First Changes to the Federal Courts

In 1801 the lame-duck Federalist majority in Congress, which favored a strong national government, made radical changes to the federal courts. The Judiciary Act of 1801 expanded federal jurisdiction, eliminated Supreme Court justices’ circuit court duties, and created 16 federal circuit court judgeships. Outgoing President John Adams quickly filled the new positions with Federalist lifetime appointees, known as the “midnight judges.” When Democratic-Republicans gained a majority in Congress the following year, they repealed the 1801 act and abolished the new judgeships.

Congress determines the structure and authority of the federal court system. After defining the federal judiciary in 1789, Congress used its constitutional power to alter the courts’ structure and operations in 1801 and 1802.

February 13, 1801

Within twelve years of the establishment of the federal judiciary, Congress approved a sweeping reorganization of the nation's court system and significantly expanded federal jurisdiction. The Judiciary Act of 1801 reduced the size of the Supreme Court from six justices to five and eliminated the justices' circuit duties. To replace the justices on circuit, the act created sixteen judgeships for six judicial circuits. The U.S. circuit courts over which the new judges were to preside gained jurisdiction over all cases arising under the Constitution and acts of the United States. The requirements for diversity suits (cases involving parties from different states) made it easier for creditors to recover debts in federal courts. In many cases, most importantly those involving land, restrictions on jurisdictional amounts were removed. In other cases jurisdictional amounts were reduced and the transfer of cases from state courts made easier. The division of states to create additional circuit and district courts further encouraged citizens to rely on the federal rather than state courts.

The reorganization of the federal judiciary was in part a response to calls for reform of the justices' circuit court obligations. As early as 1790 the attorney general, concerned that justices could rule on appeals of cases they decided in trial court, recommended the end of circuit riding. A 1793 act reducing from two to one the number of justices required for a circuit court did little to quiet the justices' complaints about the burdens of time and travel. The scope of the Judiciary Act of 1801, however, went beyond any specific revision of the judicial system and represented the triumph of those who advocated a dominant national judiciary rather than the compromise of 1789 which left the state courts with a significant share of federal jurisdiction.

Congressional debate on the bill reflected the bitter conflict between Federalists and Jeffersonian Republicans. Federalists insisted that the increase in the number of judges and the establishment of more courts were necessary to protect the federal government against hostile state governments and "the corrupters of public opinion." Republicans interpreted the act as an attempt to weaken the state governments and secure patronage positions for Federalists.Republicans also feared the expanded jurisdiction of the same courts in which their supporters had been prosecuted under the Alien and Sedition Acts. Although a version of the bill had been introduced before the elections of 1800, John Adams signed the act into law on February 13, 1801, less than three weeks before the end of his term and that of the Federalist majority in the Sixth Congress.

The partisan character and the timing of the act provoked immediate opposition to the new organization of the judiciary. The hastily confirmed appointees to the circuit courts earned the label "Midnight Judges" as Jeffersonian Republicans accused the Federalists of packing the courts following their defeat in the elections of 1800. The newly-elected president, Thomas Jefferson, and the Republican majority in the Seventh Congress came into office intent on repeal.

Former House Speaker Dade Phelan isn’t backing down from his controversial push to regulate political memes and altered images.

House Bill 366, which would require disclosures on altered media used in political advertising, received a hearing in the State Affairs Committee on Wednesday morning.

During the hearing, Phelan (R–Beaumont) insisted the bill was about addressing artificial intelligence in political advertising. But as critics have pointed out, the legislation itself doesn’t distinguish between AI-generated content and simple Photoshop edits—meaning it could criminalize even rudimentary image manipulation in political speech.

The bill, which would require disclaimers on political content featuring altered media, comes in response to a campaign mailer from Club for Growth during the last election that depicted Phelan alongside Nancy Pelosi. The mailer was intended to highlight that Phelan received major campaign contributions from a PAC that also backs Pelosi.

He argues it doesn't effect memes, only political advertisements, but the people charged with enforcing the law beg to differ, and his motives suggest that he is not exactly sincere in his protestations that memes would not be suppressed.

Robert Morris, founder of Gateway Church in Southlake, Texas, formally surrendered to the Osage County Sheriff's Office in Oklahoma Monday morning and is reportedly expected to enter a not-guilty plea in court days after being indicted on five counts of lewd or indecent acts with a child by a multi-county grand jury in that state last Wednesday.

