Election lawsuit challenges state absentee by mail requirements

MARC FUCKING ELIAS

RALEIGH — A small group of N.C. voters are suing the state and the N.C. State Board of Elections over absentee voting regulations, but demands in the lawsuit may lead to election fraud, or the appearance thereof, legal and political analysts say.

Marc Elias, a Democratic campaign attorney, is representing seven voters in Stringer Et Al. v. the State of North Carolina, alleging a number of absentee-by-mail voting regulations will disenfranchise voters come November, when a second wave of COVID-19 infections may make in-person voting too risky. The case must be heard by a three-judge panel, the lawsuit says.

The complaint focuses on:

— A requirement for voters to pay for their own stamps to submit mailed ballots

— The enforcement of a receipt deadline while mail disruptions and budgetary shortfalls plague the U.S. Postal Service

— The requirement that all absentee ballots must be signed by two witnesses or notarized

— The practice in some counties of rejecting absentee ballots because of signature discrepancies

“Taken together, these restrictions on mail ballots are at best unduly burdensome and pose significant risks to voters’ health and safety, and, at worst, impossible to comply with during a global pandemic, and will result in the disenfranchisement of an unprecedented number of North Carolinians, especially those who are medically and financially vulnerable,” the complaint reads.

David McLennan is a political science professor at Meredith College and director of Meredith Poll. Certain issues are valid, but there’s a caveat, he said.

“Reducing the number of witness signatures and providing postage would certainly reduce barriers that would prevent some from using the absentee ballot.”

North Carolina may see a small increase in turnout from removing those barriers, McLennan said, but changes might raise questions about the integrity of results.

Karen Brinson Bell, state BOE executive director, in March submitted a request to the General Assembly asking it to loosen some restrictions on absentee ballots as COVID-19 continues to interrupt a variety of state functions.

The NCSBE anticipates 30-40% of general election ballots to be cast by mail. In a presidential-year general election, officials normally would expect 4-5% of ballots to be submitted by mail, WECT-TV reported.

The request includes things such as creating an online portal for absentee voting and establishing a fund to pay for postage for returned absentee ballots. Like the lawsuit, NCSBE recommends removing, reducing, or eliminating the witness requirement in light of social-distancing rules.

The General Assembly didn’t provide any money for election services in the massive $1.6 billion COVID-19 relief package passed May 2, but legislative leaders said they would address the issue later.

“While everyone should agree about taking reasonable steps to ensure that COVID-19 doesn’t disrupt elections, the ideas put forward in this lawsuit stray far from the bounds of reasonable precautions,” said Mitch Kokai, senior political analyst at the John Locke Foundation.

Elias’ involvement leads to questions about the true motives of the lawsuit, Kokai said.

“Marc Elias is a go-to option for Democrats seeking to sway election processes and results in their favor,” Kokai said.

Elias has played a role in numerous voter related lawsuits and has represented several high profile Democrats. In 2016, Elias was a lawyer for Hillary Clinton’s presidential campaign, and he worked for John Kerry’s presidential campaign in 2004.

In North Carolina, Elias represented Democratic candidate Dan McCready in the 2018 controversy involving absentee ballot harvesting in the 9th U.S. Congressional District. The Rev. Mark Harris, a Republican, unofficially won the 9th District election, but the elections board twice refused to certify the results because of concerns over irregularities. Leslie McCrae Dowless, a GOP political operative, was indicted on charges of illegal ballot handling and obstruction of justice.

Considering the problems that arose from that election, it makes little sense to call for changes that would open the door to even more fraud and abuse, Kokai said.

That’s true, McLennan said.

“Removal of the more stringent requirements could raise questions among voters and political watchers about the possibility of a similar situation happening,” he said.

The N.C. Department of Justice is reviewing the filings, said Laura Brewer, communications director for the justice department.

Indeed. I voluntarily wore a mask when out in public, like I do every peak infectivity for flu season, as I have for the past several years. I got lots of strange looks.

I am no longer wearing a mask because the need has passed. However, I am now one of the few without a mask - and I get strange looks. The blind obedience of the sheep frightens me. The local big chain grocery store is now scanning DL for ETOH purchases now. When asked for ID to buy my bottle of wine for dinner, I gave them my dependent MIL ID. They tried to scan it and it didn't work. I pointed out my DOB on the "federal photo ID". The cashier tried to shame me into giving over my state DL so it could be scanned and she "wouldn't have to ask for a manager over ride". I refused. This is getting out of hand. Verifying age for an ETOH purchase is one thing, collecting key stats to compile in a database is another. No one else questioned it. No one else needed a "manager's over ride".

