Hart said he had turned over his weapon to police with "no questions asked" and was told that the semiautomatic rifle would be destroyed.

 

He said he had been using the rifle for pest control on his farm but said that there were other ways to do the job that do not require owning such a deadly weapon.

Your original thought and it transcibed to words is inspiring. I find myself looking at

hieroglyphs and cuneiform without an understanding that is apparent to be placed within the language I know. Second U.S. jury finds Bayer's Roundup caused cancer

(Reuters) - A U.S. jury on Tuesday found Bayer AG’s glyphosate-based Roundup weed killer caused cancer, a blow to the company eight months after another jury issued a $289 million verdict over similar claims in a different case.

 

Tuesday’s unanimous jury decision in San Francisco federal court, which came after five days of deliberation, was not a finding of Bayer’s liability for the cancer of plaintiff Edwin Hardeman. Liability and damages will be decided by the same jury in a second trial phase beginning on Wednesday.

 

Bayer, which denies allegations that glyphosate or Roundup cause cancer, in a statement on Tuesday said it was disappointed with the jury’s initial decision. Bayer acquired Monsanto, the longtime maker of Roundup, for $63 billion last year.

 

β€œWe are confident the evidence in phase two will show that Monsanto’s conduct has been appropriate and the company should not be liable for Mr. Hardeman’s cancer,” the company said.

 

Glyphosate is the world’s most widely used weed killer. Monsanto’s Roundup was the first glyphosate-based weed killer but is no longer patent-protected and many other versions are now available. Bayer does not provide sales figures for the product.

 

The case was only the second of some 11,200 Roundup lawsuits to go to trial in the United States. Another California man was awarded $289 million in August after a state court jury found Roundup caused his cancer, sending Bayer shares plunging at the time. That award was later reduced to $78 million and is on appeal.

 

Bayer had claimed that jury was overly influenced by plaintiffs’ lawyers allegations of corporate misconduct and did not focus on the science.

 

U.S. District Judge Vince Chhabria called such evidence β€œa distraction” from the scientific question of whether glyphosate causes cancer. He split the Hardeman case into two phases: one to decide causation, the other to determine Bayer’s potential liability and damages.

 

Under Chhabria’s order, the second phase would only take place if the jury found Roundup to be a substantial factor in causing Hardeman’s non-Hodgkin’s lymphoma. The jury found that it was on Tuesday.

Carl Tobias, a law professor at the University of Richmond, said Tuesday’s decision showed that the August jury verdict was not an aberration and that the Hardeman case could be an indication of what may happen in future similar cases.

 

Some legal experts had said Chhabria’s decision was beneficial to Bayer, which says decades of studies and regulatory evaluations have shown the weed killer to be safe for human use.

 

β€œWe will only really know whether it works for Bayer to isolate scientific issues once we see more trials,” said Adam Zimmerman, a law professor focusing on mass torts at Los Angeles-based Loyola Law School.

 

Chhabria has scheduled another bellwether trial for May and a third trial is likely to take place this year. All three bellwether cases will be split into causation and liability phases.

 

The U.S. Environmental Protection Agency, the European Chemicals Agency and other regulators have found that glyphosate is not likely carcinogenic to humans. But the World Health Organization’s cancer arm in 2015 reached a different conclusion, classifying glyphosate as β€œprobably carcinogenic to humans.”

 

In the trial’s second phase, Hardeman’s lawyers will be allowed to present evidence allegedly showing the company’s efforts to improperly influence scientists, regulators and the public about the safety of Roundup.

 

Hardeman’s lawyers, Aimee Wagstaff and Jennifer Moore, said they look forward to presenting that evidence to the jury to hold Monsanto accountable.

 

β€œNow we can focus on the evidence that Monsanto has not taken a responsible, objective approach to the safety of Roundup,” they said in a statement.

 

Chhabria is overseeing more than 760 Roundup cases for which Hardeman’s was a so-called bellwether trial intended to help determine the range of damages and define settlement options for the others.

 

Another Roundup trial is scheduled to begin in California state court in Oakland on March 28, involving a couple who claim Roundup caused their non-Hodgkin’s lymphoma.

Supreme Court to Consider State Prosecution of Illegal Immigrant Identity Theft

 

WASHINGTONβ€”The Supreme Court has decided to review a Kansas Supreme Court ruling that held that only the federal government has the legal authority under U.S. immigration laws to prosecute illegal aliens for identity theft. Urged on by Kansas and the Trump administration, the high court agreed March 18 to take up what promises to be a politically fraught appeal in an age in which virtually every aspect of the American immigration system is controversial or under attack. Kansas and 10 other states want the legal authority to be able to go after illegal aliens for identity theft and other offenses when they work under Social Security numbers belonging to others. A victory by Kansas would give states more power to deal with illegal aliens, instead of relying on federal officials. β€œIdentity crime is a problem that far exceeds the capacity of the United States alone to prosecute,” Kansas Attorney General Derek Schmidt stated in court documents.

The Immigration Reform and Control Act of 1986 (IRCA) made it unlawful to employ aliens who are not authorized to work in the United States, created an employment eligibility verification system, and created a civil and criminal penalty regime for employers who violate the law.

