at issue is the 14th amendment to the constitution which provides that “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state where they reside.”

The legal key to answer this is the meaning of the second requirement "…subject to the jurisdiction thereof…". This is not to sy that the first requirement (persons born or naturalized in the United States) is irrelevant. Far from it, as the understanding of this clause also bears weight in the legal interpretation of the amendment.

This latter point is straightforward - it was intended to add another basis for citizenship to the common law rule that existed prior to the 14th amendment - that is - that the citizenship of the parent (not their location upon birth) determined citizenship of the child. The purpose of this was to include slaves and Indians (who were not citizens at that time) in order to ensure that their children would be. That said, the 14th amendment also added the express condition that all such persons (children) would ALSO be "subject to the jurisdiction of the United Stated" in order to qualify.

There is certainly NO dispute about the language of the 14th amendment. There is NO dispute that the Congress has passed NO law authorizing anchor babies. And most importan, there is NO dispute that SCOTUS has never been asked to rule on the following question that 100% determines this matter:

"Does the 14th amendment's requirement that persons "subject to the jurisdiction of the United State" permit children of (illegal aliens and/or non-citizens with a residence permit) to automatically become US citizens?

I can say that when posed this way the question answers itself with common sense. So far as legal analysis, the issue is the interpretation of "subject to the jurisdiction of the US". As an interesting side note, prior to the 14th amendment, citizenship was defined and determined by STATE laws, not federal.

Congress could had from the beginning attempted to include a defined local birthright rule – whether due to place of birth or parentage – but would have found, just as the Thirty-Ninth Congress had discovered, to be no simple matter as individual States had differing opinions over who should, or should not, be their citizens.

The Fourteenth Amendment’s citizenship clause required owing complete allegiance only to the United States in advance rather than automatically bestowed by place of birth, i.e., only children born to parents who owed no foreign allegiance were to be citizens of the United States.

Who are the subjects of a foreign power? Thomas Jefferson said “Aliens are the subjects of a foreign power.”

Chairman of the House Judiciary Committee (39th Congress), James F. Wilson of Iowa, confirmed on March 1, 1866 that children under this class of aliens would not be citizens: “We must depend on the general law relating to subjects and citizens recognized by all nations for a definition, and that must lead us to the conclusion that every person born in the United States is a natural-born citizen of such States, except that of children born on our soil to temporary sojourners or representatives of foreign Governments.

Framer of the Fourteenth Amendments first section, John Bingham, said Sec. 1992 of U.S. Revised Statutes meant “every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty is, in the language of your Constitution itself, a natural born citizen.

PHOENIX (AP) — The more than 5,200 active-duty troops being sent by President Donald Trump to the U.S.-Mexico border will be limited in what they can do under a federal law that restricts the military from engaging in law enforcement on American soil.

That means the troops will not be allowed to detain immigrants, seize drugs from smugglers or have any direct involvement in stopping a migrant caravan that is still about 1,000 miles from the nearest border crossing.

Instead, their role will largely mirror that of the existing National Guard troops — about 2,000 in all — deployed to the border over the past six months, including providing helicopter support for border missions, installing concrete barriers and repairing and maintaining vehicles. Is This The Reason Whitey Bulger Got Whacked In Jail?

Reports that Boston crime boss James "Whitey" Bulger had been murdered hours after being transferred to a federal maximum security prison in West Virginia shocked the public on Tuesday, and immediately raised questions about the circumstances surrounding his death.

How was the inmate, who was reportedly in ill-health, murdered so quickly after arriving in the new prison? And how was it that guards weren't monitoring such a high-profile inmate, particularly since it came out in his 2013 trial that he worked with the FBI for years ratting out rival mobsters to help consolidate his power in the Boston underworld?

While the federal government hasn't released any more details about Bulger's death, the Daily Mail and TMZ have managed to dig up some information that, if accurate, could indicate a motive for what may have been a killing tacitly sanctioned by senior law enforcement officials. According to the Mail, Bulger, who was confined to a wheelchair at the time of his death, had been talking about outing people in the upper echelons of the FBI's informant program.

