On February 1, 2017, President Donald Trump nominated Brand to be United States Associate Attorney General.[22] Her appointment was confirmed 52–46 by the U.S. Senate on May 18, 2017,[23] and she was sworn in on May 22, 2017. The reauthorization of the 702 section of the surveillance law was a job assignment of the subject according to CNN.[24] On February 9, 2018, the New York Times reported that Brand, along with her assistant Currie Gunn, resigned from the Justice Department. The NY Times article indicated Brand oversaw "a wide swath of the Justice Department" and helped lead the department’s effort to extend Section 702 of the FISA Amendments Act that "authorizes the National Security Agency’s warrantless surveillance program."[2][25] On February 12, 2018, NBC News reported that Brand quit the Justice Department over fear she might be asked to oversee the Russia probe and was taking a position with Walmart as EVP of Global Governance and Corporate Secretary.[1][26]

Deputy Attorney General Rod Rosenstein headed to the White House Monday expecting to lose his job, a person familiar with the situation told The Associated Press. The development followed revelations that Rosenstein had made comments critical of President Donald Trump, including discussing possibly secretly recording the president and invoking the Constitution to have the Cabinet remove him from office,

Trump himself was in New York for a meeting of the U.N. General Assembly.

It was not immediately clear whether Rosenstein intended to resign at the White House over the commotion caused by his remarks last year, or if was simply expecting that he would be fired. That distinction matters in terms of whether the president would be able to name an interim successor of his own choosing.

Regardless, any termination or resignation would have immediate implications for special counsel Robert Mueller's investigation of possible collaboration between Russia and the Trump campaign before the 2016 election. Rosenstein appointed Mueller and oversees his investigation.

If Rosenstein actually does resign, Trump would be able to replace him under the vacancy rule. If he is fired, it will require Senate confirmation of a replacement—unless, of course, Mitch McConnell suddenly decides that the Senate really, really must close … because.
