Trump attorney Jay Sekulow accuses Democrats of playing politics, 'The president has not asked for Nancy Pelosi's tax returns'

As the White House faces pressure from congressional Democrats on several fronts, President Donald Trump’s personal attorney Jay Sekulow fired back at the House Ways and Means Committee’s bid for the president’s tax returns on Sunday, arguing the request does not serve a "legitimate legislative purpose."

"This idea that you can use the IRS as a political weapon … is incorrect both as a matter of statutory law and constitutionally," Sekulow said in an exclusive interview on "This Week" Sunday morning. "It's not the law for the United States. We don't have a requirement that presidents do that."

Last week, the Democrat-controlled panel formally requested Trump’s business and personal tax information dating back to 2013 from the IRS. In making his request, House Ways and Means Committee Chairman Rep. Richard Neal, D-Mass., cited Section 6103(f) of the federal tax code, an obscure, nearly hundred-year-old provision, which says that the Treasury Secretary "shall furnish such committee with any return or return information specified in such request."

The very purpose of the tax code provision Neal wants to exercise was written with the express intention of executive branch oversight, in the wake of the 1920s Teapot Dome scandal, said Steve Rosenthal, a senior fellow in the nonpartisan Urban-Brookings Tax Policy Center and a tax lawyer with 25 years' experience.

"If you look to the legislative context for why this statute exists, and then why Neal is asking, there is not any credible argument to refute the request," Rosenthal told ABC News.

In a letter to Treasury Department’s general counsel on Friday, a new lawyer for Trump, William Consovoy, called the move by Democrats "a gross abuse of power" and encouraged the IRS to "refrain from divulging the requested information."

"If it has to be litigated, it will be litigated," Sekulow told ABC News Chief Anchor George Stephanopoulos on Sunday. "As the president’s counsel, we have the right to protect his interests as a private citizen and as president."

Asked about Democrats’ request, Trump said last week that he is "not inclined" to release any of his tax information willingly, citing an ongoing audit.

Sekulow also reiterated the president’s position on the much-anticipated release of special counsel Robert Mueller’s report, which Attorney General William Barr has said could come out "by mid-April, if not sooner."

"The president has said he turns this over to the attorney general," Sekulow said Sunday. "The attorney general, pursuant to the regulations, George, makes the determination as to what’s released, how it’s released."

Democrats are clamoring for more information about the special counsel’s nearly 400-page report since Barr released his four-page letter to Congress outlining the document’s "principal findings."

On Wednesday, Democrats on the House Judiciary Committee voted to authorize subpoenas for the full report, but the chairman of that panel, Rep. Jerrold Nadler, D-N.Y., has said the committee would "work with the attorney general" before issuing any subpoenas.

"I find it ironic that people are talking about subpoenas already for the documents when we’re probably less than a week away – or about a week away – from getting them," Sekulow said Sunday.

But a report in the New York Times suggesting "some" of Mueller investigators believe Barr has "failed to adequately portray the findings of their inquiry" breathed new life into debate over Barr’s handling of the report.

The Washington Post later reported that the special counsel’s office had prepared summaries that could be released publicly, reflecting different sections of Mueller's report, which Barr has withheld. One source told the Post that the summaries contained potentially sensitive information that needed to be vetted before release.

Sekulow on Sunday brushed those reports aside, denying that the full report will be more damaging to the president than what Barr indicated in his four-page letter to congress.

"There’s two conclusions that are important to reiterate," Sekulow said. "No obstruction, and no collusion."

In response, the Justice Department issued a statement defending the attorney general’s handling of the matter without directly addressing those news reports.

"Given the extraordinary public interest in the matter, the Attorney General [previously] decided to release the report's bottom-line findings and his conclusions immediately – without attempting to summarize the report," Justice Department spokeswoman Kerri Kupec said in a statement.

China to revise laws, regulations related to foreign investment law

The State Council, China's cabinet, said Wednesday it was necessary to amend laws and supporting regulations and policies to ensure the implementation of the foreign investment law.

Draft amendments for administrative licensing law, trademark law, construction law and electronic signature law were passed Wednesday at a State Council executive meeting presided over by Premier Li Keqiang.

