The new offensive fight against COVID-19 got a boost Tuesday night as the first shipment of 13 million home COVID-19 test kits arrived at JFK via Air China Airlines, in the pouring rain, with more shipments planned throughout the week. My mom, now deceased, was born in 1924.

She told us that they used to have radio shows, stories, mystery theater, with sound effects and everything. The whole family would sit around the radio on Saturday night and listen to the stories. They were hooked. Before that, all they had were stage plays and skits that were performed. Or reading out loud to each other. Stories were very descriptive. People love to be entertained.

Terrorism threats in unstable regions in the Middle East and Afghanistan still remain a key threat to Russiaโ€™s safety, Moscow has cautioned, speculating that radicals could be making gains on the African continent.

He cautioned that this poses a risk for Russia and Central Asian states.

Russia could bring back death penalty - court chair

 

Capital punishment has not been applied by Moscow since 1996

 

The moratorium on capital punishment imposed in Russia in 1997 after the country joined the Council of Europe could be lifted in the future, the chairman of the countryโ€™s Constitutional Court said on Tuesday.

 

In a book published on the website of the court, Valery Zorkin suggested that the country return to the doctrine of national identity and that constitutional control means Moscow should make its own laws, rather than take influence from other countries in Europe. In Zorkinโ€™s view, the introduction of a moratorium on capital punishment was a concession to values which are not inherent in Russia.

 

โ€œThe fact that the Constitutional Court has made a decision making it impossible to use the death penalty in Russia at this historical stage of its development does not rule out the possibility of a return to this form of punishment in the future,โ€ Zorkin said.

 

Russia has an indefinite moratorium on the application of capital punishment, which was a prerequisite for joining the Council of Europe. However, the death penalty has not been formally abolished. A constitutional court ruling could change that.

 

According to Zorkin, the death penalty cannot be completely ruled out, as there will always be the existence of premeditated murders.

 

In the USSR and Russia, he death penalty was imposed for various crimes until the mid-1990s. The moratorium on the death penalty appeared in 1997, when Moscow signed the Convention for the Protection of Human Rights and Fundamental Freedoms concerning the Abolition of the Death Penalty.

 

In practice, the death penalty had already not been applied for a year, despite it still existing in the criminal code.

 

The move to reinstate capital punishment has been backed by some lawmakers, including MP Mikhail Sheremet from the ruling United Russia party.

 

โ€œWe are too late with this question. Lifting the moratorium on the death penalty is a necessary and justified measure. This decision should have been made long ago,โ€ he told news agency RIA Novosti. โ€œThe death penalty would be a kind of inoculation against paedophiles and maniacs, who cause great damage to the security and morality of our society.โ€

The NIH was recently accused of horrible cruelty to dogs being experimented on. A recent PETA investigation is confirming this abuse.

FOX News reports:

The National Institutes of Health was accused of involvement in a $1.2 million contract over the past decade to purchase beagles for cruel experiments, said PETA senior vice president of cruelty investigations Daphna Nachminovitch on โ€œTucker Carlson Tonight.โ€œ

 

The most recent alleged violation is from Virginia-based supplier Envigo, which is accused of providing nearly 5,000 beagle dogs and puppies to NIH and other labs to be confined and tortured.

During a PETA investigatorโ€™s visit, more than 360 dogs were allegedly found dead.

Judge For Ghislaine Maxwell Trial "Trying To Avoid A Mistrial" Over Omicron

 

The judge presiding over the Ghislaine Maxwell sex trafficking trial has asked jurors to continue attending court ahead of the New Years period, expressing concern over the speed of spread of the Omicron coronavirus variant.

 

Noting the โ€œastronomical spikeโ€ in COVID-19 cases, Judge Alison Nathan requested that jurors be available to deliberate on Dec. 30 and 31, which were originally scheduled as days off for New Years. Additionally, the days will run from 9 a.m. to 6 p.m., instead of finishing at 5 p.m.