Arrest documents reviewed by The Christian Post show that Morris was formally booked at 7:57 a.m. and released at 8:11 a.m. on a $50,000 bail bond.

Morris' attorney, Mack Martin, declined to comment more specifically on the charges but told The Associated Press he expects to enter not guilty plea on the megachurch founder's behalf at an arraignment scheduled for 3 p.m. Monday.

Morris' surrender comes just hours after Gateway Church officials offered prayers to congregants and sought to distance the church from their embattled former leader.

The charges stem from allegations made by the now 54-year-old Cindy Clemishire last June that Morris sexually abused her over multiple years in the 1980s when he was a traveling evangelist, beginning when she was 12.

Nic Lesmeister, Gateway Church's executive pastor of global outreach, reiterated in an address Sunday that Morris, who resigned over the allegations last June, no longer has any formal ties to the church.

"Last November, our elders made it clear that we had drawn a bright line as a church, and we were moving forward. And because we're moving forward, and Gateway is no longer involved in this legal matter, we won't be continuing to update you on the proceedings of the case, but we're continuing to pray for everybody that's involved and affected in this matter," Lesmeister explained.

In a statement following Morris' indictment, Oklahoma Attorney General Gentner Drummond, who served as Clemishire's attorney while he was in private practice in 2005, said Morris' alleged crimes were "more despicable" because he was a pastor when they occurred.

Harvard University on Monday announced that tuition will be free for students from families with annual incomes of $200,000 or less starting in the 2025-26 academic year.

"Putting Harvard within financial reach for more individuals widens the array of backgrounds, experiences, and perspectives that all of our students encounter, fostering their intellectual and personal growth," Harvard University President Alan M. Garber said in a statement. "By bringing people of outstanding promise together to learn with and from one another, we truly realize the tremendous potential of the University."

The new plan will enable about 86% of U.S. families to qualify for Harvard financial aid and expand the Ivy League college's commitment to providing all undergrads the resources they need to enroll and graduate, according to Garber.

Democrats Lose Another Talking Point As Egg Prices Drop Sharply For The Third Straight Week

After essentially ignoring runaway inflation for the majority of Joe Biden’s term in office, leftists rushed to blame President Donald Trump for high prices within the first few days of his second term.

One of the easiest targets was the price of eggs, which remained high due to a variety of factors outside of the current president’s control.

But after nearly two months, Trump’s economic policies are clearly beginning to take hold — and the evidence is already showing in the cost of a dozen eggs.

As even NPR admitted:

The U.S. Department of Agriculture reported Friday that the national average wholesale price of eggs has been steadily declining since late February. In other words, the cost that distributors are charging retailers is going down.

According to the latest USDA report, the average wholesale cost of large white eggs was $4.15 per dozen — about half of what it was just a few weeks ago.

The drop in wholesale prices is thanks to the absence of major bird flu outbreaks so far in March, which has allowed the nation’s egg supply to start recovering. That’s a positive sign, economists told NPR, but how soon prices might change at the grocery store will depend on a few key factors.

I can exclusively confirm that in addition to the 18 @SecretService agents on the ground in South Africa who were providing Hunter Biden with Secret Service protection on his luxurious vacation abroad while he dodged a deposition (12 per day and 6 on backup), 12 more Secret Service agents flew in yesterday to relieve the agents of their duty this week since the agents on the ground are on rotation since Hunter is planning to stay in South Africa for 3 months and was set to have Secret Service protection the entire 3 months, before I published my exclusive report.

The round trip airfare for all 30 of those Secret Service agents was paid for by the US taxpayers.

All of those agents will now have to fly straight back to the US tomorrow and be reassigned to their respective field offices after having flown all the way to South Africa just yesterday.

That’s 30 round trip airfare tickets that the US taxpayer will be paying for so that @HunterBiden ’s Secret Service agents can fly back to the US tomorrow after President Trump revoked Hunter Biden and Ashley Biden’s Secret Service.

Combined with Ashley Biden’s 13 Secret Service agents, that’s 43 Secret Service agents who now get to be reassigned to other positions.

Insane to think that until last night, 43 Secret Service agents were being utilized just for Hunter and Ashley Biden.
