come at a time when Catholicism in California is growing – fueled in large part by immigration from Latin America and Asia – while other parts of the US, including former Catholic hubs in the north-east, are seeing their numbers dwindle.

Church bankruptcy declarations are not unprecedented. From Portland to Milwaukee and from Helena to Rochester, dioceses have been declaring – and emerging from - chapter 11 bankruptcy for nearly two decades. And it isn’t only the Catholic church taking these steps. The Boy Scouts of America likewise sought protections amid thousands of sexual abuse allegations in 2020.

The flood of California suits came after 2019 legislation opened a three-year “look-back window” that would allow survivors of childhood sexual abuse to file suits based on old claims that would normally have fallen outside the statute of limitations. When the window closed last December, more than 2,000 individuals around the state had filed cases against the Catholic church; 330 accusers have sued the Oakland diocese alone.

The head of the Protestant Church in Germany has resigned amid accusations she turned a blind eye to allegations of sexual assault at a church she pastored in the 1990s.

Annette Kurschus, a senior theologian who led Germany’s largest Protestant federation, said on Monday that she had no knowledge of the alleged abuse at the time but would step down to “prevent damage to my church”.

“At every moment, I acted to the best of my knowledge and my conscience,” Kurschus said at a press conference announcing her resignation. “But public trust in my person has been damaged.”

The 60-year-old theologian has been dogged by media reports that she was informed “in detail” of allegations of sexual abuse against a church colleague in the 1990s and took no action.

The colleague — who served as a vicar in the church district of Siegen, where Kurschus worked — is now being investigated by police.

Kurschus said she had been aware of the man’s “homosexuality and unfaithfulness in marriage” at the time but heard allegations of sexual abuse only this year.

“I have never – and I stress this – never sought to shirk my responsibility, withhold important facts, cover up facts or even cover up for an accused person,” she said.

Anna-Nicole Heinrich, who heads the Protestant Church’s synod, said Kurschus’s resignation “shows the importance placed by the church on firm action on the issue of sexual violence”.

While the Catholic Church has for years been rocked by sexual assault allegations against clergy, German Protestant institutions, which represent 19 million people, have faced little scrutiny.

Should religious leaders be held responsible for disclosing to law enforcement knowledge that church members are committing acts of sexual abuse? On Friday, Arizona Judge Timothy Dickerson answered no.

Dickerson’s end-of-week ruling dismissed a high-profile child sexual abuse lawsuit against the Church of Jesus Christ of Latter-day Saints on the basis of the state’s clergy-penitent privilege.

Clergy-penitent privilege is a legal privilege that protects information from being disclosed in criminal proceedings, such as in a deposition, if that information was obtained during a confidential conversation between clergy and penitent. This privilege allows those seeking clergy counsel to communicate freely with their religious leaders with the understanding that information shared in a counseling session or other private setting will not be disclosed without their express consent, even if that information contains the confession or discovery of a crime.

This privilege was relevant to Dickerson’s ruling because the case involved the disclosure to multiple defendants including “two bishops and several other officials with the church” to whom LDS church member Paul Adams allegedly confessed he was sexually abusing his daughter.

Although Adams was excommunicated from the church, his alleged crime never was reported to civil authorities, nor was it investigated by law enforcement officials or Child Protective Services. The defendants were not responsible for reporting Adams, Dickerson explained, “because their knowledge of the abuse came from confidential communications which fall within the clergy-penitent exception.”

The failure of these church leaders to report this alleged abuse allowed Adams to continue to sexually abuse his daughter for seven more years.

Lynne Cadigan, an attorney representing the two victims who filed the lawsuit, plans to appeal Dickerson’s ruling because she believes it misuses the clergy-penitent privilege by applying it to members of the church who were not accredited clergy. She says the defendants protected by this ruling include Adams’ wife, Leizza, and non-clergy members of the church disciplinary council.

Only accredited clergy, if the situation in which a confession occurs meets the criteria laid out in the clergy-penitent privilege, are exempt from reporting requirements. Yet Dickerson’s ruling treated the group’s knowledge as exchanges that “collectively amounted” to confidential communication protected under this law.

What is really illegal to report?

Because of clergy-penitent privilege laws, acts of sexual violence that are confessed, discussed or referenced in a confidential meeting between clergy and penitents are often inadmissible for use as evidence in court. Religious leaders hearing these confessions may feel as though their hands are tied, being legally unable to report a crime they know is happening.

In response to this dilemma, many states (including Arizona) have crafted reporting laws addressing the dangers of upholding this exception for clergy, especially when it comes to cases that involve the abuse of minors. The legal exceptions granted in clergy-penitent laws can sometimes be ignored when failing to report a confession or suspicion of abuse might prevent a minor from being extracted from an abusive, traumatic and dangerous situation.

