Former Intelligence Analyst Charged with Disclosing Classified Information

According to allegations in the indictment, beginning in April 2013, while enlisted in the U.S. Air Force and assigned to the NSA, Hale began communicating with a reporter. Hale met with the reporter in person on multiple occasions, and, at times, communicated with the reporter via an encrypted messaging platform. Then, in February 2014, while working as a cleared defense contractor at NGA, Hale printed six classified documents unrelated to his work at NGA and soon after exchanged a series of messages with the reporter. Each of the six documents printed were later published by the reporter’s news outlet.

According to allegations in the indictment, while employed as a cleared defense contractor for NGA, Hale printed from his Top Secret computer 36 documents, including 23 documents unrelated to his work at NGA. Of the 23 documents unrelated to his work at NGA, Hale provided at least 17 to the reporter and/or the reporter’s online news outlet, which published the documents in whole or in part. Eleven of the published documents were classified as Top Secret or Secret and marked as such.

No Senate Intelligence Committee Republicans Publicly Stand Up for Richard Burr’s Rogue Donald Trump Jr. Subpoena

What the heck is Sen. Richard Burr's deal? He hardly seems to fit the template of your typical backstabbing RINO.

Even if the Trump Jr. subpoena is some kind of trap being set, it's hard to see how the optics would work out favorably as a result of "bipartisan support" for this nonsense. I'm guessing the cabal must have some kind of leverage over him.

Not one GOP senator on the Senate Intelligence Committee was willing to publicly align himself or herself on Wednesday evening with the panel’s chairman, Sen. Richard Burr (R-NC), after Burr made the determination, against indications from Senate Majority Leader Mitch McConnell, to issue a subpoena to Donald Trump Jr. to testify again on the Russia probe.

News broke late Wednesday afternoon that Burr had issued Trump, Jr. a subpoena to try to compel the president’s eldest son to testify again. The subpoena is in contravention of a previous promise Burr made to Trump, Jr. that he would only need to testify once and would not be subpoenaed, and it contradicts McConnell’s edict on Tuesday that the Russia hoax is “case closed” after two years of investigating with no evidence of collusion or obstruction.

Condemnation rained down upon Burr quickly and swiftly from across the Republican Party, as Sen. Rand Paul (R-KY) and House Minority Leader Kevin McCarthy both ripped him for the subpoena, as did Reps. Lee Zeldin (R-NY) and Devin Nunes (R-CA), the ranking member of the House Intelligence Committee, who served as chair for the first two years of Trump’s presidency, as well as many others in the Trump universe.

Jean-Pierre Oriol, commissioner nominee for the V.I. Department of Planning and Natural Resources, said Tuesday that the department’s division of Coastal Zone Management issued Epstein a stop-work order on Dec. 21.

Despite that order, construction activity on the island has been ongoing and includes “an excessive amount of additional roadways that have been carved out on the island, there have been two jetties, fill material has been placed into the submerged lands, so there’s evidence of work going beyond what was initially applied for. The exact amount of things is still yet to be determined,” Oriol said.

Oriol said the department, which regulates building activity in environmentally sensitive areas and issues permits for planned construction, is limited in its ability to make Epstein stop violating the territory’s laws.

Former Intelligence Analyst Charged with Disclosing Classified Information

An indictment was unsealed today charging a former intelligence analyst with illegally obtaining classified national defense information and disclosing it to a reporter. Daniel Everette Hale, 31, of Nashville, Tennessee, was arrested this morning and will make his initial appearance today at the federal courthouse in Nashville. Assistant Attorney General for National Security John C. Demers, U.S. Attorney G. Zachary Terwilliger for the Eastern District of Virginia and Acting Special Agent in Charge Jennifer L. Moore of the FBI’s Baltimore Field Office made the announcement after the charges were unsealed.

