OK Anons lawfag reply: I have posted several times recently about the significance of HABEAS CORPUS and esp. in light of what I call the ACB slide - they are linked cuz ACB wants to LIMIT the POTUS power to suspend habeas - this is one reason they push her nomination. .

The "leading case" on suspension is Ex Parte Merryman and as precedent it is a JOKE - only the DS wouls allow this traversty and chao to reign. Merryman was ONE district court judge - anons know what that means - and the Supreme Court of the United States has NEVER determined if the President has any independent authority to suspend habeas corpus. THIS IS CRITICAL IN THE HANDLING OF ENEMY COMBATANTS. I am not picking on ACB and reposting for no reason - her opinion is that Merryman is good law and she is dead wrong

i have been advocating here for a long while that POTUS act more like LINCOLN and it would certainly be more satisfying for us

however i am mindful of the fact the Civil War ended in a failure of public awakening - it did nothing to change attitudes and caused more division TO THIS VERY DAY

i believe the PLAN is to not repeat that history

I agree with this plan 1000% HOWEVER i still do not understand the total and complete blackout of results on our side - that said here is my post on ACB and HABEAS.

as anons know a writ of Habeus Corpus is a legal device to get out of jail/arrest and into court - guaranteed by the Constitution no less - POTUS can suspend this writ in times of war and ER - OK great so what is the problem?

Yet those who framed and ratified the Constitution also believed that in times of crisis, the executive might need leeway to hold suspects without answering to a court."

OK here is the disconnect - clearly the monarch had the power to imprison people - the legislature wanted to curb that power and did - that is the history - that is clearly was (is) the executive (monarch) that has this power.

The case taught in law scholl for the ACB position is Ex Parte Merriman - and it is true that case is cited for that proposition - but here is the catch - that was part of the legal confrontations in the runup to civil war - and decided by only ONE DISTRICT COURT JUDGE not SCOTUS - and BTW LINCOLN ignored it. As a result of this prelim dust up Congress voted to grant POTUS the power to suspend habeus corpus but only for the duration of the civil war. So that long expired law does not address the current status of the matter.

Well after 9-11 Congress passed more national security laws including the detention of enemy combatants (sound familiar?) A litigation ensued with the court of appeals making the following decision:

"Because it is undisputed that Hamdi was captured in a zone of active combat in a foreign theater of conflict, it was not proper for any court to hear a challenge of his status… The broad warmaking powers delegated to the President under Article Two of the United States Constitution and the principle of separation of powers prohibited courts from interfering in this vital area of national security."

YES ANONS THAT WAS ABSOLUTELY 100% CORRECT IN 2004 - but then this correct decision went to SCOTUS - which body promptly grabbed back power with a counter-attack on seperation of powers. SCOTUS carved out an exception to this long standing rule of law in holding that '… due process required that Hamdi have a meaningful opportunity to challenge his enemy combatant status…"

To further point out the legal mumbojumbo that counts for SCOTUS opinions, consider this statement: "…we have made clear that, unless Congress acts to suspend it, the Great Writ of habeas corpus allows the Judicial Branch to play a necessary role in maintaining this delicate balance of governance." OK so does this ("unless") means that if Congress DOES suspend habeus under Article 1 Clause 9 (public safety) the court CANNOT review it? Doubtful but clear as mud - and SCOTUS has made clear that they can and will review excercise of POTUS power to suspend habeus - in either event the ACB logic fails as badly as SCOTUS.

OK so SCOTUS sticks to its principle that whatever Congress or POTUS do is always subject to judicial review - however - here is the reason they gave: "…. the Judiciary must not defer to the executive with respect to detentions. Instead the constitution empowers the judiciary to act as a check on executive power in this realm"

OK but once again - whose power is being reigned in? THE EXECUTIVE. Not Congress. There are other cases that do little to clear up this question. As always the law is an utter confusion and mess, with power politics playing the major role in every case. Bottom line though, is this - If I were WH counsel I would NEVER concede the power to suspend habeus to Congress - NEVER - Lincoln was right and we won. ACB just accepts this milk toast "CON LAW" with no thought at all.

A Canadian charity affiliated with the Bill, Hillary and Chelsea Clinton Foundation on Friday disclosed the names of 21 of its largest donors after facing scrutiny for keeping the names of its donors secret.

