BIS chief says central banks on cusp of holy grail: a soft landing

FRANKFURT (PiQSuite.Com) - The world's biggest central banks may be on the verge of securing the holy grail of monetary policy: an economic soft landing, despite the sharpest interest rate hikes in decades, the head of a central bank umbrella group said on Monday.

 

Nearly all central banks increased interest rates at break-neck pace to combat a post-pandemic inflation surge, raising fears they would crash economic growth, destroy jobs and push up unemployment along the way.

 

But rate hikes are now over, inflation is sinking back to targets and employment has remained strong, insulating the economy from what would have been a sizable hit in previous episodes of policy tightening.

 

"Economic activity has remained surprisingly resilient, bolstering confidence that economies might be posed for a soft – or at least soft-ish – landing scenario," Agustín Carstens, the General Manager of the Bank for International Settlements said in a speech in Basel.

 

"If that is true, the fight against inflation has come at a remarkably small cost in terms of lower GDP growth or higher unemployment," said Carstens, whose group is sometimes referred to as the central bank of central banks.

 

U.S. consumer sentiment remains strong, keeping overall growth healthy, while the euro zone appears to have bottomed out after only a mild recession as labour markets softened far less than expected on both sides of the Atlantic.

 

Inflation rates have come down so much that investors are betting on U.S. Federal Reserve and European Central Bank rate cuts in the spring, despite near-steady pushback from policymakers that investors are jumping the gun.

 

Carstens also attempted to temper expectations, warning that inflation could turn out to be more stubborn than markets expect.

 

Governments are still spending way too much, wages still need to catch up after rapid inflation, and prices in services are lagging their historic trends, all suggesting plenty of price pressures are ahead, he said.

 

He noted that if services prices caught up with their pre-pandemic trend, that alone would imply inflation rates roughly 1 percentage point above inflation targets over the next three years.

 

"Once inflation returns to target, and central banks are able to ease up on the breaks, growth rates should return to their long-run potential levels," he said.

The Russian Ministry of Defense deployed two new points in the occupied Syrian Golan Heights on January 3 to monitor the ceasefire between Syria and Israel.

Enab Baladi‘s correspondent in Quneitra reported that the military posts were located in the villages of Mualaqah and Ghadir al-Bustan south of Quneitra.

After an absence of more than a year, Russia resumed its military patrols in southern Syria at the beginning of November 2023, as a Russian military patrol traveled south of Quneitra between Mualaqah and Ghadir al-Bustan, near the Safra company belonging to the 90th Brigade south of the governorate belonging to the regime’s army.

Since mid-2022, Israeli military vehicles have been working on constructing and paving a road inside Syrian territory, according to what was reported by Enab Baladi‘s correspondent in the Quneitra governorate and monitored by Israeli reporters during different periods, the latest of which in November 2022, when the Israeli Kan 11 channel broadcasted a report that included recorded footage from inside the Syrian territory.

Israeli Defense Forces entered the Syrian territory in mid-2022 with a military force consisting of six Merkava tanks and two military bulldozers accompanied by a number of soldiers to monitor the borders and vehicles to build a road named “Sofa 53”.

Enab Baladi‘s correspondent in Quneitra reported that Israeli vehicles continue to work on paving the road to this day, and the depth of work inside the Syrian territory is at least about 100 meters, reaching one kilometer in some areas.

Congress's $1.7 Trillion Spending Bill Goes On Trial In Texas

JOE BIDEN’S SIGNING OF THE CONSOLIDATED APPROPRIATIONS ACT OF 2023 MAY, IN EFFECT, BE NULL AND VOID BY DAY’S END IF A FEDERAL JUDGE IN LUBBOCK, TEXAS, AGREES WITH THE STATE’S ATTORNEY GENERAL THAT THE $1.7 TRILLION SPENDING BILL WAS NEVER VALIDLY ENACTED BECAUSE THE HOUSE OF REPRESENTATIVES LACKED A CONSTITUTIONALLY MANDATED QUORUM.

The bench trial in this hugely important case, State of Texas v. Dept. of Justice, begins at 10:30 a.m. Eastern on Monday before district court Judge James Hendrix — a Trump appointee who was first nominated by Barack Obama.

Here’s your lawsplainer so you can follow along with the developments.

Pelosi Playing Fast and Loose with the Constitution

On Feb. 15, 2023, Texas Attorney General Ken Paxton filed suit in State of Texas v. Dept. of Justice, challenging the constitutionality of the Consolidated Appropriations Act of 2023. As Paxton’s lawsuit explained, the omnibus spending bill originated in the House of Representatives as Resolution 2617. After the lower chamber passed H.R. 2617 in September 2021, the bill went to the Senate, which passed a different version of the bill in November 2022.

 

Because the spending bills differed, Congress needed to reconcile them, with each body then required to pass the amended version. On Dec. 22, 2022, the Senate approved the House’s amendments to the bill, with the House meeting the next day to consider the Senate’s changes.

 

As I explained shortly after Paxton sued the Biden administration, here’s where the constitutional problem arose:

 

When the House met on Dec. 23, 2022, to vote on the Consolidated Appropriations Act, it lacked a quorum to conduct business. Only 201 of the representatives were present. Nonetheless, the House proceeded with the vote. But it didn’t just count the votes of the present members. It added to the tally an extra 226 votes, cast by present House lawmakers on behalf of absent ones who had appointed them ‘proxies.’

 

While the votes of those physically present totaled 88 yeas and 113 nays, the House clerk recorded that the bill passed by a margin of 225 yea, 201 nay, and 1 present, relying on a rule originally adopted in May of 2020 that allowed members to ‘designate[] another Member as a proxy’ to ‘cast the vote’ of the designating Member if ‘a public health emergency due to a novel coronavirus is in effect[.]’

 

Then, on Dec. 29, 2022, Biden signed the Consolidated Appropriations Act, providing for appropriations through the fiscal year ending on Sept. 30, 2023.

 

The Quorum Clause Issue

 

In his lawsuit, Paxton argued that because the House proxy rule violates the quorum clause of the Constitution, which Texas maintains requires a member’s physical presence, the Consolidated Appropriations Act never became law.

 

The quorum clause, found in Article I of the U.S. Constitution, provides:

 

Each House shall be the Judge of the Elections, Returns and Qualifications of its own Members, and a Majority of each shall constitute a Quorum to do Business; but a smaller Number may adjourn from day to day, and may be authorized to compel the Attendance of absent Members, in such Manner, and under such Penalties as each House may provide.

 

Whether that provision requires the physical presence of members of the House to vote on legislation or allows the House to authorize voting by proxy is the bottom-line question at Monday’s trial.

Texas Is Right: Proxy Voting Is Verboten

 

From an originalist perspective, which looks at the text, structure, and original understanding of the Constitution, Texas’ quorum clause argument is correct.

 

It would make little sense for the Constitution to expressly say that if a quorum were lacking, the House was “authorized to compel the Attendance of absent Members,” if proxy voting were allowed. Further, as Paxton’s complaint notes, “delegates at the Constitutional Convention rejected proposals that would have allowed Representatives to ‘vote by proxy.’” The founders had also previously rejected proxy voting during debates over the Articles of Confederation, further illustrating that only those physically present counted for purposes of a quorum.