According to the indictment, Hale was enlisted in the U.S. Air Force from July 2009 to July 2013, during which time he received language and intelligence training. While serving on active duty, Hale was assigned to work at the National Security Agency (NSA) and deployed to Afghanistan as an intelligence analyst. After leaving the U.S. Air Force, Hale was employed by a defense contractor and assigned to the National Geospatial-Intelligence Agency (NGA), where he worked as a political geography analyst between December 2013 and August 2014. In connection with his active duty service and work for the NSA, and during his time at NGA, Hale held a Top Secret//Sensitive Compartmented Information (TS//SCI) security clearance and was entrusted with access to classified national defense information.

According to allegations in the indictment, beginning in April 2013, while enlisted in the U.S. Air Force and assigned to the NSA, Hale began communicating with a reporter. Hale met with the reporter in person on multiple occasions, and, at times, communicated with the reporter via an encrypted messaging platform. Then, in February 2014, while working as a cleared defense contractor at NGA, Hale printed six classified documents unrelated to his work at NGA and soon after exchanged a series of messages with the reporter. Each of the six documents printed were later published by the reporter’s news outlet.

According to allegations in the indictment, while employed as a cleared defense contractor for NGA, Hale printed from his Top Secret computer 36 documents, including 23 documents unrelated to his work at NGA. Of the 23 documents unrelated to his work at NGA, Hale provided at least 17 to the reporter and/or the reporter’s online news outlet, which published the documents in whole or in part. Eleven of the published documents were classified as Top Secret or Secret and marked as such.

According to allegations in the indictment, in August 2014, Hale’s cell phone contact list included contact information for the reporter, and he possessed two thumb drives. One thumb drive contained a page marked “SECRET” from a classified document that Hale had printed in February 2014 and had attempted to delete from the thumb drive. The other thumb drive contained Tor software and the Tails operating system, which were recommended by the reporter’s online news outlet in an article published on its website regarding how to anonymously “leak” documents.

Hale is charged with obtaining national defense information, retention and transmission of national defense information, causing the communication of national defense information, disclosure of classified communications intelligence information, and theft of government property. Each charge carries a maximum penalty of 10 years in prison. Actual sentences for federal crimes are typically less than the maximum penalties. A federal district court judge will determine any sentence after taking into account the U.S. Sentencing Guidelines and other statutory factors.

Assistant U.S. Attorneys Gordon D. Kromberg and Alexander P. Berrang and Senior Trial Attorney Heather M. Schmidt of the National Security Division’s Counterintelligence and Export Control Section are prosecuting the case.

An indictment contains allegations that a defendant has committed a crime. Every defendant is presumed to be innocent until and unless proven guilty in court.

TLDR: Q prevented a falsely engineered civil war in America.

On the surface, Q is a backchannel communication program designed by the Trump administration maintaining plausible deniability while feeding misinformation to bad actors to create chaos and narrative confusion among their ranks. Some Q connections are confirmed while others are broken or plainly false. Under the deal, Kariye agreed not to challenge an order revoking his citizenship and acknowledged having provided false information to immigration officials in July 1997 when he had applied for U.S. naturalization.

The settlement appeared to be briefly in jeopardy Monday morning, when Kariye’s lawyers asked to rescind it after learning that Kariye had been detained during a stopover at the Dubai airport.

Kariye, 57, boarded a flight last Wednesday from Seattle for a 14-hour flight to Dubai and a planned flight four days later to Somaliland.

He arrived in Dubai as scheduled, according to court records, but soon sent his Oregon-based lawyers a text from the airport that read, “some thing is wrong.’’

Some of you maybe aware of Benjamin Banneker's historic letter to Thomas Jefferson on August 19, 1791, arguing eloquently that "…however variable we may be in Society or religion, however, diversifyed in Situation or colour, we are all of the Same Family, and Stand in the Same relation to him [God]."

I wonder if any of you have ever read Jefferson's response? I had not until last night when I discovered it by accident. I was looking for a book for my son on my bookshelf and I stumbled across an old library book titled "The Writings of Thomas Jefferson." I then remembered that I had bought it for $1 at a local library give away some years ago. By chance, I happened to open the book to page 932 and there it was. I then did a google search to find it online so that I wouldn't have to retype it for this post.

The search results shocked me, but were informative. Page after page of high school and college course assignments all about Banneker's historic letter to Jefferson and how he cleverly employed rhetorical strategies to prove Jefferson to be a "hypocrite." But none of these sites ever mentioned Jefferson's response.

