In a recent legal filing, the lawyers of Abu Zubaydah – the Guantánamo Bay detainee almost tortured to death by the CIA, held without charge by the US for nearly 20 years – urged that their client be released, given Washington’s wars in Afghanistan and with Al-Qaeda are finally over.

Writing to a DC district court, they argued that these developments meant there was no legal justification for keeping him captive, and he must be immediately discharged. What the petition omits to mention, however, is that Zubaydah’s detention was, from day one, intended to be permanent in order to keep the CIA’s criminal maltreatment secret and ensure his abusers were insulated from prosecution in perpetuity.

In July 2002, four months after his capture in Pakistan, the Agency’s team in Afghanistan specifically sought “reasonable assurances” from superiors that he would “remain in isolation and incommunicado for the remainder of his life.” In response, a memo stated that there was “fairly unanimous sentiment” within CIA headquarters that Zubaydah “will never be placed in a situation where [he] has any significant contact with others and/or has the opportunity to be released,” and would “remain incommunicado for the remainder of his life.”

Langley’s desire for total omerta in all matters concerning its torture program is understandable, for a great many people have much to hide.

At the start of December, BuzzFeed published hundreds of declassified papers related to CIA Inspector General investigations into child sexual abuse by Agency staff and contractors. Buried among these was a May 2004 Special Review of the CIA’s detention and interrogation program, launched after Gul Rahman, an Afghan suspected of having militia ties, died at the ‘Salt Pit’ black site in Kabul 18 months prior.

Cyberattack closes over 300 of grocery chain’s shops

Hundreds of SPAR stores across northern England have been forced to close after an attack on the IT system of the grocery chain’s distributor impacted card payments at numerous branches.

The cyberattack has affected the stores’ ability to process card payments, SPAR said in a statement on Monday, forcing staff either to close shops or to accept only cash payments.

“This has not affected all SPAR stores across the North of England, but a number have been impacted over the past 24 hours and we are working to resolve this situation as quickly as possible,” SPAR North of England posted on Twitter.

The Twitter thread did not mention the exact number of stores affected since the incident began on Sunday but, according to the company’s spokesperson quoted by UK media, around 330 shops have now been closed.

The website for the chain’s distributor James Hall and Co has also been down on Monday. A spokesperson for the Lancashire-based wholesaler told local media they are “aware of an online attack on our IT systems” and the company is “working as quickly as possible to resolve the situation.”

The UK’s National Cyber Security Centre said it is aware of the incident.

It’s not the first time this year that British food shops have been impacted by cyberattacks. In October, an alleged attempt to “interfere” with Tesco’s IT systems temporarily disabled the supermarket chain’s website and app.

New York City is poised to become the largest place in the country to grant noncitizens the right to vote in local elections, the Associated Press reported.

A city council measure that is expected to be ratified on Thursday with a veto-proof margin will allow legally documented, voting-age residents the ability to cast ballots in elections for mayor, city council, and other municipal offices.

Under the legislation, noncitizens will not be able to vote in federal elections that determine the president or members of Congress or state elections that determine the governor or state lawmakers.

At present, the legislation would affect more than 800,000 residents of the city who, though they are not citizens, are legal green card holders or have the right to work in the United States.

The AP reported that "little stands in the way of the effort becoming law," given its broad support within the city council and its passive support from Democratic New York City Mayor Bill de Blasio. The mayor has raised concerns about the bill's legality and argued that it will undermine the “value of citizenship," but has said he will not veto it.

Progressive voting rights and immigration activists have lauded the effort as inclusive and fair to people who reside in the city legally, pay taxes, and send their children to school.

Republicans in the city have vowed to launch a legal challenge to the measure if it is signed into law.

“We are here today pledging action against perhaps the worst idea out of New York City Democrats ever — that’s giving noncitizens the right to vote in local elections,” state GOP Chairman Nick Langworthy said during a press conference last week, according to the New York Post.

“We will pursue every legal action to see that this dangerous law is struck down," he declared, adding, “Besides being bad policy, it’s unconstitutional, it’s dangerous and un-American.”

Los Angeles, CA — Maribel Duarte is not an anti-vaxxer, in fact, she is fully vaccinated as well as the rest of her family. However, her 13-year-old son suffers from allergy and lung conditions so she was holding off on getting him vaccinated due to these problems.

“Regarding my son’s health, I am against it,” she said.

