Illinois Supreme Court Rules Tax On Guns & Ammo Unconstitutional

 

The Illinois Supreme Court ruled on Oct. 21 that two taxes on guns and ammunition in Cook County violate the state’s constitution because they affect law-abiding citizens’ Second Amendment right to acquire firearms for self-defense.

 

Supreme Court Justice Mary Jane Theis wrote in a 6–0 decision that the taxes violate the constitution’s uniformity clause, while also pointing out that the revenue from the generated tax isn’t directed toward funds or programs that reduce gun violence.

 

β€œWhile the taxes do not directly burden a law-abiding citizen’s right to use a firearm for self-defense, they do directly burden a law-abiding citizen’s right to acquire a firearm and the necessary ammunition for self-defense,” Theis wrote in a 14-page opinion (pdf) filed on Thursday.

 

β€œUnder the plain language of the ordinances, the revenue generated from the firearm tax is not directed to any fund or program specifically related to curbing the cost of gun violence,” she noted. β€œAdditionally, nothing in the ordinance indicates that the proceeds generated from the ammunition tax must be specifically directed to initiatives aimed at reducing gun violence.”

 

The justice concluded that the case will be remanded to the circuit court β€œfor entry of summary judgment in favor of plaintiffs.”

 

In 2012, the Cook County Board of Commissioners approved a $25 tax on the retail purchase of a firearm within the county. The county’s Firearm Tax Ordinance was enacted in April 2013.

 

A separate county tax was enacted in 2015, which added $0.05 per cartridge for centerfire ammunition and $0.01 per cartridge for rimfire ammunition. Americans who fail to pay those taxes are subject to a $1,000 fine for the first offense and a $2,000 fine for subsequent offenses.

 

The trade group and gun-rights organization, Guns Save Life, challenged both taxes in a lawsuit against the county, saying they violate the Second Amendment rights of law-abiding citizens.

 

A spokesman for Cook County President Toni Preckwinkle said on Thursday they are disappointed in the ruling and will work to determine the next steps.

Useless, but somewhat interesting trivia is that Anon used own a flying service and fly to Jekyll Island from time to time for Sunday brunches at the club. Which were awesome! Went into a burger king the other day. Was in the mood for one of their burgers and fries. Haven't had a burger king or any other fast food in a long time. I didn't check the prices first. Trump signs bill making animal cruelty a federal crime

 

President Trump signed a bipartisan bill on Monday that makes certain acts of animal cruelty are charged as a federal felony, saying it’s important for the nation to combat β€œheinous and sadistic acts of cruelty.”

 

The Preventing Animal Cruelty and Torture Act (PACT) prohibits extreme acts of cruelty, including intentional crushing, burning, drowning, suffocating, impalement, carried out against "living non-human mammals, birds, reptiles, or amphibians," according to National Public Radio.

 

Even though animal cruelty is a crime in all 50 states, animal activists claim the new law will make it easier for the federal government to prosecute those who carry out the abuse. The bill signed by Trump makes animal cruelty punishable by a fine, up to seven years in prison or both.

 

The legislation strengthens a 2010 law called the Animal Crush Video Prohibition Act, which made the creation, sale and distribution of videos depicting extreme acts of animal cruelty a federal crime. The PACT closes a gap in the law by allowing federal authorities to prosecute individuals filmed crushing or torturing animals, regardless of whether they were the ones to create the video, according to The Humane Society.

Reps. Ted Deutch, D-Fla., and Vern Buchanan, R-Fla., introduced the bipartisan initiation to the House, NPR reported. Sens. Richard Blumenthal, D-Conn., and Patrick J. Toomey, R-Pa., told the Hartford Courant they worked together to pushed the bill through the Senate and onto Trump’s desk.

 

β€œThe barbaric torture of animals has no place in a civilized society and should be a crime β€” and thanks to this new law, now it is,” Blumenthal told the newspaper.

 

Holly Gann of the Animal Wellness Foundation told the Associated Press that the legislation will β€œbetter protect some of the most vulnerable among us.”

Ive watched it probably five times and I’m starting to get used of the heavy parts. I love the speech, I cant imagine being that brave to say much of that though.

 

Did you notice, I think Trump warned Melania when the heavy part was coming, because after he said stand up Melania, she disappeared right after that? She was not there for the rest of the speech.