But since this is also a matter of a person’s religious right to confidential confession, the use or dismissal of these exceptions is decided case-by-case. This is not the first time a judge has decided clergy-penitent privilege was an appropriate excuse for failing to report child sex abuse to law enforcement on the basis of religious freedom.

ASSISI, Italy (ChurchMilitant.com) - The overwhelming majority of victims of clerical sex abuse in 2022 were girls between the ages of 15 and 18, a report from the Italian Bishops' Conference (CEI) has revealed.

The report, titled "Protect, Prevent, Train: On the Territorial Network for Protection of Minors and Vulnerable Adults," which was released on Thursday, identified 25 of 54 victims of clergy sex abuse as postpubescent minor females from 186 dioceses.

In all, the report recorded 32 perpetrators in 2022, following an investigation conducted under the supervision of the CEI.

According to the report, 19 out of 54 victims were over 18 years old.

"The focus on the gender of the victims reveals a clear prevalence of females (44) compared to males (10)," the report stated.

Offering a profile of abusers, the report categorized the perpetrators as aged between 40 and 60, in over half of the cases. The average age of the offender was 43 years. Most were single, but two were married.

While almost all the abusers (31 out of 32) were male and belonged to both dioceses and religious orders, there were eight laymen listed as abusers, including five teachers, one catechist, the founder of an ecclesial association, and a teacher of religion.

Rete L'Abuso, an Italian network of victims of clerical sex abuse, slammed the report as "self-congratulatory," as if "the diocesan offices are doing something positive in the area."

"In addition to not reporting the cases to the civil authorities, the report does not provide any data on facts, places, etc. and consequently, it is unverifiable," Rete L'Abuso noted on its website.

The report listed only victims who turned to help desks throughout Italy, and the numbers cited by the CEI were "definitely less" than the reports received by Rete L'Abuso during the same year, the website observed.

Moreover, there are dioceses that are reluctant to acknowledge cases of sex abuse, and such dioceses did not feature in the report, the campaign group pointed out.

Indiana Megachurch Defends Retaining Pastor Accused of Clergy Sexual Abuse

A pastor at an Indiana megachurch has been accused of grooming and misconduct with two teenage girls while he was a youth leader more than a decade ago. Although church leaders admit the man’s behavior was “inappropriate,” they have kept him on staff.

Following an investigative report published last week by the Indianapolis Star (IndyStar), Tyler Bender remains as a pastor at Grace Church in Noblesville, Ind., despite his alleged misconduct with two then-teenage girls.

The IndyStar article reports that Bender allegedly behaved in ways consistent with grooming when he was a 25-year-old volunteer worship leader at the church, about 15 years ago. This reportedly included flirtatious joking, texting, sharing details of past drug use and romantic relationships, and inviting two girls to his condo.

Bender, reportedly a “rock star” to the church’s teen musicians, began a sexual relationship with an 18-year-old identified only as Jane Doe, the IndyStar reported. Another youth group member, Megan Byers, then a minor, said Bender also invited her into his bedroom, but it stopped short of a sexual relationship. Byers spoke with The Roys Report (TRR) and authorized her name to be used.

The IndyStar did not name the man accused of misconduct. However, TRR has confirmed the man is Tyler Bender, pastor of digital experience at Grace. Bender has not been accused of a crime. But victims told TRR that they believe what Bender did was clergy sexual abuse. According to information posted at The Clergy Sexual Misconduct Information & Resources, 13 U.S. states and the District of Columbia have laws against clergy sexual abuse,

but Indiana is not one of them.

How a Spanish Newspaper Tackled the Taboo of Church Abuse

Five years ago, Soledad Gallego-Diaz challenged Spain's last great taboo: sexual abuse inside the Roman Catholic Church.

The newly appointed editor of the left-leaning daily El Pais launched an investigation into allegations of abuse by clergy and lay people against children.

Unlike in the United States, Ireland and France, the Spanish Church had not sought to address this issue.

Echoing The Boston Globe's 2002 investigation of child abuse in the Catholic Church, El Pais' probe sought justice for survivors of abuse.

"I realized that the church was not going to do anything, unlike in the U.S. and Ireland. It had no intention to do anything. It was going to carry on covering up those cases that it knew about. It was the moment to find out the truth," Gallego told VOA.

Five years after the paper launched its investigation, Spain's ombudsman published a report estimating that more than 200,000 children suffered sexual abuse from some members of Spain's Catholic clergy.

The 700-page report, published October 27, is the first national independent report on this issue.

Gallego said she believed the government ordered the ombudsman's report because of the "enormous" public reaction to the paper's investigation.

Inigo Dominguez, one of two journalists who worked on the investigation from the start, said no other media were covering this issue when El Pais started.

"No other media decided to investigate. It was a deliberate decision. So, El Pais was very alone," he told VOA.