Suggestions for revisions include adding the principle of "non-discrimination" in administrative licensing, substantially raising the amount of compensation for infringing exclusive rights to use trademarks, and cutting approval time for applications for qualified construction permits.

Donald Trump Says Ilhan Omar 'Doesn't Like Israel'

Contrary to claims by Nielsen, Kobach said Trump does not need Congress to take action to stop illegal immigration.

“It’s not like we’re powerless and it’s not like we have to wait for Congress to do something,” Kobach said. “It’s sort of frustrating we see the Secretary of Homeland Security [Kirstjen Nielsen] saying ‘Well, we need Congress to help us before we solve this problem.’ No, we can actually solve the immediate crisis without Congress acting.”

Kobach detailed three steps DHS and the Trump administration can take, immediately, to not only lower illegal immigration levels, but unilaterally end the expanded policy of Catch and Release — where more than 17,000 border crossers and illegal aliens were released into the interior of the U.S. over the last 12 days.

Kobach explained:

There’s basically three steps. The first one is finalize a regulation that DHS proposed back in September. They could have finalized the regulation, made it go into effect in December, four months ago, but they’ve been dragging their feet … what the regulation would do is basically supersede the Flores Settlement. The Flores Settlement is that 20-year-old settlement that limits the amount of time that a minor can be detained and effectively limits the amount of time that a family can be detained together. Once this regulation is published, we can detain the whole family, keep them together, and that reduces the incentive to bring these minors north and using them as ‘Get out of jail free’ cards. [Emphasis added]

The second [step] is because of the lack of traditional detention space, the Border Patrol is saying ‘Well we have to let these people go.’ Now I have some … disagreements with the terms on which they’re letting them go. Let’s back up, we can create detention space. The federal government right now owns thousands, multiple thousands, of trailers and mobile homes that we use for hurricane disasters and they’re selling them at bargain prices right now … we should be using those to create basically processing centers where people … you put a fence around a park or a parking lot, you park a hundred of those trailers there and you can have people have their immigration hearings, have their asylum and credible fear hearing, have everything right there. Deploy dozens of immigration judges down to these centers. Don’t let them go, have a fleet of commercial planes ready to fly them back to their home countries. [Emphasis added]

Kobach said the three executive actions would deliver immediate results for the American people and the nation’s sovereignty.

“If we did all those three things, we’d solve the crisis,” Kobach said. “You would see a dramatic drop in the number of people coming north and you’d see these caravans coming to an end.”

Currently, DHS is operating an expanded Catch and Release policy where the Immigration and Customs Enforcement (ICE) agency releases tens of thousands of border crossers and illegal aliens into the country.

The Catch and Release process often entails federal immigration officials busing border crossers into nearby border cities and dropping them off with the promise that they will show up for their immigration and asylum hearings, sometimes years later. The overwhelming majority of border crossers and illegal aliens are never deported from the country once they are released into the U.S.

Since December 21, 2018, Trump’s DHS has released more than 125,000 border crossers and illegal aliens into the country. In the San Antonio, Texas area, alone, more than 53,000 border crossers and illegal aliens have been released since the end of 2018.

The Catch and Release policy has strained ICE resources, forcing fewer arrests of illegal aliens living in the interior of the country in recent months. At current rates, DHS is on track to release about 500,000 border crossers and illegal aliens into the interior of the U.S. by the end of this year.

California Rep. Devin Nunes said Sunday he plans to submit eight criminal referrals to the Justice Department this week related to the Obama administration’s handling of the Trump-Russia investigation.

Nunes said on Fox’s “Sunday Morning Futures” that the referrals will be made for alleged leaks of classified information to the media, for manipulating intelligence and for misleading foreign intelligence surveillance court judges regarding the infamous Steele dossier.

Suga emerges as post-Abe possibility

Campaigning for the unified local elections Saturday afternoon, Suga mentioned he had announced the new era name during a speech in front of JR Sapporo Station.

At the sound of “Reiwa,” many in the crowd of over 1,000 listeners raised their smartphones in his direction. After the speech he was swamped by the public — a sign of rising Suga fever.

Since the start of Abe’s second administration, Suga has seen himself as the prime minister’s behind-the-scenes fixer, according to a source close to him. During the era name announcement however, the spotlight shone more on Suga than Abe.

