Judge rules against detaining asylum seekers for more than seven days (2018)

On July 2, 2018, Judge Boasberg issued a preliminary injunction barring the federal government from detaining asylum seekers at five U.S. field offices in Detroit, El Paso, Los Angeles, Newark, and Philadelphia. Boasberg ruled that U.S. Immigration and Customs Enforcement (ICE) violated its own policy of granting a hearing or releasing asylum seekers within seven days if they have established a credible fear of persecution in their native country. Boasberg ordered the government to release or grant hearings for more than 1,000 asylum seekers who had been detained for more than seven days. He also said that while the lawsuit was ongoing, ICE could not detain asylum seekers for more than seven days without providing written explanations for an individual's detention following a personalized review of their claim.

I can also assure you that a good portion of those funds went towards sabotaging targeted individuals. The toxins that they spray on people on lasts for a duration and has to be reapplied every few days and is quite costly. For example, it rained early this morning and was mostly dry when my wife left for church but when she came back she told me the sprayed in front of our house and another, she noticed that the front steps were wet and had an odor, and even right now, although the win gusts are up to 20 mph for the last 6 hours, underneath my car is wet. Democratic retirements create fresh challenge for hopes of winning back the Senate

New Hampshire Democratic Sen. Jeanne Shaheen’s decision to not seek reelection marks the latest bit of tough luck for Senate Democrats, who face an increasingly challenging midterm election map as they fight to climb out of the minority.

 

After losing four seats and control of the Senate in 2024, Democrats entered the 2026 cycle confronted by a 53-47 Republican majority and a daunting map with seemingly few offensive opportunities.

 

The retirements of three incumbents in Minnesota, Michigan and now New Hampshire have only further complicated matters. President Donald Trump has won Michigan in two of the last three election cycles, and all three open seats will require money and resources to defend against Republicans hoping to expand their majority.

 

It’s a challenging reality for a party that should be looking at a favorable cycle. Midterm elections have historically been a bright spot for the party out of power in the White House, which tends to gain seats in Congress as voters weigh in on the president’s leadership. That makes 2026 a key cycle for Democrats, whose best shot at reclaiming the Senate in future cycles rests on netting seats next year.

 

Democratic Senatorial Campaign Committee spokesperson David Bergstein spoke to the importance of the party seizing opportunities next year. “This Senate map is ripe with offensive opportunities Democrats can take advantage of,” Bergstein said. “Open seats in states the GOP hasn’t won in decades don’t change the fundamentals of the cycle: Republicans have more seats to defend, and they’re doing it in a hostile political environment.”

 

Republicans have portrayed the trio of retirements as a sign that next year could defy past trends.

 

“Incumbents don’t retire when they think they’re about to have an easy re-election,” said GOP strategist Corry Bliss. “Incumbents retire when they think, ‘Holy sh*t, this environment is going to suck.’”

 

Democrats’ chances of weathering the cycle may hinge in part on Republicans’ continued recruitment challenges. The GOP has lost winnable seats in recent years with controversial, Trump-backed candidates such as Herschel Walker in Georgia, Dr. Mehmet Oz in Pennsylvania and Kari Lake in Arizona.

 

Some potential Republican recruits may be unwilling to run in a cycle when they may have to defend federal worker cuts led by Elon Musk’s DOGE initiative, possible cuts to programs such as Medicaid and the dismantling of the Department of Education, said Martha McKenna, a Democratic ad-maker and strategist.

 

“Why would a reasonable, moderate Republican ever want to run for Senate in 2026?” McKenna said. “It’s just going to be impossible for them to explain it.”

 

The DSCC’s Bergstein echoed that sentiment, saying, “Our approach at this stage is to ensure we have strong candidates in these states, identify where Republicans have weak incumbents, and build the infrastructure so we can take advantage of as many realistic opportunities as possible.”

 

A New Hampshire “earthquake”

The first blow to Democrats came in late January, when Michigan Sen. Gary Peters, the outgoing chair of the Democratic Senatorial Campaign Committee, announced that he was retiring. Weeks later, Minnesota Democratic Sen. Tina Smith made a retirement announcement of her own.

 

Smith described her retirement, along with those of her colleagues, as a personal decision about how to spend the next decade of their lives. The three of them have “great confidence” that there’s a strong bench of candidates in their states, she said during an interview on CNN Wednesday.

