Judge Orders Antifa Activist Yvette Felarca to Pay Judicial Watch Legal Fees for Her ‘Entirely Frivolous’ Lawsuit

 

MAY 21, 2019

 

(Washington, DC) — Judicial Watch announced that a U.S. District Judge in California awarded Judicial Watch $22,000 in legal fees in a case filed by an Antifa organizer in an effort to block Judicial Watch from obtaining information about her activities.

 

Yvette Felarca, a middle school teacher in the Berkeley Unified School District (BUSD), and two co-plaintiffs were ordered to pay Judicial Watch $22,000 in attorney’s fees and $4,000 in litigation costs. Felarca had sued the BUSD in federal court to keep the school district from fulfilling its legal obligation to provide Judicial Watch with records of their communications mentioning: Felarca, Antifa, and/or BAMN. Judicial Watch also asked for Felarca’s personnel file.

 

Felarca is a prominent figure in By Any Means Necessary (BAMN), a group founded by the Marxist Revolutionary Workers League that protests conservative speaking engagements. In 2016, Felarca and two of her allies were arrested and charged with several crimes, including felony assault, for inciting a riot in Sacramento. Earlier this year, Felarca was ordered to stand trial for assault.

 

U.S. District Judge Vince Chhabria, Northern District of California, who had previously ruled that Felarca’s lawsuit was “entirely frivolous,” wrote in his ruling awarding legal fees to Judicial Watch that Felarca and her co-plaintiffs’ First Amendment claims were “premised on the obviously baseless assumption” that the First Amendment condemns the speech of some while condoning the ideological missions of others.

Judge Chhabria added that “The plaintiffs also mischaracterized the documents under review” and that the plaintiffs “failed to grapple with the role Ms. Felarca played in making herself a topic of public discourse through her physical conduct at public rallies and her voluntary appearance on Fox News.”

 

Judge Chhabria’s order also states that “a significant portion of the documents the plaintiffs initially sued to protect from disclosure had been publicly disclosed months earlier in another suit brought by Ms. Felarca against BUSD, where she was represented by the same counsel. (See generally Felarca v. Berkeley Unified School District, No. 3:16-cv-06184-RS). The plaintiffs, therefore, had no reasonable argument to protect those documents from disclosure.”

 

Along with Felarca’s $20,000 payment, co-plaintiffs Lori Nixon and Larry Stefl were ordered by Judge Chhabria to pay Judicial Watch $1,000 each (Yvette Felarca, et al., v. Berekely Unified School District, et al. (No. 3:17-cv-06282-VC)).

 

“Judicial Watch is entitled to attorney’s fees because the plaintiffs’ lawsuit was frivolous, and their litigation conduct was unreasonable,” Judge Chhabria wrote in his order.

 

Additionally, Judge Chhabria’s order holds the plaintiffs “jointly and severally liable” to pay Judicial Watch $4,000 in litigation expenses.

 

In 2017, Judicial Watch filed a California Public Records Act (CPRA) request seeking public records information about Felarca’s Antifa activism and its effect within the Berkeley Unified School District. In her lawsuit aimed at keeping the Berkeley school district from furnishing the records, Felarca alleged that Judicial Watch was misusing the law for political means and the district should refuse to provide the information.

 

In January 2018, a separate judge ordered Felarca to pay more than $11,000 in attorney and court fees for her frivolous attempt to get a restraining order against Troy Worden, the former head of the University of California (UC) Berkeley College Republicans.

“This is a huge victory for Judicial Watch against Antifa and the violent left,” Judicial Watch President Tom Fitton said. “Ms. Felarca attacked Judicial Watch without basis and the court was right to reject her ploy to deny our ‘right to know’ because we don’t share her violent left views.”

Treasury Declines to Label China Currency Manipulator

 

WASHINGTON — The Trump administration on Tuesday declined to label China as a currency manipulator despite President Trump’s repeated complaint that Beijing has weakened the renminbi as a way to take advantage of the United States on trade.

 

The decision not to formally accuse China of manipulating its currency could avoid further escalating tensions between Washington and Beijing, which have grown heated following a breakdown in trade negotiations earlier this month.

 

China continues to be on Treasury’s watchlist along with the “currency practices” of Germany, Ireland, Italy, Japan, Korea, Malaysia, Singapore, and Vietnam. And the report continued to raise concerns about China’s activity in managing its currency.