 

The Supreme Court has also held that to conduct congressional business, the Constitution requires a majority of members to be “actually and physically present.” This aligns with the meaning of “present” at the founding: “not absent; face to face; being at hand.” Other constitutional provisions, such as record-keeping requirements and impeachment rules in the Senate, indicate the need for physical presence.

 

Congress’s operations over the two centuries before Covid-19 lockdowns, including during various national emergencies, further establish that the quorum clause requires the physical presence of lawmakers. As Texas highlighted in its lawsuit:

 

During the Yellow Fever epidemic, Thomas Jefferson urged President Washington to keep Congress sitting in Philadelphia, then the capital, even if it meant meeting ‘in the open f[ie]lds.’ … [I]n the aftermath of that epidemic, the Third Congress enacted a law — still in force today — stating that ‘[w]henever Congress is about to convene, and from the prevalence of contagious sickness, or the existence of other circumstances, it would, in the opinion of the President, be hazardous to the lives or health of the members to meet at the seat of Government,’ the President could ‘convene Congress at such other place as he may judge proper.’

 

There would be no reason to meet “in open fields” or to “convene Congress at such other place as he may judge proper” if the House and Senate could instead opt for proxy voting without the attendance of elected officials. Further, through the Civil War, the Spanish flu pandemic, the Cold War, and the 9/11 terrorist attacks, Congress continued to meet in person.

 

Texas Is Right, So Now What?

 

This long-settled and established practice, coupled with the text and structure of the Constitution, confirms the quorum clause requires the physical presence of elected lawmakers. But only 201 members were physically present in the House on Dec. 23, 2022, meaning the legislative body lacked a quorum “to do business.” Consequently, the House could not — and did not — pass the Consolidated Appropriations Act.

 

So does that mean the entire $1.7 trillion omnibus spending bill is unconstitutional?

 

Yes and no: Because the quorum clause, properly interpreted, required the physical presence of a majority of members “to do business,” and because the House lacked the requisite quorum when it purported to pass the Consolidated Appropriations Act of 2023, the $1.7 trillion spending bill was unconstitutionally “enacted.”

 

But Texas is only challenging two aspects of the Consolidated Appropriations Act and seeks only declaratory and injunctive relief related to those two provisions. Specifically, Paxton seeks a ruling that the legislation’s expansion of Title VII’s anti-discrimination provision to require employers, including Texas, to provide “reasonable accommodations” to “limitations related to the pregnancy, childbirth, or related medical conditions of a qualified employee,” is null and void. While Texas maintains it already provides such “reasonable accommodations,” this amendment to Title VII harms the state by increasing litigation and other costs when employees wrongly believe Texas denied them a reasonable accommodation, the state argues.

 

Second, the Lonestar State challenges the $20 million appropriated to fund nonprofits and local governments to connect illegal aliens released by Immigration and Customs Enforcement with various social services. This appropriation further encourages illegal immigration and burdens Texas’ education, health care, and other costs, according to the state.

 

If Texas prevails following Monday’s bench trial, the court’s ruling would be limited to those two provisions of the Consolidated Appropriations Act of 2023. However, to strike those two portions of the omnibus spending bill, the federal court would first need to conclude that the House violated the quorum clause and thus never constitutionally passed the law.

Consequences of a Texas Win

 

Because Paxton’s complaint is narrow, a win for Texas will have limited reach. And because the Biden administration will appeal any adverse decision, by the time a decision is final, the fiscal year ending Sept. 30, 2024, will have come and gone. That means the $1.7 trillion will already have been spent, and both the $20 million appropriated to the pilot program to assist illegal aliens and every other dollar “authorized” by the omnibus spending bill will be history.

 

That will not be the end of the case, however, because of the so-called Pregnant Workers’ Fairness Act that Congress shoehorned into the spending legislation. That portion of the omnibus bill had nothing to do with appropriations and instead amended the substantive portions of Title VII. So even after all the money is spent, there will be one aspect of the Consolidated Appropriations Act of 2023 that could be stricken.

 

Knowing that ruling in Texas’ favor won’t affect any of the $1.7 trillion in the spending bill should assuage any practical concerns Judge Hendrix may have that the bill is too big to declare unconstitutional. And while striking the amendment to Title VII will have some ramifications, Congress can always re-up the “reasonable accommodation” provision, although that is unlikely with the current red House.

 

Yet the consequences of ruling in Texas’ favor would still be huge because it would be a declaration by a federal court that a majority of members of Congress and President Joe Biden violated their duty to faithfully execute the laws of the United States — and did so to the tune of $1.7 trillion.

 

Ruling against Texas, though, would be equally significant — but devastatingly so — because it would be a sign to our country that the judicial branch is unwilling to operate as a check on the other two branches of government. If Judge Hendrix and the appellate courts ignore the quorum clause or sidestep the constitutional issue, which is more likely, they will declare to Americans that our Constitution and the rule of law mean nothing.

 

“Many Americans may not even know that fewer than half the House members were present when Congress passed the largest spending bill in the history of our country. This was a flagrant violation of the Constitution. The relief sought in this case is narrow, but it is a matter of principle that we uphold our Constitutional order, and make clear that the federal government must never do this again,” Paxton told The Federalist.

 

Logistics of Monday

 

In pretrial haggling, the parties agreed on the logistics of the trial, with Texas and the Biden administration both agreeing to present their cases based on written declarations submitted by the parties, along with other documentary evidence. No witnesses will be called, according to a person familiar with the case, with both sides also waiving opening statements.

 

The bench trial before the district court judge will proceed, The Federalist has learned, with each side essentially presenting closing statements that highlight the evidence that the court has already admitted in advance of Monday’s hearing. Arguments will begin at 10:30 a.m. ET, with Texas allocated one hour to address issues of “justiciability,” which concerns whether Paxton’s lawsuit is one appropriate for the court to consider. The Biden administration will then have an hour to counter Paxton’s legal arguments. Texas will have another hour to address the merits of its quorum clause argument, along with the arguments concerning the appropriate remedy. And the Biden administration will again have an hour to counter Paxton’s legal team. Texas, as the plaintiff, will have the opportunity to provide a rebuttal to end the argument.

 

The ‘Justiciability’ Punt

 

Since the first two hours will focus on the question of ‘justiciability,’ watch for a punt by the court because if Judge Hendrix finds the case is “non-justiciable,” he will never reach the merits of the quorum clause question.

 

We will soon know whether our Constitution and the rule of law will crumble under the exigency of circumstances or the desires of politicians.

According to the House Subcommittee on the Weaponization of the Federal Government, which falls under the jurisdiction of the House Judiciary Committee, federal law enforcement agencies partnered with a number of financial institutions to flag transactions with the terms "MAGA," "Trump" and more. They also monitored transactions at stores like Cabela's and Bass Pro Shop. Other purchases linked to religious texts, like Christian bibles, were flagged under the guise of "preventing extremism."