Officials with the Clinton Giustra Enterprise Partnership, which is based in Vancouver, B.C., said they were keeping with Canadian law in refusing to release names of donors without written permission. But the lack of disclosure appeared to conflict with the Clinton Foundation's 2008 pledge to make annual disclosures of all of its donors.

The disclosure issue with the previously obscure Canadian group has proven to be just one foundation-related headache that has faced the Clintons as Hillary Rodham Clinton has launched her presidential candidacy.

The Canadian group was founded in 2007 by Frank Giustra, a Canadian mining magnate who pledged $100 million to help the Clinton Foundation spark economic development in impoverished regions of the world. The group transfers much of its annual revenue to the Clinton Foundation in New York. A spokeswoman for Giustra said earlier this month that 1,100 people had donated to the group, though most were one-time small-dollar donors who contributed as part of a major 2008 gala for the charity. Giustra had said earlier this month that he was seeking permission from his largest donors to reveal their names.

Donors whose names were posted to the Web site of the group Friday included Ian Telfer, a Giustra friend who formerly chaired the company Uranium One. A recent New York Times story recounted how the State Department under Hillary Rodham Clinton signed off on the sale of Uranium One to a Russian state-owned company. Her aides have said she was not personally involved in the decision, which involved multiple government agencies.

Other Giustra colleagues from the mining industry are also on the list, including Sergey Kurzin, who worked with Giustra on a deal to buy uranium in Kazakhstan in 2005. The deal closed days after Giustra had dinner with Bill Clinton and the country's president. Giustra has said Clinton was not involved.

Also Friday, Giustra released a new analysis from a Canadian law firm supporting his position that he cannot disclose his group's donors without their written permission, the second such advisory notice he has publicized.

Criminal gangs in Brazil’s Rio de Janeiro, that have long held sway over the city’s favelas (slums), are enforcing their own lockdown to curtail the spread of coronavirus, even as President Jair Bolsonaro has dismissed the pandemic as a “little flu”.

Those of us who simply can’t do sit-ups and push-ups on our own and are somehow unable to download one of the numerous fitness apps out there that aren’t associated with the U.S. government finally have an option.

On Monday, the FBI promoted an app on Twitter for #MotivationMonday. According to their tweet, the app provides users with “tips for indoor workouts” and “exercises you can do at home.”

The tweet links to an FBI.gov page that advertises the Bureau’s Physical Fitness Test app that “will help you learn the benchmarks of the official FBI Physical Fitness Test.”

According to the website, the app includes videos of FBI trainers who work at the FBI Academy in Quantico, Virginia, take the fitness test with the actual FBI scoring system, and “use your phone’s GPS and accelerometer for a more realistic PFT experience.”

Wednesday say ISIS gunmen attacked a Sikh temple in central Kabul . At least 25 people were killed in the temple, and Afghanistan’s Interior Ministry reported that they’d ultimately killed all the attackers.

Nevada's Democratic governor appears to be trying to stick it to Drumpf by denying potentially life-saving medicine to coronavirus patients.

Nevada's governor has signed an emergency order barring the use of anti-malaria drugs for someone who has the coronavirus.

Democratic Gov. Steve Sisolak's order Tuesday restricting chloroquine and hydroxychloroquine comes after President Donald Trump touted the medication as a treatment for the virus.

There's been several promising small-scale studies and many coronavirus patients swear it helped turn their condition around.

The drug has been used safely for a whole range of diseases for nearly a century, though there's risks of overdose if it's taken in excess as we just saw with a couple in Arizona.

His order also limits a prescription to a 30-day supply so that people cannot find a way to stockpile the drug and ensure it's available for "legitimate medical purposes."

The governor's rule comes a day after a Phoenix-area man died and his wife was in critical condition after they took an additive used to clean fish tanks known as chloroquine phosphate, similar to the drug used to treat malaria.

Trying to prevent hording is perfectly reasonable considering panic buying, shyster resellers and looming shortages but banning a potentially life-saving drug from being used because some grossly uninformed people decided to consume dangerously large amounts of it in fish tank cleaner form and overdosed or died seems extremely excessive.