 

Treasury said that it has “significant concerns” about China’s currency practices and criticized the Chinese government for lacking transparency in how it manages foreign exchange. It noted that the renminbi has fallen by 8 percent in the last year and that China’s bilateral trade surplus in goods with the United States grew to $419 billion as of the end of 2018.

 

“The outsized magnitude of the bilateral deficit is a result of China’s persistent and widespread use of non-tariff barriers, nonmarket mechanisms, state subsidies, and other discriminatory measures that are increasingly distorting China’s trading and investment relationships,” the report said. “These practices tend to limit Chinese demand and market access for imported goods and services, leading to a wider trade surplus.”

 

The report comes as the United States and China are locked in a protracted trade war following a breakdown in trade negotiations earlier this month. The United States raised tariff rates on $200 billion worth of Chinese imports and is considering imposing tariffs on another $300 billion. China has vowed to hit back with tariffs or other punitive measures of its own.

The Michigan congressman then expanded on the purported “false narrative” that President Trump has attempted to disseminate regarding the Mueller report, claiming that Barr played a role in the findings’ misrepresentations. “Barr has so far successfully used his position to sell the president’s false narrative to the American people. This will continue if those who have read the report do not start pushing back on his misrepresentations and share the truth,” he concluded.

 

Tuesday’s tweetstorm comes as Amash continues to face fierce blowback from top Republicans over his remarks. Michigan State Rep. Jim Lower (R) recently announced that he will mount a primary challenge to the congressman, saying his remarks on impeachment “show how out of touch he is with the truth and how out of touch he is with people he represents.” President Trump responded to Amash’s statements, calling him a “loser” and a “total lightweight” in search of media attention.

 

The House Freedom Caucus has also voted to condemn Amash, one of the group’s founding members, for his statements. “It was every single person who totally disagrees with what he says,” House Oversight Committee ranking member Jim Jordan (R-OH) said of the vote. “What concerns me is Justin was viewed as a leader, right, on protecting privacy rights first to First Amendment rights.”

Border Patrol Creating A New Position To Stymie The Immigration Crisis

 

The U.S. Border Patrol announced that it’s creating a new position specifically tailored to processing and caring for migrants who reach the southern border, allowing agents to refocus their work on enforcement. The “Border Patrol Processing Coordinator” will assume certain responsibilities that have consumed the agency’s time as it deals with a surge of migrants at the U.S.-Mexico border, according to a Customs and Border Protection (CBP) press release on Tuesday. The new position is meant to bring relief to agents who have long complained that the humanitarian crisis has kept them from performing their main role at the border. Coordinators are to be tasked with feeding, cleaning, transporting and other general tasks for illegal immigrants in Border Patrol custody. Migrants in need of medical care will be transported to hospitals by coordinators, who will also be assigned to watch over migrants as they receive care.

 

“I am committed to providing the men and women of the U.S. Border Patrol the resources they need to accomplish their border security mission,” Carla Provost, Chief of the Border Patrol, said in a prepared statement on Tuesday. “Border Patrol Processing Coordinators will take on processing, transportation, and custody responsibilities, which will free up agents for critical law enforcement operations.” It’s not clear how many Border Patrol Processing coordinators the agency plans to bring on, but CBP indicated it is currently developing the position and plans to begin hiring by early fiscal year 2020.

 

The announcement comes as Border Patrol agents are becoming inundated with tens of thousands of illegal immigrants every month — many of them family units and unaccompanied children that require special care. The result of the crisis has forced 40% of agents at the Southwest border to focus on the menial tasks that come with caring for migrants — taking them away from their law enforcement role. The crisis has not only forced migrant detention centers to release thousands of families into the interior of the U.S., but has also meant a lack of narcotics enforcement. Officials within the Department of Homeland Security are warning that drug cartels in Mexico are taking advantage of the immigration emergency that’s consuming agents’ time. “Right now, we are babysitting,” an agent stated in January, decrying the nursing role they’ve been forced to take on. “We’re supposed to pay attention to medical conditions that we’re not trained for. We are not machines. We’re emotionally stressed.”

How the US Regime Uses Sanctions to Soften a Country Up for Invasion

 

On May 13th, Reuters headlined “Iran insists on ramping up oil sales to stay in nuclear pact” and reported that “EU officials … estimate Iran needs to sell 1.5 million bpd to keep its economy afloat. A drop below 1 million bpd could bring hardship and economic crisis.”