 

"The Committee and Select Subcommittee have obtained documents indicating that following January 6, 2021, FinCEN distributed materials to financial institutions that, among other things, outline the 'typologies' of various persons of interest and provide financial institutions with suggested search terms and Merchant Category Codes (MCCs) for identifying transactions on behalf of federal law enforcement," the Committee released Wednesday.

 

"These materials included a document recommending the use of generic terms like 'TRUMP' and 'MAGA' to 'search Zelle payment messages' as well as a 'prior FinCEN analysis' of 'Lone Actor/Homegrown Violent Extremism Indicators.' According to this analysis, FinCEN warned financial institutions of 'extremism' indicators that include 'transportation charges, such as bus tickets, rental cars, or plane tickets, for travel to areas with no apparent purpose,' or 'the purchase of books (including religious texts) and subscriptions to other media containing extremist views.' In other words, FinCEN urged large financial institutions to comb through the private transactions of their customers for suspicious charges on the basis of protected political and religious expression," the Committee found.

 

We now know the federal government flagged terms like “MAGA” and “TRUMP,” to financial institutions if Americans completed transactions using those terms.

The alarming details have prompted House Judiciary Chairman Jim Jordan to demand transcribed interviews with FBI Director Christopher Wray and former Director of the Office of Stakeholder Integration and Engagement in the Strategic Operations Division of the Financial Crimes Enforcement Network (FinCEN) Noah Bishoff.

 

In recent years the FBI has improperly conducted hundreds-of-thousands of searches and surveillance on American citizens without warrants.

The protest came after Prime Minister Benjamin Netanyahu rejected ceasefire terms set out by Hamas

 

Family members of Israeli hostages being held captive by Hamas have invaded a parliamentary hearing in West Jerusalem, demanding that Prime Minister Benjamin Netanyahu do more to secure the release of their loved ones.

 

A group of around 20 people pushed past security into the hearing at the Knesset on Monday, some of whom held photographs of their missing relatives, Reuters reported.

 

“You will not sit here while our children die,” multiple protesters shouted, as security guards held back some of the most enraged members of the crowd.

 

Netanyahu was not present at the meeting, but the protest came a day after demonstrators set up tents outside his private residence, demanding that he strike a deal with Hamas to secure the release of the captives still in Gaza.

 

Hamas militants took around 250 people hostage during their October 7 assault on Israel. Of those, 105 were freed in a Qatari-negotiated deal in November, while the Israel Defense Forces (IDF) has confirmed the deaths of 31, three of whom it admitted were killed in a friendly-fire incident. Hamas claims that more hostages have been killed by Israeli bombs, but the IDF denies this.

Saudi Arabia reveals new conditions for ‘normalizing’ Israel ties

 

IDF attacks on Gaza's civilians are unnecessary and unacceptable, the Saudi foreign minister said

 

A normalization of relations between Saudi Arabia and Israel will only be possible if the issue of Palestinian statehood is resolved, Saudi Foreign Minister Prince Faisal bin Farhan has said.

 

The two regional powerhouses have never established diplomatic ties, with Riyadh refusing to recognize the Jewish state as a country. Last year, Saudi and Israeli officials held talks on a potential normalization of bilateral relations under US mediation. However, the incursion into Israel by the Palestinian armed group Hamas on October 7 and the subsequent IDF operation in Gaza reportedly put the process on hold.

 

During an interview with CNN, which aired on Sunday, bin Farhan was asked if there could be normalized ties between Saudi Arabia and Israel without a credible and irreversible path towards a Palestinian state.

 

“That's the only way we're going to get the benefit. So, yes, because we need stability and only stability will come through the resolving the Palestinian issue,” he replied.

 

The top Saudi diplomat condemned Israel’s attacks on Gaza, saying that Riyadh was focused on making sure the bloodshed ends.

 

“What we are seeing is the Israelis are crushing Gaza, the civilian population of Gaza. This is completely unnecessary, completely unacceptable and has to stop,” bin Farhan stated.

 

According to the latest data from Gaza’s health ministry, the death toll from the Israeli military operation in the Palestinian enclave has reached 25,105, with 62,681 others wounded. The UN said last month that 85% of Gaza’s population has been internally displaced, while 60% of the enclave’s infrastructure has been damaged or destroyed.

 

The Hamas raid into Israel last year left around 1,200 people dead and 240 others taken hostage. More than a half of them remain in captivity.

 

CNN recorded its interview with bin Farhan on the sidelines of the World Economic Forum in Davos last week. During the event in the Swiss Alps, the Saudi diplomat also said Riyadh would “certainly” recognize Israel as part of an agreement that would include a two-state solution between the Israelis and Palestinians.

City invests $18M to relieve $2B of medical debt for New Yorkers

 

Mayor Eric Adams announced Monday that the city will invest $18 million in a three-year program to relieve $2 billion of medical debt for New Yorkers.

 

The program, run in partnership with city-based nonprofit RIP Medical Debt, aims to wipe out debt for up to 500,000 people. Individuals must have a household income at or below 400% of the federal poverty line or have medical debt that equals 5% or more of their annual household income to qualify for the initiative.

 

To relieve patients, RIP Medical Debt will purchase bundled medical debt portfolios from providers such as hospitals and commercial buyers and then erase it. Allison Sesso, the president and chief executive of RIP Medical Debt, said at the Monday press conference that the process will be application-free to ensure fewer barriers to relief. RIP Medical Debt will work with providers and hospitals around the city, purchase portfolios and run data through a debt engine to identify patients who qualify, she said, and individuals will receive letters informing them that what they owe has been erased.

Google engineer found covered in blood after allegedly killing his wife in their California home

 

Asoftware engineer for Google was reportedly found covered in blood after allegedly murdering his wife in their California home, according to a press release from the Santa Clara District Attorney's Office. The attack occurred on January 16.

 

The authorities were called for a welfare check at Liren Chen's home in Santa Clara, California, which is just a few miles outside Google's headquarters in Silicon Valley. Chen, 27, and his wife, Xuanyi Yu, were both employed by the tech giant at the time of the horrific incident.

 

Officials were alerted to the residence by an unidentified acquaintance of Chen who "expressed concern" about the couple on January 16. The acquaintance became worried after seeing Chen through a window staring "motionless on his knees" with "his hands in the air," according to the release.

 

Chen refused to pick up his phone or answer the door when the authorities arrived on the scene. After gaining entrance into the home, officers said Chen was at the scene of the murder. His right hand was "extremely swollen and purple," and his wife's body was not too far away, according to Fox News Digital.

 

Authorities noted that Yu suffered serious "blunt force injuries" to her head, which may have been the cause of death. The authorities also mentioned that Chen had blood splattered all over his "clothing, legs, arms, and hands and scratches on his arm."

 

Chen was soon arrested and charged with murder. Prosecutors said Chen faces prison time if he is convicted of the crime.

 

"Domestic violence deaths have been falling in our county, but that does not measure the depth and destructiveness of the violence," District Attorney Jeff Rosen said.

