Houston-area man convicted for role in $35M COVID-19 relief fraud scheme

 

WASHINGTON โ€” A Houston-area man was convicted Feb. 8 for his role in a scheme to fraudulently obtain and launder millions of dollars in forgivable Paycheck Protection Program (PPP) loans guaranteed by the Small Business Administration (SBA) under the Coronavirus Aid, Relief, and Economic Security Act.

 

The investigation was conducted by Homeland Security Investigations (HSI) Houston, the SBAโ€™s Office of Inspector General, the Federal Housing Finance Agencyโ€™s Office of Inspector General (FHFA-OIG), the Federal Deposit Insurance Corporationโ€™s Office of Inspector General (FDIC-OIG), and the Treasury Inspector General for Tax Administration (TIGTA).

 

A federal jury convicted Abdul Fatani, 57, of Richmond, Texas, of one count of conspiracy to commit wire fraud, one count of wire fraud and one count of unlawful monetary transactions (money laundering). He is scheduled to be sentenced on May 8. He faces a maximum penalty of 20 years in prison for conspiracy and wire fraud and 10 years in prison for money laundering. A federal district court judge will determine his sentence after considering the U.S. Sentencing Guidelines and other statutory factors.

 

According to court documents and evidence presented at trial, Fatani conspired with others to submit fraudulent PPP loan applications by falsifying the number of employees and the average monthly payroll expenses of the applicant businesses. In total, the co-conspirators sought over $35 million through more than 80 fraudulent PPP loans. Fatani distributed over $500,000 in fraudulent loan proceeds to his co-conspirators and himself using bogus payroll checks and laundered a portion of the proceeds by transferring the funds from one of his bank accounts to another bank account he controlled.

 

In addition, 15 other individuals have pleaded guilty to their involvement in the loan fraud scheme.

 

Assistant Attorney General Kenneth A. Polite, Jr. of the Justice Departmentโ€™s Criminal Division; U.S. Attorney Alamdar S. Hamdani for the Southern District of Texas; Special Agent in Charge Mark B. Dawson of HSI Houston; Inspector General Hannibal โ€œMikeโ€ Ware of the SBA-OIG; Special Agent in Charge Catherine Huber of the FHFA-OIG; Acting Inspector General Tyler Smith of the FDIC-OIG; and Inspector General J. Russell George of TIGTA made the announcement.

 

Trial Attorneys Kate McCarthy, Spencer Ryan, Della Sentilles and Louis Manzo of the Criminal Divisionโ€™s Fraud Section and Assistant U.S. Attorney Rodolfo Ramirez for the Southern District of Texas are prosecuting the case.

If Bidenโ€™s Federal Elections Takeover Is โ€˜Free And Fair,โ€™ Why Are The Plans Completely Redacted?

 

Despite finally fulfilling a FOIA request, Bidenโ€™s Department of the Interior sent Citizens United a heavily-redacted document.

 

After several executive agencies in the Biden administration were sued for refusing to comply with Freedom of Information Act requests from conservative advocacy group Citizens United over the White Houseโ€™s attempt to federalize elections, the Department of the Interiorโ€™s (DOI) Bureau of Indian Affairs finally turned over its first batch of requested documents. Thereโ€™s one problem: More than half of the 54-page document is completely redacted.

 

โ€œThe Biden administration is the least transparent in history, and these absurd redactions are just the latest example. What are they trying to hide from the American people?โ€ Citizens United President David Bossie told The Federalist.

 

As The Federalist previously reported, in March 2021, President Joe Biden issued an executive order directing hundreds of federal agencies to engage in a federal takeover of election administration. It also permitted federal agencies to work with โ€œnonpartisanโ€ third-party entities to get voters registered, yet left-wing dark money group Demos publicly admitted itโ€™s worked with federal agencies, โ€œin close partnership with the ACLU and other allies,โ€ to advance the aims of Bidenโ€™s directive.

 

Such an order set off alarm bells among Republicans and good government groups, reminiscent of the widespread takeover of government election offices by Democratic activists and donors in the blue counties of key swing states during the 2020 presidential election. Through their infiltration of state and local offices, Democrats were able to conduct partisan get-out-the-vote operations and swing the election in then-candidate Bidenโ€™s favor. This order is a taxpayer-funded version of that effort, turning federal agencies โ€” including those that dole out federal benefits โ€” into voter registration hubs and partisan get-out-the-vote centers.

 

Citizens United wanted to find out more about it, which is why last June, it filed FOIA requests with the DOI and State Department seeking email and text messages that mentioned both the executive order and the Hatch Act, a law that prohibits executive branch employees from engaging in election activities. When the agencies failed to comply, Citizens United sued. On Jan. 31, DOI sent its first round of documents per Citizens Unitedโ€™s request.

 

But the 54-page PDF sent to Citizens United is mostly redacted, save for logistical emails between White House staff and agency department heads. The plan and implementation scheme for the โ€œPromoting Access to Votingโ€ executive order itself are completely redacted.

 

In a cover letter sent with the documents, the Biden administration defended the redactions under U.S.C. ยง 552(b)(5), which allows agencies to withhold information under the โ€œPresidential Communications Privilegeโ€ (exists to ensure โ€œthe Presidentโ€™s ability to obtain candid and informed opinions from his advisors and to make decisions confidentiallyโ€) and the โ€œDeliberative Process Privilegeโ€ (โ€œprotects the decision-making process of government agencies and encourages the frank exchange of ideas on legal or policy mattersโ€).