Their work started shortly after the release of the movie "Spotlight," about The Boston Globe investigation.

As the first step in the investigation, El Pais published an email for people to contact the newspaper in confidence. The inbox soon was flooded with people who wanted to tell their stories of abuse.

Personally, the work has been very tough for the journalists involved, Dominguez said.

"Psychologically, to listen to all these terrible stories, it has put you in contact with human evil. These people have never had anyone to listen to them," he said.

"When they speak to a journalist, you realize that it is their last hope. You realize that you cannot fail, because it is their last hope." But their reporting has gone some way to achieving justice.

Angel Gabilondo, the Spanish ombudsman, spoke of the "devastating impact" on victims, and criticized the church for its inaction and attempts to cover or deny the abuse.

"What has happened has been possible because of that silence," he told a press conference.

The ombudsman report is the result of interviews with 8,000 members of the public.

It found that 0.6% of the country's adult population of roughly 39 million people said they had suffered sexual abuse as children by members of the clergy.

That percentage rose to 1.13% when it included abuse by lay people, making the potential number of victims about 400,000.

The Spanish Bishop's Conference apologized to survivors of sexual abuse by priests but questioned the accuracy of the survey that suggested such abuse was far more widespread than previous smaller investigations have found, Reuters reported.

The church's ruling body expressed its "pain for the damage caused by some church members with the sex abuses and repeated their request to the victims for forgiveness."

Francisco Garcia, Episcopal conference secretary general, said the church would contribute to a compensation fund but it would have to involve general educational institutions, sports associations and other organizations because abuse happened there too, and not just in the church.

Gallego, who was editor of El Pais from 2018 to 2020, said she has mixed feelings about the ombudsman report.

"On one hand, it was a relief that a state body, with all the resources at its disposal which are far superior to a newspaper, was uniting all the data and analyzing them. On the other, unhappiness that even the ombudsman was unable to get most bishops to answer his questions. The church hierarchy continues to believe that no one can investigate it," Gallego told VOA.

Gallego said the paper's investigation had revealed more than 2,000 victims and over 1,000 alleged abusers.

The number of reporters increased on the team in the early years of the investigation but has fluctuated throughout. And the paper is still investigating under current editor Pepa Bueno.

"The church tried to control the media. I wanted to give a voice to the victims," she said.

It was not true that the parents could have been legally arrested if they had taken Maya home on her second day at the hospital. “Against medical advice” discharges are legal and occur every day in the United States; a 2007 study shows that one to 2 percent of all hospital admissions result in one. Also, Smith’s decision to access Maya’s confidential medical records through the All Children’s portal on October 8, 2016, appears to have violated the privacy law known as HIPAA, according to Blaise Wabo, a health-care-compliance expert at a cybersecurity audit firm. Only treating physicians are allowed to access patient records unless a parent gives written consent for another party to do so. Smith was never one of Maya’s treating doctors, and on the day she opened her confidential records, there was no active DCF investigation. HIPAA violations are punishable by significant fines and up to ten years in prison. When I asked All Children’s about how child-abuse pediatricians like Smith are able to access patient records, the hospital did not answer. (Smith disputed that any HIPAA violation occurred.)

The Kowalskis sued All Children’s, DCF, Suncoast, Smith, and Bedy in October 2018, and a judge determined that there was sufficient evidence for punitive damages to be awarded for the charges of battery and false imprisonment. Early this year, Smith and Suncoast settled their portion of the lawsuit for $2.5 million. (I obtained the agreement through a public-records request.) The case against All Children’s and Bedy continues. In March, on the eve of jury selection, a judge delayed the trial indefinitely, but Jack says he is intent on deterring the hospital from needlessly separating children from their families.

“Psychologically, it destroyed all of us,” Jack says. “When somebody knocks on our door, now you don’t want to answer it because you’re worried it’s somebody from Children and Families. The city of Charleston, South Carolina has just elected a new mayor. William Cogswell has been elected as the first Republican mayor of the city since the 1800s, if you can believe it.

WCBD News reports:

William Cogswell elected mayor of Charleston

Voters in Charleston have chosen former State Representative William Cogswell to lead the city as its next mayor.

Unofficial results from the South Carolina Election Commission show Cogswell defeated incumbent John Tecklenburg, earning about 51 percent of the vote in Tuesday’s runoff election.

“The people have spoken and we’re ready, we’re ready for a new direction,” Cogswell said at his watch party in downtown Charleston shortly after declaring victory. “I am humbled by the results, no doubt. I am excited about the future of our city.”

The pair advanced to a runoff after neither earned enough votes to win outright in the Nov. 7 municipal election.

Tecklenburg, who was seeking his third term in office, conceded the race late Tuesday.

The last Republican mayor of Charleston was George I. Cunningham who left office in 1877.
