School Employee Sues District for Israel Loyalty Oath in Contract

 

In a return to the bad old days of McCarthyism, Bahia Amawi, a US citizen of Palestinian descent, lost her Texas elementary school job after refusing to pledge in writing that she would not participate in the Boycott, Divestment and Sanctions (BDS) movement. Earlier this month, Amawi sued the school district that fired her.

 

The BDS movement against Israel has become a hot button issue in the closing month of 2018. A bipartisan group of senators tried to attach the Israel Anti-Boycott Act to the unanimous spending bill that Trump almost signed to avoid the current government shutdown. Meanwhile, Donorbox, a US software company, blocked the BDS fundraising account at the behest of a pro-Israel group.

 

“The language of the affirmation Amawi was told she must sign reads like Orwellian – or McCarthyite – self-parody, the classic political loyalty oath that every American should instinctively shudder upon reading,” Glenn Greenwald wrote at The Intercept.

 

On December 12, the Council on American-Islamic Relations filed a lawsuit on Amawi’s behalf in the US District Court for the Western District of Texas against Pflugerville Independent School District, alleging that Texas’ law requiring the oath violates the First Amendment. Amawi’s complaint says the law constitutes an impermissible attempt “to impose an ideological litmus test or compel speech related to government contractors’ political beliefs, associations, and expressions.”

9th Circuit Sides With Trump On Environmental Waivers For Border Wall

The 9th Circuit Court of Appeals ruled for the Trump administration Monday in a case challenging its use of waivers to bypass environmental regulations in constructing parts of the border wall.

 

The state of California and several environmental groups sued President Donald Trump and the Department of Homeland Security (DHS) in September 2017 to stop construction of a border wall prototype and ongoing repairs to 14 miles of an existing barrier in San Diego. “Under the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (IIRIRA), the Secretary of the DHS has long had the authority ‘to install additional physical barriers and roads … in the vicinity of the United States border,'” the 9th Circuit’s opinion states, quoting the IIRIRA.

 

The IIRIRA grants the secretary of the DHS “the authority to waive all legal requirements” as is “‘necessary to ensure expeditious construction’ of those barriers and roads,” according to the 9th Circuit.

 

The 9th Circuit’s three-judge panel ruled 2-1 in favor of the federal government. The dissenting judge, Consuelo Callahan, wrote she supported the Trump administration’s argument, but thought the court lacked jurisdiction to review California’s appeal.

 

The DHS waived provisions of the National Environmental Policy Act and the Coastal Zone Management Act in 2017, expediting approval to begin construction of the border wall prototype and repairs.

 

The ruling is another legal victory for Trump in the case after U.S. District Judge Gonzalo Curiel ruled against California in February 2018. Curiel found “Congress delegated to its executive counterpart, the responsibility to construct border barriers as needed in areas of high illegal entry to detect and deter illegal entries.”

Generic drug companies conspired to fix drug prices and rake in billions by cheating customers, lawsuit says

 

 

The business practices of Big Pharma are abhorrent, but some people manage to avoid falling victim to the inflated prices of brand-name medications by getting generic pills. Unfortunately, that is looking less and less like a viable alternative as more information about extensive price fixing among generic drug companies comes to light. Now, the makers of generic pills are facing a federal antitrust case brought about by 45 different states.The attorneys general of the states in question are accusing nearly 20 generic drug makers of illegally collaborating to hike the prices of their drugs. According to the suit, which was first reported by Business Insider, employees at rival firms conspired in close communications about ways to increase their prices on drugs used to treat conditions like diabetes, insomnia, anxiety, heart failure, and epilepsy.

 

Their actions saw the prices of common drugs rise by 1,000 percent or more, with patients and taxpayers footing the bill. The lawsuit alleges they violated federal and state laws related to competition and consumer protection.

 

In one example mentioned in the civil suit, New Jersey drug company Heritage Pharmaceuticals contacted a rival’s vice president to “discuss strategy” related to how the price for a bone disease drug should be set. They found out how the rival was setting the price for its version of the medication and talked about how they could divide up the market to limit competition.

 

The lawsuit accuses some major pharmaceutical companies of this type of behavior, including Mylan, Novartis and Teva. Employees allegedly communicated via emails, text messages, phone calls and LinkedIn to find ways to hike the prices of a variety of generic medications. A criminal investigation by the U.S. Department of Justice is also underway.

 

Two of the higher-ups at Heritage Pharmaceuticals, former president Jason Malek and ex-CEO Jeffrey Glazer, have already pleaded guilty to charges including price fixing, anti-competitive conduct, and bid-rigging in different criminal actions and are reportedly cooperating with investigators.

Mexico's state-run electric company is looking to renegotiate generous natural gas contracts it has with private sector firms that stipulate payments even when gas isn't being delivered.