 

But according to Jason Foster, president and founder of Empower Oversight, a transparency and government accountability group that frequently files FOIA requests, these redactions are a prime example of the federal governmentโ€™s blatant over-redacting and censorship.

FBI Special Agents Daniel Alfin and Laura Schwartzenberger, who died in a Sunrise, Florida shootout Tuesday, devoted their careers to investigating crimes against children.

 

The two were killed at an apartment complex executing a federal search warrant. Three other agents were wounded, two of whom were transported to the hospital and have since been released. The suspect in the shooting died at the scene and the FBI has said the investigation is ongoing.

 

Miami FBI Special Agent in Charge George Piro called the shooting and the loss of Alfin and Schwartzenberger, โ€œa very dark day for the FBI.โ€

 

The agents were known for their exemplary efforts in the field, curbing child abuse with their investigatory work and educating students to the perils of sex crimes.

 

โ€œOur chosen profession is fraught with danger. Today this grim reality has taken two of our best from our family,โ€ Piro said.

 

Alfin played a key role in an โ€˜unprecedentedโ€™ child exploitation investigation

 

Alfin, 36, was a New York native and started his FBI career in the bureauโ€™s Albany, New York office in 2009. He was assigned to the Miami office in 2017, investigating crimes against children.

 

According to federal court documents, Alfin said he was โ€œrecognized as an expert in federal court in areas relating to computer forensics and the investigation of child exploitation crimes.โ€

 

The documents added that he had testified on more than 20 occasions as a witness, across more than 10 federal jurisdictions.

 

Alfin played a critical role in a massive investigation that led to hundreds of child pornography arrests, according to a 2017 FBI statement.

 

Officials at the time stated, โ€œThe case โ€“ and the thousands of follow-up investigations it has launched โ€“ is unprecedented in its scope and reach.โ€

The case involved โ€œPlaypen,โ€ described by authorities as a โ€œhighly sophisticated, global enterprise dedicated to the sexual exploitation of children, organized via a members-only website that operated on the dark web.โ€

 

Alfin and his teamโ€™s investigation resulted in the arrests of at least 350 people based in the US, the prosecutions of 25 producers of child pornography, the arrests of 51 โ€œhands-on abusersโ€ and the identification or rescue of 55 American children, the FBI said.

 

Abroad, the investigation led to 548 arrests and the identification or rescue of 296 sexually abused children, the FBI said.

 

Alfin is quoted in an 2017 FBI statement about the case.

 

โ€œItโ€™s the same with any criminal violation: As they get smarter, we adapt, we find them,โ€ he said. โ€œItโ€™s a cat-and-mouse game, except itโ€™s not a game. Kids are being abused, and itโ€™s our job to stop that.โ€

 

In 2018, Alfin was honored as part of the team involved in the case, and then-Deputy Attorney General Rod Rosenstein spoke warmly of the award recipients.

 

โ€œTodayโ€™s honorees earned the esteem of their colleagues. But most importantly, they earned the gratitude of our fellow citizens โ€“ the people whose communities you made safer, whose lives you improved, and whose trust you rewarded. Today, we pause to honor and recognize a small portion of your work,โ€ Rosenstein said.

 

Alfin is survived by his wife and one child, the FBI said.

Here, the majority acknowledged the โ€œbillions of dollars in unrecoverable compliance causes,โ€ โ€œhundreds of thousandsโ€ of jobs at risk of walk-offs, thousands of deaths and โ€œhundreds of thousandsโ€ of preventable hospitalizations cited by those for and against the requirement.

 

However, the court said that it is โ€œnot our role to weigh such tradeoffsโ€ and instead considered whether Congress had โ€œindisputablyโ€ provided OSHA with the power to regulate broad public health.

"Not even probably a year or two years ago, this would have been considered some form of sexual assault, voyeurism. But now, not even are they just allowing it to happen, it's almost as if these large organizations are encouraging it to happen," Gaines continued.

America Reports host John Roberts noted that after graduating in May of 2022, Gaines had hoped to go to dental school. In the aftermath of Lia Thomas though, Gaines has decided to put dental school on hold to advocate for womenโ€™s sports remaining a place for biological females.

 

Roberts questioned why more women werenโ€™t speaking out against the inclusion of biological males, to which Gaines said, "you know, people are terrified, especially speaking from my experience of talking to other NCAA swimmers specifically, Lia Thomasโ€™ teammates even."

 

"They're told their school has made their stance for them. They're told that if they feel uncomfortable seeing male genitalia in the locker room, then they should seek counseling resources. On Wednesday, Balenciaga and the Kering Foundation announced they would be entering a three-year partnership with the National Childrenโ€™s Alliance (NCA), a nonprofit based out of Washington D.C.

The program will focus on three main goals: Supporting National Children Alliance Mental Health Institute helping children heal from trauma by facilitating a significant increase in access to Trauma-Focused Cognitive Behavioral Training (TF-CBT), providing education for Balenciaga about child protection and actions adults can take to promote the safety and well-being of children, and raising public awareness on child abuse and child protection and promoting a happy, healthy childhood.

