The two other major systems, Virginia Commonwealth University Health and Bon Secours, set mandates in late summer. So did numerous other systems in the state.

VCU Health chose to implement the mandate, CEO Dr. Art Kellermann said at the time, because health providers were losing the battle against vaccine misinformation prevalent on the internet. Kellermann recently said VCU Health has reached a 99% vaccination rate, and only a small number of employees resigned. But HCA declined to immediately follow VCU Health and Bon Secours’ lead.

“We really took the stance — we want to encourage everyone to get vaccinated but we don’t want to be in the business of second-guessing your physician or your personal beliefs or religious beliefs,” Dr. William Lunn said Friday. Lunn is CEO of Chippenham and Johnston-Willis Hospitals, which are part of HCA.

Last week, the Centers for Medicare and Medicaid Services seemingly forced health systems’ hands by requiring facilities that participate in Medicare and Medicaid programs to fully vaccinate their staff by Jan. 4. That represents the vast majority of the nation’s 17 million health care workers. The ruling does not allow for routine testing in place of vaccination.

What happens if you object to receiving a vaccine when your employer requires it?

Just because you have a valid medical disability or theological objection to receiving a coronavirus vaccine doesn't mean your employer has to let you continue working under the same conditions you've been used to. Companies are required to make "reasonable accommodations" if an employee objects to receiving a vaccine for valid reasons. Such accommodations could include allowing the employee to work remotely or take a leave of absence. The employee could also show a negative COVID-19 test once a week, per the president's mandate.

If you don't have a medical condition per the ADA or religious reason for refusing the COVID-19 vaccine, your employer has the right to terminate your employment. Note that you likely won't be able to claim unemployment benefits if that happens because your employer's reasoning for firing you would be "for cause" that's tied to complying with company policy.

Some companies are also considering imposing fines on unvaccinated workers refusing to get the shot. This could include raising health care costs, withholding raises and restricting access to workplace amenities. For instance, the NBA says it won't pay unvaccinated players who miss games.

A 1905 Supreme Court case allows employers to require vaccines

There are precedents for large-scale vaccination requirements in US law. In 1901, a deadly smallpox outbreak in New England prompted local governments to order mandatory vaccinations for everyone in the area. Some residents, however, objected, and one took it all the way to the Supreme Court. The Supreme Court decided in Jacobson v. Massachusetts that the government may impose "reasonable regulations," such as a vaccine requirement during pandemics, for the purpose of protecting the "safety of the general public."

The court case forms the basis of guidance issued by the Equal Employment Opportunity Commission, which makes it clear that employers may make similar demands of their workers.

Gov. Evers Authorizes Wisconsin National Guard to Support Local Partners in Kenosha

Approximately 500 Wisconsin Army National Guard troops are reporting for State Active Duty as authorized by Gov. Tony Evers to support local partners in ensuring public safety in conjunction with hundreds of officers from volunteering law enforcement agencies.

“We continue to be in close contact with our partners at the local level to ensure the state provides support and resources to help keep the Kenosha community and greater area safe,” said Gov. Evers. “The Kenosha community has been strong, resilient, and has come together through incredibly difficult times these past two years, and that healing is still ongoing. I urge folks who are otherwise not from the area to please respect the community by reconsidering any plans to travel there and encourage those who might choose to assemble and exercise their First Amendment rights to do so safely and peacefully.”

“We stand ready to support our communities during times of need,” said Maj. Gen. Paul Knapp, Wisconsin’s adjutant general. “In close coordination with the governor, we have assembled approximately 500 Soldiers to help keep the Kenosha community safe, should a request from our local partners come in.”

Members of the Wisconsin National Guard will stage outside Kenosha in a standby status to respond if requested by local law enforcement agencies. Pursuant to Section 321.39(1)(a) of the Wisconsin Statutes, the governor ordered into state active duty members of the Wisconsin National Guard deemed necessary to support local law enforcement and first responders in Kenosha. As has been the case under previous missions, Guard members called to active duty may only be used to provide support to local law enforcement and to protect critical infrastructure and cultural institutions necessary for the well-being of the community, and to provide support to first responders such as the Kenosha Fire Department. A coalition of Navy SEALs and other highly trained fighters are suing the Biden administration over its COVID-19 vaccine mandate.

The group: composed of 26 Navy SEALs, five Navy special warfare combatant craft crewmen, one Navy explosive ordnance disposal technician and three Navy divers.