 

Federal Electricity Commission director Manuel Bartlett said Monday the company runs the risk of bankruptcy if it doesn't reach new terms with the companies. He said that since 2015, it has paid private sector companies 62 billion pesos ($3.2 billion) under contracts for gas delivered via pipeline to generate electricity, even when the gas isn't flowing. Several projects have been blocked by community protesters.

 

President Andres Manuel Lopez Obrador expressed optimism that the contracts could be revised voluntarily, while lambasting their existence in the first place. Several of the companies involved have ties with former government officials in Mexico.

 

"They have done juicy business under the protection of public power; they have inked unfair contracts, contracts that favor individuals," Lopez Obrador said.

 

Lopez Obrador compared the private sector investment to a "conquest," a loaded word in Latin America that alludes to the Spanish conquistadors who laid stake to the region.

 

"Mexico is no longer a land of conquest, this is over," he said, adding later that the private sector incursions into the energy sector were facilitated by influence peddling and government compliance. "There were no borders," he said.

 

Bartlett listed three companies that he said enjoy payments from the company, known as the CFE, despite stalled gas lines. One of those companies, IEnova, said in a statement: "All of IEnova's natural gas transport pipelines with CFE were awarded through open, transparent, international public bid processes, according to international industry standards."

 

The company, a unit of San Diego-based Sempra Energy, said that an IEnova pipeline that began serving CFE in May 2017 went offline the following August due to "acts of sabotage" that were reported to local and federal officials.

 

IEnova also defended its chairman, Carlos Ruiz Sacristan, after Bartlett named him as one of several former government officials who benefited from private deals with CFE. Bartlett and Lopez Obrador blame past administrations for letting CFE infrastructure fall intro disrepair while outsourcing services.

 

Ruiz Sacristan served as communications and transport minister for six years through 2000, under President Ernesto Zedillo.

 

"In his professional career in both the public and private sectors, he has conducted himself ethically, honestly, and transparently," IEnova said of Ruiz Sacristan.

 

During an interview with Mexican TV station Milenio, former President Felipe Calderon defended the contracts, calling them common in the energy industry. "Otherwise very complicated projects couldn't be financed," he said.

 

Such understandings protect the contractor in the case of community opposition or decisions on behalf of the client to, say, produce electricity by burning coal rather than natural gas.

Israel to confiscate ‘welfare funds’ from Palestine’s tax revenue

 

The Israeli government will approve a law to confiscate funds allocated by the Palestinian Authority (PA) to Palestinians it claims are involved in attacks against Israeli targets, Prime Minister Benjamin Netanyahu said Sunday.

‘No place for Israeli athletes in Malaysia,’ prime minister says

 

Malaysian Prime Minister Mahathir Mohamad said that there is “no place for Israeli athletes in Malaysia,” refusing to issue entry visas for the Israeli swimming team.

The minister stressed that: “The government will maintain its steadfast position regarding this issue as a means to protest against the continuous Israeli oppression of the Palestinian people.”

Some of us heard—it was understood who he was referring to as giving him this great advice to recuse himself—and you could say they were in career positions. But these were not the career positions or officials of days gone by when a U.S. attorney or even somebody in the Justice Department here in Washington could be trusted to give nonpolitical advice.

 

But as we have seen in the Department of Justice and FBI scandals of the last few years, we have people who were disastrously political that were seeking political victories through the Justice Department and certainly were not the nonpartisan, bipartisan people of the past.

 

I know from working with U.S. attorneys and assistant U.S. attorneys in decades past, we knew how they voted. We knew party allegiance, whether they were Republican or Democrat, but when it came to criminal law, criminal violations, those things, they may have different personal philosophies, but justice was justice. And if somebody violated the law, they were going to pursue it. They were not going to let party affiliation or their regard or lack of regard for the President or anybody else keep them from pursuing justice.

 

But this has been an extraordinary time in American history when we have found a Department of Justice had officials to the very top who were far more political than they were just; where people, even an Attorney General, would say they had a chance meeting on a tarmac, when the facts of the day indicate it really could not have been a chance meeting on a tarmac. And if it hadn’t been for a reporter spotting what he thought might be former President Bill Clinton, nobody would have ever known about that meeting while, supposedly, Hillary Clinton was under investigation.

 

We now know there was never going to be any prosecution of Hillary Clinton, no matter how grievous or egregious any criminal violation may have been, even if it meant obstructing justice by destroying emails that had been subpoenaed and destroying with a hammer or with BleachBit cellphones or computers.

Planned Parenthood Must Turn Over Documents in Contentious Lawsuit

 

OAKLAND, Calif. (CN) – A federal judge ordered Planned Parenthood and four of its affiliates to turn over a narrow range of documents related to its fetal tissue donation program in a highly acrimonious lawsuit accusing anti-abortion activists of smearing the organization.

 

U.S. Magistrate Judge Donna Ryu, who is overseeing discovery in the case, ruled that Planned Parenthood must disclose the identities of “individuals responsible for compliance with fetal tissue donation laws and regulations” at Planned Parenthood’s Mar Monte, Northern California, Los Angeles and Pacific Southwest affiliates.