The suspicious circumstances of Bulger's death would suggest that there's more to the story than a routine killing. For one, Bulger was seemingly arbitrarily transferred to the Hazelton facility in West Virginia, which had been the site of three other inmate killings over the past year. Sources also said Bulger hadn't even been processed when he was killed. So, apparently, somebody in the prison population had been tipped off that he was coming. When he arrived, Bulger was mixed in with the general population, leaving him vulnerable.

According to TMZ's sources, the circumstances of Bulger's killing were fittingly brutal for the longtime crime boss, who has bragged about killing no fewer than 40 men, though he was convicted of being involved in 11 killings. Sources told TMZ that Bulger was wheeled into a secluded corner of the prison, where three inmates beat him with a lock in a sock, and then tried to gouge his eyes out - a punishment typically reserved for so-called "rats".

A prison source tells us Bulger – who is wheelchair bound – was in general population Tuesday morning. We're told he was approached by 3 other inmates who wheeled him into a corner that could not be seen by surveillance cameras.

Our source says the inmates beat Bulger – one used a lock in a sock as a weapon – until he was unconscious. They also attempted to gouge his eyes out with some type of shiv, but were unsuccessful. Bulger fell to the ground covered in bruises and with several dents in his head.

As for the eyes, we've been doing some research – back in the days of Murder Inc., (the 1940s gangsters, not the rappers) mobsters would gouge out the eyes of witnesses who talked to cops.

According to the Mail, Bulger's death might have something to do with US Rep. Stephen Lynch, who is from Bulger's old neighborhood of Southie, and who recently introduced the Confidential Informant Accountability Act. It's possible, according to the Mail, that Bulger was preparing to open up to a member of Lynch's staff about abuses with the FBI's confidential informant program.

The Massachusetts Democrat last year introduced the Confidential Informant Accountability Act - which calls for congressional oversight into the selection and use of confidential informants. It's possible that Bulger was set to open up to someone on Lynch's team with claims of abuses in the program.

Bulger's lawyer, for one, blasted the Bureau of Prisons in a statement, accusing it of unilaterally converting Bulger's life sentence into the death penalty.

In a statement, Bulger's lawyer J.W. Carney Jr blasted the prison system over the mobster's death.

'He was sentenced to life in prison, but as a result of decisions by the Federal Bureau of Prisons, that sentence has been changed to the death penalty,' the statement read.

If these rumors prove true, they will leave many observers to ponder the possibility that the federal government was somehow involved in Bulger's death.

Many basic questions remain unanswered a day after the Pentagon announced an open-ended deployment of over 5,200 active-duty troops to the border, including the cost and scope of the mission as well as the Pentagon’s assessment of any threat posed by arriving migrants.

U.S. President Donald Trump has hardened his stance on immigration ahead of Nov. 6 congressional elections. He has drawn attention to a caravan of migrants that is trekking through Mexico toward the United States as he seeks to fire up support for his Republican party.

Republican lawmakers and other Trump supporters have applauded the deployment. But critics say Trump is politicizing the military, deploying them as a stunt to drive Republican voters to the polls without any real national security threat.

General Terrence O’Shaughnessy, the head of U.S. Northern Command, defended the operation at a briefing on Tuesday. He echoed Trump administration concerns about the caravan and compared the border support mission to other domestic military missions, like hurricane relief.

“I firmly believe that border security is national security,” O’Shaughnessy said.

The U.S. military still had no firm idea of what the operation would cost, he added. Pentagon officials have said the Defense Department will need to find a way to pay for the operation, suggesting money may need to be taken from other national security programs.

O’Shaughnessy said just over 1,000 troops had already deployed to Texas as of Tuesday, where they will carry out tasks like building barriers, erecting tents, and flying government personnel by helicopter to and from different locations along the border.

He said the more than 5,200 troops now slated to go to Texas, Arizona and California were only the start of a larger deployment and that eventually troops would go to New Mexico as well.