After refining my search, I finally found it.

In his reply to Banneker on August 30, Jefferson wrote,

It should go without saying that it saddens me deeply on behalf of all peoples that young Americans, comprising the "1%" of those most free and privileged on our planet, the vast majority of which who have never read any of Jefferson's writings, including the most sacred of all, the Declaration of Independence, are so possessed and deluded by destructive ideology that they are actively calling for the destruction of his statues and memorials.

What is even less known among our youth is that Jefferson’s original draft of the Declaration of Independence was revised by the Continental Congress to eliminate the justifiable attack on King George for encouraging the slave trade…(see image)

Jefferson knew that such compromises with principle struck at the heart of the nation’s security and integrity. In 1820, six years before his death, he wrote these melancholy words:

"But this momentous question (slavery), like a fire bell in the night awakened and filled me with terror. I considered it at once as the knell of the Union. I regret that I am now to die in the belief that the useless sacrifice of themselves by the generation of 1776 to acquire self-government and happiness to their country is to be thrown away, and my only consolation is to be that I live not to weep over it."

HOUSTON (Reuters) - Chevron Corp abandoned its pursuit of Anadarko Petroleum Corp on Thursday, outmaneuvered by a higher rival bid of $38 billion that included more than three times as much cash. The decision leaves Occidental Petroleum Corp as the likely victor in a contest that again proved the allure of U.S. shale. Anadarko’s board had considered Chevron’s $33 billion bid superior to Occidental’s initial offers, pointing to a signed agreement and joint planning meetings. Chevron’s finance chief signaled the company would be able to put more cash into its existing offer. But that did not happen. The No. 2 U.S. oil producer now stands to receive a $1 billion breakup fee.

“Winning in any environment doesn’t mean winning at any cost,” Chevron Chief Executive Officer Michael Wirth said. “Cost and capital discipline always matter, and we will not dilute our returns or erode value for our shareholders for the sake of doing a deal.”

Investors have sold off shares of oil companies that increased spending on drilling, punishing them for not using the cash to finance shareholder returns. They have pressed the industry to use capital discipline, defined as increasing production by 4 percent a year and maintaining a 4 percent dividend with flat spending. One result of that approach: the value of U.S. oil and gas mergers and acquisitions fell to a 10-year low in the first quarter, driven by investors selling off shares in companies that spent more on drilling than on buybacks and dividends.

The bidding war for Anadarko underscored the value of its prized assets in the lucrative Permian Basin of West Texas and New Mexico. The vast shale field holds oil and gas deposits that can produce supplies for decades using low-cost drilling techniques. Occidental has said it plans to shed most of Anadarko’s non-shale properties in a deal. The company has made a deal with French oil giant Total SA to take most of Anadarko’s international assets, including a liquefied natural gas project in Mozambique estimated to cost up to $25 billion to complete. Total agreed to pay $8.8 billion for the assets once the merger goes ahead.

Chevron declined to revise its offer after Occidental boosted the cash portion of its $76 per share bid. Chevron’s $65 per share offer comprised 75 percent stock and 25 percent cash compared with Occidental’s revised offer that had a 78/22 cash-stock split. A 7 percent decline in Chevron’s share price had reduced the value of its April 12 offer to $31 billion. OPEC in the dark on oil supply as Russia, Iran cut exports

DUBAI/LONDON (Reuters) - OPEC is in the dark on the oil supply outlook for the second half of this year, with Iranian and Russian outages looking increasingly significant but Saudi Arabia reluctant to pump more due to fears of a price crash, sources in the organization said.

An oil contamination forced Russia to halt flows along the Druzhba pipeline, a key conduit for crude into Eastern Europe and Germany, in April. The suspension left refiners scrambling to find supplies and its duration is unclear.

Iran’s oil exports are likely to drop further in May as the United States tightens the screw on Tehran’s main source of income. Shipments from Venezuela, also under U.S. sanctions, could fall more in coming weeks.

