7 soldiers charged after Fort Bragg trooper’s severed head found washed ashore

Seven soldiers who went camping with a Fort Bragg paratrooper before his severed head washed up on a beach are facing courts-martial on conspiracy and a slew of other charges.

The North Carolina-based soldiers were the last to see decorated Spc. Enrique Roman-Martinez, 21, during their trip to Cape Lookout National Seashore for Memorial Day weekend in May 2020.

The Californian was reported missing on May 22 — six days before his severed head was found washed up on the shore. His body has never been found.

His homicide case remains open with a $50,000 reward, but was moved to “cold case status,” a spokeswoman for the Army Criminal Investigation Division said.

No one has been charged with his death, and the seven facing courts-martial are for charges not directly related to the homicide, officials stressed……

Judge Denies Clinton Lawyer Micheal Sussmann’s Motion To Dismiss Charges For Alleged Lies To The FBI

…..The court then considered the question of whether Sussmann’s alleged lie to Baker — that he was not representing any client in bringing the Alfa Bank evidence to the FBI — “was in fact capable of influencing either the commencement or the later conduct of the FBI’s investigation.” In addressing this issue, the court summarized Sussmann and the Special Counsel’s respective positions, and, calling the question “hotly disputed,” concluded it could not resolve the dispute prior to trial.

While the trial court denied Sussmann’s Motion to Dismiss, Judge Cooper nonetheless left open the possibility that Durham’s Section 1001 case may never reach a jury, writing:

“So, while Sussmann is correct that certain statements might be so peripheral or unimportant to a relevant agency decision or function to be immaterial under § 1001 as a matter of law, the Court is unable to make that determination as to this alleged statement before hearing the government’s evidence. Any such decision must therefore wait until trial.”

In other words, the court is telling Sussmann that it will reconsider the materiality question after the prosecution has presents it “case-in-chief,” or the government’s evidence in support of its Section 1001 charge. If, at that point, the court concludes the evidence is “so peripheral or unimportant” to the agency’s function, the charge could still be dismissed without reaching a jury.

The court could likewise toss the case after Sussmann presents his defense to the charge and the government counters with rebuttal witnesses, or even after the case is submitted to the jury and the jury returns a guilty verdict. In any of these scenarios, the court could still rule, as a matter of law, that the evidence of materiality is just not enough to violate Section 1001.

These possibilities are unlikely, though, because the parties’ respective arguments make clear that sufficient evidence exists to support a jury verdict.

First, Durham’s team has made clear that it is prepared to present evidence at trial that will prove the FBI, had it known that Sussmann “was disseminating highly explosive allegations about a then-Presidential candidate on behalf of two specific clients, one of which was the opposing Presidential campaign,” could have, instead of opening a “full investigation,” conducted an “assessment,” opened a “preliminary investigation,” or delayed an investigation until after the election.

According to the Special Counsel’s briefing, it will also presenttestimony from “multiple government witnesses” confirming “that understanding the origins of data and information is relevant to the FBI in multiple ways, including to assess the reliability and motivations of the sources.” Those same witnesses will likely also testify that had they known Sussmann was presenting evidence compiled on behalf of the Clinton Campaign and Joffe, they would have more fully investigated the genesis of the white papers and how the data was compiled.

Significantly, though, the law does not care how any one specific agent would have reacted but for a lie. Rather, on the issue of “materiality,” the question is whether the lie “is capable of influencing a decision,” and the test is an objective one.

This reality will make the upcoming criminal trial quite the spectacle, with the Special Counsel’s office calling as witnesses federal agents who were not involved in the Crossfire Hurricane investigation. They will likely testify concerning proper protocols and procedures and in doing so, expose the many failings of the team investigating first candidate, and then, President Trump. In contrast, when Baker and other members of the Crossfire Hurricane team testify concerning the Alfa Bank aspect of the investigation, Sussmann’s attorneys will likely elicit testimony showing they didn’t care who Sussmann represented.