 

Prior to US President Donald Trump’s cancellation of the nuclear deal with Iran and re-imposition of economic sanctions against Iran and against any companies that trade with Iran, Iran had been selling around 2 million bpd (barrels per day).

 

Furthermore:

 

Once Europe’s biggest supplier, Iran has seen its exports gradually cut off from European buyers.

 

China – Iran’s largest oil customer with imports of 475,000 bpd in the first quarter of this year – has also stopped buying from Iran after Washington chose not to renew sanctions waivers.

 

Therefore, companies both in Europe and in China are terminating trade with Iran. The likelihood is consequently that Iran will be forced back into its nuclear program, and that things will be like what they had been before Obama had struck his deal with Iran. Here’s what that was like:

 

On 22 April 2010, the Congressional Research Service reported to Congress that:

 

Iran’s economy is highly dependent on the production and export of crude oil to finance government spending, and consequently is vulnerable to fluctuations in international oil prices. Although Iran has vast petroleum reserves, the country lacks adequate refining capacity and imports gasoline to meet domestic energy needs. Iran is seeking foreign investment to develop its petroleum sector. While some deals have been finalized, reputational and financial risks may have limited other foreign companies’ willingness to finalize deals.

 

Trump seems likely to exceed the hostility toward Iran that had been in effect during Obama’s and Bush’s Presidencies. If Trump is trying to force Iran to retaliate, then the goal is to use such retaliation from Iran as an excuse for the US military to move in — to invade.

 

The Reuters article says “One year after Washington quit the deal, Iran announced on Wednesday steps to relax some restrictions on its nuclear program.”

 

So: that is already restarting.

It must be remembered that any video, fake or not, must also be supported by additional testimonial evidence needed to authenticate its creation or, at the very least, testify as to its origins, where, when, who found it, and its proper chain of possession. Expert witnesses would be likely called by the prosecution and defense in the event a "deep fake" defense is raised.

 

Most important, it should never be ruled out that witness testimony in support of a video's accurate depiction of an actual event or events may be introduced via a cooperating witness(es) who may actually appear in the subject video. The same goes for any witness(es) who may testify to being behind the camera as the event(s) were actually filmed.

 

Bottom line, any defense attorney opposing the admission of a video on "deep fake" grounds will likely have to rebut a slew of government witnesses attesting to its authenticity and its accuracy. This will include both fact and expert testimony.

US boycotts arms control conference in protest at Venezuela

 

The United States walked out of a UN disarmament forum in protest after Venezuela took up the conference’s rotating chairmanship, insisting it would not participate in a conference led by a “rogue state.”

 

“Whatever is discussed in there, whatever is decided, has absolutely no legitimacy because it is an illegitimate regime presiding over that body,” US ambassador to the Conference on Disarmament (CD) Robert Wood told reporters Tuesday after he stormed out of the meeting.

 

Wood ditched the forum as soon as his Venezuelan counterpart Jorge Valero was granted the conference’s presidency – which rotates on a monthly basis – calling Valero’s acceptance speech a “diatribe of propaganda.”

 

The US and its allies in the Lima Group – comprised of more than a dozen Latin American allies including Mexico, Colombia, Brazil and Chile – will boycott the CD for the next four weeks, until the new chair takes over, Wood said in a statement after the meeting.

 

The CD was established in 1984 to provide an international forum for arms control negotiations, and is held three times a year in Geneva. Sixty-five countries currently participate in the conference, including all states with a declared nuclear arsenal.

 

Washington, along with a handful of allies, supports Venezuelan opposition leader Juan Guaido, who declared himself ‘interim president’ in January, with US recognition. The pro-Guaido bloc considers Venezuela’s elected president, Nicolas Maduro, to be illegitimate.

May 28 (UPI) – Oklahoma Attorney General Mike Hunter said the opioid crisis is "devastating" his state Tuesday during opening remarks in a historic trial between the state and drugmaker Johnson & Johnson, which he accused of facilitating the crisis and thousands of deaths. He accused the pharmaceutical company of a "multibillion dollar brainwashing campaign" in its effort to market and push sales of the drugs. "The pain, anguish and heartbreak … is almost impossible to comprehend. How did this happen? At the end of the day, your honor, I have a short, one-word answer – greed," Hunter said.