 

“Plaintiffs have not explained how identifying the relevant individuals for those four affiliates would be burdensome or disproportionate to the needs of the case,” Ryu wrote in her Thursday order. “Concerns about the privacy or security of those individuals shall be addressed through use of the protective order.”

 

The dispute is the latest in a bitter, three-year legal battle between Planned Parenthood and anti-abortion activist David Daleiden, the CEO of the Center for Medical Progress. The Center infiltrated Planned Parenthood conferences by posing as a phony fetal tissue procurement company called BioMax and recorded doctors discussing the sale of fetal tissue.

 

In its lawsuit, Planned Parenthood says the money it spent beefing up security, responding to government investigations and addressing vandalism and arson at its clinics after the videos were posted constituted an injury to its business and property as required under RICO (Racketeer Influenced and Corrupt Organizations Act).

 

In a motion to compel, CMP sought to force the organization to release a broad range of documents that would show it profited from selling aborted fetal tissue.

 

Ryu’s order also requires Planned Parenthood to turn over advertisements by fetal tissue procurers like StemExpress, as well as manuals on its policies related to the use of digoxin or other feticides, mechanical vacuum aspiration and their compliance with the partial-birth abortion ban.

 

CMP and Daleiden have argued they should be allowed to show that Planned Parenthood violated the law to make as much money as possible from selling fetal tissue, saying that they learned through their investigation that “intact fetal cadavers are more valuable,” and “an analysis of the total number of intact fetuses would reveal information about plaintiffs’ profit potential.”

 

“Defendants’ publicity campaign accused plaintiffs of obtaining and selling fetal tissue in an illegal manner. Plaintiffs allege that they have not violated the laws governing these practices. For this reason, defendants should be allowed to test that allegation to some degree. However, on this record, the court concludes that defendants have not established their entitlement to broad discovery into these topics,” Ryu wrote. “Even as narrowed, the court finds that the discovery requests in this group are overbroad and disproportionate to the needs of the case.”

 

Ryu limited the documents to be included in the discovery order to those produced between January 1, 2011 – two years before the alleged infiltration began – and July 15, 2015, when CMP released its first videos.

 

“Permitting broad discovery here would create a perverse outcome by inviting future defendants in similar cases to make broad accusations in order to justify greater access to sensitive information through the litigation process,” Ryu wrote. “Discovery in this case poses special concerns, especially given its political backdrop.”

 

U.S. District Judge William Orrick III denied CMP’s motion to dismiss Planned Parenthood’s case in 2016, and tossed a separate motion to strike 15 claims against it, which included charges of racketeering and violations of California law.

 

This past week, the Fifth Circuit overturned a ruling barring Texas from eliminating Planned Parenthood from the state’s Medicaid program based on one of CMP’s videos, finding it was “authentic and not deceptively edited.”

 

Daleiden said he was happy with Ryu’s order.

If it found these words, then the 5 prong pre packaged delivery is injected, meaning 5 automatic posts are inserted, with the first one auto generating the other 4 posts at random designated times with deltas in a range of 10 to 30 minutes. Note that all 4 posts are linked to each other, forming a chain of posts with a common driver (root).

Re "We are the news"

What does this mean and how do we respond to it?

 

My first reaction to this comment by Q, is "Holy crap! this is a big responsibility!" Been thinking about it ever since.

 

I have a very positive view of QResearch board. Don't care about the shills, shitposting, porn or bots. That's just part of the scene. What impresses me is the development and refinement I see, just since I've been here (summer).

 

Just my opinion, but seems to me like this board is truly becoming more like a professional news-generating resource in previous months. Not in a stuffy, formal sense, but in the sense that anons are trying to refine their approach, e.g., to provide moar sauce or include more caps and to encourage others to do the same. Many anons seem happy to increase the usefulness of existing posts, in order to make them more substantive (by adding a cap, additional link, or thoughtful commentary).

 

Would be interested in what those anons were were here at the beginning think. How do you think the board has changed? How has it remained the same?

 

Positive developments

a. more well-organized multi-page posts

b. better formatted reports greater readability (heroic, given the limits of the platform)

c. anons specializing in certain areas and so becoming capable of generating deeper, more well-reasoned posts

d. more referencing of past posts (which can help newfags get up to speed)

e. more retyping of tweets (good because tweets are hard to search on in the archive)

f. some cross-referencing of related posts

g. more collections of specialized material (with special interest threads)

 

The challenge of collaboration

One anon asked how we could better communicate/work together last night. (One disadvantage of anonymity.) Possible though if people "meet" at certain times. Or use the specialized threads as meeting places, because there are fewer anons. We are just beginning to see the possibilities with this. Other ideas?

 

One last thing: I'm a big fan of the board as it is. Free speech zone, multiple approaches, great stuff. The idea isn't to "reform" the board but to open new doors, see what else might be possible.