 

"Anyone who feels that they or someone else is being abused by their partners, please reach out your local law enforcement agency. You are not alone. We can help."

 

"We are shocked and deeply saddened by what has happened to Xuanyi," Google spokesperson Bailey Tomson said in a statement. "Our thoughts are with her family at this time, and we will work to provide support to them and to co-workers who are processing this tragic news."

 

Chen's arraignment was pushed back to January 22 because he is still in the hospital.

 

Chen and Yu both studied in China at Tsinghua University and at the University of California San Diego, according to Fox News Digital.

 

A motive has not yet been determined in the case.

In fact, top UN experts have been warning precisely this for months: that the Palestinian people face “the risk of genocide in Gaza”, and that there has been a “failure of the international system to mobilise to prevent genocide”.

 

The Financial Times reported in December that, in just two months of Israeli bombing, Gaza had become one of the most heavily bombed areas in human history.

Biden mourns Navy SEALs presumed dead off Somalia

President Biden on Monday mourned the loss of two Navy SEALs who are presumed dead after they went missing off the coast of Somalia earlier this month during a special covert mission to seize Iranian missile parts bound for Yemen.

 

Biden said in a statement that the presumed deaths of the two SEALs were a “profound loss for our country.”

“These SEALs represented the very best of our country, pledging their lives to protect their fellow Americans,” Biden said. “Our hearts go out to the family members, loved ones, friends, and shipmates who are grieving for these two brave Americans.”

“Our entire country stands with you,” he added. “We will never fail to honor their service, their legacy, and their sacrifice.”

The two SEALs went missing on the night of Jan. 11 while boarding a special combat operations craft in the Gulf of Aden. One sailor fell into rough waters and another jumped in to rescue the overboard SEAL.

Border Farce: UK Hires Private Boats for £36 Million to Bring Channel Migrants Ashore

 

The British government has reportedly hired a fleet of private boats to help the Border Force bring illegal Channel migrants ashore at a cost to the taxpayer at least £36 million.

 

According to a report from The Times of London, the UK Home Office — the government body responsible for controlling immigration and protecting the country’s borders — has signed a contract worth £36 million for the hiring of a “charter of vessel(s) to support small boats operations in the Dover Straits”.

 

The contract, which is set to come into force in April and will last until at least the end of March next year, will mean that private vessels will assist the Border Force in picking up migrants in the English Channel and bringing them ashore in Britain.

 

The government was forced into seeking private assistance to deal with illegal migration because of further delays to plans to replace the ageing fleet of cutters currently used by the Border Force, some of which are over 20 years old and need frequent repairs to remain operable.

 

While the government set aside £224 million to begin procuring five new cutters and six coastal patrol vessels in April of 2022, the process of replacing the current Border Force fleet was first pushed back to April of 2024 and now is not expected to begin until March of 2026.

 

In addition to the £36 million earmarked for private boats, the government also shelled out £9 million on refurbishing the outdated Border Force vessels to hopefully keep them running for a further five years.

 

The revelations come as Prime Minister Rishi Sunak is seeking to finally implement the long-awaited plan to send illegal boat migrants to Rwanda, which still needs approval from the House of Lords. The scheme, which was first floated by former Prime Minister Boris Johnson, still faces the potential of legal challenges from the European Court of Human Rights (ECHR) and at home with British judges having a long history of siding with illegal migrants, foreign criminals, and even terrorists in deportation battles.

 

Sunak, like Johnson before him, has argued that sending illegals to Rwanda to have their asylum claims processed rather than putting them up in accommodations in Britain will not only save money but will also serve as a deterrent to more illegals crossing the English Channel in small boats operated by people smuggling networks on the French coast.

 

Others, including Brexit leader Nigel Farage and Reform UK leader Richard Tice, have argued that if the government actually wanted to deter illegal boat migration, it should adopt a send-back-the-boats approach like that adopted in Australia.

 

In 2013, the government of former Australian Prime Minister Tony Abbott implemented Operation Sovereign Borders, in which migrant boats, mostly arriving from Indonesia, were immediately turned back to their country of origin or brought to off-shore asylum processing centres in third-party countries. The system effectively shut down the boat migrant routes that overwhelmed Australia prior to the policy’s implementation.

 

Conversely, rather than protecting Britain’s borders and sending illegals back to France, the UK Border Force has been accused of operating a “taxi service” for illegal migrants, picking them up in the middle of the Channel and ferrying them to the Port of Dover. The Border Force has even been reported to have travelled into French territorial waters to pick up migrants and bring them to British soil.

 

So far this year, over 600 illegal boat migrants have been brought ashore, following around 30,000 successful crossings last year.

Biden Thinks It’s Just a Matter of Time Before US Troops Are Killed in Iraq or Syria

 

The US might attack Iran directly if an American is killed

 

President Biden and his top advisors worry that it’s just a matter of time before an American soldier is killed in Iraq or Syria amid a flurry of rocket attacks launched by Shia militias on US bases that started in response to US support for the Israeli slaughter in Gaza, The New York Times reported on Sunday.

 

US officials suggested that if an American is killed, President Biden might attack Iran directly, which could provoke a major war. Iran is allied with the Shia militias that have been taking credit for attacks on US troops, but Tehran has denied it’s involved in the operations.

 

In October, the Pentagon said it had no direct evidence Iran was ordering attacks on US troops, and a US official told CNN that how willing the Shia militias were to act independently was always a “persistent intelligence gap.” Regardless, the US is still blaming Iran for the attacks.

 

The report said US officials have been debating how to respond to the attacks and don’t want to “go so far that the conflict would escalate into a full-fledged war, particularly by striking Iran directly.”

 

However, if an American is killed, the US officials say they may have no choice but to attack Iran. “That is a red line that has not been crossed, but if the Iranian-backed militias ever have a day of better aim or better luck, it easily could be,” the report reads.

 

It’s unclear from the report if the US would bomb Iran directly or target the Iranian military in Iraq or Syria. Israel recently killed five members of Iran’s Islamic Revolutionary Guard Corps (IRGC) by targeting them with airstrikes in Damascus, risking a response from Tehran.

 

So far, there have been over 140 attacks on US troops in Iraq and Syria since mid-October, and around 70 have been injured. The US has launched several airstrikes in response, prompting calls from the Iraqi government for the US and other foreign forces to withdraw from the country. But President Biden is choosing to stay, putting the troops in harm’s way and risking a major war.

Brennan Scrubs Obama's Passport Files

 

Obama’s top terrorism and intelligence adviser, John O. Brennan, headed a firm that was cited in March for breaching sensitive files in the State Department’s passport office, according to a State Department Inspector General’s report released this past July.

 

The security breach, first reported by the Washington Times and later confirmed by State Department spokesman Sean McCormack, involved a contract employee of Brennan’s firm, The Analysis Corp., which has earned millions of dollars providing intelligence-related consulting services to federal agencies and private companies.

 

During a State Department briefing on March 21, 2008, McCormack confirmed that the contractor had accessed the passport files of presidential candidates Barack Obama, Hillary Rodham Clinton, and John McCain, and that the inspector general had launched an investigation.