“What I can confirm is there will be additional force over and above the 5,239. The magnitude of that difference, I don’t have the answer for now,” he said.

For the last few days, President Trump has touted plans to send troops to the U.S. border with Mexico. The details of that are now coming into focus. Here's Secretary of Homeland Security Kirstjen Nielsen yesterday at the White House.

KIRSTJEN NIELSEN: The president has directed that the Department of Defense and the Department of Homeland Security work together with our governors to deploy the National Guard to our southwest border to assist the Border Patrol.

CORNISH: The details matter because the president can't just call up military forces on a whim to do domestic law enforcement. It's barred by a federal law dating back to the period after the Civil War, a law known as posse comitatus. Earlier today, George Mason University law professor Timothy MacArthur explained it to us.

TIMOTHY MACARTHUR: The law states that federalized military personnel cannot perform civil law enforcement functions. That means that anything short of search, seizure and arrest the military can assist with. And that would be providing surveillance, providing military equipment, training, information sharing, stuff of that nature.

CORNISH: So I understand this goes back to Reconstruction and the period right after the Civil War. What was going on why people decided to put this law into place?

MACARTHUR: Well, after the Civil War, during the Reconstruction era, what had happened is the southern states were either unwilling or unable to enforce civil laws. So at that time the federal government employed active duty military to keep the peace. And so what happened is Congress enacted the posse comitatus law. And that was due to the fact that the southern states didn't want military rule.

CORNISH: So ever since then, have presidents been able to get around this rule? I think you've written about the Civil Rights period where we saw federalized National Guard deployed.

MACARTHUR: Yeah. In 1957, President Eisenhower federalized the Arkansas National Guard to protect African-American students integrated into a previously all-white high school. By executive order, President George H.W. Bush deployed active duty troops to the city of Los Angeles in 1992 to quell the violence set off in response to the Rodney King verdict.

CORNISH: So what do we know about how the National Guard has been deployed in, say, support roles for border enforcement? I understand it's been done during the Bush and Obama administrations.

MACARTHUR: It has. In 2006, President Bush federalized the National Guard and sent them to the U.S.-Mexico border. In 2010, President Obama did the same. The real distinction here is what they're actually doing when they're mobilized and deployed to the border. As long as either a federalized National Guard or active duty military participate in passive activities, then it's allowed.

CORNISH: So the key word here is passive activities. What does that mean?

MACARTHUR: Well, that's generally a support role to the U.S. Border Patrol or anybody else that's securing our borders. It would be providing surveillance, providing assistance, providing military equipment and training on how to use that equipment. It's anything short of search, seizure and arrest.

CORNISH: So President Trump is working through governors to make this happen now. Is there a possibility that, say, a state could refuse - right? - could say look; we don't want to be involved in this?

MACARTHUR: Correct. The governor is the - you know, is the commander in chief for that - for those National Guard soldiers. And the governor here, she could say, you know what? We're not standing up our National Guardsmen and putting them on the border. So a governor can refuse the request of a president.

CORNISH: Is there a way that the president or administration could say, look; this is a national security issue?

MACARTHUR: Certainly the president can declare immigration as a national emergency and involuntarily mobilize National Guardsmen. But still the Posse Comitatus Act would still be in effect, which would not allow the National Guard to perform civil law enforcement functions.

CORNISH: What are you going to be looking for in the next few days as we hear more details about this?

MACARTHUR: Well, what I'm interested in hearing about is the actual application of how the president is going to put this into effect. Is he going to get the permission of the governors to bring them on in Title 10 federal status? What are the specifics of how you're going to do this and what you're going to actually do?

CORNISH: So it's not impossible. There are just limits.

MACARTHUR: Correct.

Her brother Pietro has been leading a decades-long campaign to find out what happened to her and has accused the Vatican of silence and even complicity in the case.

The Vatican has said on several occasions that it has cooperated with Italian police over the case.

Gregori disappeared exactly 40 days before Orlandi.

Her mother says Gregori answered the intercom at the family apartment before telling her parents it was a school friend and she was going out to speak to him. She never returned.