Unfortunately, being against it is no longer an option, however, as the Los Angeles Unified School District (LAUSD) took it upon themselves to vaccinate her son for her — without her consent.

Duarte told NBC 4 News her 13-year-old son came home with a vaccine card after saying yes to being vaccinated in exchange for pizza at the Barack Obama Global Prep Academy school in South LA.

The LAUSD has also taken it upon themselves to mandate the COVID-19 vaccine for all children over the age of 12. They must receive the jab before January 10, 2022 or children will be forced into virtual learning and blocked from entering campus.

The statement on the LAUSD website read, “Attention families of students aged 12 or older—this is your reminder to get your child vaccinated.

“Your first dose must be uploaded into Daily Pass no later than December 19, 2021. Both doses must be uploaded before January 10, 2022!”

Apparently, the district has since began a campaign to vaccinate students at school and is rewarding them with pizza. What’s more, according to Duarte, the unknown woman who vaccinated her son told her son to keep it a secret, so she wouldn’t get in trouble.

“The lady that gave him the shot and signed the paper told my son, ‘Please don’t say anything. I don’t want to get in trouble,'” Duarte said.

Several parents have since filed a lawsuit against the LAUSD for this very reason. NBC4 spoke to an attorney who is following these cases, Jennifer Kennedy, who explained that school districts do not have the authority to mandate medical procedures. But they are doing it anyway.

“These grotesque contests and displays of treatment and candy and gifts and favors, raffles and cash prizes inducing the kids to the vaccination…. Here is the problem, kids in California cannot consent to vaccination.”

Dutch Court Upholds Immunity From Prosecution for Israel’s Gantz in Air Strikes Case

A Dutch appeals court ruled on Tuesday that Israeli Defense Minister Benny Gantz and a former military official cannot face prosecution in the Netherlands over war crimes and alleged roles in a deadly 2014 airstrike in Gaza.

Ismail Ziada, a Dutch Palestinian who lost six members of his family in the 2014 airstrike, filed the case as a civil suit, accusing Gantz and former air force commander Amir Eshel of the deaths of his relatives.

He sought 600,000 euros ($660,000) in damages over the airstrike deaths, The Times of Israel reported

In January 2020, the court ruled that the case against both men couldn’t proceed because the men have “functional immunity from jurisdiction.”

Ziada wanted the Dutch court to order Gantz and Eshel to pay the damages and his lawyers argued that the men didn’t have immunity because their actions amounted to war crimes.

The Hague Court of Appeal said on Tuesday that the lower court was right to rule that Gantz, who was military chief of staff at the time of the airstrike, and Eshel had immunity because they were carrying out Israeli government policies.

“Dutch courts are not competent here to judge the claim. The [lower] court rightly decided that,” the court said. “High-ranking military personnel have carried out the official policy of the State of Israel, which renders a judgment on their actions moribund.”

It added that it was “not blind to the plaintiff’s suffering.”

Ziada said the court’s ruling was “in contradiction with any sense of justice” and branded the judges “cowards” for their decision.

The lower court said Ziada is free to sue the men in Israel. At hearings in 2019, Ziada rejected the idea that he has access to justice in Israel as “farcical as well as vicious.”

Microsoft Seizes 42 Websites Used by China-Based Hacking Group to Carry out Cyberattacks on US Organizations

Microsoft seized a number of websites that were being used by a China-based hacking firm to carry out cyberattacks against organizations in the United States and 28 other countries around the world, the company announced on Monday.

In a news release, the technology corporation said that a federal court in Virginia had granted Microsoft’s Dec. 2 request to allow its Digital Crimes Unit to seize the U.S.-based websites, which were being run by a hacker group known as Nickel, APT15, orVixen Panda, and stop them from carrying out such attacks.

Microsoft said it has been tracking Nickel since 2016 and monitoring these specific operations since 2019.

“We believe these attacks were largely being used for intelligence gathering from government agencies, think tanks, and human rights organizations,” Microsoft’s corporate vice president of customer security and trust, Tom Burt, said.

The company is redirecting the websites’ traffic to secure Microsoft servers to “help us protect existing and future victims while learning more about Nickel’s activities.”

However, Burt noted that “our disruption will not prevent Nickel from continuing other hacking activities, but we do believe we have removed a key piece of the infrastructure the group has been relying on for this latest wave of attacks.”

The hackers’ “highly sophisticated” attacks use a variety of techniques but often consist of installing inconspicuous malware that allows for data theft and surveillance.