The press release for the partnership claims that support from Balenciaga will allow the NCA to train almost 2,000 child abuse professionals and could provide benefits to around 55,000 children receiving mental healthcare.

โ€œWe were confronted with the reality and magnitude of childhood trauma during our listening tour where we engaged with several leading organizations and experts in the field of childhood trauma,โ€ Balenciaga President and Chief Executive Officer Cรฉdric Charbit said in a statement.

He added that the experience has enabled Balenciaga to learn and affirmed the companyโ€™s commitment to have a positive and lasting impact on kids and their future.

The NCA serves as the national association and accrediting body of Childrenโ€™s Advocacy Centers (CACs) and serves 386,000 children a year across the U.S.

In 2022, the NCA created the Mental Health Institute to increase access to โ€œevidence based, trauma focused mental health treatmentโ€ for kids.

The announcement comes after Balenciaga apologized for two concurrent controversies surrounding imagery found in their advertisements.

In an advertisement for the Balenciaga Adidas bag collaboration, the product was placed atop a desk covered in documents. One of the documents contained text of the Supreme Court case United States v. Williams, a case focused on the distribution of child pornography.

โ€œWe apologize for displaying unsettling documents in our campaign,โ€ a brand statement published on Instagram read. โ€œWe take this matter very seriously and are taking legal action against the parties responsible for creating the set and including unapproved items for our Spring 23 campaign photoshoot. Disinformation Inc: Meet the groups hauling in cash to secretly blacklist conservative news

This is the first part of a Washington Examiner investigative series about self-styled 'disinformation' tracking organizations that are cracking down on conservative media and part of a lucrative operation that aims to defund disfavored speech.

 

EXCLUSIVE โ€” Well-funded "disinformation" tracking groups are part of a stealth operation blacklisting and trying to defund conservative media, likely costing the news companies large sums in advertising dollars, a Washington Examiner investigation found.

 

Major ad companies are increasingly seeking guidance from purportedly "nonpartisan" groups claiming to be detecting and fighting online "disinformation." These same "disinformation" monitors are compiling secret website blacklists and feeding them to ad companies, with the aim of defunding and shutting down disfavored speech, according to sources familiar with the situation, public memos, and emails obtained by the Washington Examiner.

 

Brands, which have been seeking to promote products online through multiple websites to expand their digital footprint, are turning to corporate digital ad companies keyed into global markets. In turn, some of these companies are contracting "disinformation" trackers to obtain private information about which websites they should purportedly "defund."

 

The Global Disinformation Index, a British group with two affiliated U.S. nonprofit groups sharing similar board members, is one entity shaping the ad world behind the scenes. GDI's CEO is Clare Melford, former senior vice president for MTV Networks, and its executive director is Daniel Rogers, a tech advisory board member for Human Rights First, a left-leaning nonprofit group that says disinformation fuels "violent extremism and public health crises."

 

"It's devastating," Mike Benz, the State Department's ex-deputy assistant for internal communications and information policy, told the Washington Examiner. "The implementation of ad revenue crushing sentinels like Newsguard, Global Disinformation Index, and the like has completely crippled the potential of alternative news sources to compete on an even economic playing field with approved media outlets like CNN and the New York Times."

 

GDI's mission is to "remove the financial incentive" to create "disinformation," and its "core output" is a secretive "dynamic exclusion list" that rates news outlets based on their alleged disinformation "risk" factor, according to its website. There are at least 2,000 websites on this exclusion list, which has "had a significant impact on the advertising revenue that has gone to those sites," Melford said on a March 2022 podcast episode hosted by the Safety Tech Innovation Network, a British government-backed group.

 

Along with similar organizations, GDI has been raking in cash as funding pours into disinformation tracking. Its charity in San Antonio, Texas, posted $345,000 in revenue in 2020, while its affiliated private foundation saw its roughly $19,600 revenue jump in 2019 to over $569,000 in 2020, according to tax records.

 

One influential ad company that has subscribed to GDI's exclusion list to defund outlets purportedly spreading disinformation is Xandr, which Microsoft bought from AT&T in 2021 for $1 billion, according to emails leaked to the Washington Examiner.

 

Xandr informed companies in September 2022 that it would begin adopting GDI's exclusion list to punish content that is "morally reprehensible or patently offensive," lacking "redeeming social value," or "could include false or misleading information," emails show.

 

"To enforce this change, Xandr is partnering with the Global Disinformation Index ('GDI') and will be adopting their exclusion list," Xandr wrote to other companies, linking to an appeal "webform" for publishers to complete if they disagree with their "risk" rating.

 

This exclusion list is developed with oversight from GDI's "advisory panel," which counts journalists, professors, and data scientists, according to GDI reports. Three advisers include Ben Nimmo, global lead for threat intelligence at Facebook's parent company Meta, journalist Anne Applebaum, who said Hunter Biden's foreign business dealings are not "interesting," and University of Washington professor Franziska Roesner.

 

One source close to ad-buying operations in right-leaning media told the Washington Examiner that the outlet is on GDI's exclusion list, citing communications with ad companies. But the Washington Examiner was never contacted by GDI or informed of how it failed to meet GDI's standards.

But GDI, which did not reply to several requests for its exclusion list, discloses in reports which outlets it identifies as the "riskiest" and "worst" offenders for peddling disinformation. These 10, which all skew to the right, are the American Spectator, Newsmax, the Federalist, the American Conservative, One America News, the Blaze, the Daily Wire, RealClearPolitics, Reason, and the New York Post.