 

In the cases of Ramiro Garcia, Donaldo Morales, and Guadalupe Ochoa-Lara, illegal aliens who sought restaurant jobs, the Kansas Supreme Court found the IRCA preempts the application of state identity theft, identity fraud, and making false writing laws whenever any of the information needed for the prosecution is contained in or attached to a Form I-9, even when the state prosecutes for use of that very same information in non-IRCA documents, the state of Kansas stated in a brief filed with the court. β€œIt is Congress’s plain and clear expression of its intent to preempt the use of the I-9 form and any information contained in the I-9 for purposes other than those listed,” the Kansas Supreme Court found in the Garcia case.

 

Kansas argued that it is absurd to prevent it from prosecuting in such identity theft cases, and that prosecutors didn’t rely on the form and instead utilized Garcia’s tax withholding forms, on which the stolen Social Security number also appeared. The β€œmost natural reading” of the IRCA is that it forbids the use of the I-9 form itself and any appended documents, but not basic information like Social Security numbers that are also found on other forms. The Kansas law β€œdoes not regulate employment,” U.S. Solicitor General Noel Francisco said. β€œIt regulates the use of another person’s identity with the intent to commit fraud.”

Senators Stunned By Air Force Plan For More Boeing F-15X Fighters, F-35 Cuts

 

The Air Force has outlined its major near term goals by submitting a five-year plan to Congress related to the Pentagon's 2020 budget proposal that favors procurement of Boeing's new F-15X fighter β€” seen as a more cost effective compliment to Lockheed Martin's F-35, and now apparently eclipsed as the Air Force plans to buy 48 F-35s each year during FY 2021-23 instead of the 54 previously planned.

 

But the F-15X, which is Boeing's upgraded F-15, is not necessarily in competition with the F-35, instead it represents Pentagon efforts at better battlefield integration against enemy targets:

 

In a future air fight, it’s possible that the more stealthy F-35A could get closer to enemies, spot them, then relay targeting data back to F-15Xs, which could launch the missiles at threats from a safe distance. The US military has embraced this kind of networked warfare as a whole, and the strengths of the F-15X and F-35A complement each other in such an environment.

 

The five-year plan calls for 80 F-15X fighters in a $7.8B investment that would increase from eight of the planes next year to 18 per year through 2024. Lockheed Martin's F-35 will get $37.5 billion over the five years, according to the proposal, but in numbers cut down from prior projections.

 

Gen. Dunford, chairman of the Joint Chiefs of Staff, explained to the Senate Armed Services Committee last week that the Pentagon is pursuing the F-15X partly because it is β€œslightly less expensive for procurement than the F-35, but it’s more than 50% cheaper to operate over time and it has twice as many hours in terms of how long it lasts.”

 

This cheaper F-15X Super Eagle, able to carry more weapons though without the stealth capability of the F-35 (the F-15X can carry nearly two dozen air-to-air missiles) is expected to have a service life of a whopping 20,000 hours.

 

What appears a slowed trajectory for the roll out of the F-35 will likely touch off intense debate, which has already begun in the form of a letter sent to President Trump and Acting Defense Secretary Pat Shanahan from leading Republicans including John Cornyn and Ted Cruz of Texas, and Marco Rubio of Florida.

First Australian solar farm in Antarctica opens at Casey research station

The first Australian solar farm in Antarctica will be switched on at Casey research station today.

 

Australian Antarctic Division Director, Mr Kim Ellis, said the system of 105 solar panels, mounted on the northern wall of the β€˜green store’, will provide 30 kilowatts of renewable energy into the power grid – about 10 per cent of the station’s total demand over a year.

 

β€œThis is the first solar power array at an Australian Antarctic research station and amongst the largest in Antarctica,” Mr Ellis said.

 

β€œIt will reduce Casey station’s reliance on diesel generators for electricity, cutting fuel costs and emissions, as well as boosting the station’s capacity in peak periods.”

 

The project is a collaboration between the Australian Antarctic Division and Masdar, the Abu Dhabi Future Energy Company, to investigate a range of energy efficiency and energy management options at Australia’s Antarctic stations.

 

Mohamed Jameel Al Ramahi, Chief Executive Officer of Masdar, said the project was an opportunity to pool energy-efficiency expertise from the hot deserts of the Middle East and the cold desert of Antarctica.

 

β€œThis project will help to build expertise in, and the performance of, solar systems in cold and remote environments,” Mr Al Ramahi said.

 

β€œIt will test the durability and suitability of the solar panels to the strong wind and snow load in Antarctica and help us to determine if it is an efficient way of powering a station.”

 

Masdar sourced the solar panels from Aleo Solar in Germany, while Australian Antarctic Division engineers undertook wind modelling, produced technical drawings, and devised a special mounting system of brackets and rails to fit the corrugated shape of the green store cladding.

 

Engineering Services Supervisor at Casey, Doreen McCurdy, said her six-person team first installed the brackets and rails to hold the panels flush against the wall.

 

Then they installed external cable ducting, internal cable trays, a switchboard, and three inverters to convert the variable direct current (DC) into 240V alternating current (AC).

