  1. 18 U.S.C. § 371—Conspiracy to Defraud the United States

The general conspiracy statute, 18 U.S.C. § 371, creates an offense "[i]f two or more persons conspire either to commit any offense against the United States, or to defraud the United States, or any agency thereof in any manner or for any purpose. (emphasis added). See Project, Tenth Annual Survey of White Collar Crime, 32 Am. Crim. L. Rev. 137, 379-406 (1995)(generally discussing § 371).

 

The operative language is the so-called "defraud clause," that prohibits conspiracies to defraud the United States. This clause creates a separate offense from the "offense clause" in Section 371. Both offenses require the traditional elements of Section 371 conspiracy, including an illegal agreement, criminal intent, and proof of an overt act.

 

Although this language is very broad, cases rely heavily on the definition of "defraud" provided by the Supreme Court in two early cases, Hass v. Henkel, 216 U.S. 462 (1910), and Hammerschmidt v. United States, 265 U.S. 182 (1924). In Hass the Court stated:

US congressman claims billionaire donors, intelligence ties behind resistance to releasing Epstein files

  • Americans would be 'shocked' to learn their intelligence agencies worked with 'a pedophile who was running a sex trafficking ring,' says Thomas Massie

 

A US congressman suggested Sunday that the Trump administration is resisting a full release of the files on sex offender Jeffrey Epstein to protect billionaire donors and possible intelligence connections.

 

"I think it's going to be embarrassing to some of the billionaires, some of the donors who are politically connected to his campaign," US Rep. Thomas Massie told ABC News when asked why President Donald Trump opposes complete disclosure.

 

The Kentucky Republican predicted that both parties would face exposure, noting that billionaires contribute to both Republicans and Democrats.

 

He also suggested possible intelligence agency involvement including the CIA and foreign intelligence, saying Americans would be "shocked" to learn their intelligence agencies worked with "a pedophile who was running a sex trafficking ring."

 

On House Speaker Mike Johnson's Friday claim that Trump served as an "FBI informant" in the Epstein case, Massie voiced skepticism. "I don't know if the speaker misspoke," Massie said, adding that while Trump provided helpful information to victims' lawyers in 2009, being an informant "implies some formal connection and ongoing relationship with the FBI."

 

Despite Senate Republican Leader John Thune's opposition, Massie expressed confidence that House passage of a bill to release the files would put pressure on the Senate to do the same.

 

The US House Oversight and Government Reform Committee on Tuesday released more than 33,000 pages of records provided by the Justice Department. Democrats on the panel criticized the release as a pretense at transparency, as nearly all of the documents had already been made public.

 

Massie and Democratic Rep. Ro Khanna of California have introduced legislation requiring the Justice Department to release its Epstein records within 30 days. Massie also filed a discharge petition Tuesday to force a House vote.

 

Epstein, a disgraced financier and convicted sex offender, was found dead in his New York City jail cell in 2019 while awaiting trial. Authorities ruled the death a suicide, a finding reaffirmed by the Justice Department in July, although many Americans, including large numbers of Trump supporters, continue to allege a cover-up.

Trump Gives DoD ‘Secondary’ Name as Department of War, Circumventing Congress

 

The Trump administration is now referring to the Pentagon as the Department of War, even though the name has not legally changed.

 

On Friday afternoon, President Donald Trump signed an executive order giving the Department of Defense the “secondary name” of the Department of War – a workaround for the fact that a formal name change requires an act of Congress. The order also authorizes Defense Secretary Pete Hegseth to use the “secondary title” of secretary of war.

 

The change aligns with the administration’s fixation on “lethality” and a “warrior ethos,” and exemplifies the more aggressive military posture it has been taking, such as its legally questionable military strike on alleged drug smugglers in the Caribbean and deployment of troops to U.S. cities.

 

“We’re going Department of War,” Trump said during an Oval Office signing ceremony. “I think it's a much more appropriate name, especially in light of where the world is right now.”

 

“It really has to do with winning,” Trump added later. “We should have won every war. We could have won every war, but we really chose to be very politically correct or ‘wokey.’”