 

"The American Conservative had one of the lowest scores in the study for bias, indicating that almost all of the content sampled was either somewhat or entirely biased," said GDI, which did not clarify how its ratings may differ for websites publishing news or mostly opinion articles.

 

GDI's "disinformation" tracking efforts, however, have even resulted in opinions being flagged. The organization alleged in an October 2022 memo that a Washington Examiner commentary article titled "The Left's gender-bending obsession is tiresome and absurd" was "anti-LGBTQ+" disinformation.

 

That same memo singled out Amazon for hosting ads in the Washington Examiner.

Further, according to a senior executive at a company that buys ads in digital outlets,

Breitbart News is on GDI's exclusion list.

 

Melford cited Breitbart in her 2022 podcast appearance, noting that a "whole ecosystem of organizations" targeting the outlet has led to it being deplatformed.

 

Topics that have recently spawned "disinformation" allegedly relate to COVID-19, anti-vaccine content, mask protests, abortion, and alleged voter fraud during the 2020 presidential election, Melford said. She added that "disinformation narratives" have also taken hold around the idea "that there's a corrupt elite working only for themselves, not serving the will of the common man, and that only a strong man can get rid of the corrupt elite."

 

The Washington Examiner also spoke with a member of GDI's advisory panel who was granted anonymity to speak candidly about internal operations. The member claimed they haven't played a role in crafting the exclusion list but said that "disinformation" labeling, in general, could "definitely" appear to be cloaked censorship.

 

"This is the concern," said the member, adding it "sounds plausible" that any website on the index's riskiest list would also "probably" be on the exclusion list. Other ad buyers close to conservative media who contract with multiple outlets, as well as tech analysts, agreed with this sentiment.

 

But GDI has been transparent about its goal in labeling certain websites as purveyors of disinformation. The organization submitted a report to the United Nations that said it is "seeking to defund disinformation" and break "the incentive to create it for the purpose of garnering advertising revenues."

 

That same report called on "governments around the world" to examine their policies for addressing disinformation and enact "stringent repercussions" for culprits.

 

The "whole point" of the "disinformation" tracking industry is clearly to destroy "the reach, scalability, market, and even credibility" of conservative news outlets, added Benz, now executive director of Foundation for Freedom Online, a censorship watchdog.

On the flip side, all of the websites that GDI ranks as the "least risky" lean left in their news coverage โ€” minus the Wall Street Journal.

 

These include NPR, ProPublica, the Associated Press, Insider, the New York Times, USA Today, the Washington Post, Buzzfeed News, and HuffPost, according to a 27-page report.

 

The outlets purportedly show "minimal bias" and a lack of "sensational language" and have "excelled in disclosing and following their operational policies and practices," said the report. Still, many of these "least" risky outlets, such as Buzzfeed, promoted the Steele dossier, a discredited piece of opposition research that Hillary Clinton's 2016 presidential campaign fed to the FBI to link Donald Trump to Russia.

 

Others, such as HuffPost, have published numerous stories boosting the falsehood that a New York Post story on Hunter Biden's infamous abandoned laptop was "Russian disinformation."

''Starlink was never meant to be used militarily in the way that it has'', Shotwell argued, saying the company didnโ€™t foresee how profoundly โ€“ and creatively โ€“ Ukrainian forces would rely on the technology.

 

''โ€œIt was never intended to be weaponized,โ€ ''Shotwell told an audience at a space conference. โ€œHowever, Ukrainians have leveraged it in ways that were unintentional and not part of any agreement.โ€

 

Shotwellโ€™s admission that SpaceX, which was founded by Elon Musk, has prevented Ukrainian soldiers from fully using the technology confirms the long-standing belief that Musk and the company are uneasy with Ukraineโ€™s military use of Starlink.

 

Speaking with reporters after, Shotwell argued that Starlink had sent units to Ukraine to โ€œkeep the banks going, hospitals, keep families connected.โ€

 

โ€œWe know the military is using them for comms, and thatโ€™s OK,โ€ Shotwell added. โ€œBut our intent was never to have them use it for offensive purposes.โ€

 

Last October, ''Musk angered Ukrainians, including President Volodymyr Zelensky'', for proposing a peace plan on Twitter that argued Ukraine just give up efforts to reclaim Crimea and cede control of the Luhansk and Donetsk regions.

 

That same month, there were reports that the Starlink signal had been restricted and was not available past the front line as Ukrainian troops tried to advance, essentially hamstringing their efforts to retake territory from the Russians. Those reports of the outages fueled accusations that Musk was kowtowing to Russia.

 

โ€œThat has affected every effort of the Ukrainians to push past that front,โ€ a person familiar with the outages told CNN in October. โ€œStarlink is the main way units on the battlefield have to communicate.โ€

 

Ukrainian troops have roundly praised Starlink as a game-changing piece of satellite technology that has not only allowed them to maintain communications, but also better target Russian forces with artillery and drones.

 

After Musk received Ukrainian โ€“ and global โ€“ praise for quickly delivering Starlink capabilities to Ukraine, CNN obtained exclusive documents showing that SpaceX was trying to get the Pentagon to start paying for thousands of terminals, along with their expensive connectivity, for Ukraineโ€™s military and intelligence services. Thousands of units had also quietly been purchased by third countries for Ukraine.

