NAIA essentially bans transgender athletes from women's sports

The National Association of Intercollegiate Athletics, the governing body for mostly small colleges, announced a policy Monday that all but bans transgender athletes from competing in women's sports.

The NAIA Council of Presidents approved the policy in a 20-0 vote. The NAIA, which oversees some 83,000 athletes at schools across the country, is believed to be the first college sports organization to take such a step.

According to the transgender participation policy, all athletes may participate in NAIA-sponsored male sports but only athletes whose biological sex assigned at birth is female and who have not begun hormone therapy will be allowed to participate in women's sports.

A student who has begun hormone therapy may participate in activities such as workouts, practices and team activities, but not in interscholastic competition.

NAIA programs in competitive cheer and competitive dance are open to all students. The NAIA policy notes every other sport "includes some combination of strength, speed and stamina, providing competitive advantages for male student-athletes.

NAIA President and CEO Jim Carr said in an interview with The Associated Press he understands the policy will generate controversy but that it was deemed best for member schools for competitive reasons.

"We know there are a lot of opinions, and a lot of people have a very emotional reaction to this, and we want to be respectful of all that," Carr said. "But we feel like our primary responsibility is fairness in competition, so we are following that path. And we've tried as best we could to allow for some participation by all."

The NAIA's 2023-24 policy did not bar transgender and nonbinary athletes from competing in the division of their choice in the regular season. In the postseason, and with some exceptions for those who have had hormone therapy, athletes had to compete in the division of their birth sex.

There is no known number of transgender athletes at the high school and college levels, though it is believed to be small. The topic has become a hot-button issue among conservative groups and others who believe transgender athletes should not be allowed to compete on girls' and women's sports teams.

Shiwali Patel, senior counsel at the National Women's Law Center, said her organization was outraged by the NAIA policy.

"This is unacceptable and blatant discrimination that not only harms trans, nonbinary and intersex individuals, but limits the potential of all athletes," Patel said in a statement. "It's important to recognize that these discriminatory policies don't enhance fairness in competition. Instead, they send a message of exclusion and reinforce dangerous stereotypes that harm all women."

Last month, more than a dozen current and former college athletes filed a federal lawsuit against the NCAA, accusing the sports governing body for more than 500,000 athletes of violating their rights by allowing transgender women to compete in women's sports.

Hours after the NAIA announcement, the NCAA released a statement: "College sports are the premier stage for women's sports in America and the NCAA will continue to promote Title IX, make unprecedented investments in women's sports and ensure fair competition for all student-athletes in all NCAA championships."

At least 24 states have laws barring transgender women and girls from competing in certain women's or girls sports competitions.

The Biden administration originally planned to release a new federal Title IX rule - the law forbids discrimination based on sex in education - addressing both campus sexual assault and transgender athletes. Earlier this year, the department decided to split them into separate rules, and the athletics rule now remains in limbo.

"It's similar to the NIL stuff with all these different state laws," said Kasey Havekost, a former Division I athlete who is now a higher education attorney at Bricker Graydon. "The NCAA kind of does something but nothing really happens, and they look to the federal government, and the federal government is slow to put something in place and then we're left with all these different state laws."

Havekost expects lawsuits will follow and challenge the NAIA policy on the basis of Title IX laws.

"I feel like at some point, it will have to be addressed," she said. "It's a really complex issue. It might take a Supreme Court ruling."

About 190 of the 241 NAIA schools are private, and about 125 of those have religious affiliations of varying degrees, Carr said. Of the 20 presidents who voted, 17 are from schools affiliated with Christian denominations….

Fani Willis Urges Appeals Court Not To Reconsider Ruling Letting Her Stay On Trump Case

Fulton County District Attorney Fani Willis’ office urged a Georgia appeals court Monday not to take up defendants’ appeal of the decision allowing her to stay on the case against former President Donald Trump.

Willis told the Georgia Court of Appeals in a filing Monday it should reject defendants’ continued efforts to disqualify her, noting that Judge Scott McAfee found “the evidence insufficient to establish any actual conflict of interest and declined to dismiss the indictment.” McAfee’s March rulingallowed Willis to remain on the case if special prosecutor Nathan Wade, who she was in a relationship with and was accused of financially benefiting from appointing, stepped down.

Willis argued Monday the appeal only reflects defendants’ “dissatisfaction” with the outcome based on “proper application of well-established law to the facts.”

“Days of evidence and testimony failed to disclose anything like a calculated pre-trial plan designed to prejudice the defendants or secure their convictions,” the filing states. “The applicants have not identified any public statement injecting the District Attorney’s personal belief as to the defendants’ guilt or appealing to the public weighing of evidence.”

While McAfee did not find the defendants were able to prove an “actual” conflict of interest, he said the record highlighted “a significant appearance of impropriety.” He said there were “reasonable questions” about the truthfulness of Willis’ and Wade’s testimony about the timing of their relationship.

McAfee granted the defendants a certificate of review late March enabling them to appeal his ruling.

Willis argued that the appeal should be rejected because McAfee made “no factual finding of false testimony or a false affidavit.”

“In requesting a contrary finding on this issue, the applicants would have this Court invade the province of the trial court and make additional factual findings,” the filing said. “This it cannot do.”

Her filing also defended Willis’ “church speech” in January, where she suggested Nathan Wade was being attacked because of his race and falsely claimed she was paying all three special prosecutors the same amount.

“Insofar as the District Attorney delivered a speech at a local church, the trial court concluded the speech did not ‘cross the line’ because it failed to name any defendant; it did not disclose sensitive or confidential evidence; it did not address the merits of the indicted offenses to move the trial to the court of public opinion; and further, the case is too far removed from jury selection for any actual prejudice or improper effect on the jury pool to actualize,” she wrote.

McAfee’s ruling stated the speech was “legally improper” and “creates dangerous waters for the District Attorney to wade further into,” though he found it did not require disqualification. (Coward he knew was backing her. He’s scared)

ROME — Secretary of State Mike Pompeo recently published a sharp letter excoriating the Vatican’s plans to renew an agreement with the Chinese government on Church operations in China. He promoted the article in a tweet, concluding, “The Vatican endangers its moral authority, should it renew the deal.”

An indignant Vatican took the article more as a calculated affront than a diplomatic gesture. The friction broke into the open on Wednesday as Mr. Pompeo arrived in Rome and met with prelates and others who are hostile to Pope Francis, while the Vatican denied him a meeting with the pontiff and rebuffed his efforts to derail the deal with China.

“Pompeo asked to meet” the pope, who turned him down because Francis had “clearly said that he does not receive political figures ahead of the elections,” Cardinal Pietro Parolin, who, as secretary of state, is the Vatican’s second-ranking official, told reporters.

But to some observers on both sides of the tensions between the Roman Catholic Church and the Trump administration, Mr. Pompeo’s visit is as much about the coming presidential election as about China policy. Mr. Pompeo dismissed that suggestion as absurd, but intended or not, his trip signals that President Trump is on the side of those conservative American Catholics who worry about the church’s direction under Francis and think he is soft on China.

Francis and Mr. Trump, who have exchanged sharp words in the past, present starkly different visions on issues ranging from the environment to immigration to the threat of populism.
