Ketanji Brown Jackson turns independent streak loose on fellow justices

 

To hear Justice Ketanji Brown Jackson tell it, it’s a “perilous moment for our Constitution.”

 

The Supreme Court’s most junior justice had pointed exchanges with her colleagues on the bench this term, increasingly accusing them of unevenly applying the law — even if it meant standing on her own from the court’s other liberal justices.

 

Jackson has had an independent streak since President Biden nominated her to the bench in 2022. But the dynamic has intensified this term, especially as litigation over President Trump’s sweeping agenda reached the court.

 

It climaxed with her final dissent of decision season, when Jackson accused her fellow justices of helping Trump threaten the rule of law at a moment they should be “hunkering down.”

 

“It is not difficult to predict how this all ends,” Jackson wrote. “Eventually, executive power will become completely uncontainable, and our beloved constitutional Republic will be no more.”

 

Her stark warning came as Trump’s birthright citizenship order split the court on its 6-3 ideological lines, with all three Democratic appointed justices dissenting from the decision to limit nationwide injunctions.

 

Jackson bounded farther than her two liberal colleagues, writing in a blistering solo critique that said the court was embracing Trump’s apparent request for permission to “engage in unlawful behavior.”

 

The decision amounts to an “existential threat to the rule of law,” she said.

 

It wasn’t the first time Jackson’s fellow liberal justices left her out in the cold. She has been writing solo dissents since her first full term on the bench.

 

Jackson did so again in another case last month when the court revived the energy industry’s effort to axe California’s stricter car emission standard. Jackson accused her peers of ruling inequitably.

 

“This case gives fodder to the unfortunate perception that moneyed interests enjoy an easier road to relief in this Court than ordinary citizens,” Jackson wrote. “Because the Court had ample opportunity to avoid that result, I respectfully dissent.”

Rather than join Justice Sonia Sotomayor’s dissent that forewent such fiery language, Jackson chose to pen her own.

 

The duo frequently agrees. They were on the same side in 94 percent of cases this term, according to data from SCOTUSblog, more than any other pair except for Justices Clarence Thomas and Samuel Alito, the court’s two leading conservatives.

 

Sometimes Sotomayor signs on to Jackson’s piercing dissents, including when she last month condemned the court’s emergency order allowing the Department of Government Efficiency to access Americans’ Social Security data.

 

“The Court is thereby, unfortunately, suggesting that what would be an extraordinary request for everyone else is nothing more than an ordinary day on the docket for this Administration, I would proceed without fear or favor,” Jackson wrote.

 

But it appears there are rhetorical lines the most senior liberal justice won’t cross.

 

In another case, regarding disability claims, Sotomayor signed onto portions of Jackson’s dissent but rejected a footnote in which Jackson slammed the majority’s textualism as “somehow always flexible enough to secure the majority’s desired outcome.”

 

“Pure textualism’s refusal to try to understand the text of a statute in the larger context of what Congress sought to achieve turns the interpretive task into a potent weapon for advancing judicial policy preferences,” the most junior justice wrote, refusing to remove the footnote from her dissent.

 

Jackson’s colleagues don’t see it that way.

 

“It’s your job to do the legal analysis to the best you can,” Chief Justice John Roberts told a crowd of lawyers at a judicial conference last weekend, rejecting the notion that his decisions are driven by the real-world consequences.

 

“If it leads to some extraordinarily improbable result, then you want to go back and take another look at it,” Roberts continued. “But I don’t start from what the result looks like and go backwards.”

 

Though Roberts wasn’t referencing Jackson’s recent dissents, her willingness to call out her peers hasn’t gone unaddressed.

 

Jackson’s dissent in the birthright citizenship case earned a rare, merciless smackdown from Justice Amy Coney Barrett, cosigned by the court’s conservative majority. Replying to Jackson’s remark that “everyone, from the President on down, is bound by law,” Barrett turned that script into her own punchline.

 

“That goes for judges too,” the most junior conservative justice clapped back.

 

Deriding Jackson’s argument as “extreme,” Barrett said her dissenting opinion ran afoul of centuries of precedent and the Constitution itself.

 

“We observe only this: Justice Jackson decries an imperial Executive while embracing an imperial Judiciary,” Barrett wrote.

 

The piercing rebuke was a staunch departure from the usually restrained writing of the self-described “one jalapeño gal.” That’s compared to the five-jalapeño rhetoric of the late Justice Antonin Scalia, Barrett said, the late conservative icon for whom she clerked.

 

On today’s court, it is often Thomas who brings some of the most scathing critiques of Jackson, perhaps most notably when the two took diametrically opposite views of affirmative action two years ago.

 

Page after page, Thomas ripped into Jackson’s defense of race-conscious college admissions, accusing her of labeling “all blacks as victims.”