Of course, I am one of the few that absolutely refuses to go through the "porno scanner". I have paid for "TSA pre-check" and "Global Entry" access privileges, and the few times that they insist on pulling me out for special handling, I insist on the public grope and voice my opinion about the entire bullshit security theatre while they are doing it. While they are groping me and Granny, a bunch of non-native born Muslims have full access to the aircraft on the air side, and that's not a "security risk" apparently.

The 2020 election is a hurricane season of alleged conspiracies. Theory after theory has churned from the Democratic debates, the Iowa caucuses, and the Twitter goings-on of candidates’ supporters or alleged supporters. The recent theory that a Nigerian Twitter fan account for Pete Buttigieg was actually a sock puppet run by campaign staffer Lis Smith—it wasn’t—illustrates how quickly and easily conspiracy theories spread; the story was trending on Twitter mere hours after the initial allegation.

This case also illustrates the downstream consequences of laughter. Just as quickly as the theory emerged, a storm surge of snarky denials, Nigerian email scam jokes, and other can-you-believe-these-idiots eye rolls flooded social media.

For nonbelievers, “See conspiracy theory; mock” has become an ingrained response online—and we need to break the habit. The closer we get to the general election, the more conspiracy theories we’re bound to see. Making fun of them, however tempting it might be, is the worst possible reaction.

This is not a civility argument. For one thing, civility arguments are mostly bullshit rhetorical sleights-of-hand designed to shift focus from the substance of a critique to its tone. Nor is it a claim that false information is cool and fun and we should just shrug and say nothing, since who needs truth, Mike Bloomberg makes the best memes, and everything is terrible. Rather, it’s a warning that jokes about conspiracy theories are strategically ineffective. In fact, they’re likely to backfire and dump even more refuse into the already toxic political waters.

One problem is that making fun of something spreads that thing just as quickly as sharing it sincerely would. (See: Covid-19 conspiracies.) The theory in question might be a bizarro-world fever dream. The person who shares that fever dream to mock it could have the best intentions; they might assume that showing the absurdity of the theory will help prevent others from taking it seriously. But as a previous article in this series explained, the information ecology doesn’t give a shit why anyone does what they do online. Sharing is sharing is sharing.

‘Plandemic’: The concerning new coronavirus conspiracy movie going viral

A disgraced doctor is the face of a worrying new coronavirus conspiracy movie with thousands of believers fighting to keep it online.

There’s been plenty of conspiracy theories to come out of the coronavirus pandemic.

But the latest worrying one, a documentary called Plandemic, is having some serious staying power as thousands of believers battle with social media sites to keep the video online.

“The Hidden Agenda Behind COVID-19,” the documentary’s description reads. “Was COVID-19 a plan?”

YouTube and Facebook continue to delete copies of the 26-minute video, saying it breaks their “community guidelines”, but versions of it keep popping up.

Filmmaker Mikki Willis anticipated the video getting deleted, and encouraged his followers on Facebook to keep sharing it.

“Be brave. Share this video far and wide,” he wrote, adding a Vimeo link of the footage “should this video be removed from this platform”.

However, the video has also since been deleted by Vimeo.

The movie, which claims the coronavirus pandemic is part of an elaborate plan from big pharma and billionaires to enforce globally-mandated vaccinations, features Dr Judy Mikovitz as its main spokeswoman.

Dr Mikovitz, once a practising medical researcher, spent five days in jail for allegedly stealing material from a lab and had her research on chronic fatigue discredited in 2011.

She is also a well-known anti-vax spokeswoman, despite claiming she is not in the film.

In 2016 my friend, Molly MaCauley, was stabbed to death outside her home in Baltimore. She was killed because she had discovered satellites were being used to alter State and national elections.

They want to win by at least half but they prefer 2/3 that is their goal as they want a supermajority.

“We’ve tried everything to keep it out of a nursing home, but it’s virtually impossible,” Cuomo told reporters. “Now is not the best time to put your mother in a nursing home. That is a fact.”

Residents’ relatives, health care watchdogs and lawmakers from both parties cite problems with testing and transparency that have prevented officials — and the public — from grasping the full scale of the catastrophe.

And they are second-guessing a state directive that requires nursing homes take on new patients infected with COVID-19 — an order they say accelerated outbreaks in facilities that are prime breeding grounds for infectious diseases.

“The way this has been handled by the state is totally irresponsible, negligent and stupid,” said Elaine Mazzotta, a nurse whose mother died last month of suspected COVID-19 at a Long Island nursing home. “They knew better. They shouldn’t have sent these people into nursing homes.”