 

“I don’t think that any of the three of us feel like we are the only ones who can do this job in this moment, but it matters to know that I believe a strong Democrat will hold the seat when I am finished in this job,” she said.

 

Incumbency is a powerful advantage and losing it in those states is a blow to the party. With Shaheen’s departure, Democrats are suddenly faced with the prospect of contending in three open seats, including two in Midwest states that have been trending toward Republicans in recent election cycles.…

Trump thanks El Salvador for taking in alleged gang members deported from US: ‘We will not forget’

Dramatic video showed the alleged gang members being processed as they arrived at El Salvador's Terrorism Confinement Center

President Donald Trump thanked El Salvador on Sunday after the country's president shared dramatic video of hundreds of alleged migrant criminals landing in Central America after being deported from the U.S.

Trump, who recently invoked the Alien Enemies Act of 1798, which allows the deportation of natives and citizens of an enemy nation without a hearing, thanked Nayib Bukele on social media.

"Thank you to El Salvador and, in particular, President Bukele, for your understanding of this horrible situation, which was allowed to happen to the United States because of incompetent Democrat leadership," Trump wrote. "We will not forget!"

Trump also referred to the apprehended migrants as "the monsters sent into our Country by Crooked Joe Biden and the Radical Left Democrats."

A senior Trump administration official confirmed to Fox News that a total of 261 illegal aliens were deported to El Salvador yesterday – 137 were via the Alien Enemies Act of 1798, 101 were Venezuelans removed via Title 8, 21 were Salvadoran MS-13 gang members and two were MS-13 ringleaders and "special cases" for El Salvador, according to the official.

The rap sheets for those removed included kidnapping, sexual abuse of a child, aggravated assault, prostitution, robbery and aggravated assault of a police officer.

A Trump administration official also confirmed to Fox News that the planes carrying the migrants were already outside of U.S. airspace when a federal judge ordered the planes to return.

U.S. District Judge James Boasberg ordered an immediate stop to Trump's efforts to deport the alleged gang members so he could have more time to consider if Trump's use of the Alien Enemies Act was illegal.

"We did not defy a court order. The order came too late, and illegals were already in international airspace," the official said, as first reported by Axios.

White House Press Secretary Karoline Leavitt echoed the official's sentiment, telling Fox News that the order "had no lawful basis, was issued after terrorist [Tren de Aragua] aliens had already been removed from U.S. territory."

"The written order and the Administration’s actions do not conflict," Leavitt said. "A single judge in a single city cannot direct the movements of an aircraft carrier full of foreign alien terrorists who were physically expelled from U.S. soil."

In an X post, Bukele said the migrants arrived in El Salvador and were transferred to a "terrorism confinement center," where they will stay for at least a year.

The intense video showed heavily-armed Salvadorean authorities surrounding the alleged gang members, forcing their heads down and transporting them into facilities one by one.

The video also depicted the suspects getting their hair shaven and walking with their hands behind their necks as they were rounded up into their prison cells.

President Trump on Friday signed an executive order that aims to eliminate seven federal agencies, including ones that focus on media, libraries, museums and ending homelessness. (Naming the causes are supposed to cause outrage)

 

The president directed the government entities to “be eliminated to the maximum extent consistent with applicable law,” insisting they “reduce the performance of their statutory functions and associated personnel.” It ordered the heads of each entity to submit a report to the Office of Management and Budget confirming full compliance within seven days.

 

The president targeted the U.S. Agency for Global Media, which is the parent company of Voice of America (VOA),as well as the Woodrow Wilson International Center for Scholars in the Smithsonian Institution and the Institute of Museum and Library Services, an agency that supports libraries, archives and museums in every state.

 

He also dismantled theUnited States Interagency Council on Homelessness, which aims to prevent and end homelessness in the U.S.; theFederal Mediation and Conciliation Service, an agency focused on preventing, minimizing and resolving work stoppages and labor disputes; theCommunity Development Financial Institutions Fund, which aims to expand economic opportunity for underserved communities; and theMinority Business Development Agency, which promotes growth of minority-owned businesses.

 

Amid questions over the future of VOA, Trump had picked former Arizona gubernatorial and Senate candidate Kari Lake to lead the outlet. The Trump ally said at the Conservative Political Action Conference last month the international state media broadcaster won’t be “Trump TV” under her watch.