But, because the law of materiality adopts an “objective” viewpoint, it does not matter what the individual agents did, did not do, or would have (or would not have) done. Thus, even if all of the agents involved in Crossfire Hurricane testify that Sussmann’s alleged lie had no impact on their investigation, as a matter of law, it can still be material….

New details have emerged in the strange case of two men charged with tricking Secret Service officers (including some tasked with protecting the White House and First Lady Dr. Jill Biden) by impersonating federal officers.

However, a judge overseeing the case reportedly expressed sharp skepticism this week that prosecutors could back up their claims.

The judge said the suspects should be released from custody until their trial. Attorneys for the two men did not immediately respond to PEOPLE's request for comment.

In a complaint filed and unsealed last week, federal prosecutors initially alleged that the men — 36-year-old Haider Ali and 40-year-old Arian Taherzadeh — had been falsely claiming to be officers with the Department of Homeland Security (DHS) since February 2020.

The evidence laid out in the complaint was extensive, with authorities saying the two attempted "to ingratiate themselves" with real members of the federal law enforcement community by providing Secret Service agents (and one DHS employee) with gifts including a $40,000-per-year apartment, iPhones, a drone, a flat-screen TV and a case for storing an assault-style rifle.

In court documents filed this week, prosecutors for the Department of Justice laid out more details in their case, arguing that the men had secretly tried to "remove evidence of their criminal scheme from the apartment building" in which they were living.

In a memorandum filed Monday, the U.S. government argued that it had "confirmed more troubling facts" in the days since the men had been arrested, including that law enforcement had recovered "illegal high capacity magazines" while executing the search warrant at the men's apartments.

The government also said in its filing that, "after Taherzadeh was tipped off about the investigation, either he or Ali appears to have made further attempts to conceal evidence, including by trying to corruptly enlist the help of a federal law enforcement agent."

Prosecutors also argued that Ali had previously boasted of having ties to Pakistani intelligence.

A magistrate judge, however, wasn't convinced, saying in a hearing on Tuesday that the charges against the men were "overblown," CNN reports.

Judge Michael Harvey, citing Ali's FBI interview, argued that the men "just wanted to feel on the same level" as real federal agents.

CNN reported that, in an hour-long ruling, Harvey said "there is no evidence of foreign ties in this case" and ordered both Ali and Taherzadeh to be released from jail pending trial and placed on home detention.

The men will not be allowed to go to airports or foreign embassies or to communicate with any of the federal agents they are accused of having duped.

The investigation was spurred, per the initial complaint, by an alleged altercation involving a Postal Service letter carrier at an apartment complex on March 14. While investigating, a postal inspector learned from residents of the building that Taherzadeh and Ali may have been witnesses.

Prosecutors said the two men allegedly identified themselves to the inspector as members of the U.S. Special Police Investigation Unit and said they were involved in "undercover gang-related investigations" as well as investigations related the 2021 U.S. Capitol riots.

The investigation grew wider when the inspector learned that Taherzadeh and Ali were in regular contact with members of the Secret Service, whom they had provided with gifts (including the use of what they claimed to be an official government vehicle: their GMC SUV), per the complaint.

As the FBI got involved, further details emerged, showing that the men had offered gifts such as rent-free apartments to actual federal agents — including several Secret Service officers. Taherzadeh had at one point also offered to provide a $2,000 rifle to a Secret Service agent on the first lady's detail, prosecutors have claimed.

Another witness — identified in the complaint as a Secret Service agent "assigned to protect the White House complex" — told prosecutors he was provided with a rent-free penthouse apartment for approximately one year by Taherzadeh, who allegedly said he was an ICE agent, according to the witness.

At least four members of the U.S. Secret Service had been placed on administrative leave pending further investigation, prosecutors said in court filings.

Taherzadeh and Ali were each charged with one count of false impersonation of an officer of the United States.