“Sometimes, Nickel’s attacks used compromised third-party virtual private network (VPN) suppliers or stolen credentials obtained from spear-phishing campaigns,” Burt said. “In some observed activity, Nickel malware used exploits targeting unpatched on-premises Exchange Server and SharePoint systems. However, we have not observed any new vulnerabilities in Microsoft products as part of these attacks.”

Microsoft has created “unique signatures to detect and protect from known Nickel activity” through its various security products, such as the Microsoft 365 Defender.

The hackers’ attacks targeted both organizations in the private and public sectors, including diplomatic organizations and ministries of foreign affairs in North America, Central America, South America, the Caribbean, Europe, and Africa.

“There is often a correlation between Nickel’s targets and China’s geopolitical interests,” Microsoft said. Microsoft said it will continue to “take down malicious infrastructure, better understand actor tactics, protect our customers and inform the broader debate on acceptable norms in cyberspace,” but acknowledged that it alone cannot prevent such attacks from cybercriminals.

CNN’s Don Lemon Allegedly Sent Jussie Smollett Texts Informing Him of Police Investigation

CNN anchor Don Lemon allegedly sent disgraced actor Jussie Smollett texts during the Chicago Police Department’s investigation of his alleged hoax hate crime.

Testifying at his own trial on Monday, the former Empire star Jussie Smollett reportedly said under oath that he received a text message from Don Lemon informing him that Chicago police did not believe his account of what happened the night he claimed to have been the victim of a hate crime by two white Trump supporters.

According to the Daily Mail, Smollett’s remark “was presented and then struck from the record.”

Smollett faces six counts of felony disorderly conduct for allegedly filing a false police report, a class 4 felony that carries a maximum sentence of up to 3 years in prison, though experts believe he will likely get probation and be sentenced to community service if convicted. Smollett maintains that he did not stage his own hate crime, alleging that Abimbola and Olabingo Osundairo – the two brothers he allegedly hired – attacked him and then demanded $1 million for them not to testify.

During his testimony on Monday, Smollett said that he and Abimbola had a sexual relationship (the brother denies it) and that he never trusted Olabingo whenever he’d come around.

Mexican Mayor-Elect Arrested on Kidnapping Charges

An incoming mayor in Mexico remains behind bars after his arrest last week on kidnapping charges in Veracruz. The politician represents the MORENA Party, led by the Mexican President and the sitting governor of that state.

Last week, state prosecutors arrested Jorge Fabian Cardenas Sosa, the incoming mayor of Lerdo de Tejeda, on kidnapping charges. Details of the case and the kidnapping victim were not released by authorities. The politician remains behind bars pending a ruling on detention matters.

Cardenas’ arrest caused controversy in the region as political rivals used the case to more broadly attack his political party. MORENA is the ruling party in Mexico and was started by President Andres Manuel Lopez Obrador (AMLO). The party has claimed to have ended corruption.

Veracruz Governor Cuitlahuac Garcia said he previously expressed public concerns about Cardenas and another politician from his party over alleged ties to criminal activity, Mexico’s TV Azteca reported.

Veracruz is one of Mexico’s most violent as rival cartels fight for control of a shipping port and highways connecting Central Mexico and the border state of Tamaulipas.

This week, as Americans remember those 2403 men, women, and children killed – and 1178 wounded – in the Japanese attack on Pearl Harbor, Hawaii on December 7, 1941, recently released government documents concerning that "surprise" raid compel us to revisit some troubling questions.

At issue is American foreknowledge of Japanese military plans to attack Hawaii by a submarine and carrier force 59 years ago. There are two questions at the top of the foreknowledge list: (1) whether President Franklin D. Roosevelt and his top military chieftains provoked Japan into an "overt act of war" directed at Hawaii, and (2) whether Japan's military plans were obtained in advance by the United States but concealed from the Hawaiian military commanders, Admiral Husband E. Kimmel and Lieutenant General Walter Short so they would not interfere with the overt act.

The latter question was answered in the affirmative on October 30, 2000, when President Bill Clinton signed into law, with the support of a bipartisan Congress, the National Defense Authorization Act. Amidst its omnibus provisions, the Act reverses the findings of nine previous Pearl Harbor investigations and finds that both Kimmel and Short were denied crucial military intelligence that tracked the Japanese forces toward Hawaii and obtained by the Roosevelt Administration in the weeks before the attack.