 

Hunter seeks to hold Johnson & Johnson accountable for overdoses of its narcotic painkillers. Other pharmaceutical companies were attached to the lawsuit, but Hunter dropped charges against most. Purdue Pharma settled for $270 million and Teva for $85 million to avoid trial, leaving Johnson & Johnson as the lone defendant. "We have looked at literally millions of documents, taken hundreds of depositions, and we are even more convinced that these companies are the proximate cause for the epidemic in our state and in our country," Hunter said. Some 4,653 people died from opioid-related causes in Oklahoma between 2007 and 2017, Hunter said during opening remarks. "Manufactures have in a consistent and … coldblooded fashion marketed these drugs in a way that has misrepresented their tendency to be addictive and the extent to which they can be deadly," the lawsuit said.

 

Defense lawyer Larry Ottaway said that in 2009, the Food and Drug Administration backed Johnson & Johnson's assertions that opioids are rarely addictive.

 

The state accuses the company of exaggerating the benefits of opioids, and using deceptive marketing that encouraged physicians to prescribe narcotic painkillers for ailments not approved by regulators. The precedent-setting Oklahoma bench trial is the first of its kind against an opioid manufacturer. Hundreds more nationwide are pending. A North Dakota judge dismissed all of that state's claims against Purdue, ruling that the company shouldn't be blamed for drug abuse when the product is legal. "Purdue cannot control how doctors prescribe its products and it certainly cannot control how individual patients use and respond to its products regardless of any warning or instruction Purdue might give," judge James Hill wrote in his ruling.

Former Navy Judge Named to Oversee Guantánamo Military Court (NYT)

WASHINGTON — A retired Navy judge has been named to oversee the military tribunals at Guantánamo Bay, Cuba, filling a job that has lacked a permanent occupant since his predecessor was dismissed last year after discussing plea deals with defense lawyers in the Sept. 11 and the destroyer Cole cases.

The acting secretary of defense, Patrick Shanahan, appointed the retired judge, Christian L. Reismeier, to the civilian job — officially known as the convening authority for military commissions — last week and the Pentagon announced the decision on Tuesday. Mr. Reismeier, who retired as a one-star admiral in 2015, was spotted last week at Military Commissions headquarters in Alexandria, Va.

The job includes negotiating plea deals with defense lawyers, approving proposed cases, deciding whether prosecutors can seek the death penalty and funding trial and defense teams. The job’s responsibilities have been carried out since early last year on an interim basis by two lower-level officials.

Mr. Reismeier is taking over more than 15 years after the Pentagon named the first overseer of a tribunal system at Guantánamo Bay — set up after the Sept. 11, 2001, attacks — with no major Qaeda prosecution yet carried out.

The military commission’s most complex case — against five men accused of conspiring in the Sept. 11 attacks, which killed 2,976 people — still has no trial date seven years after an Obama administration convening authority approved proceeding with the prosecution.

Progress has been scant in part because the judge and lawyers are still hashing out what classified information the defense lawyers, accused terrorists and public can see at the court. The defendants had spent years in the C.I.A.’s secret overseas prison network before being moved to Guantánamo Bay.

The military judge presiding in the trial has announced that he intends to leave the case next month. Last month, the commander of the prison at Guantánamo Bay, Rear Adm. John C. Ring, was fired after a monthlong investigation and for what his superior officer called a “loss of confidence” in his ability to lead.

Mr. Reismeier’s predecessor as the convening authority, Harvey Rishikof, and his legal adviser had been discussing whether to seek life imprisonment rather than death sentences in exchange for guilty pleas by Khalid Shaikh Mohammed, accused of being the Sept. 11 mastermind, and his four co-defendants in a bid to bring a swifter resolution. They were fired by the defense secretary at the time, Jim Mattis, on Feb. 5, 2018.

Mr. Mattis said in an affidavit that he dismissed Mr. Rishikof, whom he appointed at the start of the Trump administration but never met, because of his temperament and failure to coordinate properly with other divisions in the Defense Department.

Mr. Rishikof and his legal adviser, Gary Brown, said in a joint affidavit that they had not been warned in advance that senior Pentagon officials were unhappy with their performances but were aware that they had made some unpopular and controversial decisions, including discussing guilty pleas in the two capital cases in exchange for life in prison rather than execution.

Two issues that could engage Mr. Reismeier early include the scheduled November retirement of the chief prosecutor for military commissions, Brig. Gen. Mark Martins, and whether to approve a case the general wants brought to trial against three Guantánamo prisoners for suspected links to two deadly terrorist bombings in Indonesia in 2002 and 2003.