The dearth of information is a headache for OPEC and allies led by Russia, which gather in June to decide whether to renew a supply-cutting deal. A panel of ministers meets on May 19 in Saudi Arabia to discuss the market and make recommendations.

Two delegates from the Organization of the Petroleum Exporting Countries said the Russian outage, on top of Iranian and Venezuelan export losses, would be discussed at the Jeddah meeting and it seemed more than a short-term technical glitch.

“It’s potentially significant,” one of the delegates said of the pipeline halt.

Still, the delegate added, the price of Brent crude - close to $70 a barrel, down from a 2019 high of $75.60 last month - suggested traders saw no major risk of any shortage.

Other OPEC sources said there were conflicting views on the significance of the Russian outage, and that the complexity of Russia’s pipeline system meant the issue was not straightforward.

“I’m not quite seeing the impact in terms of supply shortage,” another OPEC delegate said.

SUPPLY DROP

Analysts at Citigroup saw the Russian export loss as enough to affect the balance between supply and demand.

“While it is still difficult to assess the final impacts on balances, the severity of the problem could mean up to 400,000 bpd (barrels per day) of Russian exports could be pulled out of the market for longer than earlier anticipated,” they wrote.

That would further tighten the market, with OPEC signaling even before the Druzhba outage that demand would exceed supply by more than 800,000 bpd in the third quarter.

Talks with the Justice Department broke down over the committee’s subpoena for an unredacted version of the report.

Barr released a redacted version of Mueller’s 400-plus-page report to the public last month, but Democrats subpoenaed the full document , along with underlying evidence.

The department has rejected that demand, while allowing a few top lawmakers from the House and Senate to view a version with fewer redactions. That version blacks out grand jury information, which needs a judge’s approval for release, and it doesn’t include the report’s underlying evidence. Almost half the report’s pages contain some type of redaction including those around the Russian influence campaign, presidential pardons and other topics.

Barr has refused to testify in public to the committee after a disagreement over the Democrats’ demand that he answer questions from a staff attorney in addition to lawmakers. James Comey is in trouble and he knows it

James Comey’s planet is getting noticeably warmer. Attorney General William Barr’s emissions are the suspected cause.

Barr has made plain that he intends to examine carefully how and why Comey, as FBI director, decided that the bureau should investigate two presidential campaigns and if, in so doing, any rules or laws were broken.

In light of this, the fired former FBI director apparently has decided that photos of him on Twitter standing amid tall trees and in the middle of empty country roads, acting all metaphysical, is no longer a sufficient strategy.

And so we’ve seen Comey get real busy lately. First he penned a curious op-ed in The New York Times. Then a Times reporter, with whom Comey has cooperated in the past, wrote a news article exposing an early, controversial investigative technique against the Trump campaign in an attempt to get out front and excuse it. Next, Comey is scheduled to be encouraged on a friendly cable news “town hall.”

Comey adjudged the president as “amoral.” He declared the attorney general to be “formidable” but “lacking inner strength” unlike — the inference is clear — Comey himself. A strategy of insulting the executioner right before he swings his ax is an odd one but, then, Comey has a long record of odd decisions and questionable judgment.

“Amoral leaders [referring to the president] have a way of revealing the character of those around them,” wrote Comey without a hint of irony or self-awareness. Those whom the former FBI director assembled around him probably rue the day they ever met the man. Most are now fired or disgraced for appalling behaviors that Comey found easy to manipulate to advance his decisions.

Then, just to make sure his op-ed was odd-salted to the max, Comey mused that the president “eats your soul in small bites.” OK, let’s step back for a moment: James Comey appears to be in trouble. His strange, desperate statements and behaviors betray his nervousness and apprehension. In a way, it’s hard to watch.

Ideally, Barr’s examination will aggregate information that addresses three primary streams.

The first will be whether the investigations into both presidential nominees and the Trump campaign were adequately, in Barr’s words, “predicated.”

The Mueller report’s conclusions make this a fair question for the counterintelligence investigation of the Trump campaign. Comey’s own pronouncement, that the Clinton email case was unprosecutable, makes it a fair question for that investigation.