Congress was specific in its finding against the 1941 White House: Kimmel and Short were cut off from the intelligence pipeline that located Japanese forces advancing on Hawaii. Then, after the successful Japanese raid, both commanders were relieved of their commands, blamed for failing to ward off the attack, and demoted in rank.

President Clinton must now decide whether to grant the request by Congress to restore the commanders to their 1941 ranks. Regardless of what the Commander-in-Chief does in the remaining months of his term, these congressional findings should be widely seen as an exoneration of 59 years of blame assigned to Kimmel and Short.

But one important question remains: Does the blame for the Pearl Harbor disaster revert to President Roosevelt?

Judge sets July trial date in Bannon case

Former White House strategist Steve Bannon's criminal trial on contempt of Congress charges for defying a subpoena from the House select committee investigating the Jan. 6 attack on the U.S. Capitol will begin on July 18, a federal judge ordered on Tuesday.

U.S. District Judge Carl Nichols said during a pretrial hearing that while he was not convinced by federal prosecutors' efforts to accelerate the schedule, he did not believe that a trial should wait for nearly a year, as Bannon's defense team had argued.

The judge acknowledged that his trial schedule is "still a long time in the arc of a criminal case" but said it's necessary to address the legal and constitutional challenges that Bannon's lawyers have vowed to raise.

"This is not really a way to suggest that I'm merely splitting the difference because that's not what I'm doing," said Nichols, who was appointed by former President Trump. "But I do think that the defendant's proposal for an October trial date is too slow."

"But I also think the government's proposal for an April trial date doesn't reflect adequately the arguments that will be presented whether they have merit or not."

While Nichols's scheduling order did not give the defense as much time to prepare as they asked for, the summer trial date could hamper the select committee's ability to get information out of the one-time Trump White House strategist.

The judge indicated on Tuesday that he would allot about two weeks of time for the trial, meaning that it could wrap up in early August, just three months before the 2022 midterms.

Prosecutors from the U.S. Attorney's office in D.C. had pushed for an expeditious schedule, asking for an April trial date and saying in a court filing this week that their case against Bannon is straightforward enough to be presented to a jury in a single day.

"What's critical from the government's perspective is that the public's right to a speedy trial, which is just as well established and recognized as the defendant's, is respected in this case," assistant U.S. Attorney Amanda Vaughn said during the hearing on Tuesday.

Bannon's lawyers have hinted that they intend to bring an array of challenges against the prosecution and the select committee, raising questions about the validity of the panel's investigation and the Justice Department's decision to prosecute. The defense argued that it needs to be able to collect discovery from the executive and legislative branches in order to build its case.

"This was a radical move, and we believe for a bad motive," said Doug Schoen, one of Bannon's attorneys. "These are the kinds of things we want to look into."

Nichols ordered the two parties to confer and submit a proposed schedule for pretrial motions by Dec. 16.

Hefetz also said he had warned Netanyahu about what later became Case 2000, in which the former premier is accused of attempting to reach a quid pro quo with Yedioth Ahronoth publisher Arnon Mozes for positive media coverage in exchange for legislation weakening rival newspaper Israel Hayom.

Wisconsin Dem Frontrunner Sponsored Bill To Eliminate Cash Bail

As state legislator, Mandela Barnes tried to bar courts from considering the severity of a defendant's crime

The Democratic frontrunner in Wisconsin's Senate race sponsored a bill that would have ended cash bail and barred courts from using the severity of a defendant's crimes to argue against their release.

As a state legislator in 2016, Mandela Barnes introduced legislation to eliminate "monetary bail as a condition of release for a defendant charged with" a crime. Instead of setting bail, Wisconsin courts would be "required to release a defendant before trial" unless they found "by clear and convincing evidence" that the defendant would "cause serious bodily harm to a member of the community" if released. Under the bill, however, courts could not "use the nature, number, and gravity" of the crimes in question as the sole reason to keep someone behind bars, severely limiting prosecutors' ability to argue that the defendant would be a risk to the community.

Barnes's bill—which died in committee—came years after Milwaukee County district attorney John Chisholm espoused similar views in his inaugural campaign. Those views have faced renewed criticism in Wisconsin after Chisholm set what he later called an "inappropriately low" bail amount in the case of Darrell Brooks, who allegedly killed six people in a Christmas parade rampage just weeks after a domestic violence arrest. Chisholm, who in 2007 "guaranteed" his policies would put murderers back on the streets, let Brooks walk on $1,000 bail days before the parade tragedy.

