What's Wrong With FISA?

Congress enacted the Foreign Intelligence Surveillance Act in 1978 in response to the unlawful surveillance of Americans by the FBI and the CIA during the Watergate era. President Richard Nixon — who famously quipped after leaving office that “when the president does it, that means that it is not illegal” — used the FBI and the CIA to spy on his political opponents.

The stated reason was national security. Nixon claimed that foreign agents physically present in the U.S. agitated and aggravated his political opponents to produce the great public unrest in America in the late 1960s and early 1970s, and thus diminished Americans’ appetite for fighting the Vietnam War. There was, of course, no evidence to support that view, but the neocons in Congress and the military-industrial complex supported it even after Nixon left office.

This view - there are foreigners among us who wish us harm - came to fruition during the presidency of Jimmy Carter, who pushed for the enactment of FISA. FISA’s stated purpose was to limit - not expand - the government’s surveillance powers by requiring the intervention and permission of a judge.

Wait a minute. Government surveillance is a search under the Fourth Amendment, and government searches already required warrants from judges. So, what was new about FISA?

The Constitution requires probable cause of crime to be demonstrated to a judge before the judge can sign a search warrant. That was the law of the land until FISA came along. FISA set up the Foreign Intelligence Surveillance Court, and it authorized the judges on that court to issue search warrants based on a lower standard of probable cause.

Isn’t that contrary to the Constitution? Yes, it is. But a challenge has never reached a non-FISC federal court because the government has never used evidence that it admits was obtained from a FISC warrant in a criminal case for fear that a federal court will invalidate the FISA standard.

Just ask Carol Waldmann, a Pennsylvania Mom and wife, who logged onto her Facebook account to find her post from the Book of Luke in the Bible was scrubded from her timeline.

Luke, Chapter 10 to be exact.

“The secular left is at it again denying my link in a Facebook post to an online bible,” Waldmann said in an interview with True Pundit.

Waldmann shared chapters of Luke, as part of a build up to Christmas, for days before the Facebook overlords dropped the Biblical hammer.

ICE removes more than 267,000 individuals in fiscal year 2019

Immigration and Customs Enforcement (ICE) released its annual report on Wednesday, showing a slight decline in arrests and roughly 10,000 more removals from the previous fiscal year.

ICE conducted 267,258 removals — up from 256,058 in fiscal year 2018. According to the report, nearly all (91 percent) of the removed included individuals with criminal convictions or pending criminal charges at the time of arrest. Arrests, however, fell to 143,000 from 159,000.

In fiscal year 2019, individuals were charged for a variety of violent crimes that included homicide (1,900), kidnapping (1,800), sex offenses (12,000) and assault (45,000). The vast majority of arrests — 86 percent — involved pending criminal charges or criminal convictions, according to the report.

The report came as the agency fended off criticism over its handling of the ongoing migrant crisis, which President Trump has responded to by tightening restrictions on entry and calling for additional deportations.

A Methodist church in California has erected a nativity scene depicting Jesus, Mary and Joseph in cages – using blasphemous imagery to protest President Donald Trump’s immigration policies.

“We thought about the most famous refugee family in the world, the family of Jesus,” said the Rev. Karen Clark Ristine of Claremont United Methodist Church about her grotesque display.

The female reverend is proud to pervert the word of Christ in order to support the invasion at the border. She hopes to use the example of Christ to push America down the path of national suicide.

FNC’s Geraldo Rivera: Trump ‘Probably’ Had a Quid Pro Quo with Ukraine

On Sirius XM’s “The Dan Abrams Show,” Fox News correspondent Geraldo Rivera said there was “probably” a quid pro quo between President Donald Trump and Ukraine President Volodymyr Zelensky.

Abrams asked, “Even if impeachment sucks, can you agree that, of course, he was withholding the aid and the White House visit?”

Rivera said, “Probably, probably.”

He continued, “When you look at how foreign policy is made, how foreign aid is distributed and dispensed if you don’t think there’s this kind of backroom wrangling almost every time with Israel with Albania or Australia, of course, there is.”

He added, “Mick Mulvaney in that rare moment, spoke the truth. What’s different here is the president is surrounded by snitches and backstabbers and rats and snakes, and everything he does is construed in the most evil way possible by people who are un the business of bringing him down.”