Of the nation’s more than 25,000 coronavirus deaths in nursing homes and long-term care facilities, more than a fifth of them — about 5,300 — are in New York, according to a count by The Associated Press, and the toll has been increasing by an average of 20 to 25 deaths a day for the past few weeks.

“The numbers, the deaths keep ticking up,” said MaryDel Wypych, an advocate for older adults in the Rochester area. “It’s just very frustrating.”

Cuomo faced criticism at a recent briefing for saying that providing masks and gowns to nursing homes is “not our job” because the homes are privately owned.

“It was such an insensitive thing to say,” said state Assemblyman Ron Kim, a Queens Democrat who noted that it wasn’t until just this past week that New York and neighboring states announced a plan to combine forces to buy protective gear and medical supplies for nursing homes.

“If we had focused on that early on,” he said, “we could have saved a lot of lives.”

Cuomo’s administration defended its response to the crisis, saying it has provided more than 10 million pieces of protective equipment to nursing homes and created a database of 95,000 workers who have helped out in hundreds of New York homes.

“This was an overwhelming situation for everyone,” said Jim Malatras, who serves on the governor’s COVID-19 task force. “There were deaths and it’s unfortunate. But it doesn’t mean we weren’t aggressive.”

One key criticism is that New York took weeks after the first known care home outbreaks to begin publicly reporting the number of deaths in individual homes — and still doesn’t report the number of cases. By the time New York began disclosing the deaths in the middle of last month, the state had several major outbreaks with at least 40 deaths each, most of which were a surprise to the surrounding communities and even some family members.

Nearly 50 Percent of California Coronavirus Deaths in Nursing Homes

Data released from the California Departments of Health and Social Services on Friday show that nursing home deaths represent almost half of the coronavirus fatalities in the state.

The San Francisco Chronicle reported on the development:

There were at least 11,344 confirmed cases among staff and residents at California’s skilled nursing facilities and residential care facilities for elderly as of Thursday, according to state data. These cases account for 18.1 percent of the state’s total 62,512 cases.

Meanwhile, 1,276 staff and residents at such facilities have died of the disease, making up 49.4 percent of the state’s 2,585 deaths as of Thursday.

Given those numbers — which the state said are “provisional” — an alarming 11.2 percent of people infected with the coronavirus at a nursing home has died.

The information confirms that elderly people with underlying health conditions — the demographic in nursing homes — and the workers who care for them represent the most vulnerable population during the coronavirus outbreak.

“All data in this chart is provided to offer a snapshot of COVID-19 in skilled nursing facilities in California and does not imply wrongdoing on the part of the facility,” state officials said.

Michael Connors of the California Advocates for Nursing Home Reform said in the Chronicle report that he thinks the death toll is higher than the reported numbers, calling the number of reported deaths “horrific.”

“COVID-19 is like a viral wildfire in nursing homes,” Connors said. “It’s way past time for all public health authorities in California to start treating it that way.”

Michigan State Rep Demands Gretchen Whitmer Investigate Faked Coronavirus Testing Line

Michigan state Rep. Steve Johnson is calling on Gov. Gretchen Whitmer to investigate a fake line of patients waiting to be tested for coronavirus in a CBS News report.

Writing May 8, Johnson said, “I am calling on you today to instruct the necessary agencies in the State of Michigan to open a formal investigation into the incident that took place at Cherry Health.”

On Wednesday, Project Veritas published a report claiming CBS News and Cherry Health had staged a fake line of cars to appear as though there were demand for coronavirus testing.

“Apparently the news crew wanted more people in the line because they knew it was scheduled,” an individual identified as Nick Ross said in the Project Veritas report.

“We knew they were coming,” an unnamed registered nurse said in the video. “We had no clue that we were going to have to, like, do fake patients.”

In the Project Veritas undercover video, staffers said they “pretended” to test patients for the CBS crew to film.

The news outlet denied any knowledge of the false report, instead pointing the finger at Cherry Health.

Tasha Blackman, CEO of the organization, denied any knowledge either.

“Though the Project Veritas report claims the CBS video showing a line of cars was staged; to my knowledge CBS This Morning did not stage any part of their visit, and I did not instruct any of our staff to get in their cars as part of the line of vehicles,” she said, WWMT reported.

An employee of Cherry Health told Breitbart News employees were encouraged to watch the CBS News report when it aired.

“Cherry Health is a taxpayer funded entity,” Johnson noted in his letter, “and as such should receive proper oversight.

“This has only amplified the growing negative national attention Michigan has received.”

Johnson ended, “I demand you take immediate and decisive action and prevent such behavior from happening again.”