 

Nathan noted that the jurors can take as much time as they need to deliver their ruling. She also noted that, if they choose, they can stay later than 6 p.m. going forward.

 

She said specifically she was โ€œtrying to avoid a mistrial due to the Omicron variant.โ€

The jury is now into their fourth full day of deliberations on the innocence or guilt of Maxwell to six federal counts, including sex trafficking of minors, enticing a minor to travel to engage in illegal sex acts, transporting a minor with the intent to engage in criminal sexual activity, and three counts of conspiracy.

 

Maxwell faces up to 70 years in prison if convicted on all charges.

 

The juryโ€™s somewhat convoluted question to the court regarding a specific element of a specific charge against Ghislaine Maxwell was answered by Nathan on Dec. 27 in favor of the prosecution. At the time, Maxwellโ€™s defense team voiced its objection.

 

In the early morning hours of Dec. 28, the defense sent a followup letter to Nathan on the issue, which saw further debate on the topic in the courtroom at about 10 a.m. EST.

 

When defense attorney Christian Everdell started his discussion of the topic again, Nathan said he was โ€œseeking a third bite of the apple,โ€ but added, โ€œGo ahead,โ€ and heard the latest version of his argument.

 

Prosecutor Alison Moe had previously said to Nathan, โ€œThe jury has been accurately instructed on the law and thatโ€™s all thatโ€™s required.โ€

 

Nathan stood by her original answer to the question, which was for the jury to follow specific directions written out in their instructions.

 

There was no new activity until 4:45 p.m. when the jury sent its latest note that read, โ€œOur deliberations are moving along and making progress,โ€ and then requested to be dismissed at 5 p.m.

Ukrainian leader Volodymyr Zelensky has continued his crackdown against dissent in the media by imposing a new set of restrictive measures against three companies that own opposition-aligned TV channels, it emerged on Tuesday.

 

The sanctions take aim at channels UkrLive and First Independent, both of which are believed by the Ukrainian authorities to be owned by Taras Kozak, an MP for the countryโ€™s largest opposition party, Opposition Platform โ€“ For Life.

 

The measures also hit the Novosti media holding company, the owner of channels 112 Ukraine, NewsOne, and ZIK. These stations were taken off air in February this year, having been blacklisted by Zelensky. All three channels are also owned by Kozak, who dubbed the move โ€œan act of blatant censorship.โ€ The president explained his decision by suggesting that Kiev was fighting โ€œpropaganda,โ€ and linked the channels to Russia.

Kozak is thought by many to be the right-hand man of politician Viktor Medvedchuk, the chairman of the political council of Opposition Platform โ€“ For Life. Medvedchuk is considered an ally of Russian President Vladimir Putin, and the party has consistently called for closer links with Moscow. Medvedchuk is currently under house arrest, accused of treason and the attempted looting of national resources.

 

The new sanctions on the holding companies include the blocking of assets, restrictions on trade operations, and the canceling of licenses. In a joint statement published on Tuesday night, UkrLive and First Independent slammed them as โ€œillegal,โ€ and accused the National Security and Defense Council of running a โ€œdictatorshipโ€ where there is a โ€œde facto ban on opposition activities.โ€

 

โ€œThe Ukrainian authorities have once again proved that they see free media as their main enemy and will act by any means to suppress freedom of speech in Ukraine,โ€ the statement said. โ€œWe regard todayโ€™s events as another attempt by the Ukrainian authorities to suppress any alternative opinion about the situation in Ukraine and to use the repressive machine to fight against independent media.โ€

 

In the past year, Zelensky has also placed restrictions on the opposition-leaning websites Strana.ua and Shariy.net.

 

Almost all news outlets in Ukraine are bankrolled by wealthy individuals such as Kozak. Zelensky himself came to power in 2019 with support from the 1+1 Media Group, owned by Igor Kolomoisky, a billionaire oligarch and former regional governor.

