ICE, Department of Corrections cooperation ensures safe removal of child molester from US

 

Dangerous sexual predator convicted of first-degree child molestation

 

 

SEATTLE - U.S. Immigration and Customs Enforcement (ICE) officers removed a convicted child sexual predator and illegally present criminal alien to El Salvador Tuesday.

 

Daniel Alfonso Lemus, 43, was convicted of first-degree child molestation and fugitive charges in 2015 and sentenced to a term of 41 months to life. He was later transferred to the custody of the Washington Department of Corrections (WDOC) to serve his sentence.

 

On Oct. 15, 2015, ICE Enforcement and Removal Operations (ERO) officers encountered Alfonso-Lemus at the WDOC and lodged an immigration detainer with the jail.

 

On Oct. 26, 2020, Alfonso-Lemus was released from the WDOC, transferred to ICE ERO custody and subsequently housed at the Northwest ICE Processing Center. On Jan. 5, an immigration judge ordered Alfonso-Lemus removed from the United States.

β€œThanks to the coordinated efforts between the Washington DOC and ICE ERO, custody of Alfonso-Lemus was transferred directly to ICE, preventing this violent criminal alien from being released back into the community,” said ICE’s Enforcement and Removal Operations (ERO) Seattle Field Office Director Nathalie Asher.

 

Alfonso-Lemus was removed from the United States via an ICE Air Operations charter flight and transferred to the custody of Salvadoran authorities.

 

ICE is charged with enforcing federal immigration laws enacted by Congress. ICE officers are sworn law enforcement officers who carry out the arrest, detention, and removal of aliens found to be in the United States unlawfully.

 

Aliens processed for removal may receive their legal due process from federal immigration judges in the immigration courts, which are administered by the Executive Office for Immigration Review (EOIR). EOIR is an agency within the U.S. Department of Justice and is separate from the U.S. Department of Homeland Security and ICE. Immigration judges in these courts make decisions based on the merits of each individual case. ICE officers carry out the removal decisions made by the federal immigration judges.

Operation Trust (опСрация "ВрСст") was a counterintelligence operation of the State Political Directorate (GPU) of the Soviet Union. The created front company was called the Moscow Municipal Credit Association.

 

The head of the MUCR was Alexander Yakushev (АлСксандр АлСксандрович Π―ΠΊΡƒΡˆΠ΅Π²), a former bureaucrat of the Ministry of Communications of Imperial Russia, who after the Russian Revolution joined the Narkomat of External Trade (Наркомат внСшнСй Ρ‚ΠΎΡ€Π³ΠΎΠ²Π»ΠΈ), when the Soviets began to allow the former specialists (called "spetsy", Russian: спСцы) to resume the positions of their expertise. This position allowed him to travel abroad and contact Russian emigrants.

 

MUCR kept the monarchist general Alexander Kutepov (АлСксандр ΠšΡƒΡ‚Π΅ΠΏΠΎΠ²) from active actions, as he was convinced to wait for the development of internal anti-Bolshevik forces. Kutepov had previously believed in militant action as a solution to the Soviet occupation, and had formed the "combat organization", a militant splinter from the Russian All-Military Union (Russian: Русский ΠžΠ±Ρ‰Π΅-Воинский Боюз, Russkiy ObshcheVoinskiy Soyuz) led by General Baron Pyotr Nikolayevich Wrangel. Did SolarWinds Make the Right Move in Hiring Former CISA Director Krebs?

Christopher Krebs, the former director for the Cybersecurity and Infrastructure Security Agency (CISA), still finds himself at the center of American cybersecurity issues despite the fact that his run at CISA ended with his firing by President Trump after the 2020 election.

 

Many observers and most in the media attempted to portray the firing as a vengeful act by the outgoing president who was upset that Krebs failed to acknowledge the evidence of voter fraud that the Trump legal team has worked so hard to collect in the days following November 3, 2020.

 

The incident that wound up sealing Krebs’ fate within the administration was the November 17 joint statement released on the CISA website that was attributed to the Elections Infrastructure Government Coordinating Council and the Election Infrastructure Sector Coordinating Executive Committees. The statement claimed that β€œThe November 3rd election was the most secure in American history. Right now, across the country, election officials are reviewing and double checking the entire election process prior to finalizing the result.”

 

The statement directly contradicted the earliest claims of Trump attorneys including Rudy Giuliani and Jenna Ellis, as well of some of the wilder proclamations levied against Dominion Voting Systems, the company that sells electronic voting hardware and software, including many of the voting machines and tabulators that are currently in use in the United States and Canada, by attorney Sidney Powell by saying in clear bold lettering that β€œThere is no evidence that any voting system deleted or lost votes, changed votes, or was in any way compromised.”