 

Standing alongside Trump, Hegseth said the name change signifies the department will focus on “maximum lethality, not tepid legality; violent effect, not politically correct.”

 

Almost immediately after the signing, the rebrand began. The defense.gov website redirected to war.gov; Hegseth’s handle on the social media site X changed to @SecWar; and officials swapped the placard on Hegseth’s office door with one with the secretary of war title.

 

Trump and his allies have framed the rebrand as a return to the Defense Department’s historical name, but the Department of War was not the same agency as the Pentagon.

 

The Department of War was, essentially, the Department of the Army.

 

The Department of War was established as a Cabinet agency shortly after the ratification of the Constitution in 1789. Nine years later, the Department of the Navy was established as its own Cabinet agency.

Updated Pfizer and Moderna mRNA Shots Contaminated with DNA Up to 627× Above Safety Limits

 

Peer-reviewed study finds all vials contained billions to hundreds of billions of DNA fragments — including SV40, Spike, and ORI.

 

A newly published peer-reviewed study by Dr. David J. Speicher, Dr. Jessica Rose and Kevin McKernan has confirmed that both Pfizer-BioNTech and Moderna COVID-19 mRNA injections are contaminated with residual plasmid DNA at levels up to 627-times higher than international regulatory safety limits. The contamination was not limited to older formulations—the bivalent and XBB.1.5 versions also contained DNA residues, proving the problem has NOT been corrected.

 

The study analyzed 32 vials representing 16 unique Pfizer and Moderna mRNA injection lots and found that every vial contained billions to hundreds of billions of DNA fragments, many encapsulated in lipid nanoparticles that act as delivery vehicles into human cells.

 

In Pfizer vials, investigators also detected SV40 promoter-enhancer sequences—potent genetic elements known for nuclear targeting and tumorigenic potential. Regulators set a hard ceiling of 10 ng of DNA per dose decades ago to prevent risks of insertional mutagenesis, cancer, and other genomic harms. These “vaccines” blew past those thresholds by orders of magnitude:

 

Extreme DNA Contamination

Pfizer doses contained 371–1,548 ng of DNA per dose.

Moderna doses contained 1,130–6,280 ng of DNA per dose.

FDA/WHO limit: 10 ng per dose.

That’s 36–153× over the limit for Pfizer and 112–627× over for Moderna

Fluorometry + RNase A Confirms Regulatory Breach

Using fluorometry coupled with RNase A digestion, all products exceeded FDA/WHO limits by 36–627-fold.

 

qPCR showed all Moderna vials within limits, but 3 Pfizer vials exceeded the 10 ng/dose limit for SV40 promoter-enhancer DNA, with much greater lot-to-lot variability.

 

qPCR underestimates total DNA because it misses smaller fragments—meaning true contamination is likely higher.

SV40 Promoter-Enhancer in Pfizer Shots

Found only in Pfizer vials: 0.25–23.72 ng per dose.

This element is recognized for driving genomic integration, mutating DNA, and activating oncogenes.

Encapsulated in Lipid Nanoparticles

DNA fragments were protected inside lipid nanoparticles, bypassing natural defenses and transfecting cells directly—something regulators never considered when setting “safe” limits.

Fugitive father Tom Phillips shot dead in New Zealand

 

New Zealand fugitive Tom Phillips killed in shootout with police after four years on the run

 

New Zealand fugitive Tom Phillips has been shot dead by police during an attempted burglary in the Waikato region, according to his sister.

 

Police responded to reports of an alleged ram-raid carried out by Mr Phillips at a store in the town of Piopio early on Monday, local time.

The father fled into bushland in Waikato, in New Zealand's Upper North Island, in December 2021 with his three children — Ember, now aged 9, Maverick, 10, and Jayda, 12.

Suspect arrested after retired veterinary professor discovered dead in Auburn, Alabama

 

The Auburn Police Department announced an arrest had been made in the homicide of a retired Auburn University instructor.

 

Police responded to a call around 2 p.m. Saturday on Chadwick Lane regarding a body found in a wooded area of Kiesel Park, investigators said.