He has indicted a cybersecurity lawyer named Michael Sussmann for allegedly making a single false statement in a conversation in 2016 with then-FBI General Counsel Jim Baker. The allegedly false statement concerned not Trump or Russia, but whom Sussmann represented when he brought Baker some information about an alleged electronic connection between the Trump Organization and a Russian bank. (Disclosure: Baker is a personal friend and former colleague at Brookings and Lawfare.)

 

The indictment is, in other words, far removed from the grave FBI misconduct Durham was supposed to reveal. Very far removed. In fact, it doesnโ€™t describe FBI malfeasance against Trump at all, but portrays the FBI as the victim of agitprop brought to it by outside political operatives. It describes the FBI as diligently running down the leads it had been fed by these operatives and then, well, dropping the matter when it learned they had no merit. The misconduct it portrays is an alleged lie by Sussmann that is, at best, wholly peripheral to the substance of the allegations Durham was supposedly peddling.

 

Even taken on its own terms, the document is one of the very weakest federal criminal indictments I have ever seen in more than 25 years covering federal investigations and prosecutions. It depends in its entirety on the testimony of a single witness who is on the record, under oath, saying something rather different from what the indictment alleges. According to a new documentary out of Denmark, which interviewed former victims, the Central Intelligence Agency secretly carried out experiments on 311 orphaned children. The experiments were meant to reveal psychopathic traits and map out the link between schizophrenia and heredity. According to the report, the children were tortured in clear violation of the Nuremberg Code of 1947 that introduced ethical restrictions for experiments on humans.

 

Hundreds of Danish orphans were unknowingly used in experiments backed by the CIA, according to Danish Radio, reporting on a new documentary called โ€œThe Search for Myself.โ€

 

According to the report, the experiments began in the early 1960s and spanned the course of two decades. They were conducted to investigate the link between heredity and environment in the development of schizophrenia. However, the children were not told what research they were involved in. Not even after the experiments ended. It was also funded in part by a CIA front associated with the MK-Ultra program.

 

Eerily, the examinations took place in a basement at the Municipal Hospital in Copenhagen. The director and producer of the documentary, Per Wennick, was actually a victim of the CIA and subjected to these experiments as a child. In the documentary, he recalled being placed in a chair, getting electrodes put on his arms, legs, and chest around the heart and having to listen to loud, shrill noises, which attempted to incite a psychological response.

 

โ€œIt was very uncomfortableโ€, Wennick told Danish Radio. โ€œAnd itโ€™s not just my story, itโ€™s the story of many children.โ€ By his own admission, he was promised โ€œsomething funnyโ€ before being taken to the hospital. โ€œI think this is a violation of my rights as a citizen in this society. I find it so strange that some people should know more about me than I myself have been aware of.โ€

 

According to historian, PhD, and museum inspector at the Danish Welfare Museum, Jacob Knage Rasmussen, this was the only known experiment in Danish history that used children under state care for research โ€” and it was funded by the CIA in violation of the Nuremberg Code.

 

โ€œI do not know of similar attempts, neither in Denmark nor in Scandinavia. It is appalling information that contradicts the Nuremberg Code of 1947, which after World War II was to set some ethical restrictions for experiments on humans. Among other things, informed consent was introduced, which today is central to the world of researchโ€, Knage Rasmussen told Danish Radio. He emphasized the vulnerability of the group in the custody of the state, who had nobody to complain to.

 

According to Danish Radio, the idea to experiment on the vulnerable children came from American psychologist Zarnoff A. Mednick, who was then a professor at the University of Michigan.

 

According to Wennick and the National Archives, the research project was co-financed by the US health service. In the first year alone, the project was supported with what today corresponds to DKK 4.6 million ($700,000). It also received funding from the Human Ecology Fund.

 

The Human Ecology Fund was a CIA funded operation through the Cornell University College of Human Ecology Society for the Investigation of Human Ecology to support covert research on brainwashing. It was also connected to research under the MK-Ultra program in which social scientists, including anthropologists, were led (mostly unwittingly) to provide input into interrogation techniques still in use today.

