Fact check: KCRA investigates Oroville Dam rumors

Lake Oroville was 95 percent full on Tuesday, and that’s right where the California Department of Water Resources wants it.

But posts on social media are igniting a flurry of concern.

KCRA 3 spoke with county, state and federal leaders about the rumors.

CLAIM: The spillway is about to fail, again.

Findings: This claim is false. According to the Department of Water Resources, the spillway is fine.

“There are no issues with the dam or spillway,” said Erin Mellon, a spokesperson for the department.

The spillway was used in April to release water from the reservoir and “performed as designed,” according to Mellon.

That was the first time the spillway was used since repairs were made after it deteriorated in 2017, forcing the evacuation of more than 180,000 people.

CLAIM: The wet winter and melting snowpack will lead to too much water in the reservoir.

Findings: This claim is false. According Mellon, the water supply is being closely monitored.

“There’s about 200,000 acre-feet of storage remaining in the reservoir, which is a lot of water,” Mellon said.

She said water is being released as necessary.

“Just because we’re not using the spillway doesn’t mean we’re not releasing water from the reservoir,” she said. “Right now, Hyatt Powerplant is releasing about the same amount of water that’s coming from the snowpack.”

CLAIM: There was an earthquake in Oroville that could have disrupted the dam.

Findings: This claim is false. According to the U.S. Geological Survey, an earthquake has not disrupted the Oroville Dam.

A spokesperson for the USGS said a magnitude 7.5 earthquake near Papua New Guinea, on the other side of the Pacific Ocean, registered on equipment located in Oroville.

“Just because a seismometer near the Oroville Dam records an earthquake, it does not mean that the earthquake was near the Oroville Dam. USGS instruments are very sensitive, so we can see earthquakes far away,” wrote Paul Lausteen, of the USGS, in a statement.

Prosecutors want to meet victims of sex offender with New Mexico ties

FORT LAUDERDALE, Fla. — Federal prosecutors said Friday they want to meet with once-underage victims of wealthy financier and convicted sex offender Jeffrey Epstein before deciding whether to throw out a decade-old nonprosecution agreement that allowed him to avoid potentially severe penalties. Prosecutors said in court filings that victim input is essential in deciding how to proceed in the long-running case, which has ties to New Mexico, where he is accused of assaulting teen girls and owns a ranch near the tiny community of Stanley in southern Santa Fe County, a property he purchased from former New Mexico Gov. Bruce King. The new filings came after U.S. District Judge Kenneth Marra ruled in February that prosecutors in the office of then-Miami U.S. Attorney Alex Acosta violated a victims’ rights law by not disclosing the Epstein nonprosecution agreement to them.

Acosta, who is now President Donald Trump’s labor secretary, has defended the agreement as proper after it was criticized by Democrats and victim advocates. The 2008 deal ended a federal investigation that could have landed Epstein in prison for life, instead allowing him to plead guilty to lesser state charges that resulted in a 13-month jail sentence, required financial settlements to dozens of victims and that he register as a sex offender.

Assistant U.S. Attorneys Jill Steinberg and Nathan Kitchens — both from the Atlanta U.S. Attorney’s Office, which was chosen in March by the Justice Department to take over the case — said in court papers they need at least 60 days to talk with victims before a decision is made on whether to tear up the Epstein deal. “The victims’ views and concerns are critical to inform the government’s recommendation of an appropriate remedy, particularly given the sensitive nature of the crime at issue,” the prosecutors wrote.

Attorneys for two victims, identified as Jane Doe 1 and Jane Doe 2, countered that prosecutors should be required to announce a proposed remedy for violating their rights to be informed of the Epstein agreement. They have previously said they want the Epstein deal voided, which could again expose him to federal prosecution. “The government should go first,” lawyers Brad Edwards and Jack Scarola wrote in their filing. “After more than 10 years of litigation, the government’s suggestion that it should postpone explaining its proposed remedy is a transparent effort to do nothing but cause further delay.” Both sides proposed lengthy schedules for future court filings and action. Court documents show Epstein had a Palm Beach mansion where at least 40 underage girls were brought for what turned into sexual encounters. Authorities say he had female fixers who would look for suitable girls, some local and others recruited from Eastern Europe and other parts of the world. Epstein also has a home in New York City and a private Caribbean island. Some of the girls were brought to those places as well, court documents show.

There were some excellent articles about the penstocks at the Oroville hydro plant needing replaced, around the time of the spillway failure, that I am having trouble locating. Victims of Chile Nazi sect says German compensation not enough

Victims of a Chile-based Nazi pedophile sect said compensation offered by Germany was not enough to make up for decades of slavery and abuse.

Germany said Friday it would pay up to €10,000 (US$11,000) each to victims of the "Colonia Dignidad" commune founded by a former Nazi soldier.

"It's a help, yes, but it does not solve the problem. We are a lost generation," Horst Schaffrick, a German who arrived at the enclave with his family at the age of three, said.

Schaffrick suffered sexual abuse by former Wehrmacht soldier Paul Schaefer, who founded the sect in southern Chile in 1961.

The commune was presented as an idyllic German family village but in reality, Schaefer, a convicted pedophile, abused, drugged and indoctrinated the few hundred residents and kept them as virtual slaves.

His group had close ties to the 1973-1990 dictatorship of Augusto Pinochet and would torture and "disappear" regime critics.

Germany said Friday it would pay up to €10,000 to victims of the sect.

The compensation "covers very little, if you compare it to the 40 years of work without pay", said Schaffrick, who also referred to "the suffering caused by slavery, beatings, drugs and sexual abuse for 20 years".

"How am I going to continue in my old age, how am I going to live? It cannot be solved, that's what is serious about this situation," he said.

Violence and abuse

Winfried Hempel, who was born in the commune and lived there until the age of 20, also felt the proposed compensation "is a step forward, but certainly not enough".

"What we would have wanted, and what we are arguing for, would be that we give settlers who are old enough to retire a decent pension, no more and no less," said the lawyer, who is fighting for the victims.

At his office in Santiago, Hempel said they would continue to seek proper compensation.

Some 240 German and Chilean survivors are eligible for the payments, including about 80 who now live in Germany, from

a fund valued at an initial €3.5 million until 2024.

The European Center for Constitutional and Human Rights said Germany's foreign ministry was "dodging its legal responsibility to compensate the victims" more fully, adding that "many Chilean victims were left out".

A German government and parliamentary committee in its report said Friday that Schaefer (pictured in the wheelchair) "tore families apart, abused countless children and actively collaborated with Pinochet dictatorship henchmen on torture, murder and disappearances.

"The survivors still suffer massively from the severe psychological and physical consequences after years of harm caused by violence, abuse, exploitation and slave labour."

However, it also said that the German government "is of the opinion that no legal claims against the Federal Republic of Germany have arisen" from the abuses in Colonia Dignidad.

The support measures for victims would be paid "exclusively out of moral responsibility and without recognition of a legal obligation", it said.

The scale of the atrocities committed at the fenced-in mountain commune 350 km south of Santiago came to light only after the end of Pinochet's regime.

Schaefer, having initially run from justice, was arrested in Argentina in 2005 and then jailed in Chile for child sexual and other abuses. He died behind bars in 2010 at the age of 88.