 

“Her desire to do so is unfathomable to me. I cannot deny the great accomplishments of black Americans, including those who succeeded despite long odds,” Thomas wrote in a concurring opinion.

 

It isn’t Thomas’s practice to announce his separate opinions from the bench, but that day, he said he felt compelled to do so. As he read it aloud from the bench for 11 minutes, Jackson stared blankly ahead into the courtroom.

 

Jackson’s boldness comes across not only in the court’s decision-making. At oral arguments this term, she spoke 50 percent more than any other justice.

 

She embraces her openness. She told a crowd in May while accepting an award named after former President Truman that she liked to think it was because they both share the same trait: bravery.

 

“I am also told that some people think I am courageous for the ways in which I engage with litigants and my colleagues in the courtroom, or the manner in which I address thorny issues in my legal writings,” Jackson said.

 

“Some have even called me fearless.”

Pezeshkian, a 70-year-old heart surgeon, was elected president of Iran following the death of Ebrahim Raisi. Carlson noted that while he expected skepticism about the reliability of the Iranian president’s answers, the intent was to give Americans access to information so they could make up their own minds.

 

“Can you believe everything you hear from the president of Iran? Probably not. But that’s not the point. The point is you should be able to decide for yourself whether you believe it or not,” he said.

 

Carlson stated that some questions — including whether U.S. strikes had disabled Iran’s nuclear program — were left out because the answers would be “unknowable.” Instead, he focused on broader questions about Iran’s goals and its position toward the United States and Israel.

 

He also revealed that he has made multiple requests to interview Israeli Prime Minister Benjamin Netanyahu and hopes that request will be accepted.

 

The interview with Pezeshkian, conducted remotely with a translator, is expected to be published in the next few days.

Last month’s US strikes on Iran’s nuclear facilities failed to hit the country’s stockpile of highly enriched uranium, Pulitzer Prize-winning journalist Seymour Hersh has claimed,citing US officials.

 

The attack, which involved seven US B-2 ‘Spirit’ bombers carrying 30,000-pound bunker busters,was not even expected to “obliterate” the Iranian nuclear program, one of the journalist’s sources admitted.

 

“The centrifuges may have survived and 400 pounds of 60% enriched uranium are missing,”one of the officials said, adding that the US bombs “could not be assured to penetrate the centrifuge chamber . . . too deep.”

 

The lack of radioactivity at the targeted Iranian nuclear sites– specifically Fordow and Isfahan – following the attacksuggest that the enriched uranium stockpile had been moved ahead of time, one US official familiar with the matter said. Fordow, an underground complex built deep inside a mountain that many believed housed the stockpiles, was a particular focus of the attack.

 

The US officials cited by Hershnevertheless believe that the location of the stockpile and its fate are “irrelevant”because of theserious damage the strikeallegedly dealt to another Iranian nuclear site near the city of Isfahan.

 

The goal of the operation was to “prevent the Iranians from building a nuclear weapon in the near term– a year or so – with the hope they would not try again,” a US official told Hersh. This could translate into “a couple of years of respite and uncertain future,” the official added.

 

Following the strikes, US President Donald Trump claimed that the attack “completely and totally obliterated” Iran’s nuclear program. CIA Director John Ratcliffe also told lawmakers that several key sites had been completely destroyed and would take years to rebuild.

 

However, interceptedcommunications suggested that Tehran had expected a worse impact from the strikesand that the real damage was limited, the Washington Post reported.

 

The strikes were part of a coordinated American-Israeli military campaign launched in mid-June. The Israel Defense Force bombed Iranian targets, claiming that Tehran was close to being able to build a nuclear weapon.

 

Hersh believes that Israel was the “immediate beneficiary” of the US strike. West Jerusalem does not officially acknowledge possessing nuclear weapons.The Jewish State may still have up to 90 nuclear warheadsat its disposal, according to a recent report by the Stockholm International Peace Research Institute (SIPRI).

Israel covered up Iranian hits on military sites – Telegraph

Successful missile attacks on air bases, a logistics hub, and an intelligence center were censored, the outlet claims

 

Israel concealed thatIranian missiles hit several key military sitesacross the country during the recent 12-day war, The Telegraph reported on Saturday, citing radar data.

Working from a Cuban photograph of Morales from 1959, I viewed news coverage of the assassination to see if I could spot the man the Cubans called El Gordo - The Fat One. Fifteen minutes in, there he was, standing at the back of the ballroom, in the moments between the end of Kennedy's speech and the shooting. Thirty minutes later, there he was again, casually floating around the darkened ballroom while an associate with a pencil moustache took notes.

 

The source of early research on Morales was Bradley Ayers, a retired US army captain who had been seconded to JM-Wave, the CIA's Miami base in 1963, to work closely with chief of operations Morales on training Cuban exiles to run sabotage raids on Castro. I tracked Ayers down to a small town in Wisconsin and emailed him stills of Morales and another guy I found suspicious - a man who is pictured entering the ballroom from the direction of the pantry moments after the shooting, clutching a small container to his body, and being waved towards an exit by a Latin associate.