The spokesman for the Office of Military Commissions, Ron Flesvig, was unable to say whether, in his capacity of overseer of the war court, Mr. Reismeier could have a say on whether General Martins would be extended in the role. He has held the job since June 2011.

Deripaska Office Calls OFAC Memorandum on Sanctions Justification Groundless Accusations

 

Russian businessman Oleg Deripaska's representatives slammed the evidentiary memorandum issued by the US OFAC, which justifies the sanctions against him, as a poorly compiled document that is full of false claims and factual inaccuracies guided by considerations of personal revenge, according to a statement by Deripaska's office.

 

US TREASURY'S MEMORANDUM

 

In April 2018, the United States included Deripaska and companies controlled by the businessman, namely En+ Group and the entities it controls, Rusal and JSC EuroSibEnergo, in the Specially Designated Nationals (SDN) list. Assets of SDN-blacklisted individuals and entities in the United States are frozen and US companies are banned from working with them.

 

On January 27, 2019, the US Treasury lifted the sanctions on the three companies after Deripaska reduced his stake in the En+ Group under 44.95 percent and stopped running it via the board of directors.

 

On Tuesday, after a long resistance, the OFAC complied with a court order to release its list of documents substantiating sanctions against Deripaska. The so-called evidentiary memorandum alleges that the businessman was acting on behalf of a senior government official and working in the Russian energy sector. These claims served as justification for including Deripaska on the SDN list. Evidence largely includes articles from Western media, information from anonymous sources and assumptions.

 

The memorandum is dated June 2018, but the US Treasury had refused to publish it until compelled to do so by US order. At the same time, many fragments remain redacted, possibly due to concerns that confidential sources would become public.

May 28 (UPI) – Murderers could be going unpunished in North Korea where bribes are greasing the wheels of informal commerce, according to a new report from the United Nations High Commissioner for Human Rights. The human rights report that includes descriptions of a "vicious cycle of deprivation, corruption and repression" in North Korea includes testimonies from defectors who say serious crimes are dismissed for suspects with sufficient capital.

 

People of means in the Kim Jong Un regime can "get away with anything, including murder," one defector said. The report includes interviews with 214 North Korean escapees. Many said bureaucrats are squeezing the population with demands for bribes. The North Koreans who are being extorted of their earnings are those who make a living in informal markets, according to the report. The defectors originate from different parts of the North, including Ryanggang and Hamgyong Provinces. They also lived in the border area facing China prior to defecting, Yonhap reported Tuesday. North Korean diplomats were quick to dismiss the report. The BBC reported Tuesday Pyongyang has rejected the testimonies as "politically motivated" statements made for "sinister purposes."

 

Michelle Bachelet, the U.N.'s high commissioner for human rights, said the issue is being overshadowed by military matters. "I am concerned that the constant focus on the nuclear issue continues to divert attention from the terrible state of human rights for many millions of North Koreans," she said. The U.N. has also said 4 out of 10 North Koreans suffer from chronic food shortages, which continue to occur because Pyongyang prioritizes the military before the food needs of ordinary people. North Koreans are turning to markets because naively following state instructions means starvation, according to one defector.

 

Bribes are emerging as a key feature of the informal economy at a time when the regime is seeking increased investments from abroad. South Korea's foreign ministry said Tuesday North Korea has increased the number promotional website urging outsiders to invest in the country. The ministry also said the most widely read paper in the North is the Rodong Sinmun, and news agency KCNA is perceived as "less accessible" for everyday people, according to Seoul Pyongyang News.

"Repelling the attack, Syrian government troops destroyed three tanks, two multiple missile launcher systems, an infantry carrier, six all-terrain vehicles with heavy machineguns and killed about 100 militants," he said.

 

Apart from that, in his words, officers of the Russian reconciliation center conducted a humanitarian operation in the settlement of Maarrin in the Hama governorate and handed out 500 bags with food to local residents.

 

He also said that the Syrian authorities continue work to amnesty people dodging military service, including refugees and former members of illegal armed groups. Thus, as of May 26, 2019, as many as 58,024 people were amnestied, he added.

 

The Russian reconciliation center continues to fulfill assigned tasks after the completion of the military campaign in Syria. The center’s officers regularly travel around the country's liberated areas to assess the humanitarian situation. The main efforts of the Russian military are now focused on assistance to the refugees returning to their homes and evacuation of civilians from de-escalation zones.
