Pacific Gas & Electric Co. said it plans to file for Chapter 11 bankruptcy as investigators continue to look into the utility's possible involvement in causing the Camp Fire, which began Nov. 9 in Butte County, Calif.

PG&E said the company plans to file for voluntary reorganization on or about January 29. It issued the announcement Monday because the utility must tell employees at least 15 days before a change of control in the company.

The San Francisco-headquartered utility, which serves 16 million residents in northern and central California, said it does not expect its bankruptcy filing to impact electric or natural gas service for customers. Employees will continue to receive pay and healthcare benefits as usual, the company said.

An FBI investigation into Los Angeles City Councilman Jose Huizar is part of a broader corruption inquiry in which agents are seeking possible evidence involving Councilman Curren Price, a senior aide to Council President Herb Wesson, and several other city officials and business figures, according to a federal search warrant.

The warrant, which was filed in federal court in November but reviewed by the Los Angeles Times on Saturday, said agents were seeking evidence related to an investigation into an array of potential crimes, including bribery, kickbacks, extortion, and money laundering involving 13 people.

Agents served the warrant on Google in July for information from a private email account for Ray Chan, the former head of the Los Angeles Department of Building and Safety for Mayor Eric Garcetti, according to the warrant. Chan also served as a deputy mayor for economic development under Garcetti.

Along with Chan and Huizar, those named in the warrant included Price, who represents part of South L.A.; Deron Williams, chief of staff to Wesson; Joel Jacinto, a member of the city's Board of Public Works; and other City Hall aides who have worked for Huizar.

The warrant does not say the FBI has gathered evidence of criminal activity by any of the people named in the document, and there were no records attached to the warrant saying what evidence, if any, was discovered in Chan's email account.

No one has been arrested or charged in connection with the investigation. But the court documents lay out a more expansive FBI investigation into City Hall than had so far been revealed.

Price said Saturday that he does not know anything about the warrant. He also said he had not been contacted by the FBI.

Jacinto told The Times he was unaware he had been mentioned in a federal search warrant. He said neither he nor his wife, who is also named in the warrant, had been contacted by investigators or received subpoenas seeking records or testimony.

"I don't know what it's about, so I can't really comment," Jacinto said.

None of the others named in the warrant could be reached for comment. An FBI spokeswoman declined to comment.

Huizar's attorneys, Vicki Podberesky and Mary Carter Andrues, did not address the warrant's contents but released a statement Saturday in response to questions from The Times saying that "Huizar and his staff are focused on serving all the residents in Council District 14 and continuing to advance citywide efforts."

Chan, who retired from city employment in 2017, declined to say whether he had received a federal grand jury subpoena when contacted by The Times in November.

The first sign of an FBI investigation into City Hall occurred Nov. 7 when FBI agents hauled an array of materials from Huizar's home and office, including a cardboard box with the word "fundraising" on it. The FBI declined to discuss its investigation but confirmed that the Internal Revenue Service, which looks into unreported income, was involved.

The warrant was first reported in a tweet late Saturday by Seamus Hughes, a counterterrorism expert who is currently deputy director of the Program on Extremism at George Washington University. The document is publicly available on the federal court's online records-retrieval system.

Much of the agents' focus centered on Huizar. Agents were seeking "all financial records" relating to the councilman and his mother and brother, Salvador, according to the warrant. The FBI also wanted "all records relating to projects in and around Los Angeles" in which Huizar, his staff or several other men were involved in "acquiring permits, licenses or other official city processes."

The warrant also named three companies described as "foreign investors" and sought records relating to involvement by the companies or other foreign investors in development projects in and around L.A.

At least one of those companies was listed on a document that was linked to Chan's email account and which appeared to be a long list of business deals in which Chan was involved. The warrant sought any information related to the document.

China's global trade surplus fell in 2018: customs

BEIJING: China's global trade volume rose last year but its surplus fell again as its imports outpaced its exports, official data released Monday showed amid a bruising trade war with the United States.