An Oklahoma federal judge on Tuesday ruled against an attempt from the state to block the Department of Defenseโ€™s COVID-19 vaccine mandate for National Guard members.

 

U.S. District Judge Stephen Friot rejected a motion from Oklahoma Gov. Kevin Stitt (R), Attorney General John Oโ€™Connor, and sixteen Oklahoma Air National Guard members for a preliminary injunction to the mandate, saying the plaintiffsโ€™ claims were โ€œwithout merit,โ€ and thus the motion would be denied.

 

Stitt and Attorney General John Oโ€™Connor, both outspoken critics of vaccine mandates, filed a motion for a temporary restraining order and preliminary injunction against the vaccine mandate on Dec. 3, 2021.

 

In a complaint (pdf) which names President Joe Biden, Defense Secretary Lloyd Austin, and dozens more federal officials and agencies as defendants, the state argued that the mandate violates the Constitution and has no legal basis.

 

โ€œThis vaccine mandate certainly interferes with the sovereign prerogatives of the State of Oklahoma. It undermines the laws, public policy, dignity, and interests of the State of Oklahoma in governing the field of public health, including vaccinations,โ€ the state wrote in its complaint.

Washington State Democrats Push Bill Reducing Penalties for Drive-By Shootings

 

Washington state Reps. Tarra Simmons (D) and David Hackney (D) are pushing legislation to remove drive-by shootings from the list of crimes that elevate first degree to murder to a higher degree of murder carrying a mandatory life sentence.

 

FOX News reports that โ€œdrive-by shootings were added to the list of aggravating factors for murder charges in 1995.โ€ At the time, drive-by shootings were one of a number of crimes that would elevate charges and Simmons and Hackney are now working to remove such shootings from the list.

 

The 1995 language that Simmons and Hackney want to specifically strike from the aggravating factors list says: โ€œThe murder was committed during the course of or as a result of a shooting where the discharge of the firearmโ€ฆ is either from a motor vehicle or from the immediate area of a motor vehicle that was used to transport the shooter or the firearm.โ€

 

Simmons says she believes the language surrounding drive-by shootings โ€œwas targeted at gangs that were predominantly young and Black.โ€

 

She added, โ€œI believe in a society that believes in the power of redemption. Murder is murder no matter where the bullet comes from but locking young people up and throwing away the key is not the answer.โ€

 

Simmons points to Kimonti Carter as a example of why she wants to remove drive-by shootings from the aggravating factors list. Carter was convicted in a drive-by shooting that left two people dead in 1997. He received a 777-year sentence and Simmons said, โ€œIf he had been standing outside of the vehicle at the time, he wouldโ€™ve faced 240-320 months in prison. Instead, he was sentenced to life in prison with no opportunity for parole because of this law.โ€

Rapid antigen tests for Covid may be less sensitive in detecting the Omicron variant and are leading to 'false negatives,' the Food and Drug Administration said Tuesday.

 

The FDA made preliminary findings using samples from patients confirmed to be infected with the new mutant strain.

 

 

The federal agency said early results show that antigen tests 'do detect the Omicron variant but may have reduced sensitivity,' meaning it's possible the tests could miss an infection, known as a 'false negative.'

 

It's not clear which brand of lateral flow tests the FDA were using in their study or to what degree there was reduced sensitivity.

 

 

According to a meta-analysis of studies by the Cochrane Library, lateral flow tests detect an average of 72 percent of symptomatic cases and 58 percent of asymptomatic ones.

 

This could be the reason for their reduced sensitivity with Omicron because the new strain generally presents with milder symptoms and it is more likely than with previous variants to produce no symptoms at all.

 

The report comes as cases skyrocketed to record levels on Tuesday - with a seven-day average 254,496 infections - prompting high demand for at-home rapid tests which are in short supply.

 

Joe Biden has promised 500 million rapid tests for US households for free starting in January and the FDA also plans to set up new testing sites in addition to 20,000 already in operation.

 

 

The move comes after Amazon, CVS and Walgreens last week limited how many tests each customer could buy to cope with the surging demand.