 

One senior defense official told CNN that SpaceX had โ€œthe gall to look like heroesโ€ while having others pay so much.

 

Musk responded quickly to CNNโ€™s report, tweeting, โ€œThe hell with itโ€ฆweโ€™ll just keep funding Ukraine govt for free.โ€

 

However, SpaceX and the Pentagon had continued discussions about a possible deal for military units, according to people familiar with the conversations. On Wednesday, Shotwell indicated at least part of those conversations had ended.

 

โ€œI was the one that asked the Pentagon to fund, this was not an Elon thing,โ€ Shotwell said on Wednesday. โ€œWe stopped interacting with the Pentagon on the existing capability. They are not paying.โ€

 

SpaceX had never envisioned that Starlink would be used in Ukraine the way it has been, Shotwell said, echoing coverage and accounts of Ukrainian troopsโ€™ ingenuity on the battlefield.

 

โ€œHonestly,โ€ she said, โ€œI donโ€™t even think we thought about it. You know, it could be used that way? We didnโ€™t think about it. I didnโ€™t think about it. Our Starlink team may have, I donโ€™t know. But weโ€™ve learned pretty quickly.โ€

"The Leftโ€™s censorship efforts are anti-American, and conservatives should oppose them regardless of whether they originate in the private sector or in the White House," Rep. Jim Banks (R-IN) told the Washington Examiner.

GDI is not alone among groups blacklisting certain websites while coordinating with ad companies.

 

Another is DoubleVerify, a $4 billion publicly traded company that operates an "inflammatory news index" that clients can gain access to. Content from websites gets added to the index if it contains "blatant opinion statements in non-editorial content," violence incitement, or "the use of slurs when referring to public figures," according to

 

DoubleVerify.

 

DoubleVerify, which posted its highest revenue of $112 million in November 2022, does not publicize outlets or content on its index.

 

However, Breitbart and Newsbusters, as well as the left-leaning website RawStory, have been included in it, according to a 2016 Wired report. So has WND.com, DoubleVerify told the New York Times in 2016.

 

The Washington Examiner has also been labeled as "inflammatory," according to emails and an ad-buying source close to the matter.

 

Because of this, the outlet has run into ad problems with Comcast, Facebook, and Google, among others, emails show.

 

GDI and DoubleVerify are also linked to Integral Ad Science, an ad verification company worth over $1.6 billion that uses an artificial intelligence algorithm to rate alleged disinformation. IAS uses a technology that blocks ads from appearing on client pages deemed "too risky for their brand," according to a 2017 report.

 

IAS, which partners with the GDI to evaluate websites, teamed up with DoubleVerify in January to assist Twitter with a "brand safety" operation, according to a press release.

 

Through this new initiative,Twitter will be informed by IAS and DoubleVerifyif the companies determine that ad groups share allegedly inappropriate content, TechCrunch reported.

 

"Unfortunately, this leveraging of AI technology for censorship is the gold standard now," Benz said. "AI is the censorship workhorse, the secret sauce, and virtually no professional disinformation company in 2023 enters the industry without some AI tech aspect to their censorship schemeโ€” whether that's AI for identifying posts, for flagging posts, for sorting targeted online communities, or for mapping interrelations between different targeted online communities."

 

IAS has released dozens of recommendations through the years to brands on how to combat "fake news" and extremist" websites. One includes urging companies to "use a combination of exclusion lists," which it has claimed, separately, may not go far "enough" in fighting "fraud."

 

The Global Disinformation Index did not reply to several Washington Examiner requests for comment, nor did DoubleVerify or IAS.

 

So much for thinking Twitter will get any better with Musk, many say it's worse, and since he needs ad money, these psychos and AI will be crawling all over.

Twitter executives being beholden to so-called expertsโ€™ tweets is hardly better than doing the FBIโ€™s bidding.

 

When the New York Post dropped its bombshell reporting on documents recovered from Hunter Bidenโ€™s abandoned laptop in October of 2020, Twitter did not reach out to the FBI to ask whether the reporting was Russian disinformation โ€” despite extensive coordination with the FBI to prepare to combat foreign election interference. Instead, according to testimony at Wednesdayโ€™s House Oversight Committee hearing,Twitter relied on the tweets of supposed experts, making the tech giantโ€™s decision to censor the Postโ€™s story even more outrageous.

 

The House Oversight Committee, now in the hands of Republicans, questioned four former Twitter executives on their decision to censor the Hunter Biden laptop story. Rep. Andy Biggs, R-Ariz., pushed Twitterโ€™s former global head of trust and safety, Yoel Roth, to explain the timing of Twitterโ€™s decision to censor the New York Post story.

 

Biggs noted that in an 8:51 a.m. email on Oct. 14, 2020, Roth had taken the position that the laptop โ€œisnโ€™t clearly violative of our Hacked Materials Policy.โ€

 

But then, by 10:12, Roth emailed his colleagues with Twitterโ€™s decision to censor the story, stating that โ€œthe key factor informing our approach is consensus from experts monitoring election security and disinformation that this looks a lot like a hack-and-leak operation.โ€

 

What cybersecurity experts had Roth consulted between 9 a.m. and 10:15 a.m. on Oct. 14, 2020, the morning the Post story broke, Biggs asked the former Twitter executive.