 

Sources who tracked the investigation say that the main target of the breach was the Obama passport file, and that the contractor accessed the file in order to "cauterize" the records of potentially embarrassing information. "They looked at the McCain and Clinton files as well to create confusion," one knowledgeable source said. "But this was basically an attempt to cauterize the Obama file."

 

At the time of the breach, Brennan was working as an unpaid adviser to the Obama campaign.

 

The passport files include "personally identifiable information such as the applicant’s name, gender, social security number, date and place of birth, and passport number," according to the inspector general report.

 

The files may contain additional information including "original copies of the associated documents," the report added. Such documents include birth certificates, naturalization certificates, or oaths of allegiance for U.S.-born persons who adopted the citizenship of a foreign country as minors.

 

The State Department Office of Inspector General (OIG) issued a 104-page report on the breach last July. Although it is stamped "Sensitive but Unclassified," the report was heavily redacted in the version released to the public, with page after page blacked out entirely."

Harris' death remains unsolved, and mysteriously, unreported until one year later, when the blogosphere discovered the murder.

 

"Lt." Quarles Harris was a petty street punk con-artist. His name was "Leiutenant" (note spelling), he was not a lieutenant in anything. He was arrested in the possession of many phony credit cards that he had acquired via an identity theft scheme which involved stealing personal information from passport applications.

Counter Terrorism In Obama's Washington

Daniel Pipes, writing in FrontPage magazine, directs our attention towards Obama's assistant for Homeland Security and Counterterrorism, John O. Brennan, who conveniently outlined the administration's present and future policy mistakes in a speech on August 6, "A New Approach for Safeguarding Americans."

 

To start with, his address to the Center for Strategic and International Studies in Washington, has an unusual tenor. "Sycophantic" is the word that springs to mind, as Brennan ninety times in five thousand words invokes either "President Obama," "he," "his," or "the president." Disturbingly, Brennan ascribes virtually every thought or policy in his speech to the wisdom of the One. This cringe-inducing lecture reminds one of a North Korean functionary paying homage to the Dear Leader.

 

Specifics are no better. Most fundamentally, Brennan calls for appeasing terrorists: "Even as we condemn and oppose the illegitimate tactics used by terrorists, we need to acknowledge and address the legitimate needs and grievances of ordinary people those terrorists claim to represent." Which legitimate needs and grievances, one wonders, does he think Al-Qaeda represents?

 

Brennan carefully delineates a two-fold threat, one being "Al-Qaida and its allies" and the other "violent extremism." But the former, self-evidently, is a subset of the latter. This elementary mistake undermines his entire analysis.

 

He also rejects any connection between "violent extremism" and Islam: "Using the legitimate term jihad, which means to purify oneself or to wage a holy struggle for a moral goal, risks giving these murderers the religious legitimacy they desperately seek but in no way deserve. Worse, it risks reinforcing the idea that the United States is somehow at war with Islam itself."

 

This passage regurgitates a theory of radical Islam that, according to Lt. Colonel Joseph C. Myers of the U.S. Air Command and Staff College, "is part of a strategic disinformation and denial and deception campaign" developed by the Muslim Brotherhood. Discredited in 2007 by Robert Spencer, the theory distinguishes between good jihad and bad jihad and denies any connection between Islam and terrorism.

 

It's a deeply deceptive interpretation intended to confuse non-Muslims and win time for Islamists. The George W. Bush administration, for all its mistakes, did not succumb to this ruse. But Brennan informs us that his boss now bases U.S. policy on it.

 

Well, Obama did say this about Muslims: "I will stand with them should the political winds shift in an ugly direction." Once again, he's just doing what he said he'd do.

 

The speech contains disquieting signs of ineptitude. We learn that Obama considers nuclear weapons in the hands of terrorists to be "the most immediate and extreme threat to global security." Fine. But how does he respond? With three feeble and nearly irrelevant steps: "leading the effort for a stronger global nonproliferation regime, launching an international effort to secure the world's vulnerable nuclear material …, and hosting a global nuclear summit."

 

Nor can Brennan think straight. One example, requiring a lengthy quote.

 

"Poverty does not cause violence and terrorism. Lack of education does not cause terrorism. But just as there is no excuse for the wanton slaughter of innocents, there is no denying that when children have no hope for an education, when young people have no hope for a job and feel disconnected from the modern world, when governments fail to provide for the basic needs of their people, then people become more susceptible to ideologies of violence and death."

 

Even though most of the terrorists that have made the big time come from financially fixed families, and are well-educated, even holding professional degrees.

 

Summary: Poverty and a lack of education do not cause terrorism, but a lack of education and a job make people more susceptible to the ideas leading to terrorism. What is the distinction? Woe on us when the White House accepts illogic as analysis.

 

Further, let's focus on the statement, "when governments fail to provide for the basic needs of their people, then people become more susceptible to ideologies of violence and death," for it contains two stunning errors. First, it assumes the socialist fiction that governments provide basic needs. No. Other than in a few commodity-rich states, governments protect and offer legal structures, while the market provides.

Second, every study on the subject finds no connection between personal stress (poverty, lack of education, unemployment) and attraction to radical Islam. If anything, massive transfers of wealth to the Middle East since 1970 contributed to the rise of radical Islam. The administration is basing its policy on a falsehood.

 

Where, as they say, is the adult supervision? Implementation of the inept policies outlined by Brennan spells danger for Americans, American interests, and American allies. The bitter consequences of these mistakes soon enough will become apparent.

 

Brennan is just another gangster serving in the Obama administration. More Nonsense From Obama's Terrorism Expert

The Obama administration official who declared there was "no smoking gun" that could have alerted authorities about an al-Qaida plot to bring down a U.S. airliner over Detroit had received a personal, high-level briefing in October warning of a new al-Qaida tactic of hiding a bomb in an attacker's underwear.

 

On Fox News Sunday, John Brennan, assistant to the president for homeland security, told host Chris Wallace, "There was no smoking gun. There was no piece of intelligence that said, 'This guy's a terrorist. He's going to get on a plane.' No, not whatsoever."

 

Brennan's comment evoked derision from international expert Arnaud de Borchgrave Monday during an exclusive interview with Newsmax.TV's Kathleen Walter.

 

"I would call that twaddle in all its unrational splendor," said de Borchgrave, author, syndicated columnist, and director of the Center for Strategic and International Studies. "It's ridiculous to maintain such a thing. But [Brennan] is trying to put the best face possible on a very difficult situation. I've known him a long time, he's a highly competent man."

 

Despite Brennan's contention that no smoking gun preceded the attack, Newsweek reported that Brennan received a personal briefing in October from Muhammad bin Nayef, the Saudi Prince who narrowly survived an al-Qaida assassination attempt in August. Nayef was wounded in the explosion, which used the same technique, and the same PETN explosive material, that authorities say Nigerian Umar Farouk Abdulmutallab employed to try to bring down a Northwest airliner on Christmas Day.

 

Al-Qaida in the Arabian Peninsula claimed responsibility for both attacks.