Total trade reached US$4.62 trillion, a 12.6% rise from 2017, according to customs data.

But the trade surplus for the world's second largest economy fell 16.2% to $351.76 billion, as imports rose 15.8% while exports gained 9.9%.

"China's foreign trade has developed in a steady manner with progress witnessed, reaching a record high in import and export volume," said Li Kuiwen, spokesman for the customs administration.

China sentences Robert Schellenberg, Canadian drug suspect, to death

A Chinese court sentenced a Canadian man to death on drug trafficking charges on Monday after his previous 15-year prison sentence was deemed too lenient, a ruling likely to deepen a diplomatic rift between Ottawa and Beijing.

Millions digging out from killer storm, bracing for more winter havoc

Millions of Americans from Colorado to Washington, D.C., were digging out from a major winter storm Monday while forecasters warned that more snow chaos could be on the way next weekend.

The storm began its march in Colorado last week before dumping up to 20 inches of snow in parts of Missouri. On its way east, it rolled through an area from Baltimore to North Carolina, blanketing Washington and its environs with up to a foot of snow and pounding parts of western North Carolina with a half-inch of ice.

More than 120,000 homes and businesses remained without power Monday in Missouri, Kansas, North Carolina and Virginia.

Schools were closed for hundreds of thousands of kids across the metro Washington area Monday, just hours after the snow finally quit. Interstates were cleared but local roads remained icy, some untouched by plows.

North Carolina had the highest number of power outages lingering Monday, almost 50,000. Gov. Roy Cooper declared a state of emergency and urged residents in the mountainous west to stay off roads.

"Thanks to the crews working hard to restore power and keep our roads safe," he said.

Flight delays and cancellations across the swath of the storm were easing Monday after a weekend of scheduling havoc. A jet slid off a taxiway in Cincinnati on Sunday, but no injuries were reported.

Interstates that had been the scene of thousands of crashes and abandoned vehicles also were opening up.

Almost a foot of snow was measured at St. Louis Lambert International Airport. Omaha was digging out from almost as much, as was the Illinois capital city of Springfield.

Illinois State Trooper Christopher Lambert was among the storm's fatalities, hit by a car Saturday while responding to a three-vehicle crash I-294.

“Trooper Lambert deliberately placed his vehicle in a position to protect the lives of the victims of the previous crash, and took on the danger himself," State Patrol Director Leo Schmitz said.

The weather event itself was largely over Monday. The next few days should provide an opportunity for recovery, AccuWeather forecasts. But a "significant" winter storm could develop from Friday into next weekend, with a storm sweeping snow and ice from the central Plains to a large swath of the Northeast.

And there may be more after that, AccuWeather Lead Long-Range Meteorologist Paul Pastelok said.

"There will be no rest for the weary with another storm approaching the East between Jan. 22 and 23," Pastelok said.

In Israel, there are laws against sex trafficking, yet the Israeli government and law enforcement agencies have largely neglected to enforce these laws. Therefore, not only legislating laws, but also enforcing laws is important for change in sex trafficking in the Middle East.

Japan aims to start next round of landfill work for U.S. base in March-Okinawa

Another round of landfill work for the relocation of the U.S. Marine Corps Futenma Air Station within Okinawa Prefecture, from Ginowan to the Henoko district of Nago, is planned to start as early as March, The Yomiuri Shimbun has learned.

According to sources, the central government will notify the Okinawa prefectural government as early as this month of the timing to launch the second round of landfill work, which will cover an area of about 33 hectares at the southwestern part of the site. Since this next landfill zone is about five times that of the first landfill zone, progress toward the relocation of the Futenma air base to Henoko will further materialize.

Monday marked a month since the first round of landfill work began for an about 6.3-hectare area at the southwestern part of the planned relocation site. The landfill work has steadily progressed, as about 20 percent of that section has so far been reclaimed. The first landfill zone covers about 4 percent of the entire sea area to be reclaimed for the relocation.