The second will be whether Comey’s team obeyed long-established investigative guidelines while conducting the investigations and, specifically, if there was sufficient, truthful justification to lawfully conduct electronic surveillance of an American citizen.

The third will be an examination of whether Comey was unduly influenced by political agendas emanating from the previous White House and its director of national intelligence, CIA director and attorney general. This, above all, is what’s causing the 360-degree head spins.

Without diving into the weeds, it’s important to understand that FBI counterintelligence investigations generally proceed sequentially from what is called a preliminary investigation or inquiry (PI) to a full investigation (FI). To move from a PI to an FI requires substantial information — predication — indicating investigative targets acted as agents of a foreign power.

This is problematic for Comey in light of Mueller’s findings. There are strict guidelines governing when the FBI can task a confidential source or a government undercover operative to collect against a U.S. citizen.

In addition, the cast of characters leveraged by the FBI against the Trump campaign all appear to have their genesis as CIA sources (“assets,” in agency vernacular) shared at times with the FBI. From Stefan Halper and possibly Joseph Mifsud, to Christopher Steele, to Carter Page himself, and now a mysterious “government investigator” posing as Halper’s assistant and cited in The New York Times article, legitimate questions arise as to whether Comey was manipulated into furthering a CIA political operation more than an FBI counterintelligence case.

James Comey is right to be apprehensive. He himself ate away at the soul of the FBI, not in small bites but in dangerously large ones. It was a dinner for one, though: His actions are not indicative of the real FBI. The attorney general’s comprehensive examination is welcome and, if done honestly and dispassionately, it will protect future presidential candidates of both parties and redeem the valuable soul of the FBI.

Contempt of Congress

The Constitution does not explicitly grant Congress the power to coerce cooperation from individuals or to punish acts of disobedience or disrespect through contempt proceedings. However, the power was discussed at the Constitutional Convention and was implied in the Constitution. In 1795, Congress used the power of contempt for the first time when it arrested, tried, and punished a man accused of bribing members of the House of Representatives. Then Congress acted on its own authority—subsequently called the Self-Help power, which grants Congress the right to compel testimony and punish disobedience without the involvement of a court or other government body if the individual's actions obstruct the legislative process. By 1821, the Supreme Court recognized Congress's power to arrest and punish individuals for contempt. In 1857, Congress created a statute governing prosecution for contempt, which shifted the responsibility for determining contempt from Congress itself to the courts. Until 1945, Congress largely ignored this criminal statute and continued to compel testimony and deal with contemnors through its own power.

In the late twentieth century, the Supreme Court noted, "Congress has practically abandoned its original practice of utilizing the coercive (self-help) sanction of contempt proceedings at the bar of the House" (Watkins v. United States, 354 U.S. 178, 77 S. Ct. 1173, 1 L. Ed. 2d 1273[1957]). Under the criminal statute, Congress must petition the U.S. attorney to bring a case of possible contempt before a Grand Jury. The case is then tried in federal court.

Most contempt citations arise from Congress's investigatory powers. In its decisions since World War II, the Supreme Court has outlined requirements that Congress must meet before it can compel testimony. The investigation must have a valid legislative purpose. It must be conducted by a committee or subcommittee of the House of Representatives or Senate, or the authority of the investigating body must be clearly defined in a resolution. The questions asked of witnesses must be pertinent to the subject of inquiry. Contempt proceedings cannot be used to harass an individual or organization. Finally, before individuals can be held in contempt, they must willfully default, either by failing to appear before the investigating body or by refusing to answer pertinent questions.

Congress's contempt power has come into conflict with the First Amendment in several cases. The first of these cases was Barenblatt v. United States, 360 U.S. 109, 79 S. Ct. 1081, 3 L. Ed. 2d 1115 (1959), in which Lloyd Barenblatt refused to answer five questions of the House Un-American Activities Committee, regarding Communist infiltration of educational institutions. Barenblatt was convicted of contempt then appealed to the Supreme Court, arguing that the questions violated his First Amendment right to freedom of association. The Court, in a 5–4 decision, supported Barenblatt. The Court stated that the questions were too vague to support a contempt citation and that Congress's investigative powers must be balanced against First Amendment rights.