 

An intelligence source told Newsweek bin Nayef personally briefed Brennan because "he didn't think [U.S. officials] were paying enough attention" to the growing al-Qaida threat in Yemen.

 

U.S. intelligence sources say they believe the same bomb maker built both devices.

 

Brennan told CNN that, although he personally toured the site of the bombing in Saudi Arabia and met with bin Nayef, "There was no indication, though, that al-Qaida was trying to use that type of attack and that modus operandi against aircraft."

This 20%-figure was first found in a Pentagon study on recidivism rates of the terrorists who were held at Guantanamo Bay.

 

The context in which Brennan used that 20%-figure during his speech at the ironically appropriate Islamic Center at New York University was his comparison of terrorists and recidivism to mere, common criminals in the American penal system and recidivism there. In fact, as you will witness yourself in the following video, Brennan's exact words on the subject were:

 

"People sometimes use that figure, 20%, say, 'Oh, my goodness, one out of five detainees returned to some type of extremist activity.' You know, the American penal system, the recidivism is up to something about 50% or so, as far as return to crime. 20% isn't that bad."

In coordination with the Council on American-Islamic Relations (CAIR), Shahin and his radical delegation attempted to shake down the airline with a discrimination lawsuit and bully the citizen "John Does" who flagged the imams’ security-undermining behavior. CAIR mouthpiece Ibrahim Hooper blasted "anti-Muslim hysteria" by those who saw something and said something about the imams’ in-flight shenanigans. Shahin ranted in a teleconference strategy session in 2007 that, indeed, he and his cohorts were spoiling for the incident and planning to engineer "many, many cases" to sabotage airline security efforts.

As head of the Islamic Center of Tucson in Arizona described as the first cell of al-Qaida in the United States and home to past jihadi dry-run plotters Shahin preached that his followers must put Islamic sharia law above Western laws. He told the Arizona Republic that he doubted Muslims were behind the 9/11 terrorist attacks, concluding: "All of these, they make it up." Brennan didn’t appear to know who Shahin was. "We feel that since September 11, we aren’t enjoying these values anymore. … Also, we feel that there’s a big lack of trust between Muslims’ community and our government. … My question: Is there anything being done by our government to rebuild this trust?"

 

Instead of countering the narrative, exposing Shahin’s true intentions and vigorously defending America’s homeland security apparatus, Brennan dutifully genuflected to the gods of political correctness. Obama, he told the militant 9/11 inside-job theorist and jihad white-washer, is "determined to put America on a strong course."

 

No, not a "strong course" that includes national security profiling of Islamic radicals pretending they care about our country’s best interests. By "strong course," Brennan assured Shahin, he meant a course toward assuaging the civil rights groups who have objected to every security program at airports, borders, train stations and visa offices for the past nine years.

 

Brennan told Shahin that the post-9/11 response of the Bush administration was a "reaction some people might say was over the top in some areas" (insert indignant grievance-monger nodding and mmm-hmming here), and that "in an overabundance of caution, (we) implemented a number of security measures and activities that upon reflection now we look back, after the heat of the battle has died down a bit, we say they were excessive, OK."

 

It gets worse: Brennan then went on to decry the "ignorant feelings" of Americans outraged at the jihadi attacks on American soil. And then he told Shahin and the audience of Muslim students that he "was very concerned after the attack in Fort Hood as well as the December 25 attack that all of sudden there were people who went back into this fearful position that lashed out not thinking through what was reasonable and appropriate."

 

The Fort Hood jihadist slaughtered 14 innocent soldiers and an unborn baby after an Army career of openly threatening the lives of our soldiers, and Brennan is wringing his hands about the rest of us "lashing out" over government incompetence. He believes our true sin is not in the systemic under-reaction from the military, homeland security, intel and White House officials in charge, but in the "overreacting" of the American public.

Lemme tell you a story…

A crazy ass leader I used to work for was approving things to be bought and sold in a childrens department that had evil looking shit on it… ex: A bag for kids of a friendly hairy monster with devil horns under a christmas tree.

 

I kept finding weird shit in our financials that didn't make sense and correcting them - which I should have known would put a target on my back (literally).

 

This crazy ass leader sends out an article to the whole company about a person with my exact full name. Which I thought was so weird I forwarded it to my coworker.

 

I'm on a vacation when this happens and I connect to the wifi in our Air BnB and then the internet goes out. We call the home owners bla bla bla they send out a weird guy who overshares that he is former military… He switches out our router and it's fixed.

 

About an hour after he leaves, the weather takes a dramatic turn and basically a fucking tornado drops out of nowhere and takes out 2 buildings about 20 minutes from where we were staying.

 

And this story has happened to me so many times I have lost count. I thought I was fucking crazy. If I made you a list of all the times I've narrowly escaped death by some weird stoke of chance, they'd make a documentary about me

US Forming Colonial Admin in Ukraine Consisting of Staff Trained in West - Moscow

 

The US has started establishing a colonial administration in Ukraine, Russia’s Foreign Intelligence Service said on Monday.

Ukraine’s new colonial administration will include Ukrainian officials who were earlier trained in the West, the Russian Foreign Intelligence Service’s press bureau reported citing director Sergei Naryshkin.

"As part of its policy of total vassalization of Ukraine, the US, in fact, shifted towards forming an essentially colonial administration in the country,” according to the press bureau.

 

“Under Washington’s scheme, this administration will consist of Ukrainians trained in the West, who have sworn allegiance to American interests,” the press bureau added.

Earlier, Naryshkin said that, based on data received by the Russian Foreign Intelligence Service, the US leadership is broadening Kiev’s vassal dependence on Washington, the agency noted.

This is manifested by the fact that American advisers are present in all key government departments in Ukraine. This format is similar to "how the Anglo-Saxons of the British Empire sent “political agents” to their colonies to actually manage and control the activities of local authorities," the agency clarified.

The Russian Foreign Intelligence Service has further stated that "the Americans, under one pretext or another, demanded the dismissal of individuals in prominent government positions in Ukraine who had fallen out of favor with the White House."

 

“The ‘black list’ includes dozens of high-ranking Ukrainian officials from Zelensky’s team. The Ukrainian president has been informed that if the above-mentioned demand is not met, Washington will disclose the ‘bombshell’ corruption dossier regarding members of Zelensky’s entourage,” the agency pointed out.

Keith Olbermann . . . bad actor and cartoon character is at it again! He called Senator Richard Shelby a traitor last week. Yes, a traitor, because Shelby had the temerity to answer a constituent’s question about Obama’s eligibility to hold the office of POTUS . Hat tip to a recent post on The Betrayal Blog which brought my attention to this. I stopped watching Olbermann & MSNBC months ago and would have missed this. Olbermann’s harangues and constant ravings having become so predictable, silly, and (worse still) boring! Why watch?

 

Which brings me to March ‘08, when Olbermann & MSNBC devoted an entire hour of coverage to Obama’s passport breaches by contract workers at the State Department. Here’s a reminder of “Great Passport Firestorm” of 2008 for those who may have missed it.