Fond du Lac County district attorney Eric Toney said Barnes's proposal would erode the ability of prosecutors to keep dangerous people in custody.

"These liberal proposals take tools away from prosecutors and allow dangerous criminals to remain free, making Wisconsin more dangerous," Toney, who is running for attorney general, told the Washington Free Beacon. "Violent criminals must be kept behind bars, period."

Barnes, who did not return a request for comment, has already faced attacks from Republicans over his ties to radical criminal justice activists.

In September, the Democrat traveled to San Francisco to fundraise with the city's district attorney Chesa Boudin, the son of left-wing terrorists who has ended cash bail and declined to prosecute serial offenders. California state senator Scott Wiener also attended the event—Wiener has called to abolish U.S. Immigration and Customs Enforcement, which he labeled a "force of oppression" that makes "communities less safe."

Months later, Barnes received an endorsement from the Center for Popular Democracy (CPD), a liberal activist group at the center of the movement to defund police. Barnes headlined a November CPD event to thank the group for its support, saying he was "very honored" to land its endorsement given its "amazing work … in states all across the country." CPD organized a number of "defund police" rallies in the summer of 2020, which the group says played a direct role in local officials' decisions to cut tens of millions of dollars from their police budgets. CPD also sponsors DefundPolice.org, a "comprehensive web resource where organizers can find everything they need for their campaign to defund police in one place."

Barnes became Wisconsin's lieutenant governor in 2019 after he and running mate Tony Evers defeated Republican incumbents Scott Walker and Rebecca Kleefisch by 1 point. Barnes now holds a 29-point lead in the Democratic primary race to succeed Republican incumbent senator Ron Johnson, internal polling from September shows. Other prominent Democrats vying for the nomination include state treasurer Sarah Godlewski, Milwaukee Bucks senior vice president Alex Lasry, and county executive Tom Nelson.

Should Barnes emerge from the crowded contest, it's unclear who he would face in November 2022—Johnson has not yet announced whether he will run for reelection.

Sinaloa Cartel Ring Busted in U.S. 1,400 Miles from its Mexican Headquarters

The largescale drug trafficking operation of an infamous cartel just got busted in a mountain state some 1,4000 miles from its Mexican headquarters and only one U.S. official, a local prosecutor, has dared to acknowledge the obvious; “This poison is coming over from our southern border unchecked,” said the elected prosecutor of Colorado’s largest district. “It will not stop coming over the border from Mexico into our communities until the federal government takes that porous border seriously.” His name is John Kellner, district attorney in the state’s 18th Judicial District which serves a population of about 1.3 million and covers Arapahoe, Douglas, Lincoln, and Elbert counties. The area varies from Denver suburbs to rural neighborhoods.

The recently dismantled operation was based in Denver and has ties to the Sinaloa Cartel which is headquartered some 1,400 miles away in the northwest Mexican city of Culiacan in the state of Sinaloa. A large stash of weapons and drugs were seized by a task force consisting of federal, state, and local law enforcement agencies. Around 110,000 counterfeit fentanyl pills were confiscated along with 11.5 kilograms of cocaine, six kilograms of methamphetamine, 8.5 pounds of heroin, 28 firearms, three hand grenades, multiple high-capacity magazines including one 200-round drum magazine, armor piercing ammunition, body armor with rifle rated ballistic armor plats and $450,000 in U.S. currently. Nineteen people have been indicted, according to a statement released by the Drug Enforcement Administration (DEA). In the document the agency’s Denver Acting Special Agent in Charge, David Olesky, says “this investigation demonstrates and corroborates the alarming trend in counterfeit prescription pills laced with fentanyl flooding our streets, as well as the continuing nexus between drug trafficking and violent crime impacting our communities.”

The DEA began investigating the drug smuggling operation in April. Charges range from racketeering and conspiracy under the Colorado Organized Crime Control Act to drug distribution and money laundering. A 20-count indictment issued by Colorado’s 18th Judicial District Grand Jury outlines how the defendants distributed large quantities of cocaine, heroin, methamphetamine, fentanyl, and other controlled substances throughout the counties in its jurisdiction. Among the key defendants is Saul Ramon Rivera-Beltran, a 30-year-old who lives in Thorton and coordinated the drug shipments from Mexico, authorities say. The fentanyl is believed to have been manufactured in Mexico, smuggled into the United Sates across the Mexican border, and eventually brought to Colorado, according to prosecutors.