The conflict between Congress's investigative powers and the First Amendment surfaced again in 1992 when Nina Totenberg, a National Public Radio correspondent, refused to answer questions of a Senate special counsel about how she obtained confidential documents related to the nomination of Clarence Thomas to the U.S. Supreme Court. Totenberg had earlier revealed that the Senate Judiciary Committee was looking into accusations that Thomas had sexually harassed members of his staff. The charges led to public testimony by law professor anita hill. A Senate special counsel asked to have Totenberg held in contempt when she refused to reveal who leaked information about the charges to her. The request was denied by the Senate Rules Committee because of its potential "chilling effect on the media."

Congress also has used the contempt power in conflicts with private parties and the Executive Branch of government. For instance, business partners of Ferdinand Marcos, former president of the Philippines, produced documents for the House Foreign Affairs Committee only under threat of contempt citations. And James G. Watt, former secretary of the interior, was charged with contempt by a congressional committee in the early 1980s when, citing Executive Privilege, he refused to release Interior Department documents.

Amazon accused of using Echo Dot Kids to illegally collect data on children

A coalition of 19 consumer and privacy groups plans to file a complaint Thursday alleging that Amazon’s Echo Dot Kids Edition is illegally collecting voice recordings and other identifying information on users under 13 and that the system’s parental controls are flawed. The complaint says that the Echo Dot Kids Edition – a colorful, youth-oriented version of Amazon’s popular “smart speaker” systems that allow users to ask questions, play music or control thermostats with voice commands – violates the Children’s Online Privacy Protection Act, known as COPPA. The 1998 law sharply limits what data companies can collect without permission from parents.

The 98-page complaint is the latest in a series by consumer and privacy groups urging the Federal Trade Commission to intensify its enforcement of how leading technology companies treat children and their personal data. The Institute for Public Representation at Georgetown University Law Center served as counsel to the groups on the complaint. Unlike some previous cases, there is little dispute that Amazon’s device, which has a sticker price of about $70 but sometimes is offered for less, should be covered by COPPA. The sign-on procedure mentions the law and requests parental permission for collecting data from children.

But a draft of the complaint cites a number of alleged failings, including that the permissions need to be more specific and that the online portal lacks an effective system for verifying that a parent is the one providing approval for a child’s use of the device. The complaint also alleges that Amazon keeps children’s voice recordings longer than necessary and that the tools allowing parents to delete recordings do not work properly. The result, according to a draft of the complaint, is that Amazon could collect a wide range of information from children – names, birth dates, home addresses, phone numbers – without parents knowing or being able to delete it. The complaint also says that the Echo Dot Kids Edition allows outside developers, whose “skills” on the service resemble the apps familiar to users of mobile devices, to collect data in ways that lack transparency and potentially violate COPPA. Amazon spokeswoman Kinley Pearsall said the Echo Dot Kids Edition is “compliant with the Children’s Online Privacy Protection Act,” but her statement did not address any of the specific issues raised in the complaint.

The FTC, which declined to comment on the planned complaint against Amazon, has settled 30 cases against companies for allegedly violating COPPA over the past two decades. The commission also updated the rules governing compliance in 2013 to impose restrictions on the collection of newer technologies, such as online voice and video clips, that could identify children under 13. Sen. Edward Markey, D-Mass., one of the original authors of COPPA, plans to send a letter Thursday to the FTC urging action regarding the Echo Dot Kids Edition. “Children are a uniquely vulnerable population,” Markey planned to write, according to a draft of the letter. “We urge the Commission to take all necessary steps to ensure their privacy.”

Carrier USS Abraham Lincoln (CVN-72) is now in the Red Sea and moving toward the Persian Gulf, USNI News has learned.

The Lincoln Carrier Strike Group left the Mediterranean and transited the Suez Canal, officially entering U.S. 5th Fleet and U.S. Central Command.

The move follows a statement earlier this week from the National Security Council that, due to provocative behavior from Iran and new intelligence estimates, the U.S. was repositioning the strike group from the Mediterranean to the Gulf.