At the time I thought the story was an odd one to devote so much time and attention to. If a plane slams into a building that’s “breaking news”, but this? Passport peeking? I thought the coverage at MSNBC verged on the bizarre. Someone looked at Obama’s passport information . . . really what was the big deal? Strange, indeed, to devote so much time to something, that on the surface appeared to be rather minor and of little note.

 

Remember, at time, the issues concerning Obama’s eligibility had not been raised. Those stories were on the horizon, months away from the initial passport story . In fact, my first post questioning Obama’s eligibility was related to Obama’s dual citizenship. This was later in the summer of ‘08 when an article in the Rocky Mountain News first appeared. It mentioned BHO’s dual citizenship referenced back to 1963.

 

Now let’s fast forward to Olbermann and his assault on Senator Shelby.

How are these incidents ties together?

 

Well for starters, the answer to the question of “what’s the big deal” about looking at Obama’s passport has turned out to be a very big deal. Passport information includes date and place of birth . . . Hawaii or Kenya, for example. Passports information also details countries traveled to, travel dates and citizenship . . . US? Kenyan? Indonesian?

 

Suddenly the passport peeking is a very big deal if a person is perpetrating a hoax and knowingly running as an ineligible candidate for the office of President. Wanna bet Olbermann’s over the top, knee jerk reaction to the passport peeking was because Olbermann (and I would venture to say a host of others) always knew Obama was ineligible to run for POTUS.

 

The traitors among us do not include Senator Shelby . . . quite the contrary. Mr. Olbermann, you and everyone who has aided and assisted in bringing the faux President, the fraud Obama to the White House, you are the traitors and should be treated accordingly. Senator Clair Mc Caskill that includes you. The tip off? Olbermann’s over reaction and continued obfuscation of the truth as it relates to Obama’s citizenship. Olbermann has become a brazen liar and MSNBC is nothing less than Obama’s Pravda.

 

As an aside, I wonder who those two contract workers were who looked at Obama’s passport records? I sure as hell would love to talk to them and find out what was really in Obama’s records . . . the ones he continues to hide from the American people. Think there’s a way to find these two?

YEMENI HOUTHIS CLAIMED MISSILE ATTACK ON US MILITARY CARGO SHIP OCEAN JAZZ

 

Yemeni Houthis attacked the cargo ship Ocean Jazz of the US Navy in the Gulf of Aden. The ship was struck with missiles.

 

This is not the first attack on a US vessel in the region in recent days.

 

The Houthis continue claiming that they intend to attack any Israeli vessels, both with the Israeli flag and owned or operated by Israeli companies. The attacks will continue in response to the “disgusting Israeli-US aggression in the Gaza Strip.” In a recent statement, the Houthis added that they will continue to block Israeli ships until the country stops its “aggression” against the Gaza Strip.

WASHINGTON (CNN) – The CEO of a company whose employee is accused of improperly looking at the passport files of presidential candidates is a consultant to the Barack Obama campaign, a source said Saturday.

John O. Brennan, president and CEO of the Analysis Corp., advises the Illinois Democrat on foreign policy and intelligence issues, the source said.

 

Brennan briefed the media on behalf of the campaign this month.

 

The executive is a former senior CIA official and former interim director of the National Counterterrorism Center.

 

He contributed $2,300 to the Obama campaign in January.

 

When asked about the contribution, a State Department official told CNN's Zain Verjee, "We ethically awarded contracts. Political affiliation is not one of the factors that we check."

 

On Friday, the department revealed that Obama's passport file was improperly accessed three times this year, and the security of passport files of the two other major presidential candidates Democrat Hillary Clinton and Republican John McCain had also been breached. Three contract employees are accused in the wrongdoing, including the one who works for Analysis Corp. and who was disciplined. That contract employee accessed McCain's file in addition to Obama's. None of the contract employees was identified. Learn more about the companies involved »

 

The other two contract employees worked for Stanley Inc. They were fired.

 

The Washington Times, which broke the story Thursday night that Obama's records had been improperly accessed, reported Saturday that the State Department inquiry is focusing on the Analysis Corp.employee. Also, the investigation by the department's inspector general will include polygraph tests for supervisors in the passport section to find out whether there was any political motive.

The department spokesman said Saturday that he would not comment on whether the department was administering polygraphs to employees in connection with the investigation.

 

"While this is a rare occurrence, we regret the unauthorized access of any individual's private information," the company said Friday in a statement.

The department official said the three contract employees worked in three offices in the Washington area. One office does consular work and visas on evenings, holidays, weekends and overnights; another office issues passports; the third office scans and files materials.

 

The source said there has been no problem in the past with the Analysis Corp. employee, who has "extensive" experience. The worker has been with the company for years and has always worked under a State Department contract.

 

Explaining that the department had "complimented" this person for work in the past, the source said the individual is considered a "terrific" employee, except for this one instance, characterized as an "aberration."

 

The department asked the Analysis Corp. not to take any administrative action against the employee while the investigation is under way.

 

On Friday, the company released a statement saying it would fully cooperate with the federal investigation. The source said the Analysis Corp. has told the employee to do the same.

 

Echoing the State Department spokesman Friday, this source said there is no indication the motivation was anything but curiosity.

 

The source said Analysis Corp. learned of its employee's actions from the State Department on Friday morning. In its statement, Analysis Corp. confirmed that one of the accused was an employee and called the incident "isolated." E-mail to a friend

Honduran illegal immigrant, repeat child sex-offender arrested again after previous same-day release in Virginia

 

He was let go in July after producing child pornography.

 

Washington, DC law enforcement officials apprehended an illegal immigrant from Honduras and charged him with sexually abuse of a Virginia minor and production of child sex abuse materials. He was detained earlier in July for similar charges and released the same day.

 

Enforcement and Removal Operations (ERO) of Washington, DC arrested the 21-year-old illegal immigrant on Dec. 4 at his residence in Springfield, VA. His name was not released The alleged criminal assaulted law enforcement officials during the arrest.

 

“Fairfax County refused to honor the ICE detainer lodged against this Honduran noncitizen,” said Deputy Field Office Director Erik Weiss about the previous arrest, in a press release. The release did not name the Honduran national.

 

“When ICE detainers are ignored by local authorities, the public is put at risk; unfortunately, this time the result was the unnecessary injury of a federal law enforcement officer while prosecuting the arrest of a noncitizen charged with sexually abusing a Virginia minor and producing child sexual abuse material. ERO Washington remains dedicated to protecting the residents of our communities against threats posed by unlawfully present noncitizens.”

 

In July 2023, the Fairfax County Sherrif's office arrested the Honduran national and charged him with carnal knowledge of a child between the ages of 13 and 14 without force, producing child sex material, and possession of child sex material.

 

The day of his arrest in July, the Pacific Enforcement Response Center lodged an immigration detainer against the national with the Fairfax County Adult Detention Center, which the center did not honor. He was released without the detention center notifying ERO Washington.

 

He was arrested again on Jan. 4 at his home in Springfield, Virginia and punched a law enforcement officer during the process.