 

The team faced some challenging conditions with temperatures as low as -7Β°C and a number of blizzards.

 

β€œThe cold was a challenge, as the brackets and bolts are small and fiddly and can’t be installed while wearing gloves, so we had to use hand warmers to keep our fingers nimble,” Ms McCurdy said.

 

β€œOn windy days we had to focus on the internal installation, as the elevated work platform we use outside can’t operate in winds above 15 knots.

 

β€œOnce all the rails and brackets were in place though, we were able to install about 15 panels a day.”

 

While the panel installation is unusual in its flush mounting against a wall, it has been designed to strike a balance between maximum solar gain and stability in the wind, as well as ensuring the panels are easy to install, access and maintain.

 

There are now plans to look at connecting the panels up to a battery storage system and whether solar farms might be suitable for use at Australia’s other stations.

 

β€œOnce the solar system is running we’ll see an immediate energy contribution and we’ll be able to see how it performs as part of the station’s power grid,” Mr Ellis said.

West Virginia Attorney General Sues Catholic Diocese

 

The West Virginia attorney general filed a civil suit Tuesday against the Wheeling-Charleston Catholic Diocese and former Bishop Michael J. Bransfield, alleging they knowingly hired pedophiles. Attorney General Patrick Morrisey, a Republican, claimed the diocese knowingly retained pedophiles and also failed to conduct thorough background checks on school and camp employees and to warn parents about the potential dangers to their children.

 

Morrisey’s lawsuit is the culmination of an investigation of the diocese that he began in September 2018. β€œParents who pay and entrust the Wheeling-Charleston Diocese and its schools to educate and care for their children deserve full transparency,” Morrisey said in a statement. β€œOur investigation reveals a serious need for the Diocese to enact policy changes that will better protect children, just as this lawsuit demonstrates our resolve to pursue every avenue to effectuate change as no one is above the law.”

 

The suit alleges Bransfield and the diocese violated West Virginia consumer protection laws by failing to warn parents that confessed pedophiles like Father Patrick Condron had direct access to their children. The diocese reportedly sent Condron to rehabilitative treatment after he confessed to sexually abusing a student at St. Joseph Preparatory Seminary High School in Vienna, West Virginia. Afterward the diocese assigned him to Wheeling Catholic Elementary School from 1998 to 2001. The lawsuit also alleges the diocese hired Victor Frobas, who was later convicted of and imprisoned for child sexual abuse, despite knowing that he had been credibly accused of abuse in the past; failed to conduct a background check on Ronald Cooper, who was convicted of statutory rape and robbery, before employing him as a school teacher; and hired another priest who admitted to having been accused of sexual abuse.

 

β€œToday is a sad day, but the Attorney General still believes there are so many priests and deacons in the Catholic church β€” who are good men β€” who will support this effort so we can really seek meaningful changes in how the church handles sexual abuse,” Morrisey said. The diocese announced on March 11 it completed a preliminary investigation into allegations against Bransfield of abuse cover-up and that it restricted Bransfield from ministerial duties while the Holy See reviewed the completed investigation. Morrisey urged the diocese to release its findings to the public.

Our society needs to look in the mirror. The coming storm will be used to cleanse our country of people that are guilty of truly evil crimes. It will be easy for us to point the finger and demand justice. What will be harder for us is facing our own demons. Even though most people have never crossed the line into evil, we all have sin. Group of 170 Migrants Dug Under Arizona Border Fence, Say Feds

 

Border Patrol agents in Arizona continue to deal with β€œlarge” migrant groups exploiting weaknesses in outdated border technology to illegally enter the U.S. Most recently, human smugglers coordinated the border crossing by a group of more than 170 who dug under a portion of a barrier in the Yuma Sector. Yuma Sector Border Patrol officials tweeted a video on Monday showing a group of 171 migrants digging under an outdated section of border fencing to enter the controlled space between barriers on U.S. soil. The migrants can be seen rushing toward the first Border Patrol agents they can find to surrender and most likely, make requests for asylum.

 

Border Patrol officials said human smugglers coordinated the illegal border crossing. In the Tucson Sector, Ajo Station agents operating surveillance equipment on Sunday, observed a group of men cutting the wire mesh fence that separates Arizona from Mexico in this region. Two men crawled through the opening and dashed toward an awaiting vehicle. One of the men jumped into a Dodge SUV which sped away before the second migrant could get in, according to information obtained from Tucson Sector Border Patrol officials. The camera operators contacted a U.S. Customs and Border Protection (CBP) Air and Marine Operations (AMO) aircrew to intercept and follow the SUV as it headed north toward the State Route 85 immigration checkpoint.

 

The vehicle reached the checkpoint and Border Patrol agents conducted an immigration interview. The agents learned the driver (a 36-year-old female) and front seat passenger (a 32-year-old male) were U.S. citizens. The rear passenger allegedly attempted to utilize fraudulent immigration documents to claim legal presence in the U.S. The agents later confirmed the 40-year-old Mexican national was illegally present. The agents arrested the driver and front seat passenger who will face federal human smuggling charges. The Mexican man will be processed for immigration violations according to Tucson Sector guidelines.