 

Despite that statement, there was at least one verified compromise against the 2020 election that the CISA- and Christopher Krebs-endorsed statement regarding 2020 election security failed to mention. That was the hacking attack against Hall County, Ga., that exposed voter data of more than 180,000 residents.

 

After the ousting of Krebs at CISA, President Trump appointed Brandon Wales as the acting director for CISA as of November 17, 2020, and he remains in the position currently. Wales was certainly a highly qualified choice as he previously served as CISA’s first executive director in addition to having served as the director of the DHS Office of Cyber and Infrastructure Analysis (OCIA). OCIA provides analyzes any potential cyber or physical risks to critical American infrastructure.

 

As the process of finger-pointing and assigning blame for matters related to the well-documented instances of election irregularities dragged on, perhaps the most pressing cybersecurity issue for America and CISA has become the fallout from the recently discovered SolarWinds hacking attack that affected at least 2,000 networks belonging to at least 100 government and non-government entities globally. News of the hack broke within a few weeks after Krebs’ firing.

 

It can be argued that Krebs, while still serving at CISA, failed to protect the United States from foreign Advanced Persistent Threats, or APTs, which have attacked American entities from countries that include Russia, China, and Iran.

 

The SolarWinds attack has been attributed to a Russian hacking group known as APT29 (Advanced Persistent Threat). The group is known by several names, including the Dukes, Cozy Duke, Cozy Bear and Office Monkeys. The hackers are said to have used a new malware strain known as SUNBURST in the attack.

 

Interestingly enough, Krebs, who was America’s top cybersecurity official during most of the time that the attack was ongoing, has just been hired to consult for SolarWinds.

 

According to a statement released by the company, β€œWe have brought in the expertise of Chris Krebs and Alex Stamos to assist in this review and provide best-in-class guidance on our journey to evolve into an industry leading secure software development company.”

 

In the coming weeks, we should learn more regarding the SolarWinds attack. The company is certainly hoping that the insider knowledge possessed by Krebs will help them secure themselves and their customers from any similar attacks in the future, while discovering what vulnerabilities led to their being attacked in the first place. Whether or not Krebs is up to the task is yet to be seen, but perhaps the application of his knowledge while focusing on this singular issue in his new capacity can bring out the best in the former CISA director.

There are two sections of the Constitution at play. Article 2, section 4, says:

The President, Vice President and all civil officers of the United States, shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors.

 

So Article 2, Section 4 doesn't seem to deal with former officials. It deals with officials, who can be "removed." So let's look at Article I.

 

Article 1, Section 3, Clauses 6 and 7 say:

The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried …

 

… the Chief Justice shall preside; And no Person shall be convicted without the Concurrence of two thirds of the Members present. … Here's where is gets interesting …

 

Judgement in Cases of Impreachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: …

 

… but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgement and Punishment, according to Law.

 

On the one hand, there are only references to "officials" and the "President," etc. Nothing said about former officials. Would the Chief Justice preside over a hypothetical impeachment trial of a FORMER President? That is not expressly addressed in the text of the Constitution.

 

Article 2, Section 4 says: The President, Vice President and all Civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.

Nothing THERE on former officials.

 

So the question seems to be whether the REMEDY: "Judgement in Cases of Impreachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States" implies jurisdiction ….

 

… to try a FORMER official solely for the purpose of disqualification, even though "removal" is no longer possible, and even though criminal prosecution actually is possible (in theory, depending on the facts).

 

My personal textual interpretation is that no jurisdiction exists to hold impeachment trials of former officials (nor future officials, nor mere candidates). BUT, to answer that question would require @marklevinshow-style knowledge of the Federalist Papers, English history, etc.

 

And whether or not such jurisdiction exists has absolutely nothing to do with Trump or how you feel about him (or Pelosi). It is a constitutional question for the ages.

 

Franklin argued that impeachment was needed because otherwise the only avenue to get rid of a rouge executive would be violence (unwanted by anyone). That logic does not apply to former officials.

With the hysteria over the Capitol Building dustup Wednesday hogging the news, I think it’s important not to allow the Georgia runoff elections to be buried and forgotten about, because how a majority of liberty-minded Americans view what happened in Georgia will determine the impact it will have on America’s future.

 

If conservatives and libertarians throw up their hands in despair and view the Georgia elections as the final death knell for liberty in this country, they might just end up being right. But if they view them as a clarion call to return America to its founding conservative-libertarian roots, they might also be right. What is needed right now is clear thinking and a great deal of action.

 

The paramount question we should be focused on is not the fact that Raphael Warnock and Jon Ossoff won the Georgia elections β€” or even the possibility that their wins might have been a result of the usual Democrat cheating β€” but how two Marxists were even in a position to run for the United States Senate in a traditionally conservative state. It seems reasonable to conclude that somewhere between 30-40 percent of voters in this one-time red state apparently prefer socialism to free-market capitalism.