 

Roth responded that the experts were ones the Twitter heads were following on the platform. โ€œWe were following discussions about this as they unfolded on Twitter,โ€ Roth explained. โ€œCybersecurity experts were tweeting about this incident and sharing their perspectives, and that informed some of Twitterโ€™s judgment here.โ€

 

Rep. Kelly Armstrong, R-N.D., was incredulous: โ€œAfter 2016, you set up all these teams to deal with Russian interference, foreign interference, having regular meetings with the FBI, you have connections with all of these different government agencies, and you didnโ€™t reach out to them once?โ€

โ€œThatโ€™s right,โ€ Roth said, noting he didnโ€™t think it would be appropriate.

Instead, Twitter relied on the tweets of supposed national security experts.

 

Who those experts were, Roth didnโ€™t say, but here we have another strange coincidence: In his testimony on Wednesday, Roth told the committee that a few weeks before the Post story dropped, he had participated in an exercise hosted by the Aspen Institute, with other media outlets and social media companies, that posed a hack and leak October surprise involving Hunter Biden. Roth testified that Garrett Graff facilitated that event.

 

And at 8:23 a.m. on Oct. 14, 2020, after the Post story broke, Graff tweeted his playbook for how the media should react to โ€œthis Biden-Burisma crap.โ€

Graff followed about some 10 minutes later, tweeting, โ€œAlso, what a TOTAL coincidence that this fake Hunter Biden scandal drops the literal day after it becomes clear that both of Bill Barrโ€™s other intended October surprisesโ€”the Durham investigation and the unmasking investigationโ€”have fallen apart??!โ€

Not long after Graff began pushing the โ€œfakeโ€ Hunter Biden scandal narrative, Vivian Schiller joined in, calling the Hunter Biden story โ€œnonsenseโ€ and claiming Graffโ€™s exercise was โ€œto test readiness of some MSM.โ€

And who is Schiller? According to Graff, Schiller โ€œdesigned and ranโ€ the Hunter Biden tabletop exercise that Roth participated in. She was also the former head of news at Twitter, in addition to previously being the CEO of NPR, among other gigs.

 

In addition to Graff and Schiller, CNNโ€™s consultant and so-called national-security expert weighed in at 8:23 a.m., questioning the โ€œamplifyingโ€ of the New York Postโ€™s story, stressing that โ€œamplification is the key to disinformation.โ€

Twitterโ€™s decision to censor the Hunter Biden story was bad enough before, but to think the executives may have relied on so-called experts like these raises the outrage another octave.

 

Former Twitter Deputy General Counsel James Baker likewise indicated in an email that he had โ€œseen some reliable cybersecurity folks question the authenticity of the emails in another way (i.e., that there is no metadata pertaining to them that has been released and the formatting looks like they could be complete fabrications.)โ€ Baker, however, did not say whether he had spoken with the โ€œcybersecurity folks,โ€ and given that when pushed by the committee he hid behind attorney-client privilege, getting any more answers from Baker seems unlikely.

Beyond learning that Twitter executives opted to rely on the tweets of so-called experts over asking the FBI if the laptop was fake, Wednesdayโ€™s hearing consisted mainly of grandstanding โ€” some on both sides of the aisle โ€” and Democrats attempting to make the hearing about Trump when they werenโ€™t complaining that the entire session was a waste of time. One additional salient fact came out, however, in addition to a review of the basics of Twitterโ€™s censorship efforts.

Specifically, Roth clarified for the House committee that the FBI had not previously warned that an expected โ€œhack-and-leakโ€ operation was rumored to likely involve Hunter Biden. Rather, according toRothโ€™s testimony, the rumor that the hack-and-leak operation would target the Biden son came from another tech company.

 

Roth claimed in his Wednesday testimony that his Dec. 21, 2020, statement to the Federal Election Commission was being misinterpreted. In that statement, Roth had attested that โ€œsince 2018 he had regular meetings with the Office of the Director of National Intelligence, the Department of Homeland Security, the FBI, and industry peers regarding election security.โ€ His signed declaration then noted that the โ€œexpectations of hack-and-leak operations were discussed throughout 2020. I also learned in these meetings that there were rumors that a hack-and-leak operation would involve Hunter Biden.โ€

 

According to Roth, he should have worded his statement differently because it was not the FBI that had raised Hunter Biden as a potential subject of the hack and leak, but a peer company. One would think, however, that Roth would have clarified this point to his lawyer some two-plus years ago when Twitterโ€™s Covington & Burling attorney represented to the FEC in a cover letter that accompanied Rothโ€™s statement that โ€œreports from the law enforcement agencies even suggested there were rumors that such a hack-and-leak operation would be related to Hunter Biden.โ€

 

Clearly, the former Twitter executives seek to separate themselves from the FBI, but โ€œThe Twitter Filesโ€ make that next to impossible to accomplish. And, really, being beholden to the so-called experts tweeting out warnings of supposed Russian disinformation would hardly be an improvement.

Zero students proficient in math in 23 Baltimore schools, test results reveal

 

The Maryland State Department of Education recently released Baltimore students' 2022 test results, which revealed that 93% of third- through eighth-graders tested below their grade level in math, WBFF-TV reported. After analyzing the results, the local news outlet found 23 city schools where not a single student tested proficient in math.