 

Ayers' response was instant. He was 95% sure that the first figure was Morales and equally sure that the other man was Gordon Campbell, who worked alongside Morales at JM-Wave in 1963 and was Ayers' case officer shortly before the JFK assassination.

 

I put my script aside and flew to the US to interview key witnesses for a documentary on the unfolding story. In person, Ayers positively identified Morales and Campbell and introduced me to David Rabern, a freelance operative who was part of the Bay of Pigs invasion force in 1961 and was at the Ambassador hotel that night. He did not know Morales and Campbell by name but saw them talking to each other out in the lobby before the shooting and assumed they were Kennedy's security people. He also saw Campbell around police stations three or four times in the year before Robert Kennedy was shot.

 

This was odd. The CIA had no domestic jurisdiction and Morales was stationed in Laos in 1968. With no secret service protection for presidential candidates in those days, Kennedy was guarded by unarmed Olympic decathlete champion Rafer Johnson and football tackler Rosey Grier - no match for an expert assassination team.

 

Trawling through microfilm of the police investigation, I found further photographs of Campbell with a third figure, standing centre-stage in the Ambassador hotel hours before the shooting. He looked Greek, and I suspected he might be George Joannides, chief of psychological warfare operations at JM-Wave. Joannides was called out of retirement in 1978 to act as the CIA liaison to the House Select Committee on Assassinations (HSCA) investigating the death of John F Kennedy.

Polish Foreign Minister Radoslaw Sikorski has appealed to US President Donald Trump to resume military aid to Ukraine,complaining that a recent Russian airstrike caused damage to the Polish Embassy compound in Kiev.

 

The Russian military said its long-range strikes overnight were in response to “terrorist attacks by the Kiev regime.” Targets included industrial facilities involved in military drone and instrument production in Kiev, an airfield, and an oil refinery, according to the Russian Defense Ministry.

 

“Please restore supplies of anti-aircraft ammunition to Ukraine and impose tough new sanctions on the aggressor,”Sikorski wrote on X on Friday, addressing Trump. He also accused Russian President Vladimir Putin of “mocking”America’s peace initiatives.

 

In a separate post in Polish,Sikorski confirmed that no one was injured in the incident. Moscow says it does not target non-military targets, while attributing collateral damage to Ukraine’s air defenses and Kiev’s alleged propensity to station military assets in civilian areas.

 

The Ukrainian military reported that Russia launched over 330 drones in what was described as the single largest drone offensive to date. With the addition of missile strikes, the total number of projectiles totaled around 550, Air Force spokesperson Yury Ignat said.

 

While the US has paused certain weapons deliveries to Ukraine to preserve its own strategic reserves, Trump clarified on Thursday that there has not been a complete freeze on military aid.

 

That day, Trump and Putin held a phone discussion, which the US president later characterized as disappointing due to a lack of progress toward a peaceful resolution of the conflict.

 

Kiev and its Western backers, including Poland, continue to press Washington to expand the sanctions on Russia and boost military support for Ukraine. They have urged Trump to take the lead instead of shifting the burden onto NATO’s European members. One of their key demands is that Moscow agree to an unconditional ceasefire of at least one month.

 

Russia has rejected the idea, describing it as an attempt to allow Ukrainian forces to regroup. During peace talks in Istanbul last month, Moscow proposed a conditional truce within two possible frameworks: One requiring Ukraine to withdrawal from all Russian territories, and the other mandating a halt to Ukrainian mobilization and the suspension of Western military aid. Both were rejected.

Blackman was arrested on February 18, 2022, under the federal government’s invocation of the Emergencies Act, and charged with mischief and obstruction. He was acquitted in October 2023, but the Crown appealed and a new trial is set to begin on August 14, 2025.

 

Blackman is now seeking access to records detailing how and why his accounts were frozen, to support a Charter application at his retrial. His lawyers argue the freeze was a serious violation of his constitutional rights and plan to ask the court to stay the case.

 

“The freezing of Mr. Blackman’s bank accounts was an extreme overreach on the part of the police and the federal government,” said Chris Fleury, a constitutional lawyer representing Blackman.

 

“These records will hopefully reveal exactly how and why Mr. Blackman’s accounts were frozen.”

 

Blackman welcomed the ruling.

 

“I'm delighted that we will finally get records that may reveal why my bank accounts were frozen,” he said.

 

The Justice Centre for Constitutional Freedoms, which is backing Blackman’s legal challenge, called the ruling a significant development.

 

It is believed to be the first criminal case in Canada involving a proposed Charter challenge based on the freezing of personal bank accounts under the Emergencies Act.