 

Clear thinking on this matter also forces one to face up to the reality that America is now closer to becoming a Marxist nation than at any time in its history. And, if so, I believe it’s important for people to understand what Marxism is all about.

 

As a prelude, let me start by pointing out that socialism and communism are, for all practical purposes, one and the same. Karl Marx made it clear that socialism was but a phase along the way to communism, which is why I use those two terms, along with terms like Marxism, progressivism, liberalism, leftism, and collectivism, interchangeably.

 

Second, communism as Marx described it has never existed on this planet. Leftists like to romanticize about his heaven-on-earth version of communism, a fantasy wherein the state β€œwithers away” because everyone has equally satisfying lives β€” food, housing, medical care, and more β€” thus no one covets his neighbor’s possessions. In the real world, however, from Lenin to Stalin to Brezhnev, from Mao to Deng to Xi, the term communism (and all of its synonyms) has proven to be nothing more than a euphemism for totalitarian rule.

 

When communists take control of a country, what actually happens is that people end up with less of everything and are equally miserable. But not all people. Under communism, a new privileged class emerges that replaces the previous elites whose property was appropriated by the state. In the Soviet Union, the privileged class under communism was known as the nomenklatura. It consisted of tens of thousands of bureaucrats whom the oligarchy depended on to keep the proletariat in line.

Dutch government resigns after childcare benefits scandal

LONDON β€” The whole Dutch government collectively resigned on Friday after a scandal involving the mismanagement of childcare funds, which drove thousands of families into financial hardship.

 

An investigation revealed in December that tax officials wrongly accused thousands of working families of fraud and ordered them to repay childcare benefits between 2013 and 2019. The event has been described as an β€œunprecedented injustice” by some Dutch lawmakers.

Palm Beach Officials Looking to Cancel Trump Golf Course Land Contract

 

A Palm Beach County official reportedly contacted legal counsel to inquire about canceling the lease for Trump International Golf Club in unincorporated West Palm Beach.

 

Howard Falcon, the country’s chief assistant attorney, confirmed to the Palm Beach Post that a county official had contacted him about canceling the land contract for which the president pays the county $88,338 a month in rent.

A lawyer for the Trump organization agreed and told the paper that there is β€œno basis for canceling the lease” because there is no β€œbad boy” clause in the contract allowing the county to cancel the lease if Trump misbehaves in public.

 

The president frequently appears at Trump International Golf Club when he is staying at his Mar-a-Lago estate. He also uses the sport to entertain foreign dignitaries, members of Congress, and famous personalities.

 

Trump owns several other Florida properties, including the Trump National Doral in Miami-Dade County and Trump National Golf Club in Jupiter.

 

The Palm Beach County official’s inquiry came on the heels of New York Mayor Bill de Blasio’s decision to sever ties to the president’s businesses.

 

β€œI’m here to announce that the city of New York is severing all contracts with the Trump Organization,” de Blasio told MSNBC on Wednesday.

 

As in the case with ending the Palm Beach contract, the Trump organization insisted that the City of New York had no legal right to simply cancel his New York contracts out of hand.

 

β€œThe City of New York has no legal right to end our contracts, and if they elect to proceed, they will owe The Trump Organization over 30 million dollars,” the Trump spokesperson said in response to the mayor’s proclamation. β€œThis is nothing more than political discrimination, an attempt to infringe on the First Amendment, and we plan to fight vigorously.”

Wanted by Interpol: 2 arrested over human trafficking

On May 28 last year, alleged human traffickers killed 30 migrant workers, including 26 Bangladeshis in Libya. The incident caused a huge public outcry at home and abroad.

The transparency of timing is brutally obvious. Yes, the far-left was willing to put millions of American’s through economic pain and hardship in order to advance their interests.

 

Last week New York Governor Andrew Cuomo said the economy had suddenly become more important than the threat presented by COVID-19. Too much economic damage was inflicted upon his state and now wants to re-open.

 

Yesterday, Chicago Mayor Lori Lightfoot announced the economic damage to the service industry was so severe it was now greater than the COVID risk…. and will reopen bars and restaurants. Today, a new study shows no benefit to the lockdowns.

 

The motives here are exactly as outlined for the past year. The fear of COVID was weaponized to damage the global economy and in doing so damage the reelection guarantee of Donald Trump. Now that mission is accomplished, the walk-back begins:

 

COVID fear was a narrative cover-story to create crisis and also hide the lack of support for Joe Biden and Kamala Harris. Part of that cover-story is needed because the MAGA community was showing up in overwhelming numbers at Biden-Harris events, and the false illusion of support -propping up the Potemkin village- was being exposed. All of these machinations are part of a remarkable attempt at psychological operations in this election.