 

The nearly two dozen schools with abysmal test scores included 10 high schools, eight elementary schools, three middle and high schools, and two elementary and middle schools. In total, 2,000 students at those learning institutions took the math assessment, and zero scored at grade level.

The Foreign Intelligence Surveillance Court has triggered a wave of condemnations over the selection of David Kris, to oversee reforms of the FBI FISA process. Foreign Intelligence Surveillance Court (FISC) presiding Judge James Boasberg, left, appointed Kris, a lawyer that the Washington Post describes as โ€œhighly controversial.

 

Critics have objected that Kris writes for Lawfare, a legal site widely criticized by conservative lawyers for its left-oriented, anti-Trump positions, as well as shows like Rachel Maddow on MSNBC. That objection strikes me as attenuated and unfair. The more serious allegation however is that Kris was one of the most public advocates for rejecting allegations of FBI abuse. In a city where you can throw a stick and hit ten lawyers, FISC went to someone who insisted that allegations of abuse were nonsense and should be rejected. If the court was seeking to assure the public, it has added a new controversy for those who see a โ€œdeep stateโ€ response to reforms.

 

Kris served under the Obama Administration and was assistant attorney general for the DOJโ€™s National Security Division. He served as an associate deputy attorney general under George W. Bush from 2000 to 2003.

 

Kris was one of the loudest critics of the Nunes memo which mirrored some of the findings of the Inspector Generalโ€™s report: โ€œThe Nunes memo was dishonest. And if it is allowed to stand, we risk significant collateral damage to essential elements of our democracy.โ€ He specifically denied the claim that the FBI misled the court about Christopher Steele โ€“ a claim that has now been proven to be true.

 

Kris also maintained that โ€œThese applications already substantially undermine the presidentโ€™s narrative and that of his proxies, and it seems to me very likely that if we get below the tip of the iceberg and into the submerged parts and more is revealed, itโ€™s going to get worse, not better. And it would potentially be dangerous to disclose additional information because some of this relates to ongoing investigations.โ€

 

He has also been a prominent critic of President Trump, claiming on Twitter that the โ€œwallsโ€ were โ€œclosing inโ€ on the President.

 

Amid the Trump-Russia investigation, Kris had written that Republicans had โ€œfalsely accusedโ€ the FBI of misleading the FISC in its wiretap applications to spy on the Trump campaign. He stated that โ€œan allegation that was all but debunked by the special counselโ€™s report and the inspector generalโ€™s report,โ€ the Daily Caller noted.

Zelensky takes credit for derailing Minsk agreements

 

The Ukrainian president claimed he personally refused to implement the deal for peace in Donbass

 

Ukrainian President Vladimir Zelensky personally refused to implement the 2015 Minsk agreements โ€“ a roadmap for peace in the east of the country, which was co-sponsored by Germany and France.

 

He made the admission during an interview with Der Spiegel published on Thursday as he continues his tour across Europe.

 

Zelensky said he viewed the agreements as a โ€œconcessionโ€ on Ukraineโ€™s part, and never once actually sought to implement them. Instead, they were merely used to exchange prisoners with the two breakaway Donbass republics.

 

The president claimed he openly told that to then-German Chancellor Angela Merkel, French President Emmanuel Macron, and Russian President Vladimir Putin back in 2019, with all of them acting โ€œsurprised.โ€

 

โ€œBut as for Minsk as a whole, I told Emmanuel Macron and Angela Merkel: โ€˜We cannot implement it like this,โ€™โ€ Zelensky stated. โ€œI told [Putin] the same as the other two. They were surprised and said: โ€˜If we had known beforehand that you would change the meaning of our meeting, then there would have been problems even before the summit.โ€™โ€

 

The Minsk agreements, originally brokered in 2014 and further expanded in 2015, envisioned a roadmap for reconciliation between Ukraine and the Donbass republics of Donetsk and Lugansk. The two regions rebelled against the countryโ€™s new authorities in the aftermath of the 2014 Maidan coup in Kiev, which ousted democratically elected President Viktor Yanukovich. Ukraineโ€™s failure to implement the agreement, which would have seen the breakaway territories reintegrated with the country but retain a special status, ultimately led to the ongoing conflict.

 

Since the outbreak of hostilities in Ukraine, multiple politicians have taken credit for the failure of the Minsk agreements, admitting they were merely a ruse to give Ukraine time to build up its military. Former Ukrainian president Pyotr Poroshenko was the first to admit last year that Kiev never intended to abide by them and used the deal to โ€œcreate powerful armed forces.โ€

 

Merkel and another original signatory of the Minsk agreements, former French president Francois Hollande, have also since confirmed that this was actually the true goal of the deal.

 

Moscow considers these admissions to be evidence that the negotiations were conducted in bad faith and that the Ukrainian government and its backers had always intended for the Minsk agreements to flop and for the Donbass crisis to be resolved by force. Russia claims that its military campaign in Ukraine, launched last February, preempted an offensive planned by Kiev with NATOโ€™s help. Ukraine, Germany, and France โ€œlied to the people of Donbass, as they had a terrible fate planned for them, which Russia prevented,โ€ Kremlin spokesman Dmitry Peskov said back in January.