 

The rapid tests can be done at home, with results in minutes, while PCR tests are processed in labs and have turnaround times that can take several days.

 

The FDA didn't say that people should not use the antigen tests.

 

'The FDA continues to authorize the use of these tests as directed in the authorized labeling and individuals should continue to use them in accordance with the instructions included with the tests,' the agency said.

 

 

'Antigen tests are generally less sensitive and less likely to pick up very early infections compared to molecular (PCR) tests.'

Thousands of Marines are still not vaccinated against COVID-19 despite the U.S. militaryโ€™s vaccine mandate, and more than 160 have been discharged so far for refusing to get the vaccine.

In August, Defense Secretary Lloyd Austin announced that all service members would be subject to a COVID-19 vaccine mandate. The announcement came two days after the FDA granted full approval to Pfizerโ€™s coronavirus vaccine.

 

โ€œThe secretary has communicated to the military departments to execute this mandatory vaccination program with, obviously, skill and professionalism, which we always do, but also with a measure of compassion,โ€ Pentagon press secretary John Kirby said in a statement at the time.

 

So far, at least 169 Marines have been ousted from their positions for refusing to get the shot. Of those, 66 were discharged in just one week earlier this month.

 

More than 1,000 Marines have been approved for administrative or medical exemptions to taking a coronavirus vaccine. More than 3,000 requests for religious exemptions have been submitted, but none have been approved.

 

 

โ€œThe speed with which the disease transmits among individuals has increased risk to our Marines and the Marine Corpsโ€™ mission,โ€ the Marine Corps said in a statement.

 

The Marine Corps has struggled to keep up with the other branches of the military regarding its vaccination rate among service members. The Army, Navy and Air Force all have close to or more than 98% service members fully or partially vaccinated.

 

The Marine Corps has also been the most aggressive about discharging service members who fail to get the shot.

 

The mandatory deadline for Marines to get the shot was Nov. 28, about one month ago.

My son is a USMC reservist and he is/was supposed to be discharged for not being vaccinated come February when he has drill again. However, they sent them new information after their last drill a couple of weeks back saying essentially that the unvaccinated would be considered non-deployable but still drill ready (I.e. not getting discharged). My sonโ€™s situation is a bit more murky though. His original MOS was tanker, but the USMC got rid of tank units back in 2020 (iirc). He is now in some sort of supply unit but heโ€™s never been trained as required. In order to be โ€œdrill readyโ€ he has to go through the official training for the MOS, which is something they have just kept putting off, mostly due to muh COVID. He canโ€™t go to the MOS school unless heโ€™s vaccinated. Heโ€™s not getting vaccinated so his superiors are facing a dilemma which theyโ€™ve never dealt with and have no idea how to deal with. My guess is that heโ€™ll ultimately get the โ€œOther Than Honorableโ€ discharge in February or soon thereafter.

A 32-year-old West Side woman brutally injured in the 9/11 terrorist attacks has been awarded $8.6 million by the federal Victim Compensation Fund, the largest payment under the program so far.

"I would give every penny back to change what happened," Mardenfeld said.

 

Sometimes she can walk for very short distances with a walker, but she must use a wheelchair even to get to a car.

 

All the while, her fiancรฉ, Gregory St. John, a microbiologist and immunologist, has stayed by her side.

 

"He's an amazing person," she said. "We plan to get married, we love each other, we support each other, but right now my recovery is the focus of my life."

 

Mardenfeld would like to go back to work some day. She has a master's degree in human resources management.

 

"I have hopes of returning to a normal life but I can't look past this year," she said. "I look at it day by day and try to make the most of my recovery. I still believe in all the possibilities of what my life can be."

 

The Victim Compensation Fund has issued awards for 2,569 injury claims. Payments have ranged from a low of $500 to Mardenfeld's award.

 

For those who died, the fund has offered awards for 5,162 claimants, generally relatives, and the average payment has been $2.1 million.

That would be different than sinking it due to a firefight.