The night before the announcement, Suga apparently practiced lifting up a frame to show the new era name’s characters in the press room at the Prime Minister’s Office. The paper in the practice frame reportedly had the characters for “Heisei” written on it.

Suga has used the Cabinet Bureau of Personnel Affairs — which oversees staffing for senior ministry and agency officials — to promote policies under Abe’s platform and increase his own influence within the administration.

For instance, after he suggested that cellular communications fees “could be lowered by about 40 percent” and urged major mobile carriers to lower their rates, NTT Docomo Inc. announced it would cut communication charges by 20 to 40 percent this fiscal year.

Suga also helped cut through opposition among the ministries and agencies to the administration’s plan to successfully revise the Immigration Control and Refugee Recognition Law in order to increase the number of foreign workers.

He plans to visit the United States in May to meet with U.S. Vice President Mike Pence, expanding his role to the diplomatic stage.

Suga, 70, has emphasized he is “not thinking at all about becoming prime minister.”

However, there is a precedent — Keizo Obuchi was the chief cabinet secretary who had announced “Heisei” as the current era name, and he went on to become prime minister.

Facebook : Looks to Build Underwater Ring Around Africa

Facebook Inc. is circling Africa. Literally. The company is in talks to develop an underwater data cable that would encircle the continent, according to people familiar with the plans, an effort aimed at driving down its bandwidth costs and making it easier for the social media giant to sign up more users.

The three-stage project, named Simba after the lead character in "The Lion King," could link up with beachheads in several countries on the continent's eastern, western and Mediterranean coasts, though the exact route and number of landings is in flux, the people said.

Facebook spokesman Travis Reed declined to comment on the company's plans for Africa. "We look all over the world when we consider subsea cable routes," he said.

Simba isn't Facebook's first foray into subsea cables, the high-capacity fiber-optic lines that carry most of the world's core internet traffic. The company has led projects linking markets in North America, Europe and East Asia, usually sharing the investment burden with traditional telecommunications companies, which lack the cash to lay down the cables on their own.

"When you're one of the biggest users of bandwidth, it's entirely rational to cut out the middleman and get the capacity at-cost," said Alan Mauldin, an analyst at market researcher TeleGeography.

Negotiations for the Simba project are continuing, the people said, cautioning that talks could still fall apart.

Google parent Alphabet Inc. is also in talks to build a cable system called Equiano down Africa's western coast, according to people familiar with its plans. China's Huawei Technologies Co. is rolling out subsea cable links to Africa through a subsidiary building a cable through the Indian Ocean.

Industry executives say the proposed Simba system is uniquely ambitious. The project would give Facebook's European and Asian data centers a dedicated and reliable link to growing African markets where its apps like WhatsApp are already popular. The company has funded regional networks in developing economies like Uganda to help connect the roughly 3.8 billion people across the globe who still lack internet access.

The system also could benefit partner telecom companies like MTN Group and Vodafone PLC that already serve booming economies in South Africa and Nigeria. Those companies could help pay for the cable project in exchange for some of its fiber-optic capacity, said one of the people familiar with Facebook's plans. An MTN spokeswoman declined to comment. Vodafone didn't immediately respond to a request for comment.

Tech companies like Facebook and Alphabet, wary of the wholesale telecom market and the regulatory burdens that come with it, tend to avoid selling bandwidth on cables they help fund. They have access to whole strands of fiber-optic wire, allowing them to shuttle most of their data through private networks separated from the broader internet.

Facebook has taken a long-term view with past network investments. Its Internet.org nonprofit has financed access to a small group of websites through Free Basics, a no-cost wireless service offered in several countries. Regulators in other countries have banned the program, arguing against the limited version of the web that the Facebook-backed group has curated.

Facebook is one of several large U.S. technology companies that have taken a growing role in planning and financing the internet's plumbing to serve their interests. In the process, they have supplanted traditional telecom companies that used to dominate the industry.

Alphabet has built fiber-optic cables in several cities and launched broadband-beaming balloons over hard-to-reach areas. Microsoft Corp. is pushing U.S. authorities to allow broadband service to use the "white spaces" in the radio spectrum between the channels reserved for television broadcasts.

A project as large as the one proposed by Facebook could cost up to $1 billion to build, said Greg Varisco, chief executive of Cinturion, a privately held company planning its own cable system in the Indian Ocean.