Brookings Institution, which supports LawFare, has been a font for experts declaring proven crimes and impeachable acts by Trump. I have often disagreed with the analysis offered by Brookings experts in these controversies. Yet, while I strongly disagree with a great deal of Krisโ€™ analysis, much of that analysis is substantive and interesting.

However, there are also these troubling and sweeping statements on the very merits of the dispute over FISA. I was particularly concerned with a March 1, 2018 essay for Lawfare, where Kris dismisses questions raised over the handling of the Carter Page investigation.

I have written about the problems in that investigation, including a recent column where I called for an apology for Page over his abuse in the FISA system. Kris was one of those assuring the public that Page was clearly a legitimate target: โ€œItโ€™s disturbing that Page met that legal standard and that there was probable cause to conclude he was a Russian agent.โ€ Those abuses (long denied by Kris) are at the heart of the reforms.

 

Given those positions, it is curious that Judge James Boasberg thought that he was the best lawyer to assure the public that reforms would be faithfully and thoroughly carried out.

Bivalent COVID Vaccines Perform Worse Against Variant Now Dominant In United States: Studies

 

The new COVID-19 vaccines donโ€™t work as well against XBB.1.5, the virus variant thatโ€™s now dominant in the United States, according to multiple studies.

 

In one of the papers, researchers found the vaccines boosted neutralizing antibodies, believed to be a measure of protection, but that the antibody levels declined to previous levels within three months.

 

Compared to the antibody responses to BA.5, the responses to XBB.1.5 were reduced 20-fold.

 

โ€œFollowing bivalent mRNA boosting, responses to XBB.1.5 increase but remain low and wane within 3 months back to pre-boost levels. These data suggest that once a year boosters with the current mRNA vaccines may not provide adequate protection for an entire year for those at high risk of complications of COVID-19,โ€ Dr. Dan Barouch, director of the Center for Virology and Vaccine Research at the Beth Israel Deaconess Medical Center and a co-author of the preprint study (pdf), told The Epoch Times via email.

 

The Moderna and Pfizer vaccines both utilize messenger RNA, or mRNA, technology. The updated versions of the vaccines are bivalent, targeting the Wuhan variant and a sublineage of the BA.4 and BA.5 strain. The new versions were cleared as boosters in the fall of 2022 despite no clinical data being available. They are poised to replace the original vaccines.

 

Other studies have also found that the bivalents induce a better response than the old, monovalent boosters, but that the response is reduced against XBB.1.5 or its parent, XBB, which comes from BA.2 lineages.

Tuesday's State of the Union address sure has gotten attention for the ways in which some Republican members reacted to President Joe Biden's lies, but among the chatter, it's worth wondering if people actually tuned in for the address?

 

Not really, it turns out, given that just 27.3 million people watched, according to data from Nielsen across 16 networks. That's a decline of 29 percent, as is mentioned in Deadline's headline. The Hill mentioned in their headline that the ratings took "a nosedive."

 

Those ratings look even worse when compared to previous years, and the lack of viewers in the demographics that Biden needs support from. As Deadline mentioned:

 

The ratings look even worse when stacked up against former President Donald Trump's ratings.

 

How did the Americans who watched it feel about the address? There's already that major caveat in that so few of them watched it, but CNN has provided some data in that their poll showed 72 percent of Americans had a positive reaction to the speech, including 34 percent who had a "very positive" reaction.

 

As was the case with last year's polling about last year's address, though, there's more than meets the eye. CNN also compiled data on presidential averages from President Bill Clinton to Biden. It turns out Biden had the lowest average when it comes to Americans who say they had a "very positive" reaction following his address.

 

Biden is at a 38 percent "very positive" average, while President Barack Obama had a 50 percent average in that "very positive" category," President George W. Bush had a 53 percent average, and Presidents Bill Clinton and Donald Trump had a 54 percent average.

 

Trump and Biden were virtually tied in having the highest average of those Americans who said they had a "very negative" view, at 12 percent and 11 percent, respectively.

 

This poll also reflects how the president still has trouble with younger Americans too. "Among those younger than 45, though, just 21% reported a very positive reaction, even as speech-watchers in this age group were just as likely as those age 65 or older to say that Bidenโ€™s policies would move the country in the right direction (75% younger than 45 said so, as did 76% of those age 65 or older)," CNN noted.

 

The survey was conducted via text message with 552 adults who said they watched the speech on Tuesday. It has a margin of sampling error of plus or minus 5.7 percentage points.

I think weather warfare, HAARP, etc need to be hidden so "they" can manipulate things unmolested. That's where the NOAH (?) confidentiality agreements or some such come in.

The connection with LIGO to the Hanford site always makes me curious. One thing that I've started to get clued in on is that when "they" don't want people to start seeing things they aren't supposed to see "they" make sites inaccessible in some manner. Sometimes the means are seemingly oddball like "Hey that's under a toxic garbage dump" or "Don't disturb the spotted three-toed pheasant" as I understand it. My apologies if there really are endangered spotted pheasants, I'm just saying I think the "reasons" are mostly not the real reasons.

If the barron was made using knowkc-off integrated circuits, then the boards would have been closed using some photolithography process. This would mean that all the English writing would be present on the circuit boards.

If they'd cloned it via some other means of IP theft, you'd expect them to clean-off any watermarks or makers' marks. But they are commies, soโ€ฆ..