The second landfill zone is adjacent to the first zone, and each is surrounded by bulkheads. Repair and inspection work for the bulkheads will be completed in late March, and the central government is now expecting to begin landfill work after that.

The Defense Ministry plans to reclaim the first and second zones to almost the same level as sea level, with the first set for completion as early as April and the second as early as in 2020. Although it is necessary to eventually fill these areas with more soil, the ministry marks sea-level reclamation as a major milestone because it will clearly define the progress of the landfill work. The two zones will cover about one-fourth of the entire 160-hectare sea area to be reclaimed.

At present, soil for reclamation is unloaded from transport ships on a bulkhead about 1.5 kilometers north of the landfill zone and transported by dump trucks. To implement the landfill work more efficiently and speedily, the ministry is considering two plans: to use the first landfill zone after it is filled as a work site to place heavy equipment and other materials there, and erecting two bulkheads where transport ships can dock as early as this summer to make it possible to unload soil at multiple locations.

Thousands of Los Angeles public school teachers will go on strike Monday for the first time in 30 years.

After a brief delay, the United Teachers Los Angeles will strike following months of failed negotiations over pay raises, class sizes and school staffing. About 30,000 teachers are expected to participate.

Los Angeles Unified School District (LAUSD) Superintendent Austin Beutner told LA’s CBS 2 News that the district is attempting to have a “normal day” in the district.

“[Students will] be fed, they’ll be greeted by the same principal that greets them every morning at the door, and they will be learning,” Beutner said.

Students in the district, the nation’s second-largest, will be taught by 400 substitute teachers and 2,000 reassigned administrators during the strike, according to CBS 2 News.

Preschools in the district will be closed, and early education centers will only be open for special-needs students.

The LAUSD teachers are demanding a 6.5 percent immediate pay raise to go into effect within one year, in addition to “fully staffed” schools. The district has offered a 6 percent raise over two years of a three-year contract.

The district released its latest offer on Friday, according to CBS 2 News, offering an additional $24 million and 200 more teachers than their previous offer.

Union leaders said they alerted the district in December that they planned to strike beginning Jan. 10, but the district said it was not done through the proper channels.

DC's Reduced Child-Sex Penalties … and Why They're Normal

After Jessica Lynn Kanya attempted to sexually abuse a 14-year-old child, she was sentenced to 36 months in prison last March. But Lynn served none of that time behind bars when District of Columbia Superior Court Judge Hiram E. Puig-Lago decided to suspend her sentence.

Such leniency is common in Washington, D.C., RealClearInvestigations has found, because of the difficulty of making cases and the alternative to jail presented by the sex-offender registry. Since 2000, almost half of sex offenders convicted in the nation’s capital – the vast majority child-sex offenders – have had their sentences cut in half or suspended altogether. Judges do not comment on their rulings, but an analysis of the records of 364 D.C. offenders convicted since 2000 shows that such sentencing is a pervasive practice by more than a dozen judges, who are appointed and not elected.

Sentences are often suspended not just for crimes such as sexually touching a child, which carries jail time of 180 days. In dozens of cases, adult offenders facing years in prison received suspended sentences. The case files, in which the sex of the victims and other details are commonly withheld, include:

Alfred Jerome Dockery, charged with sexually penetrating a 14-year-old, was sentenced to 42 months in prison. Judge Geoffrey M. Alprin suspended the entire sentence.

Dominique Anthony Annice, in her early 30s at the time, charged with sexually abusing a 6-year-old. After being sentenced to 30 months in prison, Judge Robert E. Morin suspended her sentence.

Melvin L. Cromer, who according to the charge “engaged in a sexual act” with a 14-year-old and was sentenced to 60 months in prison. Judge Erik P. Christian suspended his sentence.

John Anthony, who according to the charge had anal sex with a 10-year-old girl, was initially charged with first-degree child sex abuse. After pleading guilty to a lower charge, he was sentenced to 60 months in prison. But Judge Wendell P. Gardner suspended almost the entire sentence, and Anthony only had to serve six months.