 

While the president doesn’t directly appoint the head of VOA,Trump had nominated conservative activist L. Brent Bozell III to lead the U.S. Agency for Global Media, which would make the decision. Bozell needs to be confirmed by the Senate to take his post and then could select Lake.

 

The U.S. Agency for Global Media also oversees Radio Free Asia, which broadcasts and publishes for audiences in Asia and is seen as a way to combat Chinese propaganda in the region.

 

The Trump administration has been focused on an overhaul of the federal government, with tech billionaire Elon Musk tasked with finding ways to cut spending and workers. Lest anyone think judicial insurrectionists like Russiagate co-conspirator James Boasberg are plowing new ground with regard to deportation of hostile foreign enemies, they are not. In fact, Boasberg is maliciously violating the law as part of a corrupt conspiracy to seize the powers of the presidency for himself.

 

We know this because the Supreme Court ruled in 1948—long after World War II was over—that the Alien Enemies Act gave the U.S. president absolute authority to detain and deport a German who had been in the U.S. legally since the 1930s.

 

In the case of Ludecke v. Watkins, the Supreme Court ruled explicitly that not only could the president deport legal foreign residents even if they weren’t members of a foreign army, but that the courts had no authority to even review the president’s decision to do so.

 

“The Alien Enemy Act precludes judicial review of the removal order,” the Supreme Court ruled, years after World War II had ended.

 

“Such great war powers may be abused, no doubt, but that is a bad reason for having judges supervise their exercise, whatever the legal formulas within which such supervision would nominally be confined,” the Supreme Court majority declared. “Accordingly, we hold that full responsibility for the just exercise of this great power may validly be left where the Congress has constitutionally placed it—on the President of the United States.”

 

The Founders in their wisdom made him not only the Commander-in-Chief but also the guiding organ in the conduct of our foreign affairs,” the Supreme Court ruling continued. “He who was entrusted with such vast powers in relation to the outside world was also entrusted by Congress, almost throughout the whole life of the nation, with the disposition of alien enemies during a state of war.”

 

In the current instance, the president on January 20 declared a national emergency at the border, noting an ongoing invasion by hostile and violent foreign enemies.

 

“This assault on the American people and the integrity of America’s sovereign borders represents a grave threat to our Nation,” the president declared. “Because of the gravity and emergency of this present danger and imminent threat, it is necessary for the Armed Forces to take all appropriate action to assist the Department of Homeland Security in obtaining full operational control of the southern border.”

 

The president further designated multiple violent foreign drug cartels, including the Venezuelan organization Tren de Aragua, as foreign terrorist organizations, putting them in the same category as ISIS and al Qaeda. And to protect the safety and sovereignty of the United States, the president ordered the immediate detention and removal all Venezuelan individuals associated with that violent enemy force.

 

In the Ludecke case from 1948, the petitioner being detained and removed was a German writer who had legally resided in the U.S. for over a decade with no history of violence and no direct ties to any German military or paramilitary unit, years after the war with Germany was over. And in that case, the Supreme Court said the president’s authority under the law and the Constitution was absolute and could not even be reviewed, let alone blocked, let alone reversed.

 

Compare those facts to the current case: the president is removing foreign aliens who are members of a violent foreign terrorist organization who entered the U.S. illegally for the purpose of committing illegal and often brutally violent acts the United States in the midst of a national emergency at the border and ongoing military action against the drug cartels.

Yet James Boasberg, the corrupt federal judge who also personally made sure a key Russiagate hoaxer and felon whose own fabrications he oversaw never spent a day in prison, is now trying to extort the Commander-in-Chief into pre-emptively submitting all presidential decisions—including individual flight plans—for him to review.

 

This isn’t just a constitutional abomination. It is an attempt by an inferior and unelected judge to corruptly seize the powers of the presidency from the Commander-in-Chief on behalf of a hostile foreign invading force.

 

For this reason, Boasberg needs to be placed under criminal

investigation, any security clearances currently granted to him must be revoked, all his communications must be seized and reviewed, and he must be removed from the bench until the criminal investigation into his activities is concluded.

 

The law is clear, and Boasberg is maliciously ignoring it, putting the safety and sovereignty of the entire country at risk. It’s time for him to be held to account for his actions.