 

A similar occurrence happened in Boston, where an illegal immigrant raped a disabed person and was let go by authorities in November but was then re-arrested in January.

I am a former Marine, and I can honestly tell you that when an Admiral says what this one is saying, then it's time to make sure we are all prepared for the worst case scenario. Wake up people, we have very little time left to prepare.

I'm a war vet from another country.

This is what I get out of his speech.

He is downplaying the possibility of war to prevent a panic and telling you, you only need a flashlight and some water. A flashlight = the possibility of a no grid. He doesn't mention food, you all know what the cost of food is. They have plans for the next 20 years but you should only prep for 36 hours, no world war will only last for 36 hours.

NATO is about to make a bold move and they are not sure how Russia will react.

If you are in the US or Europe, take note and prep for 2 years.

Nate: I used to belong to our local emergency preparedness and disaster recovery. Where different agencies and non-profits joined church and local communities to prep and plan after a disaster.

36 hours is the window after an event to mobilize and assess. Those 36 are initial not a given. He is literally telling communities to prepare to mobilize.

In a nuclear event. 36 hours tells you to prioritize and assess, whom can be rescued and who cannot. Truth is, nothing moves for seven days. You hope some infrastructure is available for info and instruction. Within 36 hours you will know if you need to risk moving for the sake of saving those among you or shelter in place. Risks, dangers, weaknesses, threats, and rationing all are laser focused within 36 hours.

This is why I suggest having multiple location outside your area, just in case you need to mobilize. Because with disaster recovery- you are your own first responder. In a nuclear threat- all armed government will be occupied securing threats and not have personal to save lives.

The Constitution in the 100-Mile Border Zone

The Problem

 

The Fourth Amendment of the U.S. Constitution protects Americans from random and arbitrary stops and searches.

 

According to the government, however, these basic constitutional principles do not apply fully at our borders. For example, at border crossings (also called “ports of entry”), federal authorities do not need a warrant or even suspicion of wrongdoing to justify conducting what courts have called a “routine search,” such as searching luggage or a vehicle.

Even in places far removed from the border, deep into the interior of the country, immigration officials enjoy broad—though not limitless—powers. Specifically, federal regulations give U.S. Customs and Border Protection (CBP) authority to operate within 100 miles of any U.S. “external boundary.”

In this 100-mile zone, Border Patrol agents have certain additional authorities. For instance, Border Patrol can operate immigration checkpoints.

Border Patrol, nevertheless, cannot pull anyone over without “reasonable suspicion” of an immigration violation or crime (reasonable suspicion is more than just a “hunch”). Similarly, Border Patrol cannot search vehicles in the 100-mile zone without a warrant or “probable cause” (a reasonable belief, based on the circumstances, that an immigration violation or crime has likely occurred).

In practice, Border Patrol agents routinely ignore or misunderstand the limits of their legal authority in the course of individual stops, resulting in violations of the constitutional rights of innocent people. These problems are compounded by inadequate training for Border Patrol agents, a lack of oversight by CBP and the U.S. Department of Homeland Security, and the consistent failure of CBP to hold agents accountable for abuse. No matter what CBP officers and Border Patrol agents think, our Constitution applies throughout the United States, including within this “100-mile border zone.”

Much of U.S. Population Affected

 

Many people think that border-related policies only impact people living in border towns like El Paso or San Diego. The reality is that Border Patrol’s interior enforcement operations encroach deep into and across the United States, affecting the majority of Americans.

Roughly two-thirds of the United States’ population lives within the 100-mile zone—that is, within 100 miles of a U.S. land or coastal border. That’s about 200 million people.

Connecticut, Delaware, Florida, Hawaii, Maine, Massachusetts, New Hampshire, New Jersey, New York, Rhode Island and Vermont lie entirely or almost entirely within this area.

Nine of the ten largest U.S. metropolitan areas, as determined by the 2010 Census, also fall within this zone: New York City, Los Angeles, Chicago, Houston, Philadelphia, Phoenix, San Antonio, San Diego and San Jose.

Outdated Legal Authority and Lack of Oversight

 

The regulations establishing the 100-mile border zone were adopted by the U.S. Department of Justice in 1953—without any public comments or debate. At the time, there were fewer than 1,100 Border Patrol agents nationwide; today, there are over 21,000.

The Border Patrol often ignores this regulation and, aside from limiting interior checkpoint locations to within the 100-mile zone, rejects any geographic limitation on agents’ authority. At least two federal circuit courts condone Border Patrol operations outside the 100-mile zone, federal regulations and Supreme Court precedent notwithstanding.

Federal border agents are stopping, interrogating, and searching Americans on an everyday basis with absolutely no suspicion of wrongdoing, and often in ways that our Constitution does not permit.

For example, Border Patrol, according to news reports, operates approximately 170 interior checkpoints throughout the country (the actual number in operation at any given time is not publicly known). The ACLU believes that these checkpoints amount to dragnet, suspicionless stops that cannot be reconciled with Fourth Amendment protections. The Supreme Court has upheld the use of immigration checkpoints, but only insofar as the stops consist only of a brief and limited inquiry into residence status. Checkpoints cannot be primarily used for drug-search or general law enforcement efforts. In practice, however, Border Patrol agents often do not limit themselves to brief immigration inquiries and regularly conduct criminal investigations and illegal searches at checkpoints. The Border Patrol also frequently pulls over motorists in “roving patrol” stops, often without any suspicion that an immigration violation has occurred.

The ACLU has documented numerous cases of abuse by Border Patrol and filed lawsuits to obtain more information about the agency’s practices. Given Border Patrol’s lack of transparency, and in the absence of any meaningful oversight, there is still much that we don’t know about the full extent and impact of these interior “border enforcement” operations.

Part of a Broader Problem

 

The spread of border-related powers inland is inseparable from the broader expansion of government intrusion in the lives of ordinary Americans. For example, CBP claims the authority to conduct suspicionless searches of travelers’ electronic devices—such as laptops and cell phones—at ports of entry, including international arrivals at airports. These searches are particularly invasive as a result of the wealth of personal information stored on such devices. At least one circuit court has held that federal officers must have at least “reasonable suspicion” prior to conducting such searches and recent Supreme Court precedent seems to support that view.

These practices also coincide with the spread of numerous border technologies, including watch list and database systems (such as the Automated Targeting System traveler risk assessment program), advanced identification and tracking systems (including electronic passports), and intrusive technological schemes such as the “virtual border fence” and unmanned aerial vehicles (aka “drone aircraft”). With many of these technologies in the hands of private companies, there are powerful financial incentives for the continued “militarization” of the border zone.

The expansion of government power both at and near the border is part of a trend toward expanding police and national security powers without regard to the effect of such expansion on our most fundamental and treasured Constitutional rights. The federal government’s dragnet approach to law enforcement and national security is one that is increasingly turning us all into suspects. If Americans do not continue to challenge the expansion of federal power over the individual, we risk forfeiting the fundamental rights and freedoms that we inherited—including the right to simply go about our business free from government interference, harassment and abuse.