Although there is no national database recording the resolutions of alleged child-sex crimes, experts say Washington faces the same challenges in prosecuting such crimes as everywhere else. The reduced sentences reflect the difficulties and peculiarities of prosecuting crimes involving children and sex.

Unreliable Little Witnesses

These include the challenges of using children – notoriously unreliable as witnesses and prone to trauma – in prosecutions that often lack physical evidence. And, unlike most other offenses, the penalty for sex crimes cannot be measured just through the length of sentences. Almost always there is an additional sanction that can shadow offenders for life: placement on a jurisdiction’s sex offender registry.

James Marsh, a New York-based lawyer who specializes in representing child victims, said there is a tension in such cases “between re-traumatizing the victim through the criminal justice system and obtaining the strongest possible sentence against the perpetrator.”

Deborah Tuerkheimer, professor of law at Northwestern University and a former prosecutor in the Manhattan district attorney’s office, said a further complication is the relationship built up over time between child and adult. Sometimes the adult has threatened the child, and other times the adult has been good to the child.

“Sometimes the child will even cover up for the abuser,” said Tuerkheimer. “There are psychological reasons why sometimes the children ally themselves with the abuser. Those behaviors can be used against the child and undermine the child’s story.”

But even if a child can testify, that does not entirely solve a prosecutor’s problems, especially given the unlikelihood of there being much solid evidence, like DNA, said Marsh.

Sometimes the prosecution is able to get evidence such as text communications “that the offender might have with the victim, or images that they took of the victim that shows criminal activity,” said David Finkelhor, director of the Crimes Against Children Research Center and a sociologist at the University of New Hampshire. “But physical evidence is often not available.”

Given this difficulty, the prosecutor has to ask himself, “Can I win before a jury?” said Marsh. And, “If I can’t, what is the best I can get from this in terms of a sentence, plea deal, and long-term outcomes?”

Such complications help explain why sex crimes against children – like most crimes in the criminal justice system – are resolved by a plea deal rather than trial. The prosecutors cannot be sure of conviction, and the accused, even if they believe they are innocent or can win at trial, have a powerful incentive to make the case go away.

Prison or the Registry?

Except, of course, it doesn’t, which is the unique complication of such sex offenses: Even convicts with a suspended sentence get placed on a sex offender registry – sometimes for years, but often for life. The FBI lists 55 such registries encompassing the 50 states, the District of Columbia and U.S. territories. Their existence forces lawyers, judges, and activists in the criminal justice system to ask: How do we want to punish offenders – through prison or through the registry?

“If a prosecutor can get a plea bargain that places [the convict] on the sex offender registry, that is viewed as a good outcome,” said Marsh.If a judge is looking at a first-time offender, and there has been testimony from a psychologist or psychiatrist that the accused not likely to re-offend, “a judge might say, ‘I’m not going to lock this person up,’” said G. Allen Dale, a criminal defense attorney in D.C. who has handled many sex offender cases. “What purpose would that serve?”

But some criminal justice activists worry that while the registry can keep offenders out of prison, it is also a mark that prevents convicts from getting on with their lives.

It “makes it impossible for people to reintegrate. It’s like social banishment, social death,” said Emily Horowitz, professor of sociology and criminal justice at St. Francis College in Brooklyn Heights, N.Y.

“The registry publicly outs people,” she said. “Once your picture is up there, you can’t get most jobs, you can’t live a lot of places. You won’t get over whatever it is you did.”

Being a registered sex offender not only creates problems for the convict, but also for his or her family.

“If you have children of your own, it’s a nightmare,” said Dale. “Sometimes you have to have supervision of your own children.” Plus, an offender can’t own a firearm, regularly has to pass polygraph tests, has to clear vacation plans with local authorities, and has to get permission to move from a probation officer, said Dale.

“I’ve had clients whose kids have been picked on by other kids – ‘Your daddy’s a pervert,’” he noted.

But the registries are deeply entrenched because the public considers them necessary, legal experts say.