 

Officers found the body of a 59-year-old woman. Police said she had injuries from an assault and was pronounced dead at the scene.

 

The Lee County Coroner's Office identified the woman as Julie Gard Schnuelle, a retired Auburn professor.

 

According to Auburn police, Harold Dabney III, of Montgomery, was charged with two counts of capital murder relating to the death of Dr. Schnuelle.

 

The police department said a red Ford F-150 belonging to Schnuelle was stolen and later recovered.

 

Police said Dabney was taken into custody after reports were made Sunday morning of a suspicious person on Beehive Road.

 

Schnuelle retired as a professor in the university's Department of Clinical Sciences in 2021, according to the Auburn University College of Veterinary Medicine's website.

 

In a statement, leaders at Auburn praised Schnuelle as a "beloved member of the Auburn family" and said they extend their condolences to her family and loved ones "during this unimaginably difficult time."

A federal appeals court has ruled that most of Donald Trump's tariffs are an overreach of his use of emergency powers as president.

The so-called reciprocal tariffs - imposed on nearly every country the US trades with - are being illegally imposed, the US Court of Appeals said on Friday.

The decision upholds a ruling in May from the Court of International Trade, which also rejected Trump's argument that his global tariffs were permitted under an emergency economic powers act.

Many of the tariffs that would be affected by the ruling stem from an announcement in April of a flat 10% rate on imports from all countries, which Trump said would even out "unfair" trade relations with the US.

U.S. Open Orders Broadcasters to Censor Reactions to Trump

 

An email obtained by Bounces includes instructions from the U.S. Open on supporting Trump's planned stagecraft during the National Anthem. Following up on the earlier news first reported by Bounces about Rolex’s invitation, I have further new information to report about the planning around presenting President Donald Trump’s appearance at the U.S. Open.

 

An internal email sent by the U.S. Tennis Association leadership to U.S. Open broadcasters, obtained by Bounces, requested that broadcasters censor any possible protests or other reactions to President Donald Trump’s presence at Sunday’s U.S. Open men’s final between Jannik Sinner and Carlos Alcaraz.

 

Here’s the key text from the USTA email obtained by Bounces:

 

“With respect to Broadcast Coverage, the President will be shown on the World Feed and the Ashe Court Feed during the opening anthem ceremony. We ask all broadcasters to refrain from showcasing any disruptions or reactions in response to the President’s attendance in any capacity, including ENG [Electronic News Gathering] coverage.”

 

The USTA’s plan to show Trump during the anthem, one of the noisiest and bombastic portions of Sunday’s events, is already an effective way to insulate Trump from likely booing. But the preemptive instructions outlined by the USTA in this email—asking broadcasters to censor and avoid any possible protest or negative crowd reaction to Trump for television audiences watching around the world—is further complicity in broadcasting Trump’s desired stagecraft for his first appearance at the U.S. Open in a decade.

 

The email also attached the USTA’s US Open social media policy, as well as “talking points and additional facts regarding the President’s visit.” The only attached “talking point,” however, was just a statement that “President Trump is planning to watch the US Open Men’s Singles Final from a suite as a sponsor guest.”

 

As previously first reported on Bounces, that unnamed sponsor is Rolex, the Swiss watchmaker which may be looking to curry favor with Trump during his visit to their luxury suite in hopes of lowering the high tariffs he has imposed on imports from Switzerland.

 

(Rolex PR has still not replied to Bounces’ inquiry about its motivations for inviting Trump to its U.S. Open suite.)

 

“We appreciate your understanding and cooperation,” the USTA email to broadcast personnel concludes, adding that any further questions can be brought either to the USTA Television’s managing director Patti Fallick or director of broadcasting Dayna Navatta.

 

If the crowd reacts anything like they did when Trump last appeared at the U.S. Open 10 years ago, he will be boisterously booed.

 

Though Trump being shown on the large video screens around Ashe would make for the most obvious occasion for booing or other dissent to erupt, U.S. Open attendees are also capable of chanting or booing in protest of Trump at other times of the match, which may be unavoidable for broadcasters to successfully censor if they cause any significant disruption to the match.