A Public Demand

“The policies exist because the public feels that it has a right to know, and they need to know” about offenders, said Andrew J. Harris, a professor in the school of criminology and justice studies at the University of Massachusetts, Lowell.

William Dobbs, a lawyer and criminal justice activist, attributes this attitude to the “can’t stop, won’t stop mythology” – the idea that such offenders are almost guaranteed to reoffend.

“The truth is the reoffense is among the lowest of any category of offenses,” he said.

Marsh disputes this, calling the claim “absurd.” He argues that studies showing low recidivism rates among sex offenders are due to the fact that “it is a crime that is underreported.”

As for the 10 percent of offenders who officially do tend to reoffend, “there’s very little evidence to suggest the sex offender registry reduces recidivism,” said forensic psychologist Liam Ennis.

Finkelhor, on the other hand, notes that sex offenses have declined 60 to 70 percent since the registries were introduced in 1992.

The registry is just one of the many factors – along with the difficulties of child witnesses and scant evidence – that judges and prosecutors have to weigh in such complicated and incendiary cases.

Judges are “typically very concerned about protecting the rights of the accused” in an atmosphere that often demonizes them, said Finkelhor. Striking the right balance is not easy.

“Judges across the board are very worried about being maligned in the public eye as being soft on crime,” said Horowitz. “There’s always so much blowback when the media runs with a story about someone getting a light sentence for anything – but anything with sex is like radioactive, and child sex is radioactive times 10.”

HOLD AN ELECTION

British Prime Minister Theresa May's Brexit divorce deal may not be, as one opposition lawmaker called it, "as dead as the deadest dodo," but it is definitely ailing.

It looks very likely that Britain's Parliament will reject the agreement in a vote scheduled for Tuesday. If that happens, May has until the start of next week to come back to Parliament with a Plan B — and Britain has just 10 weeks until it is due to leave the bloc, with or without a deal, on March 29.

Here's a look at what might happen if lawmakers vote down the deal.

If the deal is defeated by a big margin, Prime Minister Theresa May will face pressure to resign. But she has vowed to carry on, and there is no way her Conservative Party can evict her as leader — after a failed no-confidence vote in May's leadership by Conservative lawmakers in December, she is safe from another challenge for a year.

The main opposition Labour Party says it will try to trigger an election by calling a no-confidence vote in the whole government. But the vote will fail unless some members of the governing Conservatives or the government's allies from the Democratic Unionist Party in Northern Ireland rebel and side with the opposition.

If the government lost a no-confidence vote, it would have 14 days to overturn the result by winning lawmakers' confidence in a new vote — possibly with a new prime minster, if May was persuaded to quit. Barring that, there would be an election, a process that takes five to six weeks.

SECOND REFERENDUM

The campaign to revisit Brexit in a second referendum — driven largely by supporters of the losing "remain" side last time around — has been gathering steam as the pitfalls and complexity of the divorce process become clear.

The government is firmly opposed, but has warned that it is increasingly likely that the decision to leave the EU could be reversed if May's deal is rejected.

It's unclear whether a majority of legislators would support a new referendum, or what the question would be. Many pro-EU politicians want a choice between leaving on the proposed terms and staying in the EU, but others say leaving without a deal should also be an option.

There's a strong chance any new referendum would be as divisive as the first.

NO DEAL

"No deal" is the outcome few want — but it is also the default option. If the divorce deal is not approved, altered or put on hold, Britain will cease to be an EU member at 11 p.m. London time on March 29.

The Bank of England has warned that tumbling out of the bloc with no deal to soften the exit could plunge Britain into its deepest recession in nearly a century, and businesses warn the sudden end to longstanding trading agreements with the EU could see gridlock at British ports and shortages of food and medicines.

regarding Ag/Au you can use the ETF's to capture performance and only that. Those only have paper obligations to COMEX contracts and with the movements being pretty benign recently they have not done much. Read the prospectus in anything you want to research. It will clearly show they are nothing moar than a capture of movement on any vehicle they are tied to. You also have time slip with those too so they can under-perform because of this.
